which shall be necessary or proper to enable the Board to lay construct
erect use maintain inspect alter enlarge renew replace remove or render
unusable two mains or pipes for the transmission or storage of gas or
other materials connected with the exercise and performance of the
functions of the Board and all necessary apparatus ancillary thereto and
at any time before the expiration of a period of fifteen years from the
twenty fourth day of June One thousand nine hundred and sixty three in
consideration in each case of a further payment to be assessed in default
of agreement by a single arbitrator to be agreed upon between the parties
hereto and in default of such agreement by the Lands Tribunal to lay
construct and erect and thereafter at all times to use maintain inspect
alter enlarge renew replace remove or render unusable two further such
pipes and all necessary apparatus ancillary thereto (all hereinafter
together called "the said works") in through upon and over a strip of the
said land twenty feet in width indicated for identification purposes only
by the lines marked A-B and C-D drawn on the plan annexed hereto and
thereon coloured pink (hereinafter called "the said strip of land")
together with full and free right of access over the said land with all
necessary workmen vehicles machinery and apparatus at all reasonable times
and in an emergency at any time

NOTE: The strips of land coloured pink referred to are hatched blue on the
filed plan.
2 (03.04.2001) The Deed of Grant dated 18 November 1964 referred to above
contains the following covenants by the Grantors:

THE First Grantor and the Second Grantor (hereinafter called "the
Grantors") (to the intent and so as to bind the said land and every part
thereof into whosesoever hands the same may come and to benefit and
protect the easements rights and privilages hereby granted) hereby
covenant jointly and severally with the Board as follows :

(i) The Grantor shall not do or cause or permit to be done on the said
land anything calculated to or likely to cause damage or injury to the
said works and will take all reasonable precautions to prevent such damage
or injury

(ii) The Grantors shall not without the consent in writing of the Board
make or cause or permit to made any material alteration to or any deposit
of any thing upon any part of the said strip of land or any part of the
said land being a part nearer than ten feet measured in any direction from
the said strip of land so as to interfere with or obstruct the access
thereto or to the said works by the Board or so as to lessen or in any way
interfere with the support afforded to the said works by the surrounding
soil including minerals or so as to materially reduce the depth of soil
above the said works

(iii) The Grantors shall not erect or instal or cause or permit to be


erected or installed any building or structure or permanent apparatus in
through upon or over the said strip of land nor save with the consent in
writing of the Board (which consent shall not be unreasonably withheld)
any part of the said land being a part nearer than ten feet measured in
any direction from the said strip of land.
3 (03.04.2001) The land tinted pink and tinted blue on the filed plan is
subject to the rights granted by a Deed of Grant dated 27 February 1964
made between (1) Julian John William Salmond and (2) Eastern Gas Board.
The said Deed also contains restrictive covenants by the grantor.

following rights granted by a Conveyance of the land tinted yellow on the

(Vendor) and (2) Sidney William Roy Brazier (Purchaser):-

(b) to weep and drain from the septic tank located within the curtliage of

6 (14.04.2003) The tracks, accessways, paths and roads included in the title
are subject to rights of way.
7 A Transfer of the land tinted mauve on the title plan dated 4 September
2002 made between (1) Warrengate (Herts) Limited (Transferor) and (2)
Nnamdi Okechukwu Nwuba and Chiedu Clara Nwuba (Transferee's) contains the
following covenants:-

"The Transferees for himself and his successors in title hereby covenants
with the Transferor and its successors in title so that the same shall be
binding on whosoever hands the property hereby transferred (Hereinafter
called "the property") shall come

a. Not to keep pigs and/or breed animals on the property or any part
thereof; and

b. Not to dump or place obnoxious/inflammable or deleterious materials at


any time upon the property or any part thereof

c. Not to keep or allow to be kept on the property or any part thereof


for any period of more than forty successive days any caravan, lorry
trailer camper van or other similar vehicle

d. Not to make new openings or accesses from the property on to any farm
roads without the prior written consent of the Transferor or its successor
in Title

e. To pay on demand the costs incurred in cleaning, maintaining and


renewing any farm road, or any other existing roads, and all other roads,
drives, tracks and paths constructed or to be constructed over the
Transferors retained land in approximately the positions shown on the Plan
annexed hereto as well as the cost of mowing and cutting of the verges
including any costs reasonably incurred in upgrading such roads or
constructing a varied or substituted access in place of such roads. The
costs shall be £150.00 per annum for the one acre plot and £350.00 per
annum for the 5 acre plot and in each case shall be index linked to
inflation or to a 5% per annum cumulative increment, whichever is the
greater, and shall be payable yearly in advance"
