SUBJECT : MANUAL OF AUTHORITIES ON HUMAN
RESOURCES DEVELOPMENT AND
ADMINISTRATIVE MATTERS
In the interest of service and in line with the implementation of the DBM-
approvedDENR Rationalization Plan pursuant to Executive Order 366, a Manual of
Authorities on Human Resources Development and AdministrativeMatters is hereby
prescribed.
The attached Manual shall enhance trans~arencv/accountabi~itv and serve as
reference to expedite the processingiapproval o i doc&nents *ertaiing to Human
ResourcesDevelopmentandAdministrativeMatters.Itshallprovideguidancetoofficials
and employees on the delegated authorities at the centraloffice,-~ureaus, Regional
Ofices,PENROsandCENROs.

In line with the thrust of the government to comply with the adminisbative reforms
for good governance, the Deparbnent of Environment and Natural Resources (DENR)
adopts this Manual of Authorities to define the limits of authority at various levels of
management from the Secretary down to the lowest level of supervision. All other
approving authoriies not included in this Manual remain with the Secretary.
The DENR Manual of Authorities is in compliance with the provisions of the Anti-
Red Tape Act of 2007 (RA 9485) and other pertinent Civil Service Commission (CSC)
Guidelines, Deparbnent of Budget and Management (DBM) Issuances, and COA Rules
and Regulations.
The objectives of the revised Manual of Authorities are the following:
1. To clarify the level of authority in the Central Office, Bureaus, Regional
Offices, PENROs and CENROs pursuant to CSCl DBM I COA Rules;
2. To enhance the efficiency and ethical standards of the administrave and
human resource development services systems and procedures;
3. To promote bansparency, accountability and responsibility among all
officials of the Department and
4. To guide clientele and other concerned officeslagencies in transacting with
the Deparbnent

The man of approving authorities indicated in this Manual is based on due
diligence and Completed Staff Work JCSW) e.g. processed by the concerned
stafflpersonnel . In cases where further approval of higher authorities and agencies
external to the Deparbnent is necessary, the signature of the approving authorities
listed in the Manual should not be taken to mean final approval.
The symbol and terms as used in this Manual shall mean as follows:
a. The comma ( , ) shall mean that the preceding officials' initial while the last
official signs;
b. The bar ( I ) shall mean that concerned official signs;
c. The 'of shall mean that the second official shall sign in the absence of the
first authorized official;
d. The "and" shall mean that both officials sign;
e. 'Concerned" ASEClUSEC means that the concerned official signs
depending on the delegated subject matter;
f. "Authorized" means that an ofice order has k e n issued by the
SecretarylHead of Office authorizing himlher to sign.

Delegated authority set forth in this Manual cannot be further delegated without
prior approval of the Secretary, or the President of the Philippines in cases where
authority is delegated to the Secretary.
The authority pertains to the position rather than the person and is consistent with
the approved hierarchical structure of the organization.
Authority granted to each position is limited to transactions within its areas of
responsibility, consistent with department policies and government rules and regulations.
The Undersecretaries are authorized to issue special orders, only in the
performance of their delegated authorities prescribed under this OrderlManual.
In cases where the relevant issuances or the legal bases are not indicated, it is
understood that the Administrative Order accompanying this Manual of Authorities will

3. Detail - is the temporary movement of an employee from one department or agency to another. It does not involve a
reduction in rank, status, or salary and does not require the issuance of another appointment up to one (1) year. The
detailed employee continues to receive hislher salary only f r m the mother unitlagency.
4. Semnbent - movement of an employee fmm one department or agency to another, which is temporary in nature and
may or may not require the issuance of an appointment, but may either involve a reduction or increase in
compensation. Payment of compensation shall be charged to the recipient agency up to one (1) year.
Note:
1. MOU shall be appmvedlsigned by both Head of respective Agencies.
2. Application for renewal of secondment should be filed three (3) months before expiration of the appmved MOA
and subject to CSC approval.

Every official or employee assigned or authorized to travel under Executive Order No. 298 dated 23
March 2004 shall, within thirty (30) days after his return to his permanent official station, submit a report
with his recommendations, if any, on the conference or seminar attended, examination or investigation
conducted, or mission undertaken, to the head of his oftice. In c a e of participation in an international
conference or convention abroad in which the Philippines is represented by a delegation, a report of the
delegdon shall be submitted to the President of the Philippines through the department head

The PERSONNEL SELECION BOARD (PSB) shall cover both the recruibmnt and selection of
employees in the Firstlst and Sewn@ Levels of the career service who ate entering the civil service
for the first time or are being re-employedlreappointed, and the screening of employees who are
considered for promotion.

B.b REASSIGNMENT (pp 16-1 7)
Reassignment shall be governed by the following rules:
1. These rules shall apply only to employees appointed to first and second level positions
in the career and noncareer services. Reassignment of third level appointees is
governed by the provisions of Presidential Decree No. I.
2. Personnel movements involving lransfer or detail should not be confused wrth
reassignment since they are governed by sepatab rules.
3. Reassignment of employees with station-specific place of work indicated in their
respective appointments shall be atlowed only for a maximum period of one (1) year.
An appointment is considered station-specific when the parbcular office or station
where the position is located is specifically indicated on the face of the appointment
paper. Station-specific appointment does not refer to a specified ptantilla item number
since it is used for purposes of identifying the particular position to be filled up or
occupied by the employee.
4. If an appointment is not station-specific, the oneyear maximum period shall not apply.
Thus, reassignment of ernpl ows whose appointments do not specifically indicate the
pamcutar office or place of work has no definite period unless otherwise revoked or
recalled by the Head of Agency, the Civil Service Commission or a competent court

5. If an appointment is not station-specific, reassignment to an organizational unit within
the same building or from one building to another or contiguous to each other in one
work area or compound is allowed. Organizational unit refers to sections, division, and
departments within an organization.
6. Reassignment outside qeosraphical location if with consent shall have no limit.
However, if it is without consent, reassignment shall be for one (1) year only.
Reassignment outside geographical location may be from one regional office (RO) to
another RO or from the RO to the Central Office (CO) and vice-versa.
7. Reassignment is presumed to be regular and made in the interest of public service
unless proven otherwise or if it constitutes constructive dismissal. ConstrucSve
dismissal exists when an official or employee quits his or her work because of the
agency head's unreasonable, humiliating, or demeaning actuations, which render
continued work impossible because of geographic location, financial dislocation and
performance of other duties and responsibilities inconsistent with those attached to the
position. Hence, the employee is deemed illegally dismissed. This may occur although
there is no diminution or reduction in rank, status or salary of the employee.

The law mandates the release of the retirement pay, pensions, gratuities and other benefits of all
retiring employees of the government in all branches, agencies, andlor instrumentalifes, including
government owned andlor controlled corporations, within thirty (30) days from their date of retirement,

8.0 SALARY ADJUSTMENT /STEP INCREMENT (pp 22-23)
The maximum nurnkr of employees that maybe granted to Step lncrernentls Due to Meritoriws
Performance in any given year shall be limited to five percent (5%) of all incumbent officials and
employees in an agency.
Two (2) Step Increments Due to Meritorious Performance may b- granted to a qualified
official or emphyee who has attained two (2) ratings of "outstanding" during the two (2) rating
periods within a calendar year.
One (1) Increment Due to Meritorious Performance may k granted to a qualified official or
employee who has attained one (I) rating of 'Outstanding" and one (1) rating of 'Very
Satisfactory", or two (2) ratings of 'Very Satisfactory" during the two (2) rating periods within a
calendar year.
One (1) Step Increment Due to Length of Senrice shall be granted to qualified personnel for
every three (3) years of continuous satisfactory service in the present position
The actual salary (in a given step of a salary grade of a position) of an incumbent who is
qualified to be granted one (1 or two (2) Step lncrernentls Due to Meritorious Performance or
to one (1) Step Increment Due to Length of Service shall be adjusted to h a salary
corresponding to the next step or the second next step, as the case may be, but only up to
Step 8, in the Salary Schedule under the implementation.

B.f TRAVEL (pp 30-32)
Travel Expenses . Travel expenses incurred by government officials and employees on official travel,
either domestic or foreign. They include per diems, actual transportation fares, road tolls, parking fees,
and such other similar or incidental expenses en route to the destination and back to permanent official
station (Section 7-1 (20), CA 246).
B.g OVERTIME SERVlCE (p 33)
Pursuant to Section l(d) of Malacarlang Administrative Order No. 103, dated 31 August 2004,
"Directing the Continued Adoption of Austerity Measures in the Government", the Civil Service
Commission (CSC) and Department of Budget and Management (DBM) issued Joint Circular No. 2
dated 04 October 2004 on the "Non-Monetary Remuneration for Overtime Services Rendered", which is
hereby promulgated and adopted in the DENR Central Office, Bureaus, Regional Offices, PENROs and
CENROs.
The overtime services may be authorized for the following activities:
1. Completion of infrastructure and other projects with set deadlines when due to
unforeseen events the deadline cannot be met without sorting to overtime work;
2. Relief, rehabilitation, reconstruction and other related work or services during
calamities and disasters;
3. Seasonal work such as budget preparation and rendition of annual reports to meet
scheduled deadlines;
4. Preparation of specialfinanciallaccountability reports required occasionally by central
monitoring agencies like the Congress of the Philippines, Office of the President,
Commission on Audit, Department of Budget and Management, and National
Economic and Development Authority;
5. The provision of essential public services during emergency situations, such as power
and energy, water, distribution and control of basic staples, communication and
transportation, medical and health services, peace and order, and security;
6. Implementation of special programsfprojects embodied in Presidential directives and
authorizations and with specific dates to complete, which are in addition to the regular

duties of the employees;
7. Legal service to facilitate the dissolution of caseslresolutionsldecisions;
8, Services rendered by drivers and other immediate staff of officials when required to
keep the same working hours as their superiors; and
9. Such other activities as may be determined by the Head of Agency.

of RA9184.

Procedures in the availment of CTO are as follows:
1. Accomplishment of Application for Availment of CTO (Annex C) by concerned
officiallemployee. The request shall be prepared in two copies: original - Personnel
Division: and du~licate - concerned officiallem~lovee.
2. Signature of cokr ned Division Chief recomAenbing approval of the request
3. Certification of COC by the Personnel ChieflAdministrative Division
ChieflAdministrative Officer onthe number of hours earned.
4. Prior approval of the concerned supervisor shall be cleared first in terms of schedule of
availment before the approval of the designated approving official.
The Compensatory Overtime Credits (COCs) should be used as time-off within the year and these are
earned until the immediately succeeding year. Thereafter, any utilized COCs are deemed forfeited.
Issues or conflicts on the accrual of COCs and availment of Compensatory Time Off (CTOs) shall be
referred to CSC for resolution while other issues on the implementation of the aforesaid CSC-DBM
Joint Circular shall be resolved by DBM,

C. PERSONNEL DISCIPLINE
The general nrle in the law on Public Officers is that the power to appoint carries with it the power to
remove an employee. The Civil Service laws, rules and regulations govern administrative proceedings
including imposition of penalties.
The Central Office Grievance Committee is composed of the following:
Chairperson: Director, Planning and Policy Service
Vice-Chairperson: Director, Administrative Service
Members: Human Resource Development Sewice
Two (2) Representatives from the DENREU (One for he First191 level
and another for the Second 2nd level who shall serve for a term of two
(2) years)
Legal Adviser: Assistant Secretary for Internal Audit and Anti-Conuption
The Personnel Division Chief, Assistant Division Chief and other staff shalt act as Secretariat and shall
be the custodian of all records of the Committee.
The Committee is hereby authorized to seek the assistance of any DENR official or employee and shall
be guided by CSC MC. 02, Series of 2001, Code of Conduct and Ethical Standards of the Department,
EO No 80 entitled 'Directing the Adoption of a Performance-Based Incentive System for Government
Employees: and CSC MC No. 6, s, 2012 entitled "Guidelines in the Establishment and Implementation
of Agency Strategic Performance' in the performance of its functions. It shall find the best way to
addtess specific grievances.
In accordance with CSC Memorandum Circular No, 02, Series of 2001, regional offices may create its
own respective Grievance Committee through the issuance of a Regional Special Order (RSO) creating
such a committee to be chaired by the Chief or Head of Administrative Division. This committee wlt
hear out and decide upon comptaints of an employeelofficer against fellow employeeslofficers, in all
grade levels.

PREVENTIVE SUSPENSION (p 35)
Preventive suspension of a civil service employee or officer pending an investigation can be ordered
even withwt a hearing because such suspension is not a penalty but only a preliminary step in an
administrative investigation. Further, if found not guilty, procedural guidelines shall be formulated
separately by the Leg at Service.
However, when a respondent's guilt is confirmed, preventive suspension is punitive and is considered
part of the penalty, pending hislher appeal. The purpose is to prevent the mused from using his
position or office to influence prospective witnesses or tamper with the records which may be vital in the
prosecution of the case against him. Alonzo V. Caputong, (G. R. No. 11 0590, May 10, 1995).

The Appointing Authority in any Department, Bureau, Regional Offices, etc. may preventively suspend
any subordinate officer or employee pending an investigation, if the charge against such officer or
employee involves dishonesty, oppression or grave misconduct, or neglect in the performance of duty,
or if there are reasons to believe that the respondent is guilty of charges which would warrant hls
removal from the service (Section 51, Executive Order No. 292, 1987).

A.c SUPPLIES AND MATERIALS
"Supplies" include everything, except real estate which may needed in the transaction of
public businesses, or in the pursuit of any undertaking, project, or activity, whether in the
manner of equipment, furniture, stationary materials for cunstmction or personal property of
any sort, including non-personal or contractual sewices such as the repair and maintenance of
equipment or furniture, as well as trucking, hauling, janitorial, security, and related analogous
services (Section 357 (c) RA 71 60).
Except as othenvise provided in the General Appropriations Act, the stock on hand of supplies,
materials and equipment, spare parts, acquired through ordinay and emergency purchase,
shall at no time, exceed the normal thm-month requirements, subject to pertinent rules and
regulations issued by competent authority.
A.d EQUIPMENT
Memorandum Circular No. 401 defines obligation for Equipment Outlay as follows: This
account shall include the cost of property, other than structures and fixed facilities, which has a
life of more than one (1) year. This does not include property falling in this classification having
a value of P10,000,00 or less, where such property shall be classified as "Supplies and
Ma terialsw.
ASSIGNMENT OF LlABlLlfY
'In the assignment of liability for a disallowed overprice, the auditor shal carefully study the procedures
in processing the questioned transaction and determine those officialslemployees who had direct
participation in the fixing of the pricelprices of the same. Officialslemployees whose signature or initials
may appear on the vouchers andlor transaction documenls, who are determined to have had no
participation in the fixing of the price shall not be included among those to be held liable for the
disallowance."

Section 46 to 54 Republic Act No. 9184 and its IRR provide for exceptional cases where the
procurement of infrastructure projects may be undertaken through alternative methods of procurement.
For infrastructure of at least P500M they are subject to Sec. 4 of the EO No. 423.

AGENCY ESTIMATE
The agency estimate of construction cost shall be prepared by official(s) duly designated by the
head of the officelagencylcorporation concerned or by his duly authorized representative for his
subsequent approval.
In cases where the Agency Estimate is held confidential, it shall be finalized on the day of the
bidding after all bids have been received and shall be held confidential and signed, sealed and
ready for presentation on the day of the opening of the bidsltenders.
The estimate should show for each major work item, such as earthwork, roadwork and massive
concreting, the components of equipment rentals, fuel, labor, materials and overhead.
