SAFETY REGULATIONS UNDER FMA


1967
There are ten regulations and one rules of
safety regulations:
i. Factories and Machinery (Certificates of
Competency) Regulations, 1970;
ii. Factories and Machinery (Electric
Passenger and Good Lift) Regulations,
1970;

(Certificates of Competency)
Regulations, 1970

MAIN PROVISION

The examinations conducted by the


Chief Inspector in awarding the
certificates of competency.
The qualifications and experience of
applicants before they can sit for any
examinations.
The exemption from any examinations.

APPEAL BOARD
Any person dissatisfied (if fail) with panel
decision can appeal to appeal board.
Its decision is final.

EXAMINATIONS
First/Second Grade Engineer (Steam/Internal
Combustion Engines).
First/Second Grade Engine Driver (Steam/Internal
Combustion Engines).
Dredge master (Steam & Electric/Internal
Combustion Engines & Electric/Electric)

APPLICATION
Apply to sit for exam.
Certain fee shall be paid & possess the required
qualification

CERTIFICATES OF COMPETENCY

can be suspended or cancelled if the


holder is:
i. medically unfit, or
ii. in the case of serious misconduct
iii. if judged unfit after an enquiry or a court
case

(Electric Passenger and Good
Lift) Regulations, 1970

INTERPRETATION
GOODS LIFT
A lift primarily used to carry goods
but in which an attendant and the
person required to load and unload
the goods are permitted to ride.
PASSENGER LIFT
A lift primarily used to carry persons
other than the operator and persons
necessary for loading and unloading
and such lift includes a hospital bed
lift.

APPLICATION
Shall apply to lift that are used to transport
passengers and also goods in a vertical
direction.
Unless:
Exemption by Chief Inspector to such
condition as he may specify therein.
The owner of any lift must comply with any
other written law contained in these
regulations.

APPROVAL OF INSTALLATION OF LIFT


All such lifts require the owner to supply the Chief
Inspector with design details in order to obtain the
Inspectors approval (Reg. 6)
Application procedure such as:
- dimension and particulars of the lift;
- drawings design showing the size and position
of lift well;
- lift manufacturers certificates;
- a certificate declaring that have satisfactorily
withstood type test;
- a certificate stating the strength of suspension
ropes.

DESIGN, CONSTRUCTION,
INSTALLATION AND TESTS
The capacity of a lift is based on the lift car floor
area, and it must be displayed clearly on each lift
car (Reg.7)
Specifications for the following components of a lift
system:
- Machine room (Regulation 9);
- Lift well (Regulation 10);
- Landing doors (Regulations 12 & 13);
- Lift car (Regulations 14 to 19); and
- Suspension system (Regulations 20 to 29)

DUTIES OF LIFT OWNER


Shall ensure that such lift is maintained.
Shall enter into an agreement with an approved
firm for the periodic examination and
maintenance of such lift.
Inform an Inspector of that agreement.
Such agreement shall be for a period of not less
than 1 year and state name of the competent
person employed by the approved firm. who is
make such periodic examination and be
responsible for such maintenance.
Provide and maintain a register in respect of
every lift (as in Second Schedule)

DUTIES OF COMPETENT PERSON


Make such periodic examination and be
responsible for such maintenance.
Examine the lift at least once in every three
months
Cause the lift to be serviced and adjusted
once in every month.

NOTICES
The owner of every lift shall cause the
certificate of registration thereof to be
posted in the lift car or adjacent to the
bottom terminal landing.

ATTENDANTS

Inspector may direct any incompetents


lift attendants to cease to work, operate
or be in charge of any lift.

PENALTY
Any offence against these regulations for
which no corresponding penalty is
provided by the Act shall be liable to a fine
not exceeding RM 1000.

(Fencing of Machinery and
Safety) Regulations, 1970

MAIN PROVISIONS

Deal with safeguarding of machinery.


All dangerous parts of a machine, including
the power source and transmission must be
guarded.

Various parts of a machine shall be


securely fenced:
i. prime mover;
ii. transmission machinery; and
iii. driven machine.

MAIN PROVISIONS
All dangerous parts of a machine must be
guarded.
Construction and maintenance of fencing.
Construction of machinery.
Starting and stopping appliances for
machinery.
Electrical apparatus.

MAIN PROVISIONS

Duties and liabilities.


Duty of the occupier and the owner to
comply with the provisions of these
Regulations.

PRIME MOVERS
Every flywheel, electric generator, motor or
rotary converter, cranks, cross heads,
connecting rods, tail rods, extension piston
rods or cooling fans, governors and starting
arrangements shall be securely fenced.
Exhaust gases shall be led to a position of
safety in the open air.
Exhaust pipe shall be covered with heat
insulation material and safe from contact by
any person.

TRANSMISSION MACHINERY
The parts of a machine below shall be
guarded/fenced completely:
All shafting and shafting under work benches;
Trenches;
Friction drivers;
Clutches;
Gears;
Sprockets and chains;
Pulleys; and
Cone or stepped pulley.

TRANSMISSION MACHINERY
No person shall lubricate, adjust or apply
dressings to any transmission machinery in
motion unless can be performed from position
outside the fencing.

DRIVEN MACHINERY
All machinery using rolls:
Rolling mills;
Crushing rolls;
Dough rollers;
Rubber creping rolls; and
Rubber sheeting machine.
shall be effectively fenced.

DRIVEN MACHINERY
These Regulations relating to fencing and
safety also shall apply to abrasive, grinding,
polishing and buffing machinery.
Protection for the eyes of workers on a
around grinding, polishing or buffing
machinery shall be provided.

DRIVEN MACHINERY

In respect of woodworking saws the


provisions in this regulations relating to
fencing and safety shall apply.
Every woodworking saws such as
circular saws, band saw, swing saws or
pendulum saws shall be fenced.

OTHER PROVISIONS
To provide safety control such as:
- governor at the prime mover;
- at driven machinery.
Every devices or appliances shall be provided
and maintained by which the power can promptly
be cut-off from the transmission machinery.
Every overhead structure, crane, block, sling and
other appliances for lifting a load shall be of
sound construction and in every way suitable for
the purpose.
Cleaning and testing of machines using rolls.

DUTIES AND LIABILITIES


Shall be a duty of the occupier to comply with
the provisions of these Regulations and to
ensure that they are observed provided that
in the case of machinery used in common by
the owner and the occupier these duties shall
be the responsibility of both the owner and
the occupier.
It shall be the duty of the operator to make
use of fencing.

PENALTY
Any offence against these regulations for
which no corresponding penalty is
provided by the Act shall be liable to a fine
not exceeding RM 1000.

MACHINERY REQUIRING CERTIFICATES OF


FITNESS
The owner of every:
- Steam boiler;
- Unfired pressure vessel; or
- Hoisting machine other than a hoisting machine
driven by manual power.
Validity of every certificate of fitness be 15 MONTHS
from the date of inspection or such longer not
exceeding 3 YEARS as the Chief Inspector in his
discretion may consider appropriate.
Certificate of fitness shall issue when Inspector
satisfied that machinery complies with the provision
of the Act.

INSPECTION OF EVERY FACTORY AND


MACHINERY
Types of inspection:
Initial inspection;
Regular inspection;
Postponed of regular inspection;
Supplementary inspection;
Special inspection; and
Further inspection.

PENALTY
Any offence against these regulations for
which no corresponding penalty is
provided by the Act shall be liable to a fine
not exceeding RM 1000.

Factories and Machinery


(Person-In-Charge)
Regulations, 1970

MAIN PROVISIONS
Machinery required to be in charge of persons
holding certificates of competency.
Duties of visiting engineer.
Assessment of drivers.
Training of operators of machinery.

INTERPRETATION
VISITING ENGINEER
The holder of an engineers certificate of competency for steam
boiler, steam engine or internal combustion engines who is
employed by an owner to make periodical visits to, and inspections
of, his machinery.

CERTIFICATE OF COMPETENCY
A certificate granted under this Act by the Chief Inspector
certifying that the holder is duly qualified to be in charge
of machinery to which the certificate of competency relates.

INTERPRETATION
DRIVER
The holder of a drivers certificate of competency
For steam boiler, steam engine or internal
combustion engines

MACHINERY REQUIRING CERTIFICATED


PERSONS IN CHARGE
A person in charge of any:
Steam boilers;
Steam engines;
Internal combustion engines; and
Dredge.
This person in charge hold an appropriate certificate
of competency.

CERTIFICATE OF COMPETENCY
Visiting engineer duties. (Reg.5)
Assessment of drivers of steam
boilers/steam engine number and grade.
(Reg.13)

STEAM DREDGE
Shall be in charge of a person who holds:
An engineers (steam) certificate of
competency, such person having served for a
period of not less than 6 MONTHS as an
assistant in charge of a shift on a dredge and
had such certificate endorsed accordingly; or
A dredge masters (steam and electric)
certificate of competency.

INTERNAL COMBUSTION ENGINE DREDGE


A dredge driven by electric power generated by
internal combustion engines installed on the dredge
or directly by internal combustion engines shall be
under the charge of a person who holds:
An engineers (internal combustion engines)
certificate of competency, such person having
served for a period of not less than 6 MONTHS
as assistant in charge of a shift on dredge, and
had such certificate endorsed accordingly; or
A dredge masters (internal combustion engines
and electric) certificate of competency.

ELECTRIC DREDGE
A dredge driven by electric power from bulk supply
shall be under the charge of a person who holds:
An engineers (steam) or an engineers (internal
combustion engines) certificate of competency,
such person having served for a period of not
less than 6 MONTHS as assistant in charge of a
shift on dredge, and had such certificate
endorsed accordingly; or
A dredge masters certificate of competency.

DUTIES OF VISITING ENGINEER


To make visit of inspection at least once in every 2
weeks for steam boiler and associated machinery
and visits of inspection at least once in each month
to every internal combustion engine and associated
machinery;
To enter in the aforementioned register;
To submit to the Inspector not later than the tenth
day of every month a report on his inspection
during the preceding month in such form;

DUTIES OF VISITING ENGINEER(cont.)


To be present at every regular inspection of the
machinery and at such other inspections thereof as an
Inspector may require;
To assist an Inspector in any investigation he may
make of any accident connected with the machinery
reported under the provisions of Section 31 of the Act.

ASSESSMENT OF DRIVERS
An Inspector may ignore any steam boiler, steam engine
or internal combustion engine which:
Is required for standby purposes only;
Of itself does not require a driver under these
Regulations;
Is required to drive plan auxiliaries only.
For the purposes of assessing the number and grade of
drivers required.

TRAINING OF OPERATORS OF MACHINERY


An owner or occupier:
shall given the instructions to persons working on
machinery.
shall not require or permit any person to work on
any machinery unless he has caused such
person to be instructed.

TRAINING OF OPERATORS OF
MACHINERY(cont.)
No person can operate or work in any machinery
under Schedule (refer to the Regulation) unless:
had a course of instruction in the working of the
machinery and for a period not less than 10 days of
supervision by an experienced operator; and
in the immediate company of any operator with not
less than 6 months experience of the operation of
such machinery.

PENALTY
Any offence against these regulations for
which no corresponding penalty is provided
by the Act shall be liable to a fine not
exceeding RM 1000.

(Safety, Health and Welfare)
Regulations, 1970

MAIN PROVISIONS

Factory not be used as family dwelling;


Access to place of work;
Openings generally to be fenced;
Stairway, catwalk, runway and gangway;
Working at height;
Safety provisions in case of fire;
Fire fighting appliances;
Cleanliness and housekeeping;
Material storage;

MAIN PROVISIONS

Space for each person;


Ventilation, lighting and temperature;
Seating facilities and work benches;
Working clothes, personal protective clothing
and appliance;
Welfare provided facilities such as dressing
room, drinking water and sanitary convenience.
First aid provided.

OTHER PROVISIONS
Premises or building or part or portion of any
premises or building used as a factory cannot be
used as family dwelling.
Underground room not to be used for a factory.
Machinery cannot be installed on any floor
above the ground floor.

SAFETY PROVISIONS
Every part of any floor shall be maintained in a level,
good and non-slippery and free from holes. (Reg.6)
No materials or goods or other articles shall be
stacked on such aisles or gangways to access to
place of work. (Reg.7)
Every stairway, floor and teagle shall be fenced on
every exposed side. (Reg.8)
A stairway shall be provided to where any person is
regularly employed on any floor above the ground
floor. (Reg.9)

SAFETY PROVISIONS (cont.)


Shall be provided to ensure his safety and such
means shall where practicable include the use of
safety belts and ropes for working at height and will
be liable to fall a distance of more than 10 feet.
(Reg.12)
No person shall be required or permitted to enter
any confined space unless safety precaution have
been taken. (Reg.13)
Every factory building shall be provided with not less
than two exists from every floor in case of fire.
(Reg.21)

HEALTH PROVISIONS
The floor of every factory shall be cleaned at least
once every week or by regular sweeping or other
method. (Reg.23)
Natural ventilation or mechanical ventilation or both
shall be provided. (Reg.25)
Air cleanliness shall be maintained to protect
persons against inhalation of the fume or dust and
to prevent accumulating in factory. (Reg.26)
An Inspector shall require that suitable provision to
reduce the effect of high temperature on any person
employed. (Reg.28)

HEALTH PROVISIONS(cont.)
Provisions relating to lighting shall apply to every
factory. (Reg.29)
Emergency lighting system shall be provided in
every factory where more than 50 persons are
employed at any one time during hours of darkness.
(Reg.29)

WELFARE PROVISIONS
Working clothes, personal protective clothing and
appliances such as safety helmets, goggles, earplugs and screens, protection clothes, gloves and
respiratory protective equipment shall be provided.
(Reg.32)
Shall be provided adequate accommodation for
clothing not worn during working hours. (Reg.33)
At least one rest and dressing room shall be
provided where 15 or more women are employed.
(Reg.33)

WELFARE PROVISIONS(cont.)
Shall supply the clean and safe drinking water. (Reg.34)
Where persons of both sexes are employed sanitary
conveniences shall be separately arranged for persons
of each sex. (Reg.37)
First aid box or cupboard shall be equipped in
accordance with the Fourth Schedule and shall be
marked with red cross on a white background. (Reg.38)
More than 20 persons are employed, be trained in firstaid treatment. (Reg.38)
More than 150 persons are employed, first aid room
shall be equipped. (Reg.38)

DUTY OF OCCUPIER
Ensure that the process carried on does not affect
adversely the health of any person employed r the
public.
Comply with the provisions of these Regulations and
ensure that they are observed.
Shall be a duty of every persons employed to use
every facility to ensure his safety, health and
welfare.

PENALTY
Any offence against these regulations for
which no corresponding penalty is provided
by the Act shall be liable to a fine not
exceeding RM 1000.

APPLICATION
Every steam boiler and unfired pressure vessel to
which an authorized safe working pressure has
not been assigned by the Chief Inspector, unless
given exemption by the Chief Inspector subject to
such conditions as he may specify in the
certificate.

MANUFACTURE OF STEAM BOILERS


AND UNFIRED PRESSURE VESSELS

Prohibition of manufacturing without the


permission of the Chief Inspector
Procedure of application to manufacture:
i. Three copies of the design

iii. Particulars of the code, rules or specifications

IMPORTED STEAM BOILERS AND


UNFIRED PRESSURE VESSELS

Approval procedures for important steam


boilers and unfired pressure vessel:
i. Certificate from the manufacture
ii. Three copies of design drawing
iii. Particulars of the design, rules or
specifications of the design
iv. Details of the heating surface of the steam
boilers

STEAM BOILERS

Among the stipulated provisions are:


i. Essential fitting such as safety valves,
water pump etc
ii. Boiler houses
iii. Burning system and equipment
iv. Steam rests
v. Registration

UNFIRED PRESSURE VESSELS

Among the provisions stipulated are:


i. Essential fitting such as safety valves,
pressure gauge, manufactures name plate
ii. Location of safety valves
iii. Installation
iv. Supports
v. Cubic capacity

HYDROSTATIC TEST
Testing of steam boiler and unfired pressure
vessels before being put into service for the first
time. (Initial test)
Steam boiler shall be tested hydrostatically at
intervals not exceeding 7 years.
No person shall test any steam boilers or unfired
pressure vessel without the writing approval of
an Inspector.
Certificate shall be issued by Inspector after any
satisfactory hydrostatic test and on payment of
the prescribed fees for such test.

OTHER PROVISIONS

Among the provisions stipulated are:


i. Pipe connection and installation
ii. Maintenance
iii. Notifiable occurrences such as the bursting of a
tube
iv. Repairs
v. Registration number plate (PMT & PMD no)
vi. Records
vii. Fees for approval of design and hydrostatic
tests

PENALTY
Any offence against these regulations for
which no corresponding penalty is provided
by the Act shall be liable to a fine not
exceeding RM 1000.

RESPONSIBILITIES OF CHIEF
INSPECTOR

Provide a report on the administration of the Act and


Regulations to the Minister every year (before 15th day
of April).
These Regulation detail out the following requirements:
i. The responsibility of the Chief Inspector and Senior
Inspector to keep and maintain records pursuant to
the implementation of the Act;
ii. The provision of powers to Senior Inspectors to
conduct enquiries; and
iii. The provision of powers to any Inspectors to
conduct prosecution of offenders of the Act.

Issuance of certificate of competency.
Proceedings and enquiry held by him under Sec.
41 of the Act.
Order of exemption made by Minister under Sec.

RECORD KEEPING BY INSPECTOR IN


CHARGE OF STATE OR AREA
Description and location of factory.
Description and location of each steam boiler,
unfired pressure vessel and hoisting machine
which certificate of fitness has been issued and
particular of the engineer, dredge masters and
drivers employed.
Date of each initial, regular, supplementary,
special and further inspection or test of any
factory and machinery.

RECORD KEEPING BY INSPECTOR IN


CHARGE OF STATE OR AREA(cont.)
Notice prohibiting the operation of machinery
issued by him.
Reduction in the authorized safe working
pressure of a steam boiler and unfired pressure
vessel and of calculation.
Accident, dangerous occurrence and occurrence
of occupational diseases reported.
All fees collected.
Other matters as Chief Inspector may direct from
time to time.

MANNER OF PAYMENT
All fees shall be paid within 30 days of the date
service and credited to the revenue of the
government.

May be made in cash or by money order, postal
order or by draft.

(1), 27 (2), 29, 31, 34, 35 (1), 36, 38, 40
(3) and (4), and 42.

CONCLUSION

The Safety Regulations under FMA 1967


were enacted for the purpose of:
a) Preventing accidents due the use and
handling of machinery at the factory.
b) Establishing a minimum standard to protect
workers.

CONCLUSION
These Regulations stipulate detailed provisions
and measures in the prevention and the control
of hazards that an employer and workers should
undertake to prevent unwanted incidences at the
workplace.
The Regulations also stipulate controls over use
and handling machinery establishing the need
for certificate of fitness and the registration of the
competent persons.
