Deed of Donation

KNOW ALL MEN BY THESE PRESENTS:

We, CD HERNAN, of legal age, married to LV HERNAN., a resident of #123 J.
Chavez St., Cagayan, Philippines, hereinafter referred to as the DONOR, and FA
HERNAN, of legal age, single, residing at J. Chavez Street, hereinafter called the
DONEE, witnesseth that:
The DONOR is the registered owner of a parcel of land, consisting of ONE
HUNDRED NINETY-FIVE (195) square meters, situated in the City of Cagayan de Oro
City, as evidence by a Transfer Certificate of Title bearing No. T- 1234567, which
property is described as a whole as follows:
A parcel of land (Lot 67896 (before Lot No. 457-A, Cad-3256-D) of the
Cadastral Survey of Cagayan, Cadastral Case No. 17, L.R.C. Cad Rec.
No. 1561), situated in the City of Cagayan, Bounded on the NE., points 23, by Filipinas Street; on the SE., points 3-4, by Lot No. 18067 (before Lot
No. 456-B); on the SW., points 4-5, by Lot No. 18607 (before Lot No. 456B); and points 5-1, by Lot No. 458; on the NW., points 1-2, by Lot No.
457. Beginning at appoint marled 1 on plan, being N,, 8 deg. 11 W.,
286.60 m. from BBM No. 2; thence

less. All points referred to are indicated on the plan and are marked on

FOR AND IN CONSIDERATION of the trust, fidelity, help, and affection shown
upon the DONOR by the DONEE, and as an act of gratitude and liberality on the part of
the DONOR, she hereby voluntarily GIVES, TRANSFERS, CEDES and CONVEYS by
way of donation, unto the DONEE, her heirs, assigns, and successors-in-interest, the
abovedescribed realty, together with all the improvements found thereon, free from all
liens, encumbrances and charges of whatever kind;
The DONOR does hereby reserve unto herself and unto the following people,
namely: LV Hernan, husband of the Donor, Spouses Adrian D. Hernando and
Marjorie G. Hernando, parents of the DONEE, and CJC Hernan, younger sister of the
DONEE, as long as they live, the right to all the fruits and rents that may be derived from
the property donated for their mutual beneficial use, benefit and disposition, and
meanwhile the DONEE cannot sell, alienate, exchange, mortgage, or an any manner
encumber the property without the prior written consent of the abovementioned
personalities.
The DONOR affirms that this donation is not made with intent to defraud her
creditors, and that she has sufficient funds and property reserved for herself and her
obligations;
The DONEE hereby state that she accepts this donation subject to the terms and
conditions set forth therein, and at the same time expresses her profound gratitutde for
this demonstration of affection and act of liberality on the part of the DONOR, who by
these presents also take notice of this acceptance.

Acknowledgment
Before Me, a Notary Public, this __th day of October 2004, in the
City of Cagayan de Oro, Philippines, personally appeared spouses CD and
LV HERNAN and FA HERNAN, with their Community Tax Certificates
bearing circumstances abovementioned. They are known to me and to me
known to be the same persons who executed the foregoing instrument,
and they acknowledged that the same was made on their own free and
voluntary act and deed.
This instrument, consisting of two (2) pages, including the page on
which this acknowledgment is written, has been signed on the left margin
of each and every page thereof by the parties and their witnesses, and
sealed with my notarial seal.
