Dear Mr,

We are writing this letter to seek a speedy resolution to reinstate of our salary to
monthly paid. We had received our payslip last payroll August 15, 2014 , without any
formal memorandum from Human Resources Department that our salary payment was
already on daily basis.
We have already aired this concern to The HRD earlier when she informed us of the
plan of changing the basis of our payment due to the new payroll system that this is
violation to the Labor Code Book 3 Presidential Decree No. 442 Article 100, Diminution
of Benefits.
The basic principle under this provision is that a general prohibition on employers
against the elimination of employee supplements and benefits. The essence of the rule,
as developed by the Supreme Court, is that when the grant to employees of certain
benefits has evolved into company practice, said benefits cannot unilaterally be
withdrawn or reduced by the employer. The employees have a vested and demandable
right over them .
We have signed contracts under monthly paid basis and should be given what is due to
us your employees. Kindly refer to the definition and distinction of monthly vs daily paid
employees:
MONTHLY-PAID EMPLOYEES refer to those who are paid every day of the month
including unworked rest days, special days and regular holidays. The Equivalent
Monthly Rate of monthly-paid workers should not be less than the Applicable Daily
Rate X 365 days and divided over 12 months.
DAILY-PAID EMPLOYEES refer to those who are paid on the days they actually
worked except unworked regular holidays where they are paid in their basic wage if
they are present or on leave with pay on the working day before the regular
holiday. Equivalent Monthly Rate of daily paid employees must not be less than the
Applicable Daily Rate X 313 days and divided over 12 months (for workers with 1
rest day/week) or the Applicable Daily Rate X 261 days and divided over 12 months
(for workers with 2 rest days). (as an effect RA 9492 approved on July 25, 2007)
As per our computation more or less difference of Php 600.00 was being deprived from
us your employees. (Please see attached computation ) Php 600.00 per month or Php
7, 200.00 per year is very important to us for our familys needs.
As you will view our new payslip, number of hours were indicated equivalent to the daily
computation. We are not adept in the Labor standards but we are not also ignorant as
employees on what benefits we should have. The fact that theres no formal
memorandum on this matter was made was already a breach of employees rights.
This is not just a simple matter that we will just ignore. Thus, we decided to write an
official complaint letter in the hope of understanding our concern and receiving a
positive response to reinstate or salary payment to monthly basis. We know that the
company recognizes the importance of its employees and I hope that our rights will
continuously be upheld by the company.
