Why this Petition is Important:


The Dunedin ratepayers overwhelmingly opposed public
money being used for construction of the stadium.
The private funding for construction never eventuated
(including three $1M donations).
The promise of "Not One Penny More" than the $188M
for Stadium construction costs was false.
The $6.4M fund for the 50 year capital maintenance
never eventuated. The Nov 2014 DCC Stadium Review
stated maintenance will be 20 times higher than evidence
given in the April 2009, Stop The Stadium's court case.
This petition is the first stage in the campaign to recover
the money from those who misled the community from
start to finish.

Summary
In 2006 the so-called "independent" Carisbrook
Stadium Trust was set up to investigate the
feasibility of building a new stadium in Dunedin.
Not One Penny More!
In 2007 the Dunedin City Council provided further
funding for the Carisbrook Stadium Trust to
further "investigate" the feasibility of building a
new stadium projected to cost $188 million - "not
one penny more!" was the mantra. $17.3 million
was spent in the investigation stage alone.
The stadium which ended up costing the city
$266.4 million2, is now referred to by media as
the "troubled stadium." In the Dunedin City
Councils Stadium Review of Nov 2014, their
projected cost for capital maintenance is twenty
times higher4 than what was stated as evidence
in the Stop The Stadium court case in April 2009.
78.3% of Ratepayers Opposed
In 2008 investigations continued amongst an
unprecedented outcry from Dunedin citizens
concerned at the cost for such a small city. As a
Dunedin resident and ratepayer, I headed the
Stop The Stadium Inc campaign and it soon
became apparent, in a University conducted
survey, that 78.3% of Dunedin ratepayers shared
my concerns. However, in April 2009, the final
construction contract was signed, against the
wishes of the ratepayers.
Reverse Robin Hood
I continued to investigate the stadium issue to
expose the truth of how public money was used
for private gain. Dunedin has suffered a reverse
Robin Hood scenario where money from the poor
went into the pockets of the rich. This is the first
stage in the campaign to right this wrong and
return the money back to Dunedin ratepayers.

Dear Sir Eion


You will recall the reports in The Mirror (10/7/13 - copied below) where you promised to honour your $1 million pledge initially reported in
DScene (13/5/09).
As there had been no public reports of you having paid up I decided a few months ago to make an official request under LGOIMA to see
if this money had been received. After repeated requests for the Dunedin City Council to respond to my request I have received no
response. I thought before making a complaint to the Office of the Ombudsman I would ask you directly if you have paid up. It is in the
public interest that this pledge is honoured as it formed part of the push for the decision for the stadium to go ahead. You may also recall
the report on the front page of the ODT (March 2007) where Mr Malcolm Farry announced "very excitedly" that he had a one million
dollar donation for stadium construction with another two "in the wings". This was also reported in the National Business Review.
I have prepared a sequence of events to help clarify the situation:
1. Mr Malcolm Farry announces three $1m donations for stadium construction in March 2007.
2. The Marketing Bureau, commissioned by Carisbrook Stadium Trust, tells Dunedin City Council in Dec 2007 that naming rights are
worth over $10m.
3. ODT reports Sir Eion Edgar becomes trustee of CST in August 2008.
4. Edgar and Farry announce Forsyth Barr have signed a Heads of Agreement in Jan 2009 and it is reported in NBR that a "substantial
cheque" has been signed.
5. Council documents of cashflow projections, peer reviewed by PwC in Feb 2009, show that the naming rights payments have
changed from full payment up front to two years in advance - "front-end loading" is the term for this.
6. Edgar announces in DScene in May 2009 he is making a $1m donation to the stadium.
7. Nine changes, as revealed in LGOIMA response from DVML, are made to the Forsyth Barr naming rights agreement then the
contract is signed on 2 August 2011...the day after stadium opens. One of the final changes is from yearly in arrears to monthly in
arrears.
8. Forsyth Barr makes their first payment on 1 September 2011. They are paying monthly in arrears.
9. Edgar, through Forsyth Barr lawyer in Oct 2012, denies having stated that Forsyth Barr had written a "substantial cheque". The NBR
journalist distinctly remembers the "substantial cheque" comment being made. However, no correction sought from NBR at the time.
10. The naming rights contract is no more than $5m as revealed in 2013 through LGOIMA request to DVML.
11. Edgar claims his $1m donation is part of the naming rights corporate contract in The Mirror in July 2013. The $1m donation still
unpaid. None of the other three $1m donations for construction have been paid.
12. Michael Sidey is paying $1 million as part of the Forsyth Barr naming rights. I think what is happening is "double-counting".
Announcing million dollar donations for construction then two of these donations form part of the corporate contract for naming
rights. Either they are two $1million payments are donations and the naming rights is only $3m or the naming rights is $5m and the
two million dollar donations don't exist. You can't have it both ways. This "double-counting" trick is what happened in the STS High
Court injunction case where they claimed the $15m grant from Central Government was to offset the private funding shortfall AND
was also used to offset the increase in land costs. This "double-counting" trick was established in the Court of Appeal.
So, Sir Eion, have you paid the $1 million donation initially pledged for construction of the stadium? If you have paid $1 million as part of
the Forsyth Barr naming rights then good on you. That's between you and the corporate contract signed by Forsyth Barr. I'm sure
Forsyth Barr are happy about that. What is of interest to the public is have you paid the $1 million donation pledged in DScene?
As Chairman/Trustee of a number of Charitable Trusts you will be aware of the definition of a donation as recorded on the Charities
Commission website. It bears no similarity to a corporate contract. I have copied Charlotte Henley, Forsyth Barr's lawyer, into this email
so she can confirm this definition, in case you still have any doubts.

Mrs Turner complained about what she said was the


"obscene haste". . . "Dunedin does not need a $200
million temple torugby to survive as a city."

The Dunedin Town Hall echoed to the sound of a


clapping and stamping crowd clearly and
vociferously opposed to the proposed stadium last
night.
The meeting, organised by Stop the Stadium, heard
about the organisation's latest strategy - a plan to
withhold the average $66 a year the Dunedin City
Council has told ratepayers they will have to pay for
the stadium.
Broadcaster Dougal Stevenson was master of
ceremonies, and the speakers were Dunedin
businessman Alistair Broad, Dunedin city councillor
Dave Cull, Otago regional councillor Gerry Eckhoff,
Dr Robert Hamlin, of the University of Otago School
of Business, NHNZ chief executive Michael
Stedman, and former Dunedin mayor Sukhi Turner.
The meeting attracted up to 1800 people, with both
the ground floor and gallery levels, which seat more
than 900 people each, almost full.
Mrs Turner complained about what she said was
the "obscene haste" with which councillors were
spending money that would drain the pockets of
ratepayers for decades to come.
"Dunedin does not need a $200 million temple to
rugby to survive as a city."
The average rate increase was supposed to be $66
a year, and, to make the council take notice she
urged people to withhold that money.
A pamphlet distributed at the meeting said the
strategy had been "confirmed" by the University of
Otago faculty of law dean Prof Mark Henaghan as a

"no-risk, low-cost means of protesting" to the


council.
People should deduct $16.50 each quarter, which
would attract a 10% annual penalty of $6.50, "but
we think that there is no cheaper or more effective
way of delivering a serious message to the
council".
Asked after the meeting if that amount of money
would make a difference, Stop the Stadium
president Bev Butler said it was not so much the
money as the message behind the action.
"It's to show the majority of citizens do not support
the stadium."

would cost, most households in Dunedin could not
afford the rate rise to pay for it, the stadium would

cost ratepayers' money to run, and there were
many better ways to spend the money, including
keeping the Highlanders at Carisbrook, buying the
former chief post office, getting "Third-World" buses
off the main street, putting State Highway 1
underground at the University of Otago, or
reinstating trams.
Cr Eckhoff said the the stadium was designed to
provide for the New Zealand Rugby Union and its
international partners, despite them having no
monetary input.
The public consultation on the project was a "sham"
and the councils should have set up public focus
groups and facilitated meetings between the
Carisbrook Stadium Trust and those who opposed
the project.
Mr Stedman said there had been a lack of detail
and "non-partisan evidence" on what the stadium
would be used for, and there were questions over
whether the Otago Rugby Football Union would be
able to pay to hire the stadium, as it was "failing
dramatically".

Dr Hamlin said the money the trust had raised from


seating packages was not capital, but revenue.
He said building companies were not insurance
companies and could not provide certainties on the
cost.
"A guaranteed maximum price contract with a very
small hole in it is about as useful as a bicycle tyre
with a very small hole in it."
Cr Dave Cull said the total project cost had risen by
$10 million, the guaranteed maximum price
contract offer contained loopholes that could
expose the council to risk of price increases, a
contract had not been finalised with the University
of Otago, nor had an occupation and revenue
agreement been signed between the Otago Rugby
Union and the trust.
The meeting ended with a standing ovation for the
speakers.

"public money has been used for private gain" is unconscionable. I smiled to
myself when reading about the 'Reverse Robin Hood' in the summary section
(page 2) of the Official Petition Report. Everyone should check out this report.
Hopefully this petition will be more than a catalyst to right this terrible wrong and
return millions of dollars back to the Dunedin's rate payers. Let's hope it inspires
other communities who have been victims of corporate greed to stand up fight for

I believe that a few key individuals, Eion Edgar among them, are responsible for
the stadium being foisted upon Dunedin residents at ratepayers expense and
against their wishes. It would be decent for these individuals to now compensate

I am signing this petition because, on the evidence provided, Sir Eion seems to
have reneged on making his promised contribution to the Stadium. That pledge,
along with others, was used to encourage the Council to agree to build the
Stadium in the face of ample evidence that it was going to be a financial disaster.
Sir Eions contribution would now soften the impact on Council finances, and fulfil
a promise that was presumably made in good faith.
