ALCOHOLANDDRUGSSTANDARD

1.0PURPOSE

1.1Thisstandardpromotesahealthier,saferandmoreproductiveworkplace.Thehealthand
welfare of our employees is a serious concern of management. It is imperative that we
promote a working environment that is free from alcohol and drug abuse, respects the
dignityofemployees,andsupportsthepositivecontributionthateachemployeecanmake.

1.2.Throughtheimplementationofthisstandard,wealsoendeavortoencourageemployees
whomayhavealcoholordrugabuseproblemstoseektreatmentandcounselinginorderto
return to the workplace, their social circles, and their families as positive, contributing
members. Such employees should speak to their closest Human Resources (HR)
representative to ascertain whether any companysponsored benefits are available in their
area.

2.0SCOPE

2.1 This standard covers all aspects of MI SWACO controlled operations and affiliated
companieswiththeexceptionoftestingrequirementsthatareapplicableonlyintheUSAand
otherapprovedareasoftheworld.Affiliatedcompaniesrefertoothercompaniesordivisions
owned or controlled by any legal entity within MI SWACO (hereinafter referred to only as
MISWACOortheCompany).

2.2Forpurposesofthisstandard,CompanyPropertyisdefinedtomeanallownedorleased
real and personal property of the Company. This includes, without limitation, all facilities,
marinevessels,aircraft,automobiles,trucks,equipmentandmachinery.

2.3ItisrecommendedthatJointVentureorotherrelatedcompanieswhereMISWACOdoes
nothaveacontrollinginterestalsoadoptthisstandard.

3.0AFFECTEDPARTICIPANTSANDDEFINITIONS

Participantsaffectedbythescopeofthisstandardincludethefollowing:

3.1EmployeesoftheMISWACOGroupofCompanies
The term Employee is defined as fulltime, parttime, seasonal and casual employees.
Employees must comply with the full provisions of this standard. Such compliance is a
conditionoftheircontinuingemployment.Employeesaregivenacopyofthisstandardand
askedtosigntheacknowledgmentform,seeAppendixC.Thesignedformshallbeplacedin
theemployeespersonnelfile.

3.2ContractorsandThirdPartyParticipation.
At the discretion of the Company, this standard shall be extended to include employees,
agents, and representatives of any contractor or third party that supplies products and/or
services to MI SWACO, or performs work for MI SWACO, such as consultant engineers.
Suchindividuals,whileonthepropertyofMISWACO,oronthepropertyorworksiteofan
MI SWACO customer, or in a Company vehicle, or in a personal vehicle on Company
business, are required to comply with the full provisions of this standard or comply with a
standard oftheir own that is equal to ormorestringent than this standard as acondition of
their ongoing association with MI SWACO. Contractors or Third Party will be asked to
validatecompliancebyMISWACO.

3.3MISWACODriver.
Any employee or consultant that drives or has access to drive an MI SWACO Vehicle, as
defined,orreceivesaregularvehicleallowanceordrivesapersonalvehicleorrentedvehicle
on Company Business. Land transportation contractors such as spot hire type services,
including courier services, restaurant delivery, noncontract personnel transport (such as
generalpublictaxis)andotherservicesofthistypearenotconsideredMISWACODrivers.

3.4MISWACOCoveredPersonnel.
All individuals listed in paragraphs 3.1, 3.2 and 3.3 are collectively referred to as
MISWACOCoveredPersonnel.

3.5ApplicantsforEmployment.
Subjecttolocallaw,anyindividualapplyingforemploymentinapositionthatiscoveredby
thisstandardisrequiredtopasspreemploymentdrugscreeningasanabsoluteconditionto
the Company extending a binding offer of employment and prior to an individual
performinganydutiesorservicesrelatingtoCompanyBusiness.

3.6CompanyBusiness.
Company Business shall mean any activity that supports or furthers, either directly or
indirectly,thebusinesspurposesorobjectivesofMISWACO.Forpurposesofthisstandard,
any MI SWACO Covered Personnel claiming reimbursement for mileage in a personal
vehicleshallbedeemedengagedinCompanyBusiness.

4.0RESTRICTEDSUBSTANCES

All MI SWACO Covered Personnel are explicitly prohibited from using Restricted
Substances, as defined below in Sections 4.1, 4.2 and 4.3, during any of the following
circumstances: while at work or on call; while in, on, commuting to and from, or using
Companyorcustomerproperty;orwhileonthejobsiteofacustomer:

4.1 Narcotics, Illegal Drugs, Designer Drugs, Inhalants, Other Controlled Substances or
drugparaphernalia.

4.2MisuseofLegalDrugsandInhalants.
Misuse includes, but is not limited to, use or possession of any legal drug for which
MISWACOCoveredPersonneldonothaveavalidprescription,orpossessioninquantities
greaterthanthoseprescribed.

4.3AlcoholorIntoxicatingBeverages.
Alcoholoranyintoxicatingbeveragesareconsideredrestrictedsubstancesunlessspecifically
authorized by Management. Management approved entertainment of customers shall have
limited approval for the transportation of alcoholic beverages. Additionally, all alcoholic
beverages must remain closed and out of reach of any vehicle occupants during its entire
transportation.

5.0RESPONSIBILITIESOFMISWACOCOVEREDPERSONNEL

In order to comply with the provisions of this standard, MI SWACO Covered Personnel
mustassumethefollowingresponsibilities:

5.1WorkingundertheInfluenceofPerformanceImpairingMedications.
MI SWACO Covered Personnel who have been prescribed legal medications or over the
counter medications that could affect the safe performance of their duties are required to
notify their supervisor prior to performing any hazardous tasks. This could include the
operationofamotorvehicle,forklift,crane,heavyequipmentormachinery;workatthesite
of an oil or gas well; work in a warehouse or around or near hazardous chemicals or
substances; work near explosives or radioactive materials, or work in other hazardous
environments.

5.2ReportingtoWorkorWorkingWhileImpairedbyaRestrictedSubstance.
MISWACOCoveredPersonnelshallnotreporttowork,orstartworkingwhileimpairedby
any Restricted Substance as defined in Section 4. For the purposes of this standard,
impaired is defined as having any Restricted Substance in the body to the extent that a
urine,blood,hairorbreath/salivatestreportsapositivetestresult.Inthecaseofalcohol,the
levelis.04gramspercent(GMS%)orBloodAlcoholConcentration(BAC).

5.3DrivingWhileImpairedbyaRestrictedSubstance.
MI SWACO Covered Personnel shall not drive any vehicle on Company Business, or any
Company vehicle on personal business, while impaired by any Restricted Substance as
definedinSection4.

For the purposes of this paragraph on driving, impaired is defined by local law. To the
extent a location does not have an applicable law on driving and consumption limits for
RestrictedSubstancesincludingalcohol,theRegionalVPorCountryManagershallestablish
anappropriatelevelwiththeassistanceofariskassessmentteamandapprovalofthelocal
QHSEDepartmentandtheGlobalDirectorSafety.

5.4 Cooperation with Authorized Representatives of MI SWACO Management, Law


EnforcementOfficialsorCustomers.
In order to enforce the provisions of this standard, the Company may require MI SWACO
Covered Personnel to participate in urinalysis, breath/saliva, and/or blood testing.
MISWACOshallcarryoutreasonablesearchesofMISWACOCoveredPersonnelandtheir
personal effects, which include, but are not limited to, personal vehicles, wallets, purses,
backpacksandbriefcaseswhenonCompanyBusiness.MISWACOCoveredPersonnelmust
comply with any legitimate request from a Company management representative or law
enforcement officer. Customers also have the right to conduct reasonable unannounced
searches of MI SWACO Covered Personnel and personal items that are on customers
property.

5.5SelfReferralforDrugorAlcoholDependency.
MISWACOCoveredPersonnelwhoaredrugoralcoholdependentarestronglyencouraged
to seek rehabilitative assistance. Voluntarily seeking rehabilitative treatment shall not
jeopardize their position with the Company. However, referral to a substance abuse
treatment program (subject to local law) is specifically excluded as an option for any
MI SWACO Covered Personnel after any incident that requires or prompts alcohol and/or
drugtesting.IfMISWACOCoveredPersonnelarefoundtobeinviolationofthisstandard
through a positive test result for any restricted substance, disciplinary action, as defined in
thestandard,shallbeadministeredimmediately.

5.6SelfReportingofViolationsorAllegedViolationstoManagement.
Any MI SWACO Covered Personnel who are arrested for, charged with or under
investigation for violation of any drug or alcohol related offense, either while on Company
BusinessorwhichmayaffectthemperformingCompanyBusinessinthefuture,mustnotify
theirsupervisorbeforetheendofthenextbusinessdayofthespecificviolationorallegation.
Upon being notified of a violation or alleged violation under paragraphs 5.1 5.4 above, the
involved supervisor must immediately notify the responsible manager, who in turnmust
notify the responsible Country Manager and the Region Vice President (VP) or equivalent,

whointurnmustnotifythecorporateVPQHSE,VPGeneralCounsel,VPHRandtheGlobal
DirectorSafety.

5.7ReportingViolationsofOthers.
Many of the services provided by the Company are performed in hazardous work
environments. Therefore, MI SWACO Covered Personnel have an obligation to report any
violations of this standard to management. This information may be instrumental in the
prevention of serious accidents or even fatalities that are directly related to alcohol or drug
abuse on the job or while driving. Violations can be reported in confidence using the
CompanyEthicsLine,seeAppendixAforcontactinformation.

6.0TESTING

6.1TimingandRequirementsofTesting.
Subject to local law, MI SWACO requires the testing of MI SWACO Covered Personnels
urine,blood,hairorbreath/salivaforrestrictedsubstancescoveredbythis standard. Where
practicable alcohol testing shall be administered within 2 hours of the incident and drug
testingshallbeconductedwithin32hoursoftheincident.Wherealcoholordrugtestinghas
been conducted by law enforcement officials, additional Company testing is not required.
Generally the specimen collection for testing will be done at the work site during normal
workinghoursandunderthefollowingconditions(6.1.1to6.1.10):

6.1.1Preemployment.Allneworrehireapplicantsforemploymentwhoarefinalcandidates
shall be required to submit a urine sample for drug testing prior to employment. For
seasonaltemporary,casualorcontractMISWACOCoveredPersonnelwhohaveabreakin
serviceofsix(6)monthsorlonger,orifithasbeentwelve(12)monthsorlongersincetheir
lastpreemploymentdrugscreen,apreemploymenttestisrequiredbeforerehiring.

6.1.2GovernmentRequests.Variousfederal,state,orlocalgovernmentagenciesrequirethat
MI SWACO Covered Personnel in certain occupations submit to that agencys drug and/or
alcohol abuse testing programs. MI SWACO Covered Personnel and required to be tested
byanysuchgovernmentagencymustcooperate.

6.1.3CustomerRequests.CustomersofMISWACO,includinggovernmentagencies,often
have their own policies regarding substance and alcohol abuse that are incorporated into
contracts.MISWACOCoveredPersonnelmustcooperatewithcustomerrequests.Thismay
include annual preaccess drug and alcohol testing for some customers. Where alcohol and
drug testing is performed after an Incident on a Customers location, the MI SWACO
Covered Personnel or Contractor may not be allowed to return to work without a negative
alcoholanddrugreport.ThesameappliestoReasonableSuspiciontestingconductedwhile
onaCustomerslocation.

6.1.4 Motor Vehicle Crashes. All MI SWACO Covered Personnel traveling in an
MI SWACO Vehicle, whether for Company or personal use, or in personal vehicles on
Company Business, involved in a Crash are required to submit urine, breath/saliva and/or
bloodsamplesforalcoholanddrugtestswithin2hoursorassoonaspossibleafterthecrash,
unless the vehicle is legally parked and unattended. MI SWACO Covered Personnel shall
checkwiththeirsupervisororclosestQHSEManagerforapprovedspecimencollectionsites.

6.1.5 OntheJob Injury Incidents. All MI SWACO Covered Personnel who are directly
involved in an onthejob incident involving injuries where treatment beyond first aid (see
Appendix A Definitions) is administered must submit urine, breath/saliva and/or blood
samplesforalcoholanddrugtestsunlessimpractical.

6.1.6 Property Damage Incidents. As part of the investigation of an incident where there is
significant property damage including environmental spills, or potential for significant
property damage or injury, MI SWACO may require the MI SWACO Covered Personnel
involvedtobealcoholanddrugtested.

6.1.7 Reasonable Suspicion. The Company may ask MI SWACO Covered Personnel to
submit urine, breath/saliva and/or blood samples for analysis for alcohol and/or drug tests
when reasonable suspicion exists, as determined by the Company. Reasonable suspicion is
basedondirectobservationsand/orphysicalevidenceofactivitiesthatareprohibitedbythis
standardorthelaw.Hearsayevidenceisnotavalidreasonfortesting.IntheU.S.,theQHSE
approvalmustcomefromtheMISWACOGlobalDirectorSafety.

6.1.8 Periodic DrugTesting.Subject to locallaw, atthediscretion of the local managerand


withthepriorapprovaloftheRegionQHSEManagerorequivalent,agroupofMISWACO
CoveredPersonnelmaybedrugtestedthroughouttheyear.IntheU.S.,theQHSEapproval
mustcomefromtheMISWACOGlobalDirectorSafety.

6.1.9RandomDrugTesting.Randomtestingfordrugsshallbeconductedattherateof25to
50% of all MI SWACO Covered Personnel per year, in locations where approved testing
facilities are available, see Section 7.6. This random testing shall not be performed where
suchtestingisprohibitedorlegallyrestrictedinsomeothermanner.

6.1.10 NonTesting. In certain situations, the Company may elect not to exercise its right to
testaparticularindividualorgroupofMISWACOCoveredPersonnel,unlessmandatedby
law.

6.2 Right to Explain Test Results. After test results have been received, MI SWACO
Covered Personnel shall be given adequate opportunity to explain their test results by
disclosinganyinformationtheyfeelisrelevanttothetestingprocess.Thisisusuallyhandled
throughaMedicalReviewOfficer(MRO).SeeSection7.3.

6.3AppealProcedure.AnyMISWACOCoveredPersonnelwhobelievetheyareentitledto
a different test result may file an appeal in writing under this standard to the local
management or, in the U.S., to the MI SWACO Global Director Safety. If the appeal is
denied in whole or in part, they shall receive a written notice which states the specific
reason(s)forthedenial.

6.4 MI SWACO Covered Personnels Right to Request Retest of Specimen. If it is


determined that there is no legitimate medical explanation for a confirmed positive test
result other than the unauthorized use of a Restricted Substance, MI SWACO Covered
Personnel shall be given the opportunity to request a retest of the original specimen at the
sameoranotherapprovedlaboratory.

MISWACOCoveredPersonnelmustmakeawrittenrequestwithinten(10)daysfromthe
datetheyknowthetestresults.Allrequestsforaretestofthespecimeninquestionmustbe
madeinwritingtothelocalmanagementor,intheU.S.,totheMISWACOGlobalDirector
Safety. MI SWACO Covered Personnel shall pay all retest costs in advance. Once
MI SWACO Covered Personnel have requested a retest, the Company will forward a
documenttothemdetailingtheentireretestprocedure.

7.0COMPANYRESPONSIBILITIES

MI SWACO is responsible for ensuring that this standard is reasonably enforced in a


consistent,confidential,andequitablemanner.Specifically,theseresponsibilitiesinclude:

7.1TestingConditions.
All testing must be performed under reasonable and sanitary conditions and samples shall
be collected by trained personnel with due regard for the privacy of MI SWACO Covered
Personnel.

7.2Reliability.
All samples shall be gathered in a manner that reasonably ensures that substitution of or
interferencewiththesampleshallnotoccur.

7.3MedicalDisclosures.
TestedMISWACOCoveredPersonnelshallbegivenadequateopportunitytodiscloseany
informationtheyfeelisrelevanttothetestingprocess.Thismayincludetheidentificationof
prescriptionornonprescriptiondrugsbeingtakenorotherrelevantmedicalinformation.A
Medical Review Officer (MRO) shall be used. An MRO means a licensed physician
responsibleforreceivingandreviewinglaboratoryresultsgeneratedbytheCompanysdrug
testingprogramandevaluatingmedicalexplanationsforcertaindrugtestresults.

7.4Expenses.
The Company pays all costs for the initial test(s). If testing is performed outside of the
workplace, MI SWACO Covered Personnel shall be reimbursed for related transportation
costs.Anytimespentinthetestingprocessshallbetreatedasworktimeforthepurposesof
compensationandbenefitsforcurrentMISWACOCoveredPersonnel.

7.5AppropriateDocumentation.
MISWACOshallberesponsibleformaintainingappropriatelegaldocumentsthatestablish
correct identification of samples. These documents are generally referred to as Chain of
Custody forms. Other documentation, i.e. acknowledgement forms, alcohol testing forms,
etc.,willbekeptinaccordancetoregulations,customerrequestsandCompanypolicy.

7.6TestingStandards.
MISWACOiscommittedtoprovidingthehighestqualityoftestingtoassuretheaccuracy
ofresults.Suchtestingstandardsincludethefollowing(7.6.1to7.6.5):

7.6.1DrugtestingAlaboratorythatiscertifiedbytheSubstanceAbuseandMentalHealth
Services Administration (SAMHSA), or its foreign country equivalent using established
laboratorystandardsandprotocols,shallperformalltesting.

7.6.2 The laboratory shall test for various substances specified by the Company. The
particular substances tested for and the level at which a positive result is reported may be
changedbytheCompanyfromtimetotimeduetochangesortrendsindrugsofabuse,laws
ortechnology.

7.6.3 The laboratory must use gas chromatography/mass spectrometry (GC/MS) to confirm
anyinitialpositivetestresult.

7.6.4 If a sample is shown to be positive for a particular substance, the remainder of the
sampleshallbefrozenforaperiodofoneyearfromthedateofcollection.Thisfrozensample
shallbemaintainedforthesolepurposeofconfirmingthataspecifiedsubstancewaspresent
inthesampleatthetimeoftheinitialtesting.

7.6.5 Alcohol testing may be conducted with breath, blood or saliva specimens. Trained
collection personnel shall conduct alcohol testing. A saliva screen shall be conducted as an
initialscreen.Iftheresultsofthisscreenarepositive,aconfirmatorytestshallbeconducted
usinganEvidentialBreathTesting(EBT)device.

7.7EmployeeSuspensionduringIncidentInvestigations.
MISWACOCoveredPersonnelmaybesuspendedfromworkwithpaypendingtheresults
ofanalcoholordrugtest.

7.8ActiontobetakenafteranImmediatePositiveTest.
Once the Company is aware that the result of an immediate alcohol or drug test of any
MISWACOCoveredPersonnelispositive,theCompanyshalltakeallreasonablemeasures
topreventthemfromdrivinganyvehicleorreturningtotheworkplace.

7.9Confidentiality.
MISWACOCoveredPersonnelmayobtaininformationandrecordspertainingtotheirtest
results by directing a written request to the local management or, in the U.S., the Global
Director Safety. The testing laboratories shall release results only as permitted or required
bylaw,andonlytoauthorizedrepresentativesoftheCompany.

7.10ConsistentAdministration.
The Global Director Safety shall coordinate the administration and enforcement of this
standardforalllocationsthroughouttheworldtoensureuniformity.

8.0DISCIPLINARYACTION

Disciplinary action shall be enforced and reported according to the circumstances listed in
Sections8.1to8.11.Theonlyexceptiontoimmediateterminationforcauseshallbewiththe
written approval of the respective Senior VP (geographical or Business Segment) and the
corporateVPsofHR,GeneralCounselandQHSE.

8.1UnderminingofStandard.
Any MI SWACO Covered Personnel who undermine any section of this standard shall be
subjecttoimmediateterminationforcause.

8.2ReportDisciplinaryActiontoHRDepartment.
The responsible manager shall advise the responsible HR Department of the violation and
disciplinaryaction.

8.3ArrestorInvestigationsbyLawEnforcementAgencies.
MISWACOCoveredPersonnelchargedwith,orunderinvestigationinconnectionwithan
alcohol or drug related criminal offense may be subject to discipline up to and including
termination for cause. Refer to Sections 5.6 and 5.7 for the reporting requirements. The
Companysdisciplinaryactionisnotdependentinanywayonthedispositionofthecaseby
anyjudgeorcourt.

8.4EligibilityforRehire.
MISWACOCoveredPersonnelterminatedunderthisstandardarenevereligibleforrehire
as employees, consultants or contractors, nor may they be employed or used in any other
waybytheCompany.

8.5FailingaPreemploymentTest.
Ifasampleisfoundtocontainanysubstanceprohibitedbythisstandard,theapplicantshall
be ineligible for employment or used in any way by the Company for one year. A second
positive occurrence precludes the applicant from any subsequent application for
employmentwiththeCompany.

8.6 Positive Test Results for an Employee of a Contractor or Third Party. Any individual
representing or acting as an agent for, or an employee of, a contractor or thirdparty
company who is found to have a positive alcohol or drug test, or engaged in activities
prohibited by this standard while on MI SWACO property or at any customer or
MI SWACO job site must leave the property immediately. The individual shall not be
allowed to return without the prior, written consent of MI SWACO Regional VP or
equivalent.

8.7 Use, Possession, Transportation, Distribution, or Sale of Restricted Substances. (See


Sections4.1,4.2,and4.3).
MISWACOCoveredPersonnelfoundtohaveviolatedtheprovisionsofthisstandardinthe
areas of use, possession, transportation (except as provided for in Section 4.3 of this
standard),distributionorsaleofRestrictedSubstancesaresubjecttoimmediatetermination
forcause.

8.8FailureofMISWACOCoveredPersonneltoComply.
Refusal to comply with a legitimate request of an authorized MI SWACO representative,
lawenforcementofficialorcustomertosearchorsubmittotestingasdefinedinthestandard
shallresultinterminationforcause.Switchingoradulteratinganyurine,hair,bloodorother
sampleusedfortestingisgroundsforimmediateterminationforcause.

8.9FailuretoReport.
Any MI SWACO Covered Personnel including supervisors, managers and Vice Presidents
who fail to report violations as required in Sections 5.6 or 5.7 in a timely manner shall be
subject to disciplinary action up to and including termination. Under most circumstances
timelyshallmeanbytheendofthebusinessdayfollowingthedaytheywerenotifiedofthe
violation.

8.10Drugs:PositiveLaboratoryTestResults
In the absence of any legitimate, verified medical reason, a confirmation level or higher
positive test report indicating usage of any drug as defined in this standard shall result in
immediateterminationforcause.

8.11AlcoholorIntoxicatingBeveragePositiveTestResults

8.11.1 Permanent Removal from Customers Property MI SWACO shall permanently


remove MI SWACO Covered Personnel from any customer property as required by the
customerwhoseEBTconfirmedalcoholtestresultis.04%BACorhigher.

8.11.2ImmediateRemovalfromMISWACOsPropertyIftheconfirmationtestusingan
EBTreportsanamountofalcoholequaltoorgreaterthan.04%BAC,butlessthan.08%BAC,
the MI SWACO Covered Personnel shall be immediately removed from the property and
shallnotperformanyworkfor24hours.TheMISWACOCoveredPersonnelmusttestzero
before returning to work. A second occurrence at this level shall result in immediate
terminationforcause.MISWACOCoveredPersonnelwhotest.08%BACorhigheronthe
confirmationtestshallbeterminatedforcauseimmediately.

8.11.3 Operating a Vehicle While Impaired, Under the Influence or Intoxicated. Under
these circumstances if an alcohol positive confirmation test level is equal to or greater than
the amount allowed by local applicable law where the incident occurred, the MI SWACO
Driver(see3.3)shallbedisciplinedaccordingtothefollowingtable.

Where testing is required in accordance with this standard, test laboratories and Medical
ReviewOfficersmustbecertifiedtoanationalstandardwheneverpracticableandapproved
by the Global Director Safety. Each Region shall maintain a list of approved collecting
