infrastructure must be developed to enable precious molecules (the natural gas and natural gas
liquids) to be distributed to locations for optimal economic use or further development. From
pipeline transmission systems to compressor stations, from fractionation plants to crackers, and
from river terminals to rail loading stations, capital investment must be plowed into midstream
assets.

NUISANCE IN THE SHALE GAS PLAYS
Nuisance claims are getting more attention because of a large verdict against a natural gas
operator in Texas last year. This presentation examines the law of nuisance and the types of
claims that may be asserted against hydraulic fracturing operations under this vague tort.
Special consideration will be given to defenses and the law of damages, with an evaluation
of how the recent West Virginia decision modifying the law of residential real property
damages may impact nuisance claims.

This presentation will cover the legal theories and practical reasons for pooling of
separate oil and gas tracts to form one or more units, and various arguments against
pooling. It will survey the most important cases with an emphasis on West Virginia
decisions. It will conclude with a summary of the integration and pooling bills that
have been adopted and considered by the West Virginia legislature.

THE OSHA INSPECTOR IS HERE WHAT NEXT: AN OVERVIEW OF OSHA FROM


INSPECTION THROUGH CONTEST

The shale boom has created many new construction and manufacturing projects for
midstream operators. These infrastructure projects are creating plant facilities built for the
gathering, processing, fractionation and transportation of energy. This construction activity,
and subsequent operations, has or will capture the attention of OSHA. This presentation
provides an overview of OSHA's jurisdiction, its legal authority for inspections, and practical
information about how to respond to OSHA, from the initial inspection through the contest
and appeal.

THE NEW AMENDMENTS TO THE ENDANGERED SPECIES ACT: THE POTENTIAL


IMPACT ON THE GROWTH AND DEVELOPMENT OF THE WEST VIRGINIA OIL AND
GAS FIELDS
The Endangered Species Act discussion will cover the Multidistrict litigation that resulted in a
schedule for the US Fish & Wildlife Service to make affirmative determinations on whether to
list more than 1,000 candidate species. This session will include an update on the proposals
for the Northern Long-Eared Bat, which is indigenous to WV and 37 other states. An
assessment of the Endangered Species Act rulemakings, listing decisions, and agency
funding will also be discussed.
