The Committee for the Formation of
Provisional Transnational Government
of Tamil Eelam calls the prosecutor for
the International Criminal Court to
open an investigation not only into the
specific incident of the murder of LTTE
leaders, but also into the conduct of
the Sri Lankan armed forces during

cent statements by former chief of the
Sri Lankan armed forces General
Sarath Fonseka.
It also asks the countries that are a
party to the Statute of the International
Court of Justice to refer this matter to
the International Court of Justice.
The committee meanwhile urged Ban
Ki-Moon, the UN Secretary General, to
bring these incidents of War Crimes
and Crimes Against Humanity before

The UN Special Rapporteur on Extra-
judicial Summary or Arbitrary Execu-
tions, has asked the government to
provide an explanations with regard to
the circumstances of the death of 3
senior LTTE cadres and their families
during the last stages of the military
operations.
The request for explanations follows
the recent statement made by Gen
(Rtd) Sarath Fonseka an opposition
candidate in the forthcoming Presiden-
tial election, alleging that such killings
had taken place, in an interview with
The Sunday Leader of Dec. 13, 09, the
President's media unit said.
The letter by the UN Special Rappor-
teur, Phillip Alston, addressed to Mrs.
Kshenuka Senewiratna, the Perma-
nent representative of Sri Lanka to the
UN Office in Geneva states,

Excellency,
I have the honour to address you in my
capacity as Special Rapporteur on ex-
trajudicial summary or arbitrary execu-
tions pursuant to General Assembly
resolution 60/251 and to Human
Rights Council resolution 8.3.
I write to your Excellency's Govern-
ment with regard to the circumstances
of the death of three senior represen-
tatives of the Liberation Tigers of Tamil
Eelam (LTTE), Mr. Balasingham Nade-
shan, Mr. Seevaratnam Pulidevan and
Mr. Ramesh, as well as of members of
their families, in the night of 17 to 18
May 2009.
According to information I have re-
ceived:
On 17 May 2009, the day before your
Excellency's Government announced
of the Sri Lankan armed forces during
their final offensive from January 2009
through May 2009;
2. Ban Ki-Moon, the UN Secretary
General, to bring these incidents of
War Crimes and Crimes Against Hu-
manity before the UN Security Coun-
cil;
3. Countries that are a party to the
Statute of the International Court of
Justice to refer this matter to the Inter-
national Court of Justice.
In a recent interview appearing in the
Sri Lankan newspaper The Sunday
Leader on December 13, 2009 retired
General Sarath Fonseka stated that
the Defense Secretary Gotabhaya Ra-
japaksa had ordered the killing of Tamil
Tiger rebel leaders after they had laid
down their arms and as they were try-
ing to enter Government-controlled ter-
ritory to arrange a cessation of
that its forces had completely defeated
the LTTE. Messrs, Nadeshan, Pulide-
van and Ramesh were trapped with
other senior cadres of the LTTE in a
small area north of Vellamullivaikkal.
Through intermediaries they sought to
establish contact with your Excel-
lency's Government to inquire how
they could surrender to the Sri Lanka
Army (SLA).
The reply, coming from the Secretary
of Defence in your Excellency's Gov-
ernment and from a Members of Par-
liament who is at the same time a
senior adviser to the President, and
conveyed through the intermediaries,
was that they should walk towards the
positions of the SLA in a way that
made their intentions clear and holding
a white cloth. The Commander of the
SLA 58th Brigade, the unit on the front
line with the last LTTE position, how-
ever, received a telephone call from
the Secretary of Defence instructing
him to order his forces to shoot those
surrendering. When Messrs. Nade-
shan, Pulidevan and Ramesh walked
towards the SLA positions carrying
white cloths in the first hours of 18 May
2009, soldiers opened fire on them and
killed them. An unspecified number of
family members of the three men were
killed as well.
These allegations were made by the
Commander of the Sri Lanka Army at
the time of the events and subsequent
Chief of Defence Staff (now retired)
General Gardihewa Sarath Chandralal
Fonseka, in an interview to the news-
paper The Sunday Leader. The ac-
counts of journalists embedded with
the SLA 58th Brigade confirm some of
hostilities last May. He said he learned
from government media reporters that
the Defense Secretary, who is also the
President's brother, had directly or-
dered army commanders to shoot two
Tamil Tiger leaders, having earlier told
them to walk towards the army carry-
ing white flags.
Despite Sarath Fonseka’s subsequent
retraction of his statements, The Sun-
day Leader interview, reports by
human rights organizations, and the
U.S. Department of State report com-
pel a launch of an investigation by the
appropriate international institutions.
Given the Sri Lankan Government’s
track record in domestic Human Rights
investigations (1977 and 1983
pogroms, the 1981 burning of Jaffna
Library, the 1996 Chemmani mass
graves, Krishanthi’s murder in 1996,
the 2006 killing of French aid workers)
the alleged circumstances of the death
of Messrs. Nadeshan, Pulidevan and
Ramesh and their families.
While I do not wish to prejudge the ac-
curacy of these reports, I would like to
refer your Excellency's Government to
fundamental legal rules applicable to
all armed conflicts under international
humanitarian law and human rights
law.
Common Article 5 (applicable to armed
conflict not of an international charac-
ter) of the Geneva Conventions of
1949, to which your Excellency's Gov-
ernment is a party, dictates that "[p]er-
sons taking no active part in the
hostilities, including members of armed
forces who have laid down their and
those placed hors de combat by sick-
ness, wounds, detention or any other
cause, shall in all circumstances be
treated humanely [....]". To this end the
following acts are and shall remain
prohibited at anytime and in any place
whatsoever with respect to the above-
mentioned persons: (a) violence to life
and person, in particular murder of all
kinds".
Similarly, an authoritative study of cus-
tomary international humanitarian law
finds that attacking and killing persons
who are recognized as hors de combat
is prohibited. Persons hors de combat
include anyone who clearly expresses
an intention to surrender, provided he
or she abstains from any hostile act
and does not attempt to escape (Rule
47 0f the Customary Rules of Interna-
tional Humanitarian Law identified in
the study of the International Commit-
tee of the Red Cross).

coupled with the US State Depart-
ment’s repeated and consistent obser-
vations in its annual Human Rights
reports that impunity remains a prob-
lem, a domestic investigation will be a
farce. It is an established legal princi-
ple that exhaustion of domestic legal
remedies is not a prerequisite for an in-
ternational investigation when such an
investigation would be a futile exercise.
Failure by the international community
to act on this matter will only deepen
the sense of betrayal felt among Tamils
worldwide. Furthermore, inaction on
the part of the international community
will also undermine the very integrity of
these international institutions, erode
faith in the rule of law, and encourage
rogue States and totalitarian regimes
to take all humanitarian laws into their
hands
It is my responsibility under the man-
date provided to me by the Human
Rights Council to seek to clarify all
cases brought to my attention. Since I
am expected to report on the death of
Messrs. Nadeshan, Pulidevan and
Ramesh, as well as of the members of
their families, I would be grateful for
the cooperation and observations of
your Excellency's Government. In par-
ticular in relation to the following ques-
tions:
1. Are the allegations summarized
above accurate, If not so, please share
the information and documents prov-
ing their inaccuracy.
2. What information does your Excel-
lency's Government have on the family
members of Messrs. Nadeshan,
Pulidevan and Ramesh allegedly killed
on 18 May 2009.
3. Please refer to the results of my mil-
itary, police, judicial and other inquiry
or investigation carried out in relation
to the allegations summarized above.

In a statement sent to Asian Tribune
to justify why Sivajilingham, the TNA
MP is contesting in the forthcoming
Presidential election, the Tamil Na-
tional Alliance Member of Parliament
N. Srikantha categorically said that
Sinhalese leaders who are contesting
in the Presidential election have mis-
erably failed to go beyond the casual
reference to the 13th Amendment to
the Sri Lanka Constitution.
He further said, “Both Mahinda Ra-
japaksa, the President who is seeking
reelection prematurely and his main
adversary Sarath Fonseka have not
put forward any apolitical package for
the resolution of the ethnic conflict
apart from making reference to the
13th amendment to the Constitution
and nothing has emanated from ei-
ther camps to tackle the national
question meaningfully and conclu-
sively. “ TNA Parliamentarian Srikan-
tha categorically said that both the
candidates have no desire whatso-
ever to grant autonomy to the North
and East region which the Tamil
speaking people rightly consider as
their homeland. “But on the other
hand” Srikantha said, “both are en-
gaged in claiming credit to the suc-
cessful conclusion of the war which
consumed many thousands of pre-
cious lives of the Tamil civilians and
also the fond hopes for a peaceful
and happy existence.”
“In this situation the Tamil people vot-
ing for either of them would lead to
the destruction and interment of our
political aspirations they were able to
cherish in the midst of indescribable
sufferings, Srikantha said.
In his statement, Srikantha further-
more said that arms struggle can be
crushed and decimated, but the Tamil
political struggle need to be carried
forward until its goal for political jus-
tice is achieved. “ The political stand
of our people who wish to live with

less the disease is cured--which
means establishing a safe place for
the Sri Lankan Tamils--the symptom
will keep on recurring. Colombo's
long-time oppression of the Tamils is
the disease, and the human rights vi-
olations that concern the EU are just
a symptom, said Tamils for Obama in
a letter to the EU's European Com-
mission and the European Parlia-
ment's members. Unless the disease
is cured--which means establishing a
safe place for the Sri Lankan Tamils--
the symptom will keep on recurring,
the Tamil group said.
A spokesman for Tamils for Obama
explained "We used this medical
metaphor to try to clarify the situation
to the European Union. You don't
need to be a doctor to know that un-
less you can cure the disease, the
symptoms are not going to go away,
at least not for the long term. The dis-
ease here is the Colombo govern-
ment's oppression of its Sri Lankan
Tamil minority, which began almost as
soon as the British left in 1948. The
human rights violations of the Sri
Lankan government are just a visible
result of this underlying cause.
The EU's European Commission is
currently reconsidering Sri Lanka's
status in the EU's GSP Plus program,
a tariff abatement that saves the Sri
Lankan clothing industry hundreds of
millions of dollars a year. The Euro-
pean Commission has decided to
suspend Sri Lanka's preferential
trade status following a probe criticiz-
ing the island's human rights record,
Agence France-Presse reported re-
cently.
"Textiles and garments are one of Sri
Lanka's biggest export earners,
maybe the biggest. So this is some-
thing that gets the attention of both
Sri Lanka and the European Union,"
said the Tamils for Obama
spokesman. "We want the EU to un-
derstand that these human rights vio-
lations by Sri Lanka are a recurring
symptom. They aren't going to disap-
pear unless some effort is made to
treat the disease that causes them,
and the disease in this case is Sri
Lanka's abuse of its Tamil minority.
"We suggested that a good beginning
in curing this disease will be to create
a safe home for Sri Lanka's minori-
ties. We told the Europeans that 'no
other solution will work for very long.
We suggest that the international
community should ask Sri Lankan
Tamils what they want. A referendum
would be a good first step.'
"We also suggested that 'The exam-
ple of Bosnia, in which European
Countries acted to rescue Bosnian
Muslims from their Serb oppressors,
is instructive,' said the spokesman for
Tamils for Obama.
Tamils are an ethnic group living
mainly in the northeast of Sri Lanka
and southern India. During the final
weeks of the recent civil war, the Sri
Lankan government killed about
1,000 Tamil civilians per day, accord-
ing to the United Nations, and about
30,000 in 2009. Tamils are a minority
population in Sri Lanka, and have
borne the brunt of a civil war they re-
gard as genocide. One-third of the
Tamil population has fled the island
and formed a substantial diaspora
overseas. Tamils for Obama is com
prised of Tamils who have settled in
the U.S. or who were born in the U.S.

Former Army General Sarath Fon-
seka’s recent interview in a leading
Sri Lankan newspaper adds to the
mounting evidence that war crimes
were committed during the last phase
of the country’s civil war. Fonseka’s

statements in the Sunday Leader this
week reveal that the ruling leaders
deliberately orchestrated war crimes,
in flagrant violation of the Geneva
Conventions.
His interview, together with several in-
dependent investigations and reports,
highlight the need for an international
inquiry into war crimes as suggested
by UN High Commissioner for Human
Rights Navi Pillay.
“Crimes against humanity were com-
mitted during the last phase of the
war in Sri Lanka, and the international
community and world leaders need to
step up to hold the perpetrators re-
sponsible,” said David Poopalapillai,
National Spokesperson for the Cana-
dian Tamil Congress. “No nation has
violated the Geneva Conventions as
flagrantly as Sri Lanka.”
In late May, the Times of London re-
vealed that more than 20,000 Tamil
civilians were killed in the latter
stages of the war mostly due to gov-
ernment shelling. The paper’s finding
was in stark contradiction to state-
ments from government officials, who
had repeatedly claimed no civilian
had been killed.
A few months later, a Channel 4 video
surfaced showing summary execu-
tions of Tamils by government sol-
diers. Journalists for Democracy in
Sri Lanka, an independent group
which obtained the material, said the
video was filmed in January - when
the international media were pre-
vented by the Sri Lankan government
from covering the conflict zone.
In October, the U.S. State Depart-
ment detailed reports of abuses that
took place, including government
shelling in the No Fire Zone, the ab-
duction and murders of Tamil civilians
and the forceful reduction of medical
and food supplies to Tamil areas dur-
ing the conflict. Mr. Poopalapillai said
the international community should
deal with the Sri Lankan state “in a
similar way it dealt with Serbian
leader Slobodan Milosevic and Sad-
dam Hussein.
MSF lists Sri
Lanka among top
ten humanitarian
crises of 2009

The international humanitarian organ-
ization Doctors Without Borders (also
known as Médecins Sans Frontières
or MSF) has included Sri Lanka in its
annual list of top 10 worst humanitar-
ian crises. The worst emergencies of
2009, according to the statement,
were those in which civilians in con-
flict zones were being “attacked,
bombed and cut off from aid.”
“There is no question that civilians
are increasingly victimized in conflicts
and further cut off from lifesaving as-
sistance, often deliberately,” said the
organization’s International Council
President Christophe Fournier, in a
statement.
“In places like Sri Lanka and Yemen,
where armed conflicts raged in 2009,
aid groups were either blocked from
accessing those in need or forced out
because they too came under fire.
This unacceptable dynamic is becom-
ing the norm.”
Also included in the list, for dangers
faced by civilians and aid workers,
were Pakistan, Somalia, Yemen,
Afghanistan and the Democratic Re-
public of Congo.
Besides violent conflict, the fight
against HIV/AIDS and childhood mal-
nutrition was also included as crises
that are losing global significance in
terms of funding. According to the
statement, the World Bank estimates
$11.8 billion to fight malnutrition but
the current funding is at $350 million.

“Just when more and more people
were accessing crucial medicines and
medical experts were acknowledging
the need to put people on treatment
sooner, patients will be turned away
from clinics because the funding just
won’t be there,” said Fournier. “The
timing could not be worse.”
MSF has worked in Sri Lanka since
1986. The Sri Lankan conflict has
made the list four times before (in
2007, 2006, 2001 and 1999) in the
list’s 12-year history.
The aid group began compiling the
annual list in 1998 after observing
how the famine in southern Sudan
went “largely unreported in U.S.
media.” Through the list, the organi-
zation hopes to attract greater atten-
tion and create greater awareness of
these often under-reported crises.

Many of Sri Lanka's war refugees
may be unable to vote in January
polls, the first national election after
the government's crushing defeat of
separatist Tamil Tiger rebels in May,
election monitors said on Monday.
That could provide a fresh grievance
for the country's mostly Hindu ethnic
Tamil minority, many of whom believe
the Buddhist Sinhalese majority has a
habit of discriminating against them.
Administrative obstacles and a lack of
proper procedures for those in camps
to register could mean nearly all of
the more than 300,000 war refugees,
who are overwhelmingly Tamil, will be
unable to vote in the Jan. 26 presi-
dential poll, independent election
monitors said.
"Up to 95 percent of IDP's might be
deprived of their voting rights at the
presidential elections as a proper
mechanism has not been in place,"
one of the monitors, Keerthi Then-
nakoon of the Campaign for Free and
Fair Elections (CAFFE), told Reuters.
But he added that "if the elections
commissioner acts swiftly he can rec-
tify the mistakes" before the election.
Over 280,000 ethnic minority Tamils
fled their homes due to intense fight-
ing between the Tamil Tiger rebels
and the military during the last phase
of the 25-year civil war, which effec-
tively ended on May 18 with the killing
of top separatist leaders. They joined
tens of thousands who fled earlier.
Officials say 70 percent of the war
refugees have relocated from the
main military guarded camps and
thousands of others are being al-
lowed to come and go from the
camps where they have been held
since the end of the war.
The government has faced pressure
from foreign countries and aid and
rights groups to speed up resettle-
ment of the thousands of Tamils dis-
placed by war. However, many of
those who have left the camps have
not returned to the original residences
where they would normally vote.
Election officials says voter registries
are up to date and refugees will be al-
lowed to cast their vote, if they apply
in advance.
"We are setting up special polling
booths for people in camps to vote
but people who are displaced from
their original place of registration
have to apply for voting in their pres-
ent location," Assistant Elections
Commissioner for the northern district
of Vavuniya A.S. Karunanidhi told
Reuters.
However, independent election moni-
tors said there was no proper voter
education process to tell refugees
where they can vote, how to register

and how they can apply for a tempo-
rary identity card, nor is it yet clear
how the refugee ballot boxes will be
identified and located.
Tamils make up almost 12 percent of
the Indian Ocean island nation's pop-
ulation of 21 million. In past elections
the Liberation Tigers of Tamil Eelam,
who led the losing battle for an inde-
pendent Tamil state, discouraged
Tamils from going to the polls. This
time they could emerge as a key
swing vote.
The refugees' situation has been a
political issue since the war's end,
and increasingly so in the weeks
since former army commander Gen-
eral Sarath Fonseka said he would
challenge incumbent President
Mahinda Rajapaksa in the January
ballot where some 14 million Sri
Lankans are expected to choose from
among 22 candidates.
Rajapaksa and Fonseka are consid-
ered far out in front of the rest of the
field.
Whoever wins will need to reach out
to the Tamil minority to avoid new un-
rest among the group, political ana-
lysts say, but going too far could
antagonise Sinhalese nationalists
whose support is needed in parlia-
ment for an effective government.

Tamil doctor for in-
ternment camp
comments
Sri Lanka Ministry of Health has inter-
dicted a Tamil doctor, Dr Murali Val-
lipuranathan, for speaking out on the
conditions on the detention camps,
and informed him that the Ministry
"found him to have acted in a manner
that brought disrepute on the Govern-
ment of Sri Lanka," Sri Lanka weekly
Lakbima reported. Ministry of Health's
communication, written in Sinhala
dated 10th November 2009, said that
Dr Vallipuranathan was being re-
moved from service for causing disre-
pute to the Government of Sri Lanka,
and that his salary was also being
stopped. According to reports in
Lakbima, a Sinhala physician, Dr
Chrishantha Abeysena, had sent an
e-mail to his collegues including Dr.
Vallipuranathan, titled “urgent” which
said that the CNN was conducting a
poll on whether the international com-
munity should intervene in Sri Lanka.
Abeysena had requested those on his
mailing list to answer in the negative.
In response, Dr Vallipuranathan had
written back: “What do you want us to
do? Observe silently the inhuman
treatment taking place at the Forced
Detention Camps (FDC) under the
name of provision of health services
and security? I think this is time for us
(the medical professionals) to discuss
this more openly without any racial
feelings. I hope you are aware of
what is really happening at the FDC.
If not please watch Channel 4 and
enlighten yourself," Lakbima article
said. Dr. Vallipuranathan had in-
cluded in his e-mail the link to the
Channel 4 report that showed Sri
Lankan soldiers allegedly shooting
unarmed Tamils, and had added:
“Anyway IC (international community)
will not interfere just because some-
body votes at CNN. Await your kind
response (except the white van reac-
tion)...” Lakbima report said that no
charge sheet was filed, but Dr. Val-
lipuranathan had received a letter last
month signed by Health Secretary
stating that a preliminary inquiry
found him guilty of bringing disrepute
to Government of Sri Lanka, and that
he was being interdicted pending fur-
ther inquiries. Lakbima said, after the
indictment letter in November, Vallipu-
ranathan had circulated another e-
mail which said, "[t]hough I have
clearly stated that I had expressed
my private opinion because Dr.C.
Abeysena sought my opinion, and it
is my fundamental right to express
private opinion which has no rele-
vance to my position in the govern-
ment service, I am now interdicted
without a charge sheet issued to me
so far," and added, "[p]erhaps this is
the best way the reconciliation with
minorities can take place in Sri Lanka
at the end of the war."
