MEMORANDUM OF AGREEMENT

(Watershed and Mangrove Rehabilitation Project)



KNOW ALL MEN BY THESE PRESENTS:
This Memorandum of Agreement entered into by and between:
The Camarines Norte Water District (CNWD), a Government Owned and Controlled Corporation
with postal address atVinzons Avenue, Daet, Camarines Norte, herein represented by its
General Manager MS. MA. ANTONIA B. F. BOMA herein referred to as CNWD;
The Bureau of Jail Management and Penology Daet District Jail, a Government Agency with
postal address at Barangay San Isidro, Daet, Camarines Norte represented herein by its Warden
J/SINSP GERARDO S BERDIN, hereinafter referred to as BJMP,
W I T N E S S E T H:
WHEREAS, the Camarines Norte Water District and Department of Environment and Natural
Resources have previously entered into a MOA for the protection, conservation and
rehabilitation management of portions watershed inside the Abasig-MatogdonMananap
Natural Biotic Area (AMMNBA) and mangrove areas in Brgy. Manguisoc, Mercedes, Camarines
Norte;
WHEREAS, the National Integrated Protected Areas System (NIPAS) law promotes the
development and conservation of natural resources and it encourages the participation and
cooperation of every sector of the population as well as non-government organizations (NGOs)
for sustainable development;
WHEREAS, the BJMP recognizes the utmost importance of environment initiatives being
undertaken in Abasig-MatogdonMananap Natural Biotic Area (AMMNBA) and Mangrove area in
Brgy.Manguisoc, Mercedes, Camarines Norte;
WHEREAS, the CNWD recognizes the fact that the success of environmental regeneration,
rehabilitation, protection, and conservation can be achieved in partnership with the
communities and other NGOs working for the protection and preservation of natural resources.
NOW THEREFORE, for and in consideration of the foregoing premises the parties hereby
mutually agree to the following terms and conditions:
CNWD shall:
1. Make one (1) hectare available from its plantation site with Global Positioning System
(GPS) reading at SitioKalantas-Abasig area in AMMNBA (14: 01 .851 - 122: 47 28.79) and
in Mangrove area in Brgy. Manguisoc, Mercedes, Camarines Norte (14: 06 .471 - 123:
01 10.89) for the BJMP to plant, protect, conserve, rehabilitate, develop and manage;

2. Allow BJMP based on its budgetary priorities to implement the reforestation and
rehabilitation within the designated areas;


3. Designate regular staff that shall coordinate with BJMP in the assessment and
implementation of watershed and mangrove plantation establishment;

4. Provide technical assistance in undertaking the implementation of the projects; and

5. Monitor, inspect and certify the performance and progress of the project
implementation, specifically in the technical aspects of the plantation management;

BJMP shall:
1. Designate personnel of the Bureau who shall coordinate with CNWD in the
implementation, monitoring and evaluation of the reforestation project;

2. Plant and maintain planted trees in the watershed and mangrove areas identified and
provided by the CNWD at BJMPs expense;

3. Conduct maintenance activity every other month of each year for a period of five (5)
years;

4. Provide protection to established plantation area;

5. Conduct inventory of trees including the height, diameter, number of trees and name of
species every last quarter of the year;

6. Conduct survey and mapping of the planted trees through Global Positioning System
(GPS) within the CNWD plantation area;

7. Prepare and submit annual report to the CNWD not later than the last week of the 1
st

month following the year just ended; and

8. Keep records and/or documents of the projects for records and possible adoption to
other sites;
PROJECT MONITORING AND EVALUATION
The CNWD and BJMP shall organize a project monitoring and evaluation team within
sixty (60) days from the execution of this instrument with the end in view of determining how
to effectively achieve the objectives of the project.
OTHER TERMS AND CONDITIONS
The area of concern under this agreement shall remain under the administrative
jurisdiction of CNWD and any improvement, structure, facility and similar developments to be
introduced by the BJMP shall first be approved by the CNWD prior to the implementation and
shall remain on the site even after the termination/cancellation of this agreement. This
agreement shall be terminated or cancelled for any violation or non-compliance of BJMP with
the conditions of this agreement.

EFFECTIVITY
This MEMORANDUM OF AGREEMENT shall take effect immediately and shall remain in
force for a period of five (5) years, renewable at the start of the 6

year, under revoked,
revised, or amended upon express mutual agreement by all parties hereto.

This instrument refers to a Memorandum of Agreement consisting of three (3) pages
including the page whereon this acknowledgment is written and which is signed by the parties
and their instrumental witnesses on each and every page thereof.
