Plaintiff Maria Stender, re:>iding in Cranforct, New Jersey, has worked for Defendant Borough of Roselle Park since 19$6. She has been Defendant's Municipal Court Administrator since 1996. 7, Defendant Roselle Park is a municipality with offices located at 110 East Westfield Avenue,. Roselle Park, New Jersey. 8. Defendant has been, and continues to be, an employer within the meaning of the FLSA. FACTS COJ.!MON TO ALL COUNTS 9. Plaintiff has been employed as with Defendant since 1986. She has been Defendant's Municipal Court AdmJ.nistrator since 1996. lie Municipal Court Administrator, E'laintiff has been treated as a Department Head d<;1spite being listed in Defendant's personnel policies as a Supervisory employee. Plaintiff is not similarly situated to other Supervisory employees. In April 1996, to Plaintiff, o.,fendant entered an agreement with its "Department Heads" providing them with the "beBt benefits received by Borough Employees through the various collect;i.ve bargaining units for vacation time, holidays, personal time, sick time, and health benefits." In addition, this agreement provided, regarding retiring benefits, that "after 15 years of service, all hoiipital, major medical, dental and preiicription shall be <1fforded upon retirement and that this coverage sh<>ll remain in effect for the retiring Department Head and spouse for the remainder of their lives." Regarding tel'mination compensation, the agreement provided that "each Department Head shaJ.l l'eceive an amount of money equivalent to his or her basic wage at retirement for 90 days provided that he or she has at le<ist 20 years of full time employment with the Borough." For the entire period of Plaintiff's employment, Plaintiff was required to accumulate and ;r'eport to the Chief Financial Officer. l;lll compensatory time that she worked in e11cess of 35 hour.s per week. '.!'he compensiltory time was awarded to her, consistent with the FLSA, at one and one half times her hourly pay, 12. For the entire period of her if Plaintiff was absent or late or otherwise needed to utilize her compensatory hours tllat she had accumulated, she W;:ts dJ.rected to subtract the hours needed from her compensatory "bank" of )lours. 13. For approximately 22 years, through October 2008, Plaintiff was paid her unused accumulated compensatory time from the Parking Offenses Adjudication Fund. 14. The above practices we:r.e done with the knowledge and agreement of the Chief Financial Ottice:t as well as the Municipal Judge who signed Plaintiff's time sheets each week indicating and approving the number of overtime/compensatory hours that Plaintiff worked in excess of 35 hours each week. 15. For the year 2010, Plaintiff accumulated 326 compensatory hours for which she has not been paid. Pursuant to the FLS.A., Defendant was required to pay Plaintiff for any compensatory time aocum\1lated in excess of 240 hours. 18. For the year 2011, Plaintiff accumulated 455 compensatory hours for which she has not been paid. l?Ut'suant to the FLSA, Defendant was requirad to pay Plaintiff for any compensatory time accumulated in excess of 240 hours. 19. For the year 2012, to date, Plaintiff accumulated approidmately 100 compen,.atory hours f.or which she has not been paid. 20. Jn 2012, Plaintiff utilized app:i:oximatel.y 100 cornpt;insatory hours that she had accumulated over the years. 21, In or around October 2008, Plaintiff wa informed that compensatory time would no longer be paid out of the Parking Offenses Adjudication Act funds. 22. In response to her corre,,pondence, by letter d<>ted March 6, 2012, for the fi:r.iit time in her entire employment, Defendant advised Plaintiff that they believed that he:r. position as Municipal Court Administrator was exempt J:rom overtime/compensatory time under the FLSA. Defendant completely ignored the fact that for approximately 26 yeal'.'s of employment, Plaintiff was required to aGcurnulate and report to the Chief Financial Officer all of her compensato:cy time which, when it was beneficial to DeJ;endant, i.e. r utilizing the Parking Offenses Adjudication Act tunds, Defend<111t acknowledged and compensated Plafotiff for her overtime. 24. By purposefully Plaintiff, at its whim, Defendant has knowingly violated the FLSA. 25. The FLSA requires employers to pay non-exempt employees overtime compensation. 27, The FI,SA requires employers to pay overtime compensation at the rate of 011e and one half times each employees regular hourly rate for all hours worked in exce:;is of 40 hours in any given work week. 28. Whether Plai.ntift ;Ls a non-exempt Supervisory employee or an exempt Department Head employee, despite treating her as a Department Head for various other purposes, for the purpose of her entitlement to overtim<1/compensatory time, Defend<>nt treated her as a non-exempt employee and agreed to provide her, and indeed did provide her, with overtime/compensatory time at a rate of pne and a half times her hourly rate, for approximately 26 years. 2 ~ Jn 2010 1 2011 and 2012, Plaintiff regularly worked more than 35 hours per week for Defendant, at Defendant's request, and received no overtime pay or cornpensQ.tion for those hours worked. 30.
