0s mayor, Mack influenced actions taken on behalf of the city of Trenton, including
matters concerning the disposition of city!o7ned property% "iorgianni, a convicted felon
and the proprietor of a Trenton sand7ich shop called 'o'os $teakhouse, is Mayor Macks
associate% 9alphiel Mack is Mayor Macks brother and 7as employed by the Trenton
Board of Gducation as Trenton &entral -igh $chools head football coach%
The Macks, "iorgianni, and others conspired to corrupt certain functions of Trenton city
government in favor of a purported developer 7ho 7as seeking to build a parking garage
on a city!o7ned lot on Gast $tate $treet% In reality, the developer 7as cooperating 7ith
federal authorities% 4uring the course of the negotiations, 7hich lasted almost t7o years,
the defendants agreed to accept more than >551,666 in bribes, of 7hich >)(,666 had been
paid at the time of their arrests%
To attempt to evade la7 enforcement detection, the defendants employed intermediaries,
used code 7ords, and attempted to limit their discussions of the scheme over the
telephone%
Beginning in $eptember 8656, "iorgianni had several recorded meetings 7ith an
individual 7ho 7as cooperating 7ith la7 enforcement O&W!5P, during 7hich "iorgianni
agreed to serve as an intermediary, or ?buffer,@ for cash payments to Mayor Mack in
e=change for the mayors support of a parking garage proHect% 4uring these meetings,
"iorgianni described his intent to promote and facilitate a corrupt system of government
in Trenton% 4uring a $eptember 5(, 8656, meeting, "iorgianni stated that he conducted

In e=change for the money, the agreement contemplated that the mayor 7ould use his
influence to get the necessary approvals for the proHect% 0s the conspiracy developed, the
mayor and "iorgianni proposed that the city sell the land for the parking garage to the
developer for a reduced price in e=change for a larger bribe%
Initially, on May 5), 8658, a city of Trenton official OTrenton 3fficial!5P e!mailed &W!8
letter stating that the total assessed value for the Gast $tate $treet lot 7as >8./,666 and
that the land value 7as >8.5,,66% &W!5 and &W!8 later discussed 7ith "iorgianni that
&W!8 and the proHect investors 7ould be 7illing to purchase the Gast $tate $treet lot for
>866,666 and 7ould be 7illing to pay a bribe to the mayor in e=change for the price
reduction% "iorgianni, in turn, proposed that the city of Trenton set the sale price for the
Gast $tate $treet lot at >566,666 and that the >566,666 difference be split among Mayor
Mack, "iorgianni, and &&!5% "iorgianni reJuested a draft offer letter reflecting the
>566,666 purchase price for the Gast $tate $treet lot, 7hich &W!8 provided to "iorgianni
on May 8:, 8658%
Moments after a May 81, 8658 meeting 7ith Mayor Mack, "iorgianni called &&!5 and
stated, ?I got the okay from you kno7 7ho, rightL Tell VTrenton 3fficial!5W to get that
letter out, today%@ &&!5 then met 7ith Trenton 3fficial!5, 7hose responsibilities included
negotiating the sale of city!o7ned property and reJuested Trenton 3fficial!5 to issue the
>566,666 offer letter% Trenton 3fficial!5, in turn, called Mayor Mack, 7ho, instead of
discussing the matter over the telephone, directed Trenton 3fficial!5 to meet him in
person% Trenton 3fficial!5 then met 7ith the mayor, 7ho approved the letter offering the
Gast $tate $treet lot to &W!8 and the investors for >566,666, and the offer letter 7as
issued that day%
The Drug Distribution Conspiracy
"iorgianni, along 7ith eight other defendants, also appeared in court today facing
o=ycodone distribution charges% ONeither Mayor Mack or 9alphiel Mack 7ere charged
7ith the narcotics conspiracy%P
0ccording to the complaint
3=ycodone, the active ingredient in brand name pills such as 3=ycontin, 9o=icodone,
and #ercocet, is a $chedule II controlled substanceSmeaning that it has a high potential
for abuse%
"iorgianni organiNed and oversa7 a Trenton!based o=ycodone distribution conspiracy
responsible for the distribution of thousands of o=ycodone pills% "iorgianni arranged for
the sale of pain pills prescribed to him and facilitated the distribution of o=ycodone
prescribed to some of the other defendants and others in this case% 'o'os $teakhouse, a
sand7ich shop that "iorgianni o7ned and that Mary Manfredo operated, served as a front
for this drug distribution organiNation and a clearing house 7here prescription pain pills
7ere stored, provided to drug dealers for distribution, and 7here narcotics proceeds 7ere
returned% The investigation uncovered evidence that "iorgianni and the other
coconspirators used a doctor and pharmacy in Mercer &ounty and another doctor in
Gsse= &ounty to obtain and fill these prescriptions, 7hich 7ere in large part obtained
through fraud%
Numerous conversations 7ere intercepted on the 7iretaps among "iorgianni, other
defendants named in the complaint, and &&!5 prior to the time &&!5 began cooperating
7ith authorities on 'une 85, 8658% Based on the recorded conversations and information
subseJuently learned from &&!5, 0nthony 4imatteo, 9alph 4imatteo, $r% and "iuseppe
?'oseph@ $cordato distributed prescription pain medication fraudulently obtained on
behalf of the operation% In one recorded conversation, $cordato described to "iorgianni
his efforts to cause an individual, 7ho according to $cordato had Hust undergone open
heart surgery, to become addicted to o=ycodone by providing this individual 7ith a free
pill as a sample% "iorgianni, in many intercepted telephone calls, used coded language
such as ?steaks@ to refer to the prescription pain pills%
&&!5 7as supplied prescription pain medication from Gugene Bro7n, an 0tlantic &ity
resident, a portion of 7hich Mark Bethea 7ould distribute and a portion of 7hich 7as
delivered to 'oHos $teakhouse for distribution% &arol BounitN and $tephanie *ima also
fraudulently obtained prescription pain medication and provided this medication to &&!5
to be distributed%
"iorgianni, 7ho has a prior felony conviction, also is charged 7ith unla7fully possessing
four firearms 7hich, along 7ith hundreds of rounds of ammunition, 7ere recovered from
his residence during the e=ecution of a search 7arrant% Gugene Bro7n, 7ho also has a
prior felony conviction, is charged 7ith unla7fully possessing a loaded firearm, found in
his residence during the e=ecution of a search 7arrant%
The drug conspiracy count 7ith 7hich the defendants are charged is punishable by a
ma=imum potential penalty of 86 years in prison and a >5 million fine% The felon in
possession of firearms counts, 7ith 7hich "iorgianni and Bro7n are each charged, is
punishable by a ma=imum potential penalty of 56 years in prison and a >8)6,666 fine%

official earlier that month and had received contributions from a number of people,

3casio, at trial, raised the primary argument that he pursues on appeal that he could not
be convicted of conspiring 7ith Moreno and MeHia, because they 7ere the victims of the
alleged -obbs 0ct e=tortion conspiracy% The follo7ing day, Manrich pleaded guilty to the
charges lodged against him in the superseding indictment% 3casio, ho7ever, proceeded

3ne 7ho kno7ingly participates in a conspiracy to violate federal la7 can be held
accountable for not only his actions, but also the actions of his coconspirators% &ontrary
to 3casios argument, nothing in the -obbs 0ct forecloses the possibility that the
?another@ can also be a coconspirator of the public official% 0 bribe!payors mere
acJuiescence to the scheme suffices to render a bribe!taker guilty of e=tortion%
0lthough the Fourth &ircuit affirmed 3casios convictions it vacated the sentencing
courts a7ard of restitution to Grie Insurance% 3casio maintains that Grie 7as not a victim
of any of his offenses of conviction% 0t best, he contends, Grie 7as the victim of an
uncharged insurance fraud scheme% The controlling statute defines a ?victim@ as ?a
person directly and pro=imately harmed as a result of the commission of an offense for
7hich restitution may be ordered including, in the case of an offense that involves as an
element a scheme, conspiracy, or pattern of criminal activity, any person directly harmed
by the defendants criminal conduct in the course of the scheme, conspiracy, or pattern%@
The statute authoriNes restitution only for losses traceable to the offense of conviction%
Indeed, nothing in the superseding indictment or in the trial evidence suggests that an
obHect of that conspiracy 7as to commit insurance fraud% Nor does the record suggest that
an insurance fraud scheme 7as part of a pattern of criminal activity included as an
element of the &ount 3ne conspiracy% #erhaps 3casio could also have been convicted of
defrauding Grie Insurance or conspiring to do so, but that did not occur% The Fnited $tates
0ttorney and the grand Hury did not see fit to charge 3casio 7ith an insurance fraud
scheme, and it 7ould thus be inappropriate to penaliNe him as though he 7as also
convicted of that offense%

Both men are charged 7ith federal counts of conspiracy, false impersonation and illegal
conversion of government property, all felonies% The trial is scheduled to begin March 55

Neither 0lguire nor &ooper could be reached for comment Wednesday, and a F%$% Forest
$ervice spokesman said the agency cannot comment on a case involving personnel%
