Cleanliness
Every establishment shall be kept clean and free from effluvia
arising from any drain, privy or other nuisance and in particulara) Accumulation of dirt and refuge shall be removed daily.
b) The floor of every work-room shall be cleaned at once in every week.
c) Where the floor is liable to become wet in the course of any manufacturing
process to such extent as is capable of being drained.
d) All inside walls and partitions, all ceilings, or tops of rooms, and walls, side
and tops or passages and staircases shall be furnished.
e) The date on which the process required by clause.
Artificial humidification
In any establishment in which the humidity of the air is
artificially increased, the water shall be effectively purified before it is so
used.
Overcrowding
1) No work-room in any establishment shall be over crowded to an extent
injurious to the health of the worker employed therein.
2) Without prejudice to the generally of the provisions.
Drinking Water
1) In every establishment effective arrangement shall be made to provide and
maintain at a suitable point conveniently situated for all workers employed
therein, a sufficient supply of wholesome drinking water.
2) All such points where water is supplied shall be legibly marked Drinking
Water in Bangla.
3) Where dehydration occurs in the body of workers due to work near
machineries creating excessive heat.
2) Such Latrines and Urinals shall be provided separately for male & female
workers.

Welfare
Washing Facilities
In Every establishment1) Adequate and suitable facilities for washing and bathing shall be provided
and maintained for the use of the workers therein.
2) Separate and adequately screened facilities shall be provided for the use of
male and female workers

Canteens
1) In every establishment wherein more than one hundred workers are
ordinarily employed, there shall be provided adequate number of canteens for
the use of the workers2) The government may make rules for providing these facilities.
3) The managing committee to be formed under the rules shall determine the
foodstuff to be served in the canteen, and the charges thereof.
Shelters
In every establishment wherein more than fifty workers are ordinarily
employed, adequate and suitable shelters or rest rooms, and a suitable lunch
room, with provision for drinking water, where workers can eat meals
brought by them, shall be provided and maintained for the use of the
workers.
Safety
Fencing of Machinery
In every establishment the following shall be securely fence by the safeguards
of substantial construction.
a) Every moving part of a prime mover and every fly wheel connected to a
prime mover.
b) The head-race and tall-race of every water wheel and water turbine.
c) Any part of a stock-bar which projects beyond the head stock of a lathe.
b) Driving when not in use shall not be allowed to rest or ride upon shafting
in motion.
c) Suitable device for cutting off power in emergencies from running
machinery shall be provided and maintained in every work-room.
Excessive weights
No person shall be employed in any establishment to lift, carry or move any
load so heavy as to be likely to cause him injury.
Working Hours
Daily hours
NO adult worker shall ordinarily be required or allowed to work in an
establishment for more than eight hours in any day.
Weekly hours
1) No adult worker shall ordinarily be required or allowed to work in an
establishment for more than forty eight hours in any week.
2) Subject to the provisions of section 108, an adult worker may work for
more than forty eight hours in a week.
Night shift
Where an adult worker in an establishment works on a shift which extends
beyond midnightP.T.O.

a) For the purposes of section 103 a holiday for a whole day shall mean in his
case a period of twenty four consecutive hours beginning from the end of his
shift
b) The following day for him shall be deemed to be period of twenty four
consecutive hours beginning from the end of his shift and the hours he has
worked after midnight shall be counted towards the previous day.

Dispute as to age
1) If any question arises as to whether any person is a child or an adolescent,
the question shall in the absence of a certificate as to the age of such person
granted by a registered medical practitioner, be referred by the inspector for
decision to registered medical practitioner.
2) A certificate as to age of a person granted by registered medical practitioner
as mentioned in sub section (1), shall be conclusive evidence as to age of the
person to whom it relates.

Casual Leave
Every worker shall be entitled to casual leave the full wages for ten days in a
calendar year and such leave shall not accumulated and carried forward to the
succeeding year.
Sick Leave
1) Every worker other than a newspaper worker, shall be entitled to sick leave
with full wages for fourteen days in a calendar year.
2) Every newspaper worker shall be entitled to sick leave with half wages for
not less than one eighteenth of the period of services.
3) Such leave shall not be accumulate and forward to the succeeding year.
Weekly holiday
An adult worker employed in an establishmentP.T.O.

Festival Holidays
1) Every worker shall be allowed in a calendar year eleven days of paid festival
holidays.
2) The days and dates for such festivals shall be fixed by the employer in such
manner as may be prescribed.
3) A worker may be required to work on any festival holiday but two days
additional compensatory holidays with full pay and a substitute holiday
shall be provided for him in accordance the provisions of section 103.
