A part of the decision for him to move in with me was a recognition by his siblings that there
was work to be done with Bob that I was in the unique position to do. From day one, John 8:32
has been a key verse for reflection. As Catholics, we are also great believers in confession
because we believe before you can remove the speck for you brothers eye, you must remove
the plank from you own. All of his siblings could attest that I have pushed, not just Bob, but
everyone to take ownership of their part in this tragedy. My motto could be taken from Pope
Benedict XVI, Caritas in Veritate (Love in Truth). Over these months Bob has come to accept
many hard truths about many things including himself. Like all of us, there is still work to do,
and I hope that the outcome will allow me to continue to accompany him in this process. .
As I close I ask first for Maureen. Even today I look at her and the words of Jesus from the cross
come to mind, Forgive them Father for they know not what they do. A basic principle of
moral theology is that a human act requires operation of the intellect and the will. I am certain
beyond any doubt that she did not and does not understand. I ask that you look not only to her
punishment, but to her healing.
As for Bob, what more is there to do? His name is destroyed. And the thing he cherishes most
in this world, his family, has been rent asunder. To borrow from Ezekiel, The parents eat sour
grapes, and the childrens teeth are set on edge.
In you final deliberations I would pray that you return in your heart to your days at Howard,
return to those fundamental truths we learned as idealistic students of theology, and let your
justice be tempered with mercy. Please give serious consideration to the alternative sentencing
proposals so that some visible good might come from this series of events that have caused so
much pain to so many people. Throughout the trial you unabashedly showed that you were a
man of faith. On January 6, I ask you to show the world that you are also a man of charity and
most of all a man hope.
I continue to pray for you, not only in your deliberation of this matter, but as you carry out
your ministry of justice in the lives of all those whose names go unnoticed by the world, but are
also Gods beloved children.

I met Governor McDonnell on many occasions during his term of public service in
Virginia. He is a good man, good public servant, and deserves tremendous credit for his service
to this country. I think it is a real crime the way he and his family has been treated this past
year. He was a part of something that was "inappropriate" but he his punishment has not fit the
crime.
I am disgusted about the way he has been treated and think he deserves an apology from
those that have tried to benefit from his mistakes. He worked hard to us during his public
service. I asked a former media person about him. She said that she know him when he was
Attorney General. He went the extra mile to be available and give honest answers.
Please judge the total contributions of this professional, not just one part of his service.
Balance is important is all aspects of life, and hopefully the law. A little public service by Bob
McDonnell should be all that would be required. He has already paid more than he should in
personal and family pain.

Thank you for your service to our community, and the Commonwealth for your years of
service as a judge and public servant. Thank you as well Judge Spencer for the
opportunity to express my personal knowledge and unqualified support for Robert F.
McDonnell, and my encouragement to you to extend him a lenient sentence.
I write you with great respect and a heavy heart for a man who I have known, worked
with, and also worked for over 20 years. During this time, I have served the
Commonwealth as Special Assistant to the Secretary of Health and Human Resources
where I worked directly with then Delegate Bob McDonnell on the issue of welfare
reform. I worked with him again, when I served as Communications Director and Senior
Advisor to the Commissioner for the Virginia Department of Social Services during the
implementation of welfare reform in the mid 1990s. Most, recently I directly served the
people of the Commonwealth under Governor McDonnells leadership as the
Commissioner of the Virginia Department of Social Services, and Special Advisor to the
Governor for Family Reintegration of State Offenders.
In these various capacities I have worked with former Governor McDonnell on issues
that range from:
Significantly reducing the number of homeless people in Virginia
Increasing the number of foster children who are adopted
Helping imprisoned adults to reintegrate with their children and family members
while in prison and once they get out
Helping individuals entrapped in the spider-web of dependency on welfare to find
work, reestablishing their work ethic and regaining their personal dignity
Aggressively restoring the rights of formerly incarcerated parolees
increasing the number of people who volunteer and donate to Virginia Food Banks
Increasing the number of prisoner reentry initiatives that helped to reduce the
recidivism rate in Virginia
Strengthening Virginia families by reduce the number of children who grow up
without a mother and father in their home

What is important to note is during this period of great leadership on behalf of the least
of these, Delegate and then Governor McDonnell could have chosen to focus on more
lucrative issues that would have likely increased his influence, his wealth, and his stature
in the General Assembly. I believe this personal decision to focus on issues that help
those less fortunate demonstrates a side of Governor McDonnells character that should
be considered by the court.
Governor McDonnell chose to focus on issues that disproportionately affected the poor,
the young, the weak, the imprisoned and vulnerable in our Commonwealth. These are
constituencies that seldom vote, give money to campaigns, or have any great political
influence. These are issues that are seldom championed by most politicians and
particularly not Republicans.
As background, I grew up in Norfolk, Virginia, and spent the first four years of my life in
government subsidized housing project called Liberty Park. During my high school years
we lived in a single family dwelling at the intersection of Princess Anne Rd, and
Merrimac Ave. across the street from both Bolling Park and Roberts Park. This was my
home. When I toured prisons, welfare offices, housing developments and the like, with
Bob McDonnell, I was taking him to places and introducing him to people who were like
me as I grew up.
My personal experience, for good or bad, has likely made me overly sensitive to well
meaning, do-gooder politicians. Those who come around only during election time,
those who make promises but dont deliver, those who look for a photo ops with poor
people, using them as props to advance their own political careers. I would not be a party
to this type of behavior. What I saw in Bob McDonnell was the very opposite of that.
Governor McDonnell went to places when the media wasnt there, and when it was not to
his advantage politically to do so. He served those less fortunate because of his love for
people, and his character and commitment to try to make their lives better.
The Bob McDonnell that I personally experienced, partnered with, and observed in the
middle of Richmond City Jail, a church in Church Hill, or a visit to Gilpin Court, was the
same man that I saw in the Governors Cabinet meeting, or a private meeting in his office
to discuss legislation, or bumping into him walking the hall during a busy day. A man of
principle, a man of love and compassion for others in need of help.
The Bob McDonnell I witnessed countless times, time and time again was a man of great
compassion who could relate as comfortably with a tatted up prisoner, welfare mother
or child in need of adoption, as with a member of the General Assembly or dignitary.
For the sake of time I will limit my observations to three memorable occasions.

In the summer of 1994 the Virginia Commission on Citizen Empowerment held a series
of large and small meetings, tours and discussions across Virginia to get the best ideas to
improve the delivery of welfare assistance to the poor. I served as staff to that
Commission and then Delegate McDonnell served as a member of the commission and
future patron of the welfare reform legislation. We visited a number of government
subsidized facilities like Gilpin Court in Richmond and housing projects in Norfolk and
Roanoke. I saw then Delegate McDonnell warmly and respectfully listen, learn and
discuss the best ways for people to transition off of welfare.
His view was not one embrace by Republicans who were more draconian at the time, in
fact his approach, demeanor and message was one of hope, support and encouragement to
help those entrapped in a cycle of poverty to break free from the debilitating and spider
web of welfare. He did not come or leave with an entourage, but by himself. He spoke
personally and directly with people, often staying after the event to converse with people
with compassion, attentiveness and respect. These were individuals who likely did not
vote for him, support him, or likely never vote for him. But he treated them as if they
were at a Republican convention. His compassion and respect extended great dignity to
the people he spoke with.
In July of 2013, Governor McDonnell was in the twilight of his tenure as Governor. In
my capacity as Special Advisor to the Governor for Prisoner Reentry and Family
Reintegration I arranged for the Governor to participate in a Daddy Daughter Dance
which was taking place at the Richmond City Jail. The Governor did not need to come,
the event would have happened without him. The press coverage was limited, but the
focus was on encouraging offenders who would be getting out within the next two years
to reestablish relationships with their family.
The Daddy Daughter Dance served as a opportunity for the guys to reconnect
relationally, but also emotionally with their daughters. Governor McDonnell not only
came with his own daughter, but stayed for the entire event, rather than popping in and
popping out for a photo op. On his way out, he then sat and talked with more inmates
who were also focusing on reintegrating with their family members. Governor
McDonnell expressed great respect, warmth and grace to these men, giving them dignity
and hope for the future.
While most of my interaction with Governor McDonnell has been professional, I have
also interacted with him on one personal occasion. Governors make dozens of decisions
daily and he made one which adversely affected me directly. After the decision was
made, Governor McDonnell took time to review it, looked into the matter further and
realized that he had relied on incomplete information when making his decision. Once he
realized this error, he rectified the decision and then sought me out to let me know why
he made the first decision and how he was made it right in his second decision. He did
not have to do that. He could have blown me off and moved on. But, instead he sought

me out to personally communicate his apology and appreciation that all was resolved. I
so respect the man for doing what others rarely do at all.
In closing, Judge Spencer, thank you again for the opportunity to share my thoughts with
you as you make this important and difficult decision. I respectfully request that you
employ great leniency in your sentencing. Please know that if you would like any

One last occasion that I would like to share that highlights the character of Bob
McDonnell is his Executive Order which expanded the automatic restoration of civil
rights to non-violent ex-offenders. Governor McDonnell often stated when talking about
the restoration of rights that we are a nation of second chances, we believe in
forgiveness and restoration. That giving people second chances is the American way.
Ben Jealous, National President of the NAACP, participated in the event and lauded
Governor McDonnell for demonstrating great courage and integrity. In an interview with
Democracy Now, Mr. Jealous said it best:
You heard the Governor talk about redemption for instance. That is the value
that he and I found three years ago when we talked about this, that we both
treasure. That was the principle we could come together on. People have a right
to redemption. And if someone is going to redeem themselves, then we as a society
have to do everything that we can..to help them.
Judge Spencer, as you execute justice in your sentence, please do so with the
consideration of the type of man of character and integrity that Bob McDonnell has
demonstrated throughout his life and career. Please extend to him the grace, mercy and
redemption, that when given the opportunity, Bob McDonnell extended to others.

Beyond the collaboration on official and professional business, I also saw Bob's commitment to
our community at a personal level. For example, we both are supporters of the Central Virginia
Food Bank. I have been with Bob and his sons as we volunteered at the Food Bank, and I know
this was something Bob did every year as Governor.

of the boat, discovering later that he broke his arm. As Rex tells it, I set about to interview
McDonnell. The talk didnt last long, and I stepped back to check my notes. The next thing I
knew, I was sitting on the deck of the boat with people, including the governor, hovering about
asking how I was doing. I had passed out from the pain, I learned later and fallen. My first
words, Im told, were gems of wit under fire: Did something happen?
Something did happen. I was standing next to Rex when he literally hit the deck. And he hit
hard. Not knowing how injured he might be, I propped him up with my legs. To my surprise, it
was not the trained marine law enforcement agents or the boat captain or the Governors
protective agents who jumped to administer aid. It was Bob McDonnell. The Governor of the
Commonwealth of Virginia, the former Boy Scout, the former Army Officer was immediately
there offering first aid. With Rex leaning on my legs I had a front row seat to the compassionate
Bob McDonnell, checking his vital signs, unbuttoning Rexs shirt, asking him questions about
his pain and medical history. Wow.
Here we were there with 20 or so people gathered for a boat trip but everything was on hold. We
had a second boat and the Governor could have easily turned the scene over to his staff and the
officers present. But he stayed there until Rex was lifted into a chair and was stable. Later, Rex
would say in an article, I wonder if Obamacare will work as well as McDonnellcare.That
evening, McDonnell called me at home. It turns out that politicians can be caring people. Who
knew?

Dear Judge Spencer,
I am writing to you on behalf of former Governor, Robert F. McDonnell, to make
request for a lenient sentence, because of the long history of good he has done for
our great Commonwealth, and because he became over the last four years, a
personal friend.
My family has been in Virginia since colonial times, and I have a great love for
our Commonwealth and the people who live here. I was the first person in my
family to graduate from College, Im a proud graduate of Virginia Tech and
manage my own small business. But I am also the wife of a former member of
Governor McDonnells Cabinet, Secretary of Natural Resources, Doug
Domenech, and in that capacity, I was privileged to get to know the Governor
personally during my husbands term, 2010-2014.
One of the things I respected and appreciated was the Governors first hand
knowledge of military service. There were many occasions when he honored and
supported military families. I felt this personally. My son is an active duty Army
Officer, and during 2012 he was serving with the 82nd Airborne unit in
Afghanistan. As you can imagine, with a son downrange, we were anxious for
news of his welfare, and said many prayers on his behalf.
Once the Governor knew that our son was in the Army, he ALWAYS asked
about how he was, and how I was doing, as he understood first hand how hard it
is to have your child serving in harms way. As a man of faith, the Governor
encouraged us that he was praying for our son. We were grateful for the
understanding and concern he showed. We are grateful to God that our son
returned safely, along with all of his platoon.
I was also very impressed by the Governors initiative to find homes for the
children remaining in Virginias foster/adoption system, and my husband and I
both supported that effort, since we adopted our youngest child through a
Virginia Agency. The Governors Initiative was very successful, placing over
1,000 children in loving homes. The desire of the Governor to meet the needs of
some of the least powerful and disposessed people in our Commonwealth shows
the true heart of this man you will have to sentence.
In light of his compassionate and long service to our Commonwealth, I implore
you to make his sentence lenient.

We are Paul and Gail Duberstein. We are former neighbors of Bob McDonnell when he resided in
Virginia Beach. I have been a Regional Director of Operations with Jackson Hewitt Tax service for the
past 16 years, retiring this past April. Gail, after serving 30 years as a Virginia Beach Educator specializing
in reading and writing, is also retired. We have known Bob and his family for 20 plus years.
During that time we have witnessed Bob tirelessly giving of himself whenever asked. I recall one
incident when our neighborhood association needed some assistance with a proposal to the Virginia
Beach City Council regarding an adjacent neighborhood that was going to be built. Bob offered his
services and spent many hours with the neighborhood council formulating a proposal. He then went
above and beyond by actually delivering the proposal to the Virginia Beach City Council. In addition, his
time spent on this project was pro bono.
This is only one example of the many times that Bob was there for someone when needed. Over the
years Bob has earned our respect and admiration for his service and actions in which he has been
involved.
We would like to thank you for your service during the course of the recent trial for Bob. We would also
ask that you consider leniency when handing out the sentencing for him. We ask this because we know
Bob as a person, neighbor, and good friend.
