To the Honorable Samuel J . Alito, Circuit J ustice for the Eighth Circuit Court of
Appeals:
Petitioner, J ohn Middleton, respectfully seeks a one-hour conditional stay of his
execution, pending his filing of a Petition for a Writ of Certiorari to review the just issued
opinion of the Missouri Supreme Court, denying Mr. Middletons request for a hearing to present
evidence of his incompetence.
Mr. Middletons stay expires at 6:00 p.m. Central Time, so this Court immediate action is
required allow Mr. Middleton time to file the writ petition. Mr. Middleton requests a stay until
7:00 p.m. Central time to file Petition for a Writ of Certiorari.

CONCLUSION
This Court should grant this application for stay of execution pending this Courts
consideration of Mr. Middletons petition for a writ of certiorari.
