It has always been a state goal to promote social justice and eliminate or at least diminish social
inequality. Hence, it is my stand that same-sex marriage should be legalized.
The Constitutional guaranty to equal protection requires the equal application of laws to individuals or classes. It basically denies the State, the ability to discriminate for the protection of civil rights. However, in certain instances, the state may actually make distinctions provided that such classification has a rational basis, and that it is for a legitimate purpose. Marriage or the right to marry in its legal sense is a basic civil right. It must not only be available to heterosexual couples but as well as to the homosexual couples.
The LGBT community is emerging; in fact, states have recognized and protected their rights from discriminatory employment and other social policies. It is time to take another step and allow same- sex marriages. Restricting the legal definition of marriage as a union between a man and a woman is discriminatory to an individuals sexual orientation or preference. Such distinction is unnecessary when the essence of marriage is in fact companionship on every aspect of life. People argue that same-sex is immoral. But morality as a concept is subjective and does not fix a borderline standard. Moreover, isnt acceptance, fair treatment of other peoples differences a moral obligation? Some say that marriage is the foundation of a family and is very crucial in the proper upbringing and rearing of children. But is sexual orientation determinate of a persons parenting capacity? A persons capability to perform or to be a positive catalyst to society is not dependent on sexual preference. Neither could procreation justify such unfair treatment and application of the law; because if thats the case, then the same should also apply to sterile and infertile couples, because anyway, they defeat the purpose of procreation. Some strict conservatives even attempt to argue that same- sex marriage offends GOD. But isnt the ultimate commandment of the Lord, is for us to love our neighbours regardless of their sexual orientation and preference? Isnt it true that God knows no distinctions? He loves both the good and the sinners.
