Subject:
1.
Introduction
1.1.
The 232nd meeting of the Executive Board of the National
Highway Authority was held at 1130 hours on Feb 27, 2014 at the
NHA Head Office Auditorium, Islamabad. Mr Shahid Ashraf Tarar,
Chairman NHA presided.
1.2.
All Members attended except Dr Shujat Ali, Additional
Secretary (Budget), Finance Division, who was represented by the
Joint Secretary, Finance Division. List of participants is at Annex-A.
1.3.
The meeting commenced with recitation of verses from the
Holy Quran and Urdu translation.
2.
2.1.
The Chairman extended warm welcome to the participants
of meeting.
2.2
The Chairman stated that the last meeting was held on
Dec 17, 2013 and due to passage of two months, agenda is relatively
bulky / voluminous. He requested for consideration and decision on
all agenda items being of important nature.
2.3.
The Chairman paid tribute to Mr Maroof Afzal, former
Chairman NHA for his good efforts towards achievements of the
Authority during his short period of stay in NHA. He also appreciated
valuable participation of Mr Aamir Hasan, former Senior Joint
Secretary, MoC in the Board meetings.
2.4.
The Chairman welcomed Mr Sabino Sikandar Jalal, Joint
Secretary, MoC as a new member of the Executive Board.
2.5.
The Chairman briefed the Board about his important
activities since his posting. He narrated that the Prime Minister is
taking keen interest in the development of country & nation, primarily
focusing on highways & communication sector. Lahore - Karachi
Motorway and Pak-China Economic Corridor are couple of important
initiatives of the Prime Minister. He assured the Board that NHA will
make hectic efforts to accomplish assigned targets and achieve desired
goals under the valuable guidance & supervision of this august Board
through optimum utilization of NHAs in-house capabilities.

4.1.
The Secretary NHA solicited confirmation of minutes of

231 Executive Board meeting held on Dec 17, 2013. Comments /
observations from Mr Munir Ahmed Anjum, Chief (T&C) Planning
Commission received vide letter No 4(67-24)/PC/T&C/2013 dated Feb
4, 2014 were presented before the Board for information, discussion &
decision. After deliberations the Board agreed to the said observations
for insertion in the confirmed minutes of meeting.
4.2.
The Additional Secretary (Budget), Finance Division also
made some written observations which were, along with the response
provided by the Finance Wing, presented before the Board for
information, discussion and decision. After deliberations the Board
decided that these observations and their response be made part of
the minutes.
4.3.
The Member (Aided Projects) presented response / reply
to the queries made by the Board on Agenda Item 15 titled Revised
Addendum-15 of M/s EA Consulting (Pvt) Ltd for Construction
Supervision of Lyari Expressway Project. The Board, however,
decided that the agenda item be presented again.

The Chairman enquired about the commencement date of
consultancy services on Sukkur - Shikarpur - Jacobabad (Package-II).
The Member (Planning) explained that original agreement for
consultancy services with M/s Oriental Consultants was signed in
2006 for three ADB funded projects including Hub - Uthal (N-25,
ICB-I), Multan - Muzaffargarh (N-70, ICB-II) and Sukkur - Jacobabad
(N-65, ICB-V). ICB-I & ICB-II were completed in 2010. Works on ICB-V
were supposed to be started in 2007; however, this package was
actually started in Feb-2011 because of delays caused by land issues
and 2010 floods. He further added that original period of consultancy
contract for design review/ supervision was expired in Dec-2010.
5.6.
The Chairman sought clarification about

agreement in 2006 until start of work in Feb-2011. The
clarified that nothing was charged by the Consultant

Supply of 15x Weigh Bridges to Afghanistan
Proposal
8.1.
The Executive Board is requested to accord approval for
award of the works for supply of 15 Nos Weigh Bridges to Afghanistan
to the highest ranked firm in the combined (Technical + Financial)
evaluation ie M/s TolLink Pakistan, at their bid price of
Rs 114,000,000/- (Rupees one hundred fourteen million) only.

8.3.
The Chief (T&C) observed that this project is shown to be
financed through PSDP allocation, whereas, there is no such funding
arrangement in the PSDP. The GM (P&CA) clarified that the project on
PSDP is shown erroneously in the working paper. Funding for this
purpose is made by the Committee for Reconstruction &
Rehabilitation of Afghanistan (CRRA). The Chief (T&C) stated that, if
the project is neither funded through PSDP nor NHA sources then is it
the power of the Board to approve it? The Member (Planning)
explained that since it is an assignment to NHA and its administrative
control lies with the Board, therefore, approval is requested being the
competent forum for NHA schemes.
8.4.
The Chairman suggested that as against required funds of
Rs 90 million CRRA has allocated only Rs 62 million, therefore, supply
of bridges may be ordered as per funds available in first phase and
remaining quantity of weigh bridges may be supplied in second phase
on availability of funds.
8.5.
The Board agreed with the suggestion of Chairman and
cleared the proposal.

direction that supply of weigh bridges will be ordered in phases as per
availability of funds.

Lyari Expressway Project: VO No 10 (Ex-post facto
approval of Continuation of Technical Assistance &
Supervision by M/s RECO)

Proposal
9.1.
The Executive Board is requested to accord in-principle
approval of re-rating so that proceedings of the re-rating committee
may commence and submit its recommendations to the Board for
approval / consideration.

9.2.
9.3.
The Chairman after due discussion suggested that a
standing committee headed by the Member (Planning) may be
constituted for framing the policy on the basis of which cases of
Variation Orders, Addendums, escalations and re-rating proposals be
submitted to the competent authority for decision. The Member
(Planning) proposed that cases for policy of revision of PC-Is be also
included in the ToRs of the said committee.
9.4.
The Chief (NTRC) enquired about the percentage of the
works completed. The Member (AP) informed that 80% works have
been completed. The VP-NESPAK asked about the payments made to
M/s FWO and M/s RECO. The Member (AP) replied in this regard that
M/s RECO was nominated Sub-Contractor and mode of payment was
through M/s FWO. M/s FWO used to claim the paid amount from
NHA in Interim Payment Certificates. NHA has so far paid Rs
214,132,914/ = to M/s FWO and M/s FWO paid Rs 347,346,653/= to
M/s RECO.
9.5.
During deliberations Member (AP) informed that the then
Member (Motorways) without his authority accorded further
provisional extension in technical assistance of M/s RECO till Dec 31,
2011 at the revised rate of Rs 7.5 million after the expiry of the
extended period. The Chairman took notice and directed that this case
be scrutinized and be submitted for appropriate action.

9.6.
The Chief (T&C) and VP-NESPAK expressed their dissatisfaction over the contents of the presentation as the data /
information provided in it was not according to that of working paper.
The Board then directed that the presentation be thoroughly prepared
on standard format & all the relevant data / information be
appropriately covered.
9.7.
After detailed deliberations the Board did not clear the
proposal and deferred it with the directions that the working paper be
resubmitted with proper details and presentation.

10.1.
Executive Board is requested to approve Addendum-2 of
M/s Techno Consult International (Pvt) Ltd, for Construction
Supervision of Road from Hyderabad Badin to Mirwah Sanjar Chang
road costing Rs 14,394,661/= (+23.74%) with revised consultancy
contract cost of Rs 75,023,283/= and increase of (+95.3%) entailing
EoT from Jun 30, 2012 to Mar 31, 2013 (274 days).

10.2.
The Member (AP) presented the case. He explained that
addendum has been necessitated because of the extension of
construction contracts (Pack-I Jun 30, 2012 and Pack-II Mar 31,
2013).

After deliberations the Board has cleared the proposal.
However, the Chairman directed that all proposals regarding Variation
Orders / Addendums be provided with proper background, reasons
and justifications so that decisions could be taken smoothly and
effectively.
10.4.
The Board directed that quality of briefings to the Board
be improved and presentations be made in a standard format in
respect of all agenda items. It was further instructed that during
presentation the supporting staff of respective Member should be
present outside the meeting place along with complete record and
information relevant to the agenda under consideration for ready
reference as & when required by the Board.

Cost Escalation Due to Increase in Prices of
Construction Material: Rationalization of Factor-C for
Specified Materials (Khuzdar-Shahdadkot Road, SecIV, Pack-IV, Wangu Hills)

11.1.
The Executive Board is requested to allow application of
rationalization of weightage for Fuel & Bitumen for use in price
adjustment formula under Clause-70 of CoC ie Fuel Factor as 0.240
and Un-Skilled Labor as 0.080 (8%) and Bitumen (0.047) in the best
interest of the project.

11.2.
11.3.
The Chief (T&C) stated that the Board has time & again
directed not to consider revision of Factor-C items. The VP-NESPAK
supported the version and opined that Factor-C is being misused,
therefore, working paper need to be scrutinized and earlier decisions
of the Board be annexed for consideration and decision of the item.
The Chairman agreed, in principle, with this point of view. However,
he opined that Factor-C consideration seems justified only because of
increase in scope of work.
11.4.
The Member (Planning) clarified that initial project was for
earthworks and cut only, whereas, now this proposal include full
fledged road component, therefore, revision of Factor-C has been
necessitated.
11.5.
The VP-NESPAK objected that weightage of fuel equal to
0.24 (as proposed) is very high & will open a Pandora box. After detailed
discussion the Board agreed with the suggestion of VP-NESPAK that
weightage of fuel should not be over 0.17.
11.6.
The Chief (T&C) suggested that the Member (Planning)
may go through the proposal and a suitable proposal be submitted to
the Board for consideration. The Chairman explained the urgency &
importance of the project and apprised the Board that further delay in
decision can not be afforded and it will cause negative effect on
completion of the project; therefore, he suggested that the proposal
may be cleared in the interest of public works with the weightage of
fuel equal to 0.17.

The Joint Secretary (MoC) observed that promotions
against PC-I posts cannot be made under the rules. The Member
(Admn) clarified that these are not the promotions but appointments
on acting charge basis against 30% posts of PC-Is as prescribed by the
National Highway Council.
14.4.
The Joint Secretary, Finance Division remarked that
usually effective date for promotion is considered from the date of
approval of competent authority. The Member (Admn) explained that
as per practice, promotions in NHA are made effective from the date of
meeting of Departmental Promotion Committee (DPC).
14.5.
The Inspector General (NH&MWs) Police opined that
integrity of the recommended officers be checked in PERs and
personnel having good service record be considered for promotion as
NHA plays vital role like backbone in the development of the country.

The Chief (T&C) supported the said version and added that other
vacancies falling under the promotion quota be also worked out and
deserving employees of the Authority be considered for promotions. He
further suggested that the Admn Wing also see that these cases do not
fall under any litigation and there is nothing pending against the
officers recommended for promotion. The Chairman assured the
Board that only deserving personnel having good career record would
be suggested for promotions.

The Joint Secretary, Finance Division remarked that this
proposal needs to be considered by the Finance Division before getting
approval of the Executive Board. The Member (Admn) narrated that
the Executive Board is competent to create, abolish and re-designate
the posts in NHA; hence the proposal is within the competency of the
Executive Board. The Chief (NTRC) was of the view that, since some of
the NHA employees have gone to the courts, the matter may be
decided in the light of orders of the courts.

awarding the contract to M/s Frontier Works Organization (FWO) for
execution of balance / leftover works of Kalat Quetta Section-II
ICB-2 km 60+000 to km 114+4 (54.4 km) and Quetta - Chaman
Section-II ICB-4 km 59+800 to km 116+424.40 (56+624.40 km) at the
evaluated / negotiated bid amount of Rs 6,060,810,961/= including
cost of Consultancy & Supervision, Risk of Quantity Variation and
Market Fluctuation.

The Board was informed that USAID has specified in the
MOU that the works will be awarded to M/s FWO through a
negotiated contract. The award of works to M/s FWO on single source
basis as per USAID requirement is in line with PPRA Rule-5.
23.4.
However, Public Procurement Regulations 2011 require
that whenever an agency shall invoke Rule-5, it shall bring the case to
the ECC which will concur or otherwise for the agency to proceed in
term of Rule-5.
23.5.
NHA took up the case with MoC vide its letter dated Aug
23, 2013 and subsequently MoC forwarded the Summary to ECC vide
its letter dated 18 September 2013. The ECC in its meeting held on
Jan 8, 2013 has approved, in principle, the award of works to M/s
FWO on single source basis subject to fulfillment of all codal
formalities; and approval of the revised PC-I of the project by
CDWP/ECNEC (Annex-C).
