Inindorso namin ang impeachment complaint
nina Bagong Alyansang Makabayan Secretary
General Renato Reyes, Jr at ng 27 iba pa
laban kay Pangulong Benigno S. Aquino sa
isyu ng Disbursement Acceleration Program.
MR. DE LOS REYES: Suppose the President, despite a law
that does not grant extension, anyway grants extension to
the general, does she commit culpable violation of the
Constitution which is a ground for impeachment?
MR. DAVIDE:It relates to officers other than the Chief of
Staff under which he may be allowed extension. Then that
would be a violation of the Constitution.
MR. DE LOS REYES: Culpable?
MR. DAVIDE: It can be classified as culpable and, therefore,
a ground for impeachment.
Aquino culpably violated the
Constitution
Section 17, Article VII, 1987 Constitution
Section 17. The President shall have control of
all the executive departments, bureaus, and
offices. He shall ensure that the laws be
faithfully executed.

Ito yung pondo para isang proyekto na hindi
pa na-bid at nagkaroon ng kontrata o
obligasyon.
Walang karapatan si Aquino na hugutin ang
unobligated funds bago matapos ang bisa ng
taunang badyet.
Sec. 25 (5), Article VI, 1987 Constitution
Section 25 (5). No law shall be passed
authorizing any transfer of appropriations;
however, the President, the President of the
Senate, the Speaker of the House of
Representatives, the Chief Justice of the
Supreme Court, and the heads of Constitutional
Commissions may, by law, be authorized to
augment any itemin the general appropriations
law for their respective offices from savings in
other items of their respective appropriations.

pantungo sa ibang sangay ng gobyerno

Nilipat ni Aquino ang mga
pondo
Cross border transfer
Inilipat ni Aquino ang mga unobligated at
unreleased funds o di umanoy savings sa
Kongreso para dagdagan ng P250 M ang
badyet ng Kongreso. Inilipat din ni Aquino
ang mga diumanoy savings para dagdagan
ng P143.7 Milyon ang badyet ng COA.

Gumastos si Aquino sa mga PAP na
walang appropriation sa ilalimng GAAs.

Culpable violation of the Constitution for DAP
Aquino betrayed public trust
Ipinipilit ni Presidente Aquino na tama ang
DAP, Tama ang intensyon, tama ang
implementasyon, tama ang resulta.
Mali ang implementasyon. Inagaw ni Aquino
ang kapangyarihan ng Kongreso at
lansankang nilabag ang Saligang Batas, ang
General Appropriations Acts at iba pang
batas.
At lalong mali ang resulta. Naging pork barrel
ni Aquino ang P144 Bilyong pondong DAP!
Pinagtaksilan ni Aquino ang
tiwala ng publiko
Dinagdagan ni Aquino ang PDAF o pork
barrel ng mga mambabatas at mga lokal na
upisyal sa ilalimng Various Local Projects
na umabot sa P17.3 B. Ang buong P144 B
pondo ay ginamit ni Aquino na malaking
pork barrel niya.
Inabuso ni Aquino ang kanyang poder nang
agawin niya ang kapangyarihan ng Kongreso
sa paggawa ng badyet.
Inagaw ni Aquino ang poder ng Kongreso sa
utos niyang bawiin ang mga unobligated
allotments at iligal na mag-ipon ng saving na
aabot sa P157 Bilyon at ibaling ang pondong
P144 Bilyon sa ibang pagkakagastusan na
hindi ipinasya ng Kongreso.
Nilabag ni Aquino ang tatlong nabanggit na
prubisyon ng Saligang Batas, ang General
Appropriations Act ng 2011, 2012 at 2013,
ang batas laban sa technical malversation at
iba pang batas.
Isinagawa ni Aquino ang 116 ulit na technical
malversation, saklaw ang halagang P144
bilyon, labag sa anti-graft and corrupt
practices act.
Hindi maliit na halaga, hindi libu-libo o
milyun-milyon, bilyun-bilyon ang technical
malversation ni Aquino at hindi ito ginawa
minsan o makalawa kundi 116 ulit.
Tinangka niyang ikorap ang mga halal na
upisyal sa pag-apruba at paglabas ng mga
dagdag na pondo para sa pork barrel ng mga
senator judges sa panahon at matapos ang
impeachment trial ni Chief Justice Renato
Corona.
