NOTICE
Please take notice that the Court en bane issued a Resolution
dated FEBRUARY 4, 2014, which reads as follows:
"G.R. No. 180016 (Lito Corpuz v. People of the Philippines). - The
Court resolves to:
(1) SET this case for ORAL ARGUMENTS on February 25,
2014, Tuesday, at 2:00 p.m. at the New Session Hall, New Supreme Court
Building, Padre Faura St., Ermita, Manila, on the following issues:
a. Whether or not the Court may modify by adjusting for inflation
the penalty of 4 years and 2 months to 15 years that the Court of Appeals
imposed on petitioner Lito Corpuz for the P98,000.00 fraud that he
committed, which penalty was computed based on the value of money in
193 0 when the legislature enacted the Revised Penal Code;
b. Whether or not that portion of Article 315 that imposes a
maximum penalty based on the amount of the fraud exceeding P22,000.00
should be declared unconstitutional and void for being disproportionate and
excessively harsh in view of the decline of the value of money since 1930;
c. Whether or not, procedurally, the Court may determine the
constitutionality of the penalty that the Court of Appeals imposed on Corpuz
even when he did not raise such question in his petition for review and, in
the affirmative, under what circumstances can such determination be done;
and
d. Whether or not the penalty that the Court of Appeals imposed
on Corpuz violate the Equal Protection Clause or the Unusual Punishment
Clause of the Constitution and, if so, what standards need be met before a
penal law or parts of it can be declared unconstitutional on either of those
two grounds.
(2) REQUIRE the Office of the Solicitor General, the counsel for
petitioner Corpuz, the Senate President or his designated counsel, the
