WITNESSETH THAT

responsibility promotes and supports technical vocational education and training
(T-&T) and finds the existing program offering of the T-( using the %ual Training
'ystem (%T') in line with such purpose as well as its own manpower development

wor.force through the development of technical s.ills and proper wor. values!attitudes
the &'TA34('1M&*T has expressed its willingness to partner with the T-( and accept
students!trainees to undergo the re7uired in,plant training/ (additional information may
be added).

terms hereinafter provided the parties hereby agree to execute this Memorandum of
Agreement under the following terms and conditions:
'ection 9/ The T-( and the &'TA34('1M&*T to establish a training partnership
under the %ual Training 'ystem and 6ointly apply for accreditation with T&'%A for the

'ection :/ As part of the partnership the T-( and the &'TA34('1M&*T agrees
to underta.e the following functions and responsibilities:
Annex A
A/ The &'TA34('1M&*T shall:
1. ;nderta.e to carry out in,plant training for the students!trainees nominated
by the T-( in accordance with the Training Plan 6ointly wor.ed out by the
&'TA34('1M&*T and the T-( following a scheme of %ual Training
'ystem and within the training schedule specified hereto attached as

2. Assign personnel to train and guide the students!trainees ma.e
recommendations regarding discipline and proper behavior and determine
the proficiency of the students!trainees in specific trade or craft5
3. Provide the students!trainees with the necessary tools and materials
re7uired during the training5
4. %esignate!appoint a T2A(*(*) =++2%(*AT+2 to represent the
&'TA34('1M&*T in all meetings with the T-( in connection with the
implementation of %T' and other related concerns5
5. 2emit to the T-( the amount of """"""""""""""""""""""""""""
(P """""""""") per student!trainee per month for the student!trainee>s
training allowance/
6. Provide the students!trainees> insurance policy during their in,plant
training5 and
7. (n addition to the above compliance with the applicable provisions of

3/ The T-( shall:
1. 8acilitate the processing of the accreditation of the T-( and the
&'TA34('1M&*T with T&'%A and furnish the &'TA34('1M&*T
with a copy as evidence of its compliance therewith5
2. 2ecommend students!trainees who will undergo the in,plant training
in the &'TA34('1M&*T5
3. %esignate!appoint a T-( (ndustrial =oordinator who will be
responsible for:
a/ Meeting regularly with the &'TA34('1M&*T Training
=oordinator5
b/ +rienting the students!trainees about proper attitude and
behavior to be observed within the company site5
c/ Monitoring and evaluating the performance of students!trainees
in the &'TA34('1M&*T during the in,plant training5
d/ =onducting monthly visit at the training station!wor.place of the
&'TA34('1M&*T to monitor the status of the program5
4. ;nderta.e the in,school training by conducting theoretical sub6ects
and laboratory practice related to the approved curriculum and
Training Plan 6ointly developed with the &'TA34('1M&*T5
5. &xercise due care and diligence in the selection and supervision of
the trainees in order that in6ury damage or loss of person(s) and
property within the &'TA34('1M&*T premises will be avoided5
6. Pay the students!trainees their daily allowance from the training
allowance paid to them by the &'TA34('1M&*T5
7. &nsure that the students!trainees undergo competency assessment
after completion of their training;
8. (ssue a =ertificate of Training to %T' student!trainee upon completion
of the training5 and
9. (n addition to the above comply with the applicable provisions of the
2epublic Act *o/ ?@A@ (%T' 4aw)/
*+T&: Any other arrangements between the T-( and the
&'TA34('1M&*T may be added/
'ection B/ The T-( and the &'TA34('1M&*T further agrees that for the duration
of the in,plant training of the T-(>s students!trainees the following shall be observed:
9/ There is no employer,employee relationship between the
&'TA34('1M&*T and the students!trainees/ *either is the
accommodation given by the &'TA34('1M&*T in allowing the
students!trainees to undergo in,plant training be considered as a
guarantee for employment with the &'TA34('1M&*T upon
completion of the program5
:/ The &'TA34('1M&*T is not obliged to pay the students!trainees
compensation of any .ind other than the grant of the training
allowance during the in,plant training herein elsewhere provided5
B/ The students!trainees and the T-( shall abide by the
&'TA34('1M&*T>' rules and regulations and with those imposed for
the program otherwise they shall be excluded from further
participation therein5
C/ The &'TA34('1M&*T reserves the right to refuse acceptance of any
students!trainees nominated or recommended by the T-( and
discontinue the training of any such trainee on reasonable grounds
after written notice to the T-(5
D/ The T-( may pull,out any students!trainees from the
&'TA34('1M&*T on reasonable grounds after it has sent a written
notice of such pull,out5
@/ The &'TA34('1M&*T may extend the in,plant training of
students!trainees who have exceeded the allowable number of training
hours sub6ect to the approval of the T-(/
'ection C/ That all business and technical information data software and related
documentation in whatever form provided recorded or unrecorded (hereinafter
collectively referred to as # information$) which the &'TA34('1M&*T may furnish or
has furnished T-( and the students!trainees shall be:
9/ used solely for the purpose for which it was furnished5
:/ treated in strict confidentiality and the students!trainees cannot without
the consent of the &'TA34('1M&*T be examined as to any
communication made to them in the course of training5
B/ not be reproduced except as necessary for its authorized use5 and
C/ returned (if in tangible form) together with all copies thereof when
demanded by the &'TA34('1M&*T or when no longer needed/
'ection D/ This Agreement shall ta.e effect on """"""""""""" and shall
continue to be in effect unless terminated by either party by giving the other party a
written notice of its intention to terminate the Agreement at least thirty (BE) days prior to
the intended date of termination/ Any provision of this Agreement may be amended
only with the written consent of both parties herein/
