26 U.S.C. 1125 et. seq.; for unfair competition arising under the common law of the
27 State of California; and for violation of Californias statutory unfair competition law
28 arising under Cal. Bus. & Prof. Code 17200 and 17500.

This Court has original subject matter jurisdiction of this action under

8 Defendants pursuant to due process and/or the California Long Arm Statute because
9 Defendants have committed and continue to commit acts of infringement in
10 violation of 35 U.S.C. 271(a), (b), and (c), and place infringing products into the
11 stream of commerce, with the knowledge or understanding that such products are
12 sold in the State of California, including in this judicial district. Moreover,
13 Defendants acts, including both unfair competition and other violations of
14 California law, caused and are causing injury to Prestige within this judicial district.
15 On information and belief, Defendants derive substantial revenue from the sale of
16 infringing products within this judicial district, expect their actions to have
17 consequences within this judicial district, and derive substantial revenue from
18 interstate and international commerce, including within this judicial district.

22 or offered for sale infringing products in this district, and have committed other acts

25 suffering harm in this district.

BACKGROUND FACTS

On October 25, 2013, Prestige duly acquired a golf stick and reflector
5 business from Golf Solutions I, L.L.C. d/b/a Laser Link Golf (the Laser Link
6 Business) pursuant to an asset purchase agreement between the two companies and
7 in exchange for substantial consideration. Further, pursuant to this asset purchase
8 agreement, Prestige acquired the intellectual property, goodwill, and physical assets
9 related to the Laser Link Business.

In connection with its acquisition of the Laser Link Business and the
21 associated intellectual property and goodwill, Prestige acquired and owns all right,
22 title, and interest in the asserted design patents: (1) the D405 Patent, titled
23 Flagpole Reflector, a copy of which is attached as Exhibit A; (2) the D243
24 Patent, titled Flag Stick Reflector, a copy of which is attached as Exhibit B; and
25 (3) the D637 Patent, titled Flag Stick Reflector Insert, a copy of which is attached
26 as Exhibit C. The designs claimed in the Asserted Patents are embodied in
27 Prestiges Smarty 5 Reflector (as well as a previously offered substantially similar
28 product sold under the trade name Smarty Reflector) and/or in Prestiges SmartStick

1 products. Prestige also acquired all of Golf Solutions Is rights and goodwill in the
2 trade names SmartStick and Smarty and the trade dress embodied in the SmartStick
3 and Smarty.

5 offered for sale its Smarty and SmartStick products in interstate commerce, and has
6 vigorously protected its intellectual property, including the innovative and
7 distinctive designs of Prestiges Smarty and SmartStick that are protected through
8 the above-mentioned design patents issued by the United States Patent and
9 Trademark Office and duly assigned to Prestige. Prestiges design patents cover the
10 distinctive ornamental features of the Smarty 5 Reflector and SmartStick products,
11 including, for example, their overall appearances, shapes, and the location and
12 distribution of prisms throughout the devices. Prestige is informed and believes that
13 customers in the marketplace have come to associate these distinctive ornamental
14 features and overall appearances with Prestiges high quality products, including its
15 Smarty and SmartStick products.

Prestige is informed and believes that in 2014, Par Aide began offering
2 its own knock-off reflector products, dubbed Prism Flagsticks and PinSite Reflector,
3 in lieu of the previously offered SmartStick and Smarty products. Prestige did not
4 authorize Par Aide to practice the designs claimed in the Asserted Patents. Nor has
5 Prestige authorized Par Aide to offer products confusingly similar to Prestiges
6 SmartStick and Smarty products. Similarly, Prestige has never authorized Par Aide
7 to use Prestiges duly held goodwill and intellectual property associated with the
8 Laser Link Business, including the distinctive trade dress customers have come to
9 recognize when seeking the SmartStick and Smarty Reflector.

11 Prestiges SmartStick products. Par Aides Prism Flagsticks are shown in the
12 attached Exhibit F, which is a screen shot from Par Aides website. On information
13 and belief, this resemblance includes overall the appearance of the SmartStick
14 products, for example, the shape and arrangement of the prisms in the sticks, and the
15 colors and overall design of the sticks. Thus, Par Aides Prism Sticks are
16 confusingly similar to the previously offered SmartStick products. Moreover, Par
17 Aid sells its Prism Flagsticks under the very same part numbers it previously used
18 for the SmartStick products, as demonstrated by the attached Exhibit G, which is a
19 screen shot from Par Aides website.

On information and belief, Par Aide has used, imported into, sold, or
4 offered for sale in the United States its PinSite Reflector product, which infringes
5 the Asserted Patents. Par Aide has not obtained permission from Prestige to use,
6 sell, offer, or import Prestiges designs claimed in the Asserted Patents. On the
7 contrary, though Par Aide once licensed the Asserted Patents from their previous
8 assignee, Par Aide has not sought to renew this license. Par Aide had many options
9 in developing its PinSite Reflector. Nevertheless, Par Aide chose to willingly
10 infringe Prestiges designs claimed in the Asserted Patents by making, using, selling
11 or offering for sale, and/or importing its PinSite Reflector product during the terms
12 of Prestiges Asserted Patents, knowing full well that its PinSite Reflector product is
13 covered by the Asserted Patents.

16 Patents) is such as to deceive an ordinary observer, giving such attention as a
17 purchaser usually gives, including inducing the purchaser to purchase one supposing
18 it to be the other. Par Aides PinSite Reflector has an overall appearance that is
19 confusingly similar and substantially the same, in view of the prior art and in the
20 eyes of an ordinary observer, as the Smarty 5 Reflector (and the designs claimed in
21 the Asserted Patents), as demonstrated by the side-by-side comparison below (Table
22 1).

4 a purchaser usually gives, including inducing the purchaser to purchase one
5 supposing it to be the other. Par Aides Prism Flagsticks have an overall appearance
6 that is confusingly similar and substantially the same, in view of the prior art and in
7 the eyes of an ordinary observer, as Prestiges SmartStick products (and the designs
8 claimed in the Asserted Patents), as demonstrated by the side-by-side comparison
9 below (Table 2).

7 Prestiges trade dress or any confusingly similar trade dress in connection with the
8 marketing and/or sale of Par Aides infringing Prism Flagstick.

5 1118, Prestige is entitled to an order requiring destruction of all infringing products
6 and promotional materials in Par Aides possession.

embroidered flags is constructed using 400 denier material with reinforced stitching. The 400 denier material is more durable
and is less likely to pucker when embroidered upon. Par Aide continues to recommend a lighter 200denier material for
regular golf flags, but recognizes a heavier 400 denier material provides the highest quality and satisfaction when
embroidery is preferred.

1. Acquire artwork. You need the correct artwork of your logo before we can start.
2. Select flag. Determine flag style, colors and quantity. Twelve-flag minimum for embroidery. Nine-flag minimum for screen printing.

4. Approve quote. Once a purchase order is received, a sample flag or JPEG file will be sent for logo approval
