This move is completely illegal. We believe that they know it and are just
playing dumb and hope that no one complains until it’s too late. Aside
from this move is an obvious attempt to silence him and punish him for
speaking out. It is absolutely illegal to move a prisoner with an open
habeas before the courts. Marty has not one, but two open habeas before
the court at this time.
#1 A habeas in Camden Federal Court # 08251
Rule 36 of the Supreme Court states that Marty can’t be moved while
there is an open habeas.
They did not go to the judge because they know that the judge would say no and
that it would open them up to scrutiny and more bad press. Instead they tried to
slide this past everyone on a holiday weekend. They are breaking the law. Later if
they get caught, they will just say they made a mistake. Bottom Line, Marty needs
your help. We have gotten him a lawyer, but we are in a race against time to stop
them from moving him.
Please Call email and fax the following people and tell them you know what they are
doing and demand that they stop. Try to get through personally but if you can’t
then at least leave a voice mail. This is a numbers game we need to let these
folks know that we are watching and we won’t stand for it!

After a lot of digging we have uncovered some additional information regarding Marty’s pending
black bag illegal transfer.
In the background we found that the Assistant Warden J. Wagner is the most likely the button man for
whoever is really behind this move. The Warden at Fort Dix just got the job 10 days ago and may not
even know what Wagner is attempting. Wagner is also the person that approves and disapproves the
press requests to see Armstrong, of which there are many including a well known author (William D.
Cohen) in the process of writing an expose of Goldman Sachs..
We have also now had the time to speak with a high quality federal criminal lawyer who intends to get
involved through the courts first thing Monday morning. Hopefully he stomps on these guys hard.
Clearly the prison official’s strategy is to claim that they were unaware that Armstrong has open Habeas
in the Camden Federal District Court and the United States Supreme Court. By later claiming ignorance
can later claim innocent error. However by making everyone on this list acutely aware of the fact that
Armstrong has two open habeas.They have committed a criminal act. They are individually and
collectively guilty of a willful act of contempt of the powers of the Supreme Court of the United States and
the powers of the Camden Federal District Court of New Jersey. Additionally, those that are aware of this
crime and do not report it are also guilty of a crime called 'Misprision' defined as being aware of a felony
and not reporting it.

#2 In all communications, mention that their actions are a willful act of contempt of the powers of
the Supreme Court of the United States and the powers of the Camden Federal District Court of
New Jersey. We are also notifying the clerks of the Supreme Court of the United States and the
Clerk of the New Jersey Federal District court of Camden that there powers are being ignored by
the prison officials at FCI Fort Dix Prison in this matter. Furthermore, let them know that we
intend to present this issue to members of Congress and demand an investigation of the abuse of
power by Fort Dix BOP. Remember its important that The Warden, The Assistant Warden S.
Wagner, Kevin Byrd and David Steel, along with their bosses at the regional level and Traci
Billingsly in Washington, know that we are calling the cops on them. We also should tell them that
we think that someone should be fired for doing this.

This habeas is now posted on the scribd site. Let Mr Suter know what’s going on and ask for his
help. Let them know what going on. Let them know that the prison officials at Fort Dix are illegally
usurping the powers of their judges and moving Armstrong while he has two open habeas. Ask
them to protect Armstrong and consider putting the responsible parties at the BOP in contempt.

Let them know what going on. Let them know that the prison officials at Fort Dix are illegally
usurping the powers of their judges and moving Armstrong while he has two open habeas. Ask

#5) Finally, call your Congressman and Senators let them know about this situation and ask for an
investigation. Remember if they can do it to Armstrong they can do it to you and your family as
well.
