In attention to your letter dated February 18, 2014, please be informed that
pursuant to the provisions of Section 2J.16,Article J, Chapter II of the Provincial
Revenue Code of 2005,and Section 98, Article J, Chapter II of the Revised
Revenue Code of the Province CY 2013, the sharing of the proceeds of the
amusement tax is as follows:

Please be informed further, that as per records of this Office, the total
amount
of

THOUSAND
THREE
HUNDRED(P176,300.00) PESOS representing amusement tax was collected for
the period from April to august 2010; February to June 2011 and January to July
2012. There were no collections made from Piat Cockpit Arena for the period
January 1, 2007 to April 5, 2010 and July 8, 2012 to present.
In view hereof, please find attached xerox copies of the above-cited
provisions of Provincial Ordinance No. 2005-07 entitled Cagayan Provincial
Revenue Code of 2005 and Provincial Ordinance No. 2013-8-008 entitled An
Ordinance Revising the Provincial Revenue Code of 2005 of the Province of
Cagayan for your ready reference.
May this information be of help in the review of existing ordinances in your
Municipality.

This has reference to the recent conference we had last February 05,
2014 at the Kamaranan Hall of the province with the different contractors who
were awarded projects by your agency.
It was suggested by one of the contractors, and ultimately it was agreed
upon during the said conference,that the sand and gravel tax shall be
automatically withheld from the final payment of contracts to contractors pursuant
to the provision of Section 64, Article.H, Chapter II of the Revised Revenue Code
of the Province of Cagayan CY 2013 which states that and I quoteSec.64.
Imposition of Tax. There is hereby levied and collected a tax of ten percent(10%)
of the fair market value in the locality per cubic meter of ordinary stones, sand,
gravel, earth extracted from the bed of seas, lakes, rivers, streams, creek and
other public waters, as well as public and private lands within the territorial
jurisdiction of the Taxes
