PROMPT NOTIFICATION IN CASE OF INCIDENT

AND
WHAT YOU NEED TO DO WHEN YOUR CARGO IS DAMAGED

Dear Customers,
As you know, incidents may occur at any stage of the transportation chain by many reasons beyond the control
of the carrier or its servants; however, if concerned parties timely and correctly react, there will be an important
chance to prevent or mitigate damages and/or losses in the benefit of the cargo interests, carrier and any third
party involved.
The following guideline provides useful information that will contribute to react in an effective and speedy
manner in case:



An incident affecting goods is noticed by the cargo interest or


Your goods are found damaged upon arrival and the entitled party deems necessary to file a cargo claim
against the liable party.

Since each incident or damage is unique, the following guideline is of a general nature only and it is subject to
the terms and conditions of the contract of carriage.

I- Prompt notification in case of an incident with goods has been noticed by the cargo interest:
In case you face a situation that might affect your goods, we kindly
request you to immediately contact our agency staff in destination.
As soon as you become aware of a potential cargo loss or damage,
please send the carrier, through the agency staff in destination, a
notification pointing out:

The Bill of Lading number.


The container number.
A short description of the alleged cargo loss or damage.
A request for a decision as to whether a joint survey inspection will be required.

Customers duties:



Minimize the loss and/or prevent the loss, as applicable, from further
damage after the incident occurs.
Keep the affected items intact until the survey inspection has been
performed.

II- What you need to do when your cargo is damaged


If damage or loss to your goods is ascertained during a joint survey inspection and provided
you are the party entitled to file a claim against the carrier, please do so by stating the
amount to be claimed and attaching the following documents:
1. Original Bill of Lading (straight bills of lading included) or other document of carriage.
This will need to be duly endorsed where applicable.

2. Original of Release and Assignment or Subrogation of Rights executed by the Insurer (where
applicable): The document shall, amongst other relevant information, indicate the payment date and
indemnified amount.
3. Adjustment Report issued by qualified adjusters.
4. Survey Report.
5. Documents to justify the Sale and Purchase of the Cargo:

Commercial Invoice;
Packing List;
Un-stuffing Tally;
Stuffing Tally in case of cargoes being carried under FCL/FCL conditions, and
when shipments involve fruit or other perishable product. The shipment date will
need to be stated in such documents.
Import or Export Declarations before Customs to support the payment of the
import or export taxes or duties, where necessary.

6. Documents certifying the reception of the cargo at destination/origin.


7. Documents certifying the salvage of the cargo.
8. Instruction certificate issued by an Official Authority to support the destruction of the Cargoes.
9. Technical Documents (e.g. Laboratory Analysis Certificates).
10. Power of Attorney (POA) to act on behalf of the claimant.
11. Other Documents: In order to facilitate the analysis of the claim.

proper analysis of the cargo claim.
