According to the petitioners, the Teachers/Lecturers working in the Private
PolytechnicInstitutionsandtheTeachers/LecturersworkingintheGovernment

are required to do the same work and therefore, the discrimination only
regarding the regularization of their services is impermissible in law and is

contractual employees and they have accepted the employment with full

not the case of the respondents that any illegalities took place during the
selectionprocess.

appointmentofthepetitionerscametoanend,therespondentGovernment
issuedtheresolutiondated26th October,2005andcontinuedtheLecturersfor
the further period of two years. It is to be noted that the Government of

MaharashtrahasstatedintheaffidavitfiledbeforethisCourtthatithaddecided
tocontinuetheservicesofthecontractualemployeesaftergivingfourtofive
days'breakuntilthecandidatesselectedthroughMPSCareavailableandthat
theGovernmentofMaharashtrahaddecidedtogrant30days'leavetothese
ba

employeesandhadincreasedmonthlypackageoftheseemployees. These
factors show that the posts, in which these employees are appointed on

contractualbasis,arepermanentandfulltimepostsandtheservicesofthese
employeeswererequiredbytheGovernmentofMaharashtratodischargeits
constitutionalobligationofimpartingeducation.

ThecontentionoftheStateGovernmentastowhethertheposts
shouldbefilled onaregularbasisorcontractualbasisisapolicymatterand
cannot be within the domain of the judicial review of this Court is without

followtheConstitutionalScheme. Itisnotindisputethataftertheirselection,
thepetitionershaveworkedforaperiodbetween3yearsto10years. Inthis

postswhicharestillvacantandtheadvertisementissuedbytheMPSCisonly

for400posts.Itcan,thus,beclearlyseenthatevenafterthecandidateswho
wouldbeselectedthroughtheselectionprocessconductedbytheMPSCare
available,morethan4500postswillbevacant. Itis,therefore,clearthatthe
petitioners'absorptionwouldinnowayaffectthecandidateswhowouldnowbe

selectedthroughtheMPSC.Itis,thus,clearthatthepetitioners'continuationin
service would not adversely affect the fundamental right guaranteed under
