Appeal from U.S. International Trade Commission
in Investigation no. 337-TA-796
____________ _______________

UNOPPOSED MOTION TO DISMISS APPEAL
PURSUANT TO FED. R. APP. P. 42(b)
_____________ ______________

The United States International Trade Commission instituted this
investigation based on a complaint filed by Apple Inc. (Apple). The
Commission determined that Samsung Electronics Co., Ltd., Samsung Electronics
America, Inc. (SEA), and Samsung Telecommunications America, LLC
(STA) (collectively, Samsung) violate 19 U.S.C. 1337 because Samsungs
products infringe certain claims of U.S. Patent Nos. 7,479,949 (949 patent) and
Case: 14-1015 Document: 52 Page: 1 Filed: 06/13/2014
7,912,501 (501 patent). The Commission issued an exclusion order barring
entry of Samsung articles that infringe the 949 and 501 patents. The Commission
also issued cease-and-desist orders barring SEA and STA from importing, selling,
marketing, advertising, distributing, transferring, and soliciting U.S. agents or
distributors for infringing articles.
Samsung appealed the Commissions final determination and orders.
Samsungs appeal was docketed as No. 2014-1150. Apple also appealed, seeking
to broaden the scope of the exclusion order and cease-and-desist orders. Apples
appeal was docketed as No. 2014-1015.
Samsung filed an unopposed motion to dismiss its appeal voluntarily,
pursuant to Rule 42(b) of the Federal Rules of Appellate Procedure, and that
motion has been granted. That means the Commissions exclusion order and
cease-and-desist orders will remain in place.
Apple thus respectfully requests that Apples appeal No. 2014-1015 also be
dismissed under Rule 42(b).
Counsel for Samsung and counsel for the United States International Trade
Commission have informed counsel for Apple that they do not oppose this motion.
Upon dismissal of Apples appeal, each party will bear its own appeal costs and
fees.
