Defendants request leave to file a memorandum of law not to exceed 40 pages in
support of their Motion for Summary J udgment and in response to Plaintiffs Motion for
Summary J udgment. That memorandum of law exceeds the page limitation imposed by
Local Rule of Civil Procedure 7.2(e)(1). As Plaintiffs acknowledged in their similar
motion for leave, which the Court granted, this case involves significant questions of
constitutional law that are matters of first impression in this federal district. Defendants
counsel have informed Plaintiffs counsel of this request, and Plaintiffs counsel advise
that they not oppose the relief requested. Defendants thus request the Courts permission
to exceed the local rule page limit for motions by filing a memorandum of law not to
exceed 40 pages.
