AGAINST THE INNOCENT EXECUTION ARGUMENT: Many of the world's social and government
institutions put innocents at risk. Yet, I am aware of only one -- the U.S. death penalty -- that has no
proof of an innocent executed since 1900. Paroles, probations, pretrial releases and mandatory releases
have resulted in hundreds of thousands of innocents being harmed or killed while such criminals were
under "supervision." Most recently, and historically, we also note the terror and death visited upon
innocent citizens by those criminals who escape from prison. It appears that there are many other
pressing criminal justice practices which put many more innocents at risk and which do, in fact, result in
extraordinary loss of life.
In fact, under all debated scenarios, many more innocents would be put at risk by not executing.
AGAINST THE RACISM ARGUMENT: Historically, charges of racism with the U.S. criminal justice have
been accurate. But not so with the modern death penalty. White murderers are twice as likely to be
executed as are black murderers and are also executed 15 months more quickly than black death row
inmates. A 1991 Rand Corp. study, a 1994 Smith College study, as well as a review of murders within
capital circumstances, reveals that the foundation for being sentenced to death is the crime itself.

DEATH PENALTY IS NOT JUST A DETERRENT, IT IS JUSTICE SERVED:

Just as firm is the fact that in most cases, the death penalty
is a matter of justice and equality. With most crimes, the purposes
of the punishment are to rehabilitate the convict and to send a
warning to others who would commit similar crimes. In contrast, the
death penalty intends neither to rehabilitate nor dissuade others
from capital crimes.

Certainly, the threat of the ultimate penalty may give pause to
a small percentage, but most capital cases involve a defendant who
is far from rational enough to weigh the costs and benefits of his
action.

Still, this misconception of the death penalty as a deterrent is
one limp argument constantly trotted out against capital
punishment. Many people ask, If the death penalty is
working, why isnt the murder rate falling?

This is an appeal to emotion, not reason. Of course the victims are still dead. They would still be dead if
McVeigh had gotten life in prison, too. Or 20 years. Or probation. No one thinks the purpose of
punishment is to undo the crime, yet death penalty abolitionists routinely remind us that killing a
murderer won't bring his victims back to life. If that is a reason to ban executions, it is a reason to ban all
punishment.

Ham's "closure" argument, meanwhile, is simply uninformed. The families of murder victims do not stop
mourning when the killer dies, but for many, there is indeed a measure of solace in knowing that the
monster who destroyed their loved one will never hurt anyone again. Abolishing executions certainly
won't bring "closure" to grieving relatives. On the contrary, it will deepen their torment, mocking them
each time they remember that the person they loved is in the grave, while his killer continues to
breathe.

If you search the internet via search engines for "death penalty", you are likely to find thousands, if not
tens of thousands of "hits" to web sites related to the topic. With very few exceptions, these sites are
anti-death penalty. Is this because the majority of people are against the death penalty? Not according
to recent surveys. It is simply because people who are adamantly opposed to the death penalty tend to
take an activist stance and become involved in working to stop the death penalty. For the most part,
people who support the death penalty do so quietly, in their own minds and feel no need to do so in any
public fashion. It is the law and they expect it to be carried out.
