LastTuesdaybroughttoanendthe2014electioncycle.InPennsylvania,
thebiggestwinnerisGovernorElectTomWolf.Withhiswin,Wolfnow
entersthevaguetimeoftransition,thatperiodofadozenweeksorsoto
shiftfromthesinglefocusofacampaigntothebroadmanagementof
governing.
Inmakingthatshift,theGovernorElectwillalsohavetobalancehis
desireforchangewiththerealitiesofexecutiveagenciesandprograms
alreadyinplace,andalegislaturenowmoredeeplycontrolledbyanother
party.
Fromanenvironmentalandconservationperspective,thereareagoodnumberofissues
thatGovernorElectWolfwillhavetoaddress,andforseveralofwhichhehasalreadysignaled
someofhisintentions.FirstandforemostwillbeappointingSecretariestomanageDEPand
DCNR.Bothagencieshavecriticalmandatesinensuringthehealth,safety,andwelfareofthe
Commonwealth,andbothfacecriticalchallenges.
Whilechangingprioritiesisoftentherightofanewadministration,boththeDEPand
DCNRhaveongoingresponsibilitiesthat,whiletheymaybetweaked,stillmustbecarriedout.
DCNRmanagesover120stateparksandmorethan2.5millionacresonbehalfof

Pennsylvanians.Keepingthoseparksandforestsoperating,andmanagingthemultipleusesof
theforestsinasustainablewayinfaceofavarietyofextractiveuses,isforemostinthe
Departmentscharge.
Itisincumbentuponthenewadministrationtoensurethehigheststandardsandpractices
forindustriesoperatingin,on,andunderourcommonlands.Itisalsocriticaltoreinstatetheban
onanyfurtherleasingofstateforestorparklands700,000acresarewellmorethanenough.
TheDEPischargedwithprotectinghumanandenvironmentalhealththroughregulating,
essentially,howmuchwecandegradetheenvironment.Theydothisbysettingrules,issuing
permitsallowingacertainlevelofimpact,andthenenforcingthosepermits.Unfortunately,the
departmentdoesnothaveadequateresourcestoeffectivelycompletetheseroles.
Byitsownadmission,DEPisunderstaffedintheareasofshalegasandwater
management,andhascontinuedtoreceivebudgetsthatarenotenoughtocoveritsneeds.
ThishastochangeandoffersagreatopportunityfortheWolfadministrationtosignalits
supportofPennsylvaniashealthbypresentingtheGeneralAssemblywithabudgetthat
adequatelyfundsandstaffsDEP.
GovernorWolfwillalsobefacedwithfulfillinganumberofcommitmentsbothmadeby
andimposedupontheCommonwealth.AchievingpollutionlimitsintheSusquehannawatershed
tolimitimpactsontheChesapeakeBay,anddevelopingaplantolimitcarbonemissions
statewide,arebuttwoofthefederalprogramsinplay.
FinallygettinglongoverdueregulationsoutfortheOilandGasAct,dealingwithunwise
legislationdefiningunconventionalgasdevelopment,andcontinuingtoaddressabandonedmine
drainageandbrownfieldissueswillalsotaketheattentionoftheGovernorandDepartment.
Finally,therearealsothenewinitiativesatwhichtheGovernorElecthashintedat,or
thatheshouldbeencouragedtoundertake.
Inhiselectionnightspeech,Wolftalkedofallformsoffossilfuelsplayingaroleinthe
Commonwealthsfuture.Indeed,Pennsylvaniasenergyeconomywasastapleofhiscampaign.
HowthisisoperationalizedinthenewadministrationwillbecriticaltoPennsylvanias
environmentalfuture.
Asamajorglobalemitterofgreenhousegases,itisincumbentuponPennsylvaniatouse
itsconsiderableinnovativecapacitytoreducethoseemissionsandindeedprofitfromdoingso.
Afirststepwillbetolimitmethaneemissionsfromnaturalgasdevelopment.Another,as
hehassaidhewilldo,willbetojointheRegionalGreenhouseGasInitiativeandotherstates
alreadyaheadofusinaddressinggreenhousegases.GovernorWolfwillalsoneedtorecommit
Pennsylvaniatoadvancingrenewableenergyinourstate.
Thenewadministrationmustalsotakeheadoftheimpactsofthe25,000to50,000miles
ofnewpipelinethatarecomingtoarightofwaynearyou.Whileplanningandsitingofthe
interstatepipelinesaregovernedbyfederallaw,thereislittletonocontrolofwhereandhowthe
intrastatelinesaresitedorinstalled.Thishastochangeandsoon.
Insum,GovernorElectWolfhasmanygreatopportunitiestoconfirmhiscommitmentto
Pennsylvaniaslongheldenvironmentalandconservationvalues.Itbeginswithpickingleaders
ofDEPandDCNRwhorecognizeandembodythosevaluesandcanworktoachieveresultswith
avarietyofstakeholderstoprotectandenhanceourcommonwealth.
ItthencarriesontodevelopingpoliciesandstrategiesthatfulfillthepromiseofArticleI,
Section27ofthePennsylvaniaConstitution:
Thepeoplehavearighttocleanair,purewater,andtothepreservationofthenatural,

scenic,historicandestheticvaluesoftheenvironment.Pennsylvania'spublicnaturalresources
arethecommonpropertyofallthepeople,includinggenerationsyettocome.Astrusteeofthese
resources,theCommonwealthshallconserveandmaintainthemforthebenefitofallthe
people.
Aswitheveryadministration,thePennsylvaniaEnvironmentalCouncillooksforwardto
workingwiththeGovernorElect,histransitionteam,andDEPandDCNRastheymoveahead.

IndependentFiscalOffice:StateFaces$1.85BillionBudgetShortfall

TheIndependentFiscalOfficereportedThursdayPennsylvaniafacesa$1.85billionshortfallin
revenue$171millionforFY201415and$1.679millioninFY201516.
Thereportfindsthatpolicymakerswillfaceashortfallof$1.85billioninFY201516.
Thisincludes$171millionforthecurrentfiscalyearand$1,679millionrelatedtonextyear.
Knittelsaid.ThenonrecurringrevenuesandonetimecostssavingsemployedintheFY
201415budgetcontributesignificantlytothisdeficit.
Inresponsetothereport,Gov.ElectWolfsaid,"Thebudgetdeficitprojectionreleased
todaybytheIndependentFiscalOfficeisbadnewsforPennsylvania,butthedepthofthe
financialholebeingleftbytheCorbettAdministrationisstillnotknown.
"Today'sreportshowingamultibilliondollarbudgetdeficitisastarkreminderofthe
direfiscalsituationmyadministrationwillface.Asbadastodaysnewsis,whatliesaheadcould
beworse.Itiscriticalthatweunderstandthefullextentofthisbudgetcrisissothatwecan
addressourchallengesinaresponsiblemanner.
"Leadersfrombothpartiesneedtoworktogethertoachievemeaningfulsolutionsforthe
peopleofPennsylvania.WehavetomovePennsylvaniaforwardandmakedifficultdecisionsin
ordertosolveourstate'sfinancialcrisis."

Wolfsaid,"Amultibilliondollardeficitandastagnanteconomywillpresentsignificant
challengesfortheincomingadministration.Ourtaskforceisworkingtounderstandthe
complexityofthesituationathand,butintheendthereisnoquestionthatthelegislativeleaders
onbothsidesoftheaislearegoinghavetoworktogethertoreachsolutionsforthepeopleof
Pennsylvania."
JoshShapiroBudgetDeficitandFiscalStabilizationTaskForceViceChairfor
Gov.ElectWolfadded,"TherealityofthedepthofPennsylvania'sfinancialcrisisisunknown,
butyesterdaywelearnedthatthedeficitbeinghandedtotheincomingWolfAdministrationisa
multibilliondollarhole.Makingmattersworse,theIFO'sprojectionscameonthesamedaywe
learnedthattheCorbettAdministrationhasmaxedoutitsborrowingforbasicexpenses.There
aregreatchallengesahead,andbothpartiesmustcometothetabletofindnewsolutionsto
addressingthiscrisis."
Amongotherfindings,theIFOreportsaid
FY201415includes$572millioninnonrecurringrevenues,$619inonetimesavingsand
$332millioninfundingshifts.ThesemeasuresexacerbatethestructuralimbalanceinFY
201516,asthetemporarymeasuresarenotrepeated.Theresultingsnapbacklowersrevenues
andincreasesexpendituresforFY201516.
Pensioncontributionsforstateemployeesandschoolemployeeswillincreasefrom$1.7
billioninFY201415to$2.4billioninFY201516$700million.Mandatedemployer

contributionsforpensionscontinuetodrivemuchoftheexpendituregrowthinthenearterm.
However,theannualgrowthbeginstomoderateafterFY201617.
Slowtaxbaseerosionandnormalexpendituregrowthbecometheprimarydriversofthe
structuralimbalance.Netrevenuesareprojectedtoincreaseatanaveragerateof2.7percentper
annumandareoutpacedbyexpenditures,whichareprojectedtogrowatanaveragerateof4.1
percentperannum.
ThePennsylvaniapopulationisexpectedtogrowslowlythroughFY201920.Theprojections
assumenochangeintheworkingagepopulation(ages2064)andanincreaseof2.8percentper
annuminthe65+cohort.Thesedemographictrendswillrestraintaxrevenuesandincrease
expendituresduetotheriseintheservicepopulation.

OrganizationforWatershedsandRivers(POWR),anaffiliateofthePennsylvania
EnvironmentalCouncil.VotingwillbemanagedthroughWoobox,anonlinecontestapplication
thatrestrictsvotingtoonevoteperemailaddress.
POWR,anaffiliateofthePennsylvaniaEnvironmentalCouncil,administerstheRiverof
theYearprogramwithfundingfromDCNR.Presentedannuallysince1983,thisyears2014
designationwasawardedtotheSchuylkillRiverinsoutheastPennsylvania.
Itsreallygreattoseehowengagedpeopleareincampaigningfortheirlocalrivers,
saidPECPresidentandCEODavittWoodwell.
TheSchuylkillRiverGreenwayAssociationservedastheleadorganizationinpresenting
theSchuylkillRiver.
HavingtheSchuylkillnamedRiveroftheYeargavetheSRGAtheopportunityto
reconnectthepublicwiththeriver,saidSRGAExecutiveDirectorKurtZwikl.Thehonor

temperaturesforanextendedperiodcancausepipesinvulnerableareastofreezeandburstand

takingtheproperpreventivesteps,customerscanavoidworryingaboutfrozenpipesandmaking
expensiverepairstodamagedplumbinginsideandoutsideofthehome.
Propertyownersareresponsibleformaintenanceofthewaterservicelinefromthecurb
tothehouse,aswellasanyinhomepiping.PennsylvaniaAmericanWaterencouragesresidents
totakethefollowingprecautionstoreducetheriskoffreezingandburstingpipes.
Beforefrigidweathersetsin:
Knowwhatareasofyourhome,suchasbasements,crawlspaces,unheatedroomsandoutside
walls,aremostvulnerabletofreezing.
Eliminatesourcesofcoldairnearwaterlinesbyrepairingbrokenwindows,insulatingwalls,
closingoffcrawlspacesandeliminatingdraftsneardoors.
Knowthelocationofyourmainwatershutoffvalve.Ifapipefreezesorbursts,shutthe
wateroffimmediately.
Protectyourpipesandwatermeter.Wrapexposedpipeswithinsulationoruseelectricalheat
tracingwirenewspaperorfabricmightalsowork.Foroutsidemeters,keepthelidtothemeter
pitclosedtightlyandletanysnowthatfallscoverit.Snowactsasinsulation,sodon'tdisturbit.
Whentemperaturesareconsistentlyatorbelowfreezing:
Ifyouhavepipesthatarevulnerabletofreezing,allowasmalltrickleofwatertorun
overnighttokeeppipesfromfreezing.Thecostoftheextrawaterislowcomparedtothecostto
repairabrokenpipe.
Opencabinetdoorstoexposepipestowarmerroomtemperaturestohelpkeepthemfrom
freezing.
Ifyourpipesfreeze:
Shutoffthewaterimmediately.Don'tattempttothawfrozenpipesunlessthewaterisshut
off.Freezingcanoftencauseunseencracksinpipesorjoints.
Applyheattothefrozenpipebywarmingtheairaroundit,orbyapplyingheatdirectlytoa
pipe.Youcanuseahairdryer,spaceheaterorhotwater.Besurenottoleavespaceheaters
unattended,andavoidtheuseofkeroseneheatersoropenflames.
Oncethepipeshavethawed,turnthewaterbackonslowlyandcheckforcracksandleaks.
Whenyouareaway:
Haveafriend,relativeorneighborregularlycheckyourpropertytoensurethattheheatis
workingandthepipeshavenotfrozen.

TheDepartmentofAgricultureFridayjoinedtheDepartmentofEnvironmentalProtectionin
urgingtheEnvironmentalProtectionAgencyandtheArmyCorpsofEngineerstowithdrawand
revisetheproposedWatersoftheUnitedStatesrule,citingtherule'snegativeimpactonrural
communitiesandagribusinessesandonstrongstatelevelmanagementprograms.
"Thisproposedruleisheavyhanded,premature,confusingandoverreaching,"said
AgricultureSecretaryGeorgeGreig."Theruleisalreadysubjecttodifferingfederalstaff
interpretations,whichcoulddelaypermittingandunderminestrongstatelevelregulatory
programslikethoseundertheDepartmentofEnvironmentalProtection.Onesizedoesn'tfitall,
andIurgetheEPAandACOEtorecognizethatthedifferencesinourcountry'sregionsmake
strong,comprehensivestateprogramsandPennsylvaniaalreadyhasonethesensible
solution."
Greigsentthedepartment'scommentslastweektotheEPAandACOE,addressingseven
keyconcerns:
Theproposedrulewasprovidedforreviewbeforethesciencebehinditwasfinalizedbythe
federalScientificAdvisoryBoard.
Itassumesstatelevelregulatoryshortcomings,eventhoughPennsylvania'sprogramexceeds
federalCleanWaterActstandards.
Onesizedoesnotfitall,astheproposedruledoesn'taccountforsignificantregionalclimate,
geography,geology,hydrogeology,rainfall,andsoildifferences,potentiallyundermining
Pennsylvaniastatelawprotections.
Asdrafted,itcreatesmoreconfusionthanclarification,leavingmultipletermsandphrases
ambiguousorundefined.
Theagenciesdidnotadequatelyconsidertheproposedrule'sadverseimpactsonrural
communitiesandsmallagribusinesses,astherulewouldexpandfederaljurisdictionandcover
agricultureactivitiesonpreviouslyunregulatedland.
FederalauthorityispotentiallylimitlessandinconsistentwithlimitssetbyCongressand
recognizedbytheSupremeCourt.
Theproposedrulewouldhavedirect,substantialeffectsonstateprogramslikesoil
conservation,nutrientmanagementandpesticideregulationduetomorefederaloversightanda
broaderdefinitionofwaters.

TheDepartmentofEnvironmentalProtectionsFridayannouncedithasawardedLeeward
Construction,Inc.,ofHonesdalea$498,400contracttoexcavateandquenchacoalrefusebank
fireintheEynonsectionofArchbaldBorough,LackawannaCounty.
TheworkatEdStabackPark,wherethefireislocated,isscheduledtobeginon
November15.
Thisprojectwilladdresssignificantminefirethatwillresultinasafer,healthier
environmentforarearesidents,saidtoMikeKorb,Director,ProgramManager,WilkesBarre
District,BAMR.Residentswillseequiteabitofactivityatthefiresite,butcanbeassureditis
allinanefforttoeliminatethishazard.
ThefirewasdiscoverednearthecoalrefusebankonOctober20,andreportedtoDEPs
WilkesBarreoffice.Localpublicworksandfirecompanieswereunsuccessfulintheirattempts
todigoutandextinguishthefire.
OnOctober28,DEPhiredacontractortodrillnearthefiretodetermineitsdepthand
intensity.Thecontractordrilled25boreholes,threeofwhichwere20to40feetdeepand
registeredat100degreesFahrenheit.Thedepthofthefireisstillunknownhoweveritmeasures
approximately35feetindiameteronthesurface.Theareatobeexcavatedwilllikelybeless
thanoneacre.
Thefireexcavationandquenchingprojectwillconsistofconstructingaccessroads,
establishingawatersupply,applyingfirefightingfoam,excavatingandquenchingtherefuse
materialandregrading.Uponcompletionoftheproject,anydisturbedareaswillbeseeded,
cleanedandtheequipmentremovedfromthesite.
LeewardConstructionwillberequiredtohaveapprovedgasmonitoringequipmenton
siteatalltimestocheckforcarbonmonoxide,carbondioxide,hydrogensulfideandoxygen.
Thoseequipmentwilltakeaminimumofthreereadingsaday,within20feetofthenearby
homesorasdirectedbyDEP.
FundingfortheprojectisprovidedbytheAbandonedMineReclamationFund,whichis
subsidizedbythecoalindustryviaatonnagefeeoncoalmined.

115,033poundsoftrashfromtheLakeErieshoreline.
TheInternationalCoastalCleanupistheoldestandlargestvolunteerdriven,beach
cleanupeffortofitskindintheworld,andthisyearcelebratedits28thanniversary.Fromits
beginningsin1986with12sitesontheTexascoastline,theICChastransformedtomorethan
6,000sitesinabout100countrieswith600,000volunteers.

PennsylvaniaMakingProgressInWasteTirePileCleanup

InMarch1996,acatastrophictirefireengulfedabusysectionofI95inPhiladelphia,damaging
theroadwayandreleasingtoxicemissions.Thefiredrewattentiontoanenvironmentalissuethat
hadbeenquietlybuildinginPennsylvaniawastetirepiles.
Lawmakerstookuptheissuethatsameyear,passingAct190thatenabledDEPtobegin
toassessandremediatetirepiles,liketheoneresponsiblefortheI95fire.
In1996,Pennsylvaniahad36millionwastetiresinhundredsofpilesacrossthestate.
Manyhadbeenestablishedfordecadesasalessexpensivewaytodisposeofunwantedtires.
Othersbelievedthattheywouldsomedayhavevalue,sothetireswerestashedinhillsidesand
valleys.
SincethepassageofAct190,DEP,incooperationwithprivateindustryandwilling
landowners,hascleanedup97percentofthesewastetires.Lessthanamillionwastetiresremain
inthestate.
Pennsylvaniahasproactivelyaddressedthisproblembycommitting$29millionto
remediatewastetirepiles.Muchofthatmoneywasraisedbytippingfeespaidbythewaste
managementindustryandnottaxpayerdollars.
Wastetirepilesareaneconomic,environmentalandhealthblightonthelandscapeof
Pennsylvania.Thestatehasbeenaleaderinwastetirepileremoval,butthereisstillworktobe
done.

businessesfromthedesignatedcountiesareeligibletoparticipatebycompletingthe
CHEMSWEEPregistration/inventoryformthatwillbedirectmailed.Theregistrationperiod
endsFebruary28.
Anindependentcontractorhiredbythestateagriculturedepartmentcollectsand
packagesallwastepesticidesateachparticipatinglocation,primarilyforincinerationatfacilities
approvedbytheU.S.EnvironmentalProtectionAgency.
ChemSweepcoversthedisposalcostforthefirst2,000poundsperparticipant.Above
thatlevel,participantsarebilledattheagriculturedepartmentscontractedprice.

Anewbuildingincludesagreenroofplantedwithvegetationsolarpanelsgeothermal
heatingandcoolingonsitestormwaterinfiltrationwaterconservingplumbingfixtures
regionallypurchasedmaterialsandhighrecycledcontentmaterials.
OncethesitewherethefamousHenryRiflewasmade,theJacobsburgNationalHistoric
Districtliesalmostentirelywithintheparkgrounds.
C.F.Martin&Co.hasbeencreatingthefinestinstrumentsintheworldfor180years.It
continuestoinnovate,introducingtechniquesandfeaturesthathavebecomeindustrystandards,
includingXbracing,the14fretguitarandtheDreadnoughtsize.

Fiftysixprojectstoimprovetransportationalternativesareinlinefor$33millioninfederal
funds,PennDOTSecretaryBarryJ.SchochannouncedMonday.
Transportationalternativeprojectsenhancepedestrianandbicyclefacilities,improve
accesstopublictransportation,createsaferoutestoschool,preservehistorictransportation
structures,provideenvironmentalmitigation,createtrailsthatserveatransportationpurpose,and
promotesafetyandmobility.
TheseawardsrepresentyetanotherwayPennDOTisworkingtobroadenthereachof
transportationinvestmentsinPennsylvania,Schochsaid.Combinedwithawardsfromthenew
stateMultimodalFundandtheTransportationInfrastructureInvestmentFund,thisprogram
opensthedoortoanevenwidervarietyofimprovementsforthepeopleofPennsylvania.
MovingAheadforProgressinthe21stCentury,the2012federaltransportation

TransportationEnhancements,SafeRoutestoSchool,ScenicBywaysandthe
RecreationalTrailsProgram(RTP)arenowconsolidatedintotheTransportationAlternatives
Program(TAP).
PennDOTevaluatedtheapplicationsandmadeselectionsbasedonsuchcriteriaassafety
benefits,reasonablenessofcost,readinessforimplementation,statewideorregionalsignificance,
integrationoflanduseandtransportationdecisionmaking,collaborationwithstakeholders,and
leverageofotherprojectsorfunding.

RonaldRohallAppointedToStateConservationCommission

RonaldRohall,chairmanoftheWestmorelandConservationDistrictBoardofDirectors,was
recentlyappointedbyGov.CorbetttotheStateConservationCommission.
Rohallwillserveafouryeartermonthe14membercommission,whoseprimary
missionistoensurethewiseuseofPennsylvaniasnaturalresourcesandtoprotectandrestore
thenaturalenvironmentthroughtheconservationofitssoil,water,andrelatedresources.
ThecommissionprovidessupportandoversighttoPennsylvanias66county
conservationdistricts,includingtheWestmorelandDistrict.
RohallhasbeenactiveformanyyearsasavolunteerwiththeStateConservation
Commission.HecurrentlychairstheSCCsLeadershipDevelopmentCommitteeandwas
awardedthecommissionshighestrecognition,theConservationLeadershipAward,for
outstandingservicetoconservationin2007andagainin2010.
Formorethan20years,hehasbeenavolunteerwiththeWestmorelandConservation
District,servingontheBoardofDirectorssince1993.In1999,hewaselectedvicechairmanof
theorganizationsboard,andin2011hewaselectedchairman.
