AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:
I, Sergeant Robert E. Ford Jr., am a sworn member of the Hartford Police Department and have
approximately twelve (12) years experience in law enforcement and criminal investigations. I am currently
assigned to the Hartford Police Internal Affairs Division and have been so for the last two years. My primary
responsibilities are to investigate allegations of police misconduct and criminal activity.

On November 2,2009, at approximately 1500 hours, I was at the Hartford Police Department located at 50
Jennings Road. I entered the Officer's Report Room to talk with Officer Germaine Coachman and Officer
Bryant Moore.

While in conversation with Officer Coachman and Officer Moore; Officer Rhashim Campbell entered the
room, approached us and stood to the left of me while we were talking. Officer Campbell was looking for
Lieutenant Kevin Ahlquist and inquired about his location. Officer Tuyen Bergenholtz entered the room and
asked Officer Campbell about the condition of his injured finger. Officer Campbell reported to me and the
additional officers standing around that he received his injury from a prisoner biting him and hoped that the
person did not have HIV, hepatitis or any other communicable disease. At this time Officer Coachman,
Officer Moore, Officer Bergenholtz, Officer Campbell and I were engaged in a mutual conversation regarding
Officer Campbell's injured finger and the probabilities that he could have been affected with a communicable
disease. I asked Officer Campbell, "How did you let someone bite you?" at which time he informed me that
he was wrestling with someone when he was bit. Officer Campbell reported that a prisoner punched him in
the face before he got bit. I asked Officer Campbell how did he let a prisoner punch him in the face?

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

Officer Campbell informed me and all the officers present that the prisoner punched him in the face
through the cell bars. Officer Campbell stated, "I opened up the door and whooped his ass." Officer Moore
asked for clarification and asked Officer Campbell if he meant to say that he was effecting an arrest and was
defending himself? Officer Campbell answered "No" and repeated "I opened up the door and whooped his
ass." Officer Campbell continued to boast how he beat up the prisoner for punching him in the face and
stated, "I tried to kill him, I tried to fuck him up."

Officer Coachman and Officer Moore physically grabbed Officer Campbell and escorted him out of the
report room while advising me to ignore him and suggested that he was on medication and not fully aware of
what he had reported to the room full of officers and me.

I initiated an investigation based upon Officer Campbell's statements that he entered a locked cell and
assaulted a prisoner. The investigation revealed the following facts:

On November 1, 2009 at 0025 hours, Michael Stewart was arrested by Officer Robert Fogg for a domestic
related incident involving his wife Antoinette Stewart. The domestic arrest was documented under Hartford
Police Department Incident/Prosecutor Report 09-46569. The following is a summary of Officer Fogg's
report: Officer Fogg witnessed Michael Stewart struggling with his wife over her pocketbook. Officer Fogg
observed Michael Stewart snatch the pocketbook away from his wife. Officer Fogg ordered Michael Stewart
to drop a concealed item that he retrieved from the pocketbook and show his hands. Michael Stewart was
reportedly intoxicated from alcohol, refused to comply with the officers' directions and police issued oleoresin
capsicum spray (OC spray) was used to control and arrest him. Stewart was reportedly angry and hostile with
EMS staff who responded to decontaminate and offer him relief from the effects of the OC spray. Stewart
was secured in handcuffs and transported to the Hartford Police Booking Division by Officer Fogg. There
was no additional force used on Stewart during the arrest. Michael Stewart was charged with violating
Connecticut General Statutes 53a-181 Breach of Peace and 53a-167a Interfering with an Officer.

On November 4,2009,1 reviewed video surveillance footage from the booking facility. The surveillance
footage shows the following: November 1, 2009 at 0113 hours, Michael Stewart arrived at booking with
Officer Fogg. At 0116 hours, Michael Stewart was escorted to cell D-7 where Officer Lee and Officer
Campbell searched and removed his sneakers and other personal property. The officers removed the
handcuffs and left him inside the cell alone. On several occasions, Michael Stewart was shaking the cell door

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

and appeared to be agitated and shouting. Michael Stewart removed his pants and shirt but kept on his
boxer underwear, socks and t-shirt.

At 0211 hours, Michael Stewart, reached his right arm through the cell bars, turned on the water spigot and
water spouted to the floor; flooding the area. Michael Stewart then returned to a bench where he laid down.
Officer Campbell and Officer Lee spent approximately twenty five (25) minutes cleaning water from the floor.

At 0236 hours, Officer Campbell and Officer Lee walked Michael Stewart from cell D-7 to another
unoccupied cell. Officer Lee and Officer Campbell locked Stewart inside the cell but returned seconds later
and retrieved his pants and shirt which Stewart carried with him and placed on a bench. Immediately upon
entering the cell, Officer Campbell forcefully shoved Stewart and retrieved the pants and shirt. Officer Lee
and Officer Campbell exited the cell. Officer Campbell closed and locked the cell door, turned his back to the
cell and began to walk away. Stewart reached out through the bars and appeared to hit Campbell on the back
of the head with his right hand. Officer Campbell turned back towards the cell, unlocked the cell door,
entered the cell and punched Stewart on the right side of his face with his left fist. Officer Campbell
attempted another left handed punch and Stewart dodged it. Officer Campbell grabbed Stewart and wrestled
him on to the bench. Officer Lee was present and witnessed the entire incident and intervened when Officer
Campbell was apparently having difficulties with Stewart. Officer Lee approached, kicked Stewart's leg and
helped to gain control of him. While Stewart was seated and bent over on the bench, in the corner, Officer
Campbell used his knee and hands to deliver several strikes to Stewart. Lieutenant Ahlquist approached the
cell, looked in and quickly exited. Lieutenant Ahlquist went and retrieved handcuffs from an officer.
Lieutenant Ahlquist subsequently returned to the cell and handed the handcuffs to Officer Lee. Officer Lee
and Officer Campbell handcuffed Stewart behind his back and he remained seated on the bench. Lieutenant
Ahlquist and Detective Gustavo Rodriguez were both present inside the cell when Stewart was handcuffed by
Officer Lee and Officer Campbell. Lieutenant Ahlquist and Detective Rodriguez left the cell after Stewart
was placed in handcuffs. Lieutenant Ahlquist remained standing outside the cell and watched as Officer Lee
and Officer Campbell lifted Stewart from the bench by his handcuffed arms, but walked away before they
pushed him to the floor face first. Officer Campbell appeared to have kicked Stewart on the head with his
right foot while Stewart was on the ground handcuffed. Officer Campbell exited the cell and returned shortly
with a pair of leg shackles. While Stewart was handcuffed behind his back, Officer Lee and Officer Campbell
dragged Stewart approximately one foot and shackled his leg to the bench.

The undersigned affiant, being duly sworn, deposes and says:

At 0559 hours, Stewart was transported to Saint Francis Hospital for treatment.

I reviewed the case incident report regarding the incident that occurred inside the booking division.
Hartford Police Department Incident/Prosecutor Report 09-46610 was completed by Officer Campbell.
Officer Campbell documented on HPD Prosecutor Report 09-46610 that on 11-1-09 at 0300 hours, Michael
Stewart was arrested for violating Connecticut General Statutes 53a-167c Assault on a Public Safety Officer.
Officer Campbell's police report to the prosecutor reads as follows:

"On the above date and time I was assigned to Hartford Police Booking. While working in booking I was
called to the rear single cells because (a) Michael Stewart DOB 7-14-68 turned on the water and flooded the
cells. Myself and another officer tried to clean it up the best we could and then place (a) Michael to another
cell. While walking (a) Michael to the new cell, he began to push away from me stating "Why I gotta go in
there" I told him that he could not flood the new cell and placed him inside. As I was closing the cell door (a)
Michael struck me in the head and moved back in the cell. Myself and another officer, then went inside to
restrain the accused and place him in handcuffs so that he could not strike another officer, (a) Michael
became combative and was wrestled to the bench. While I was restraining the accused, he bit my right ring
finger and broke the skin. I finally got my finger out of his mouth and restrained him until he could be placed
in handcuffs. At that time my right ring finger was bleeding and throbbing in pain from (a) Michael biting it.
I then went to St. Francis Hospital Emergency room to be treated for my injuries."

On November 5,2009 and November 9, 2009,1 interviewed Stewart. Stewart reported that he was initially
arrested because he was involved in an incident with his wife. Stewart reported that during that incident he
was pepper sprayed several times by the arresting officers. Stewart complained that he was assaulted by the
booking officers inside the booking facility. Stewart reported that he does not remember many specific details
of the incident since Stewart drank a six pack of beer and at least two Long Island ice tea alcoholic beverages.
Stewart reported that he turned on the water because he was pepper sprayed during his arrest and he wanted
relief from the burning. Stewart reported that he was moved to another cell and that is where he was assaulted
by both of the officers.

Stewart denied that he ever struck or assaulted any officer. Stewart reported that he reached outside the cell
for the officer when he was inside the cell because the officer took his pants and he wanted them back.
Stewart reported that he received knee blows to the head and was choked by the officers. Stewart reported

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

that the officers banged his head against the wall. Stewart reported that he does not know which one of the
officers hit him with any specific strike because he tried to maintain his body in the fetal position to protect
him from the blows. Stewart reported that he bit Officer Campbell in self defense because he was being
choked by him. Stewart reported that his head was slammed on the ground while he was handcuffed behind
his back. Stewart complained that he has received headaches and dizzy spells since the incident occurred.
Stewart complained of injuries to his neck, head, face, mouth, wrists and several body parts; in addition to the
scrapes he received from when the officers dragged him on the floor. Stewart reported that he received
medical treatment and he does not believe that the injuries are serious. Stewart reported that he was
transported to Saint Francis Hospital where he received treatment for the injuries he sustained. Stewart
provided me with a copy of his discharge instructions that he received from Saint Francis Hospital. The
discharge instructions documents that Stewart was diagnosed and treated for facial contusions and multiple
abrasions.

On November 9,2009,1 observed several bruises on Stewart's head, face and body. Stewart's booking
photograph depicts injuries to his mouth, left side of his forehead and left side of his face. The left side of his
face underneath his cheek appeared to be swollen.

On November 9,2009, investigators interviewed Officer Bryant Moore. Officer Moore reported that on
November 2,2009, in the presence of fellow officers, Officer Campbell stated that he was punched and bitten
by a prisoner; thereafter, Campbell, "went in the cell and whooped his ass." Officer Campbell denied that it
was done in self defense.

On November 9,2009, investigators interviewed Officer Tuyen Bergenholtz. Officer Bergenholtz heard
Officer Campbell boast that he "whooped his ass."

On November 9, 2009, Officer Gemaine Coachman was interviewed by investigators. Officer Coachman
reported that she can not recall the entire sequence of events that occurred; but she recalled that Officer
Campbell reported that the prisoner punched him in the face through the cell bars and he opened up the door
and "whooped his ass."

Investigators interviewed Officer Dowd on the same date. He did not recall who was inside the room or
what the conversation was about.

AFFIDAVIT

The undersigned affiant, being duly sworn, deposes and says:

On November 10, 2009 investigators interviewed Lieutenant Ahlquist. Lieutenant Ahlquist, who was the
booking supervisor on November 2, 2009, reported that he did not hear Michael Stewart make any threats to
himself or any other officer. He further reported that Officer Lee called for him when Officer Campbell and
he were engaged with Michael Stewart. Lieutenant Ahlquist reported that he responded and Officer Lee
informed him that they needed handcuffs. Lieutenant Ahlquist reported that he retrieved handcuffs from an
officer who was present inside booking and gave them to Officer Lee. Lieutenant Ahlquist reported that
Officer Campbell said that Michael Stewart struck Officer Campbell in the head while Officer Campbell was
walking Stewart into the cell.

On November 10, 2009, investigators interviewed Detective Gus Rodriguez. Detective Rodriguez reported
that he was inside booking on November 1,2009 and observed Officer Campbell and Officer Lee when they
struggled with the Stewart inside the cell. Detective Rodriguez reported that he walked in the cell with
Lieutenant Ahlquist and he was going to assist, but by the time he went to help, Stewart was handcuffed.
Detective Rodriguez reported that he did not see Stewart receive any punches, strikes or kicks. Detective
Rodriguez reported that he did not see any officer choking Stewart and did not see any officer with their hands
around his neck. Detective Rodriguez reported that he did not see Stewart bite Officer Campbell. Detective
Rodriguez reported that he heard Stewart talking and he recalled him saying, "I'm a Grandfather." Detective
Rodriguez reported that he left the cell once Stewart was secured in handcuffs.

On November 12,2009, investigators interviewed Officer Robert Fogg. He reported that Michael Stewart's
behavior was belligerent and violent at the time of his arrest. Officer Fogg reported that Stewart appeared to
be intoxicated and behaved as if he did not understand his commands. Officer Fogg reported that Michael
Stewart kicked at the back seat cruiser door and window while being transported to booking. Officer Fogg
reported that he stopped his cruiser and told him to stop kicking at the windows. Officer Fogg reported that
Michael Stewart stopped his behavior. Officer Fogg reported that Stewart stated that he was going to sue and
that he was setting up the officers. Officer Fogg reported that Michael Stewart's behavior changed when he
entered booking. Officer Fogg reported that Michael Stewart was cooperative and he did not make any
threatening comments inside booking. Officer Fogg reported that he escorted Stewart to the rear cell where
Officer Lee and Officer Campbell removed his personal property. Officer Fogg reported that the only force
used on Stewart during his arrest was the application of OC spray.

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

he remained with Stewart from the time of his arrest until he left him at booking. Officer Fogg reported
that Stewart was not injured and did not complain of any injuries other than being contaminated by the OC
spray. Officer Fogg reported that he did not see any physical injuries or deformities on Stewart's face and
head when Stewart was turned over to the booking room officers.

Officer Campbell's admissions to fellow officers and the video surveillance show that contrary to his police
report, his physical force against Stewart was inconsistent with mere restraint and in fact constituted an assault
in the third degree.

Based upon the above reported facts and circumstances I respectfully request an arrest warrant be issued
charging Rhashim Campbell with committing an Assault in the Third Degree, in violation of Connecticut
General Statutes 53a-61 and Fabricating Physical Evidence in violation of Connecticut General Statutes
53a-155(a)(2).
