Commencement, Delays & Supervisions.

Notice of 7 days from Engineer to contractor necessary for commencement of work.


Contractor to start the work as soon as reasonably possible but within 42 days from the
Letter of Acceptance.
Contractors planning schedule is considered approved if not commented by clients
engineer within 21 days.
Contractor is entitled to extension of time for variation of scope of work.
For exceptionally adverse climatic conditions also extension can be considered.
Unforeseeable shortages in the availability of personnel or goods caused by epidemic or
government action can be the reason for extension.
Any additional mobilization for catching up with delayed project execution by contractor is
at the risk and cost of the contractor.
If contractor fails to comply with time for completion he shall pay delay damages to the
Employer for this default as per rate stated in the tender.
Suspension of work by Engineer is permitted. Contractor can claim time extension and
cost for complying with the Engineers instructions provided suspension is not for
reasons on the contractors side.
Contractor entitled to payment of the value of undelivered plant and or Materials if work is
suspended for more than 28 days.
If work is suspended beyond 84 days, the contractor may give 28 days notice to resume
the work, beyond which the work (whole/part) shall be treated as omission or contractor
may give notice of termination.

"Commencement Date" means the date 14 days after the date the Agreement comes into effect or
any other date agreed between the Parties.



8.1
Commencement of Work
Except as otherwise specified in the Particular Conditions of Contract, the
Commencement Date shall be the date at which the following precedent conditions
have all been fulfilled and the Engineers notification recording the agreement of both
Parties on such fulfilment and instructing to commence the Work is received by the Contractor:
(a) signature of the Contract Agreement by both Parties, and if required, approval
of the Contract by relevant authorities of the Country;
(b) delivery to the Contractor of reasonable evidence of the Employers Financial
arrangements (under Sub-Clause 2.4 [ Employers Financial Arrangements]);
(c) except if otherwise specified in the Contract Data, effective access to and
possession of the Site given to the Contractor together with such permission(s)
under (a) of Sub-Clause 1.13 [ Compliance with Laws ] as required for the
commencement of the Works;
(d) receipt by the Contractor of the Advance Payment under Sub-Clause 14.2
[ Advance Payment ] provided that the corresponding bank guarantee has been
delivered by the Contractor.
If the said Engineers instruction is not received by the Contractor within 180 days from
his receipt of the Letter of Acceptance, the Contractor shall be entitled to terminate
the Contract under Sub-Clause 16.2 [ Termination by Contractor ].
The Contractor shall commence the execution of the Works as soon as is reasonably
practicable after the Commencement Date, and shall then proceed with the Works
with due expedition and without delay





The Contractor shall commence work on the Contract on a date to
be specified in a written order by the Employer acting through
the Engineer, and shall fully complete the work within the
time for completion stated in the Form of Tender from and
including the date thereof. The specified time for completion
shall be considered to include public, official, religious and
summer holidays.






The specified date for the Contractor to commence work
shall be no later than Sixty (60) calendar days from the
Engineer's order to commence work. In this respect allowance
of one month was considered necessary for the Contractor to
arrange the supply of the pipes and fittings and of the rest of the
materials for the purposes of the contract.
The Engineer shall give to the Contractor the order to
commence work not later than 15 days after the date of the
execution of the Contract unless the Employer specifically
sanctions an extension of such period to 30 days
