Apparentlytheoldgeneralwasright.Deathisnottheworstofevil.
Iamdueincourttheendofthemonth.Theexwifelawyerwantsmejailedforback
childsupport.Theamountrangesfrom$2,200.to$3,000.dependingonwhoyouask.
Notbigmoneyafterbeingseparatedovertenyearsandunemployedforthelasttwo.
ButIdooweit.
IfIshowupforcourtwithoutthemoneyandthelawyersaysjail,thenthejudgewill
havethebailifftakemeintocustody.Therereallyarenosurprisesonhowthesystem
worksonceyouknowhowitactuallyworks.Anditdoesnotworkanythinglikethey
taughtyouinhighschoolhistoryorcivicsclass.
Icouldhavemadeaphonecallortwoandborrowedthemoney.ButIamdonebeing
bulliedforbeingaman.IcannotbelievethesepeopleinWashingtonaresostupidto
thinktheycangovernAmericanswithanironfist.Twentyfiveyearsago,thefederal
governmentdeclaredwaronmen.Itistimenowtoseehowcommittedtheyaretotheir
cause.Itistime,boys,togivethematasteofwar.
Therearetwokindsofbureaucratsyouneedtoknowtheonesthatsayandtheones
thatdo.ThebridgebetweenthemissomethingIcallTheSecondSetofBooks.Ihave
somefiguresofthesuccessoftheirlabors.YouandIareinthesenumbers,aswellas
ourspousesandchildren.ButfirstletmetellyouhowIendedupinthisrabbithole.
MystorystartswiththeinfamousslappingincidentofApril2001.Whileputtingmy
fouryearolddaughtertobed,shebeganlickingmyhand.Aftergivingherthreeverbal
warningsIslappedher.Shegotacutlip.Mywifeaskedmetoleavetocalmthings
down.
WhenIreturnedhourslater,mywifesaidthepolicewerebyandsaidIcouldnotstay
therethatnight.Thenextdaythepolicecamebymyworkandarrestedme,bookedme,

Aftersixmonthsofmenotliftingafingertosavethismarriage,shefiledfordivorce.
Almosttwoyearsaftertheincident,Iwastalkingwithheronthephone.Shetoldme
thatnightshehadcalledamentalhealthproviderwehadforoneofthekids.Wendy,
thecounsellortoldmythenwifethatifshedidnotcallthepoliceonme,thenshetoo
wouldbearrested.
Thiscountryisrunbyidiots.
ThepolicesergeantFreyerscrewedthisupfromthegetgo.WhenIgottheCourt
ComplaintformtheboxwascheckedthatsaidDomesticViolenceRelated.Icouldnot
believethatslappingyourchildwasdomesticviolence.SoIlookedupthelaw.Minor
custodialchildrenareexempted.Apparently,93%ofAmericanparentsstillspank,slap
orpinchtheirchildren.TothisdayIstillwonderifFreyerwouldhavemadethisarrest
ifithadbeenthemotherthathadslappedthechild.
LabellingsomeonesactionasdomesticviolenceinAmericaninthe21stcenturyisakin
tolabellingsomeoneaJewinGermanyinthe1930s.
Theentirelegalweightofthestateiscomingdownonhim.ButIconsidermyselflucky.
Myfamilywasdestroyed.ButthatpoorbastardinGermanyhadhisfamilyliterally
annihilated.
ArrestsaremandatoryforthepoliceinNewHampshirefordomesticviolence.Thatis
notlaw.Thatispolicedepartmentpolicy.LawscomefromtheLegislatureandthe
Governorsofficetogether.Godonlyknowswherethesepoliciescomefrom.The
StatesAttorneyGeneralalsohasamandatoryarrestprotocolfordomesticviolence.I
callthesepolicies,proceduresandprotocolsTheSecondSetofBooks.Younevercover
theSecondSetofBooksyourjunioryearinhighschool.Thatbecausewearenot
supposetohaveaSecondSetofBooks.ThisisAmerica,wehavetheruleoflaw.
Iamaregularguy,acoffeeandcheeseburgertypeoffellow.Asremarkableasmylife
hasbeen,Ifigurethatwhathappenstomemustbehappeningtoothersaswell.Iwas
48yearsoldwhenIgotarrestedhereformyfirsttime.SoIwentlookingforthearrest
numbersfordomesticviolence,thisnewgroupthatIhadunwillinglyjoined.Icouldnot
findanything.SoIwrotetheU.S.Dept.ofJusticeinWashington.Theywrotebackthat
theydidnotkeeptrackofdomesticviolencearrests.TheFBIkeepstrackofallother
crimes.Howcomenotdomesticviolence?Ithoughtsomelowlevelclerkwasblowing
meoff.
Atthetime,IhadmailingaddressesinbothNewHampshireandMassachusetts.SoI
wrotetoallsixCongressionaloffices,thetwoSenatorsfromeachstateandthetwo
Congressman.Theylikedoingfavorsforconstituentshopingyouwillfavorably
remembertheirnameinthevotingbooth.Allsixofficesreportedbackthesamething.
Theydonotknowhowmanyarrestsfordomesticviolencehavebeenmade.I
immediatelyknewsomethingwaswrong.AndIalsoknewthiswasnotgoingtobegood.
Improvise,adaptandovercome.TheArmyteachesthattoeverysoldierittrains.They
saythatnobattleplansurvivesthefirstfiveminutesofcombat.Soyourpeopleonthe
groundhadbetterbeabletothinkforthemselves.Takingcasualtiesinwarisjustan
occupationalhazard.Takingcasualtiesandnotaccomplishingyourmissionisadisaster.
After21yearsofArmyservice,Iamprettygoodatimprovising.
ThefirstthingIfoundwasastudynotofdomesticviolencearrestsbutofdomestic
violenceinjuriesfor18unnamedstatesandtheD.C.intheyear2000.Inthestudy51%
oftheinjurieswerenoinjuries.SoIknewIhadastudyofpolicereports.Whoelsebut
apoliceofficerwouldrecordnoinjuries?Ipopulatedthatouttothe50statesandcame
upwith874,000arrestintheyear2000.
Ihadoriginallypopulatedthenumberbackto1994whentheViolenceAgainstWomen
Act(VAWA)wasenactedintolaw.Iwouldlaterfindoutthesearrestsstatedwiththe
U.S.AttorneyGeneralsTaskForceofDomesticViolencetenyearsearlierin1984.As
individualstatesdatabecameavailableforvariousyearsandstates,Iwould
incorporatedintomyinformalstudy.ThenumberIhavenowin2011is36million
adultshavebeenarrestedfordomesticviolence.Ihaveagutfeelingthisnumbercould

thereisareallycooltrickyoucandoonceyouhavethisnumber.Youcanfindouthow
manyAmericanmen.womenandchildrenendeduphomelessbecauseofthesearrests.
MostofthedomesticviolencestatisticsIhaveseenbreakdownwith75%maleand25%
femalebeingarrested.SoIamgoingtousedthemalepronounfortheonearrested
spouseandthefemalepronounforthevictimspouse.Thatshouldmakethedomestic
violencefeministsecstaticmanbad,womangood.Butthatisokaybecausethatis
probablythelastnicethingIamgoingtodoforthemtoday.
Suddenly,everythingmadesense.Sheisthetypethatbelievesthatpeopleinauthority
actuallyknowwhattheyaretalkingabout.IfbothsheandIwerearrested,whatwould
happentoourthreechildren,ages7,4and1?TheywouldendupinStatecustody.
Somywifecalledthepoliceonherhusbandtoprotectthechildren.Andwhowasshe
protectingthekidsfrom?Notherhusband,thefatherofthesechildren.Shewas
protectingthemfromtheStateofNewHampshire.
Ifhehasminorchildren,moneywillsoonturnintoanissue.MostmenIknowdonot
mindpayingchildsupport.Theywanttheirkidstohavefoodontheirplates,clotheson
theirbacks,andaroofovertheirheads.Butitdoesstressthatmansfinances.Child
supportisusually33%ofthemansgrossincome.Withholdingfortaxes,socialsecurity
andhealthinsurancecanrangeupto28%ofhisgrosspaycheck.Soamanmaking$500
aweekgrosshasonly$825monthlyleftoverafterwithholdingandchildsupport.That
isnotenoughmoneyforanapartmenthereinCentralMassachusetts.Thatdoesnot
includeotherexpenseslikeheating,electric,gas,groceries,telephone,cable,car
paymentandcarinsurance.Soheisinafinancialhole.Estimatesofhomelessmenrun
82%to94%.Iamgoingtoroundthatdownto80%.
AftertheKinghaslefthiscastle,hiswiferunsintoaproblem.Shewasusetogettinghis
wholepaycheckforthehousehold.Nowshegetathirdforchildsupport.Figurethey
bothworkandmadethesamemoney,herbudgetwentfrom100%downto66%.Ifshe
wasrunningthehouseon$3,045.amonthwhentheKingwashome,nowwithouthim
sheonlyhas$2,220.MosthouseholdsinAmericacannotwithstanda27%hitonthe
householdaccount.Shelljugglethebillsbuteventuallymostwivesfigureoutthatthey
canpayallthesmallerbillsiftheyjustdoesnotpaythebigbill.Thatwouldbetherent
orthemortgage.SosixtoninemonthsaftertheKingisoutofthecastle,theQueen,the
PrincesandthePrincessesarealsoonthestreet.Domesticviolencefeministsstatethat
50%ofvictimspousesofdomesticviolenceenduphomelessatsometimeintheirlives.
Thelastgroupofhomelessfromthesearrestsarechildren.Thedomesticviolence
feministsstatethat70%ofdomesticviolencecouplehavechildren.So50%female
times70%childrenequals35%.Butchildrenisplural.Sowewilldoubleto70%.
Oddisntit?Theyknowthat50%ofvictimspousesenduphomelessandthat70%of
themhavechildren.Howcantheyknowthepercentageswhentheydonotknowhow
manytotalarrestsweremade?ThosepeopleattheU.S.JusticeDept.cannotevenpull
offacrediblecoverup.
Menare0.8,womenare0.5,andchildrenare0.7foragrandtotalof2.0homeless
Americansforeverydomesticviolencearrest.Multiplythatby36millionandyouget
72millionmen,womenandchildrenendinguphomelessatsomepointintheirlives
overthelast25yearsbecauseofthesedomesticviolencearrests.
ThatisareallylargenumberevenbyWashingtonstandards.Thatisalmost25%ofthe
entirepopulationoftheU.S.using2010censusfigures.Whichbegsthequestiondid
thesehomelesspeoplecontributetothislatesteconomicmeltdown,ordidtheycause
it?Becauseiftheydidcauseitthentherecoverywillnotbemeasureinmonthsoryears
butindecades.
SomeoftheboysintheFathersMovementthinkCongressmighthaveshotthemselves
inthefootoverthisone.Personally,Ithinktheyshotthemselvessomeplace
anatomicallyhigher.NowondertheSpeakeroftheHouseisalwayscrying.The
DummiesonthePotomac.
Twentyfiveyearsagothefederalgovernmentstartpushingthesearrestsonstates
legalsystems.Now,wehaveaneconomyontherope.Theyhavethrownahugeamount
ofmoneyatbanks,bigbusinessandlocalandstatesgovernment.Andwearestillinthe

andnooneisevenlooking.Butwhyshouldlook?AccordingtotheAttorneyGeneral,we
donotknowhowmanyarrestswehavemade.
AndiftheTeaPartyisanyindication,insurrectionisbrewingintheland.Justa
coincident?Notlikely.Thisiswhathappenswhenthegovernmentwipesoutthemiddle
class.
Whenthenamanisarrestedfordomesticviolence,oneoftwothingscanhappen.If
theyareonlydatingandhaveseparateapartments,thenhecanheadhome.Butifthey
arelivingtogether,thenthisfellowhasarealproblem.Bailconditionsandthena
possibleprotectiveorrestrainingorderpreventhimfrombeingwithher.Soheneeds
tofindanewplacetolive,atleastuntilthechargesareresolved.TheKingofhisCastle
isnolongerallowedintohiscastle.AfeministnamePencewhowrotethatwas
absolutelygiddyatthatoutcome.Sohecangethisownplaceifhehasenoughmoney.
Orhecanmoveinwithhismother,hissisteroranotherrelative.Hemighthaveagirl
friendwhowouldlethimstaywithher.Andifnoneofthisispossible,wellthenIguess
heissleepinginhiscardownbytheriver.
TheideaforthesearrestscamefromsomethingcalledtheMinneapolisPolice
Experiment(MPE)of198182.
In1984TheU.S.AttorneyGeneralsTaskForceofDomesticViolencerecommended
arrestastheprimaryweaponindomesticviolenceassault.LawrenceW.Sherman
recommendnotusingthearrestsbecausetheMPEwasjustonestudyanditcouldbe
wrong.Theyignoredhim.Andby1992,93%ofthepolicedepartmentsinthenation
hadadoptedsomeformofmandatoryarrestindomesticviolencecases.
Butby1992fivemoreadditionalstudiessimilartotheMPEbecameavailable.
LawrenceW.Shermanreviewedallfivestudies.Thenonceagainhewrotethatthe
policeshouldnotusearrest.Intwoofthefivestudies,theyfoundthesameresultas
theydidintheMPE,thatanarrestcutdowntheoddsofafutureassault.Butinthe
otherthreestudiesanarrestactuallyincreasetheoddsofafutureassault.Soarresting
someoneinadomesticviolencesituationtocutdownonfutureassaultsdidnotwork
anybetterthanjustflippingacoin.IdonotknowifLawrenceW.Shermanisstillalive.
ButfortunatelyhewroteabookcallPolicingDomesticViolencethatwaspublishedin
1992.
Sowehave800,000Americanpoliceofficersarrestingoneineverysixadultsinthe
countryandthrowing25%ofthemen,womenandchildrenoutonthestreetsinan
efforttoenforceapolicythattheyknewdidnotworkbackin1992.AndIhadalways
assumedthatyouneededamantoreallyscrewsomethingup.Ohwell,theregoes
anotherglassceiling.
Whywouldtheypushanarrestpolicythatdoesnotwork?Therearetwoschoolsof
thoughtonthereasonwhy.ThefirstcomesfromLawrenceW.Sherman.Hecallsitthe
LawofJustDesserts.Revengeforslightsandoffences,realorimagined.Iamsure
therearesomethatwouldarguethatwomenarenotvengeful.Butwhatisthatold
saying?Hellhathnofury..
Thesecondideacomesfromthemotherofthesecondwaveoffeminism.Idospeakof
thebrilliantBettyFriedan.IntheEpilogueChapterofthe20thAnniversaryEditionof
herbookTheFeminineMystique,Bettyrelayedwhysheresignedasthefirstpresident
oftheNationalOrganizationofWomenin1970.Bettywrotethatshe,wasunableto
openlyfightthemanhatersandunwillingtofrontforthemanymoreSomanhating
bigotsnoonlyexisted40yearsago,theywerealsograbbingpower.NowWashingtonis
fundingthem.Makesyouwonderwhatbigotstheywillfundnext.MaybetheKlan?
Feministshadalwaysclaimedthatwhenwomentookover,wewouldhaveakinder,
gentler,morenurturingworld.After36millionarrestsand72millionevictionswhatwe

Icanassureyouthateverythingtheydoislogicalandbythebook.Theconfusionyou
havewiththemisyoubothareusingdifferentsetsofbooks.YouareusingtheoldFirst
SetofBookstheConstitution,thegenerallawsorstatutesandthecourtruling
sometimecallCommonLaw.TheyareusingthenewerSecondSetofBooks.Thatisthe
collectionofthepolicy,proceduresandprotocols.Onceyouknowwhatsetofbooks
everyoneisusing,theneverythingtheydolookslogicalandupright.Anddonotbother
tryingtoarguewithmethatthereisnoSecondSetofBooks.Ihavemyowncopiesat
home.Oratleastagoodhunkoftheimportantpartofit.
Officesweregivenpadswithoneofthreewordswrittenonthemcounsel,sendor
arrest.Counselmeanttheofficerwastotrytomediatethecouplesspat.Sendwasto
sendoneofthespousesoutofthehouseforeighthoursasacoolingoffperiod.Arrest
wasarrestoneofthetwospouses.Theofficerwastodoasthetoppaperonthepad
saidtodo.TheexperimentwassetupbythePoliceFoundationandLawrenceW.
Shermanwastheleadresearcher.Theresultsshowcounsellingresultedinafuture
assaultin24%cases,sendwas19%,andthearrestoptionresultedinafutureassaultin
only10%ofthecases.Perhapsacheapwayofcuttingdownfuturedomesticviolence.
IgotmySecondSetofBookswhenIsuedtheJaffreyNHpolicedepartment.Underthe
discoveryrule,IwritethemwiththematerialIwantedanditwouldarriveinthemaila
fewweekslater.IgotthePoliceAcademyTrainingManual.IgottheDepartments
PolicyandProcedureManual.Igotthenodropprotocolthattheattorneygeneralsent
toallhisorherprosecutors.Ievengotthedomesticviolenceprotocolsforthecourt
system,onehundredpagesworth.Onceyoureaditthematerial,thenyouwillknow
whatthepolice,prosecutorsandjudgeswilldo.Theyarecompletelypredictableonce
youknowwhatsetofbookstheyareusing.
Thepoliceacademytrainingmanualstatesthatanarrestinadomesticviolencecallis
thepreferredresponse.TheycitetheMinneapolisPoliceExperiment(MPE)asits
justification.ButtheauthoroftheMPE,LawrenceSherman,saiddonotusearrest
becausefivefollowupstudiesshowthatitdidnotwork.Thewouldbeaviolationofthe
4thAmendmentintheFirstSetofBooksagainstunreasonablesearchandseizure.Then
thereisthatwholeissueofwhetherthepolicehavetherighttoarrestforanyreason
otherthantheybelieveacrimewascommitted.
TheJaffreyPoliceDepartmentPolicyandProceduresManualstatesthatifawifesays
shedoesnotwantherhusbandarrested,thepolicearetoignoreher,arrestthe
husband,andgetwiththeprosecutortoseewhattheycanworkout.Inotherwords,
makethearrestandthenseeifyoucanMickeyMouseit.Thewifeiseligibleforspousal
immunity.Ifsheinvokesit,thennostatementshemades,writtenororal,are
admissiblebecauseshecannotbecrossexaminedaboutitunderoath.(Didyousay

geniuseswiththeirMastersandPHDs.Othersthinktheyaresowackythattheycall
themfruitloops.Well,Ihaveathirdnameforthem.Suckers.Theydidnotgethiredfor
theirmedicalability.Theygotthesebecausetheywerewillingtotakethesecasesoffthe
judgeshands.Whichhasdonenothingforthecredibilityfortheirprofession.Weare

previouslyexisted.Ifajudgereleasesadefendantandhegoeskillssomeone,thatjudge

IsuedMonadnockFamilyServicestomakethemgoaway.ItoldtheirlawyerByronthat
theywerealegitimatetargetformen.Wesettledfornomoney.Theywouldhave
nothingtodowiththisreconciliation.Thecounsellorwasreleased.Andtheywouldno
longergetinvolvedinanydomesticviolencecases.
Everytimeweendedbackincourtoverwhateversquabbles,IwouldaskJudgeSullivan
formychildrenback.Thedecisionbelongtothecounsellorshewouldtellme.Buthe
knewhehadscrewedup.Icouldseeitinhisface.Buthewouldnotfixit.Hewouldnot
stepoutofthatboxthosedomesticviolence/sexualassaultadvocateshadbuiltforhim.

away.
SowhenguyslikeAlexBaldwinandIcalljudgescowards,wehavelegitimatereasons

Thereare220millionadults18orolderinthiscountryofbothsexes.Ifmyfigureof36
millioniscorrect,thenthatis16.4%oftheadultshavebeenarrested.Itcouldbeashigh
as55millionor25%.Itmightbeaslowas22millionor10%.Whateverthenumber
therearetwothingsthatCongressshouldknow.First,isthefellowwhodiscoveredthe
arrestsinMinneapolisbackin1992saiddonotuseitbecauseitdoesnotwork.And
second,thepeoplearrestednowconstituteaFifthColumnhereintheUnitedStates.
OurloyaltytoWashingtonisgone.ButwhatdidthesegeniusesonthePotomacexpect?

insteadof65,000employeesattheDept.ofEducation,thenewgovernmentisonly
hiring45,000.Insteadofanaveragefederalwageof$70,000ayear,thenewaverage
willbe$52,000.Thenewgovernmentwillhavetowriteataxcode.Everyonepays15%
withnodeductions.HowmanyIRSemployeescouldyougetridofiftherewereno
moredeductions?Anythingispossiblewithanewgovernment.
Normallyoverthrowingaelectedgovernmentisconsideredtreason.Treasonis
punishablebydeathhereintheUnitedStates.Butthereisonewayofoverthrowing
thegovernment.Thatisthroughtheballotbox.Thenitisnottreasonbutdemocracy.
Allegedly,Washingtonisinfavorofdemocracy,particularlyiftheircandidatewins.
ThereisnolegalmechanismintheConstitutionortheFederalcodeoftheUnited
StatesfordissolvingthegovernmentoftheUnitedStates.Sothatiswhatweneedfirst.

ThisIvyLeagueinbreedinginWashingtonhasproducedanelitethatknowswhatbest.
