Mayor Watson called the meeting to order at 6: 00 p. m. with eight members present.
City Clerk Clausen gave the Invocation and led the Pledge of Allegiance.
MINUTES- May 19, 2014
Alderman Johnson moved to approve the minutes of the May 19, 2014 meeting. Alderman Lewis seconded the
motion and it passed unanimously.
PUBLICCOMMENT
Rick Scott, ofPanther Mountain Road, expressed his concerns with Maumelle Water Management becoming a
public water authority.
PROCEDURALMOTION
Alderman Lewis moved to have all ordinances and resolutions read by title only. Alderman Anderson seconded
the motion and it passed unanimously.
ORDINANCE852 APPROVINGTHEFORMATIONOFANIMPROVEMENTDISTRICT
With no objections, Mayor Watson called for the first reading of the ordinance establishing the Maumelle
Property Owners Multi-Purpose Improvement District No 16. The City Clerk gave the reading.
RESOLUTION2014-27 APPROVINGACONDITIONALUSEPERMIT
With no objections, Mayor Watson called for the reading of the resolution approving a conditional use permit
for Come Spend the Day with Us Adult Day Care Center, operating in a PCDzone. The City Clerk gave the
reading.
Alderman Lewis made a motion to approve Resolution 2014-27. Alderman Anderson seconded the motion and
it passed unanimously.
RESOLUTION2014-28 REGARDINGSURPLUSPROPERTY
With no objections, Mayor Watson called for the reading of the resolution approving the disposal of a recycle
truck for the Public Works Department. The City Clerk gave the reading.
Alderman Lewis made a motion to approve Resolution 2014-28. Alderman Johnson seconded the motion and it
passed unanimously.

DISCUSSIONOFBONDPROJECTS
Marion Scott, of 12 Spring Drive, asked the Council to be careful and prudent of which projects to add to a
ballot. She stated she would rather the right decisions be made carefully rather than quickly.
Adam Hazen, of 107 Nantucket Loop, spoke in support of the indoor aquatic center. He stated he would like
the whole City to have a chance to vote on it.
Perryn Andrews, of 3 Monarch Drive, spoke in support of the indoor aquatic center and noted several benefits
available through swimming.
Karen Lamoreaux of, 10 Holly Brook Cove, stated revenue is being lost from Maumelle to North Little Rock
and other communities. She stated having the indoor aquatic center would benefit Maumelle.
Kathie Marshall, of 124 Montpellier Drive, detailed her reasons for supporting the indoor aquatic center.
Mark Bugg, of 21 Crystal Mountain Lane, stated the aquatic center needed to be added to the ballot because he
felt having the center would enhance the amenities of Maumelle.
Nancy Swankhouse, of 6 Riverwood Place, stated she was for the indoor aquatic center and it would be
beneficial to all ages.
Alderman Johnson stated that the projects that got over 50%
on the survey should go to the ballot and he could
support the pool going as well. Alderman Anderson agreed.
Alderman Hogue agreed and added that a sales tax question should be added.
Alderman Johnson stated the pool and tax should be considered separately.
Mayor Watson stated that the City Hall project should not move forward simply because it was well received on
the survey ifthere was a desire to rework that project and combine it with the senior wellness center.
Alderman Norris stated that he was still uncomfortable with moving the pool project forward due to the lack of
support it received in the survey process.
Alderman Anderson noted that people have been requesting the pool for several years.
Alderman Mosley stated that he was not in favor of any bond projects at this time.
Mayor Watson stated he would elect to put the ball fields, senior center and pool on the ballot.
Alderman Kelley expressed concern over operation on the pool but agreed people should get the chance to vote
on it.
Alderman Anderson moved to have the ball fields, senior wellness center, indoor pool and tax issue put on the
November ballot. Alderman Hogue seconded the motion.

Alderman Lewis stated that the motion may be premature and that we had time to look at these issues further.
He shared concerns he had with the projects.
Alderman Norris asked if going forward with the senior wellness center would keep the city hall project from
being possible. Mayor Watson stated that it would not, but that plans would have to be made accordingly.
Alderman Anderson stated that the intent of his motion was to get the ball rolling and that we could tweak
language of the ordinance as needed.
Alderman Johnson stated that this was just giving everyone the chance to vote on these issues.
Alderman Lewis moved to add the city hall project to Alderman Anderson' s motion. Alderman Anderson
seconded the motion and it passed with only Alderman Mosley voting no.
Alderman Lewis stated that two meetings from now he would like to consider an ordinance on a combined
senior wellness center and city hall project.
Alderman Anderson' s amended motion passed with only Alderman Mosley voting no.
Alderman Hogue stated that she expected the Council to consider a special election for a sewer project in the
future.
PARKINGANDTRAFFICCOMMITTEEREPORT
Mayor Watson stated that the proposed four-way stop at Arnold Palmer Drive and Barber Drive and Barber
Cove was voted down 5- 2 by the committee. He stated that no formal action was taken at Odom Boulevard
North and Ridgeland Drive and Naylor Drive or Odom Boulevard North and Diamond Pointe Drive. He stated
that Public Works was looking into clearing some vegetation and placing some caution lights at those
intersections.
MAYOR' SCOMMENTS
Mayor Watson stated the Memorial Day Ceremony had a turnout ofabout 250 people.
Mayor Watson noted that Sky Zone was officially open.
Mayor Watson stated Relay for Life raised over$ 53, 000 for the American Cancer Society.
PLANNINGCOMMISSIONREPORT
Alderman Hogue stated there was one item on the agenda and it was to approve a conditional use permit for the
adult day care. She noted it passed unanimously with one commissioner absent.
ALDERMEN' SCOMMENTS
Alderman Johnson stated he liked the statue at the Memorial Day ceremony ofthe soldier' s boots and flag. He
asked howmuch one would cost to put in Maumelle. Mayor Watson stated he would look into it.
Alderman Hogue stated the memorial bench for Wallace had not been completed due to lack of funding. She
stated she would like to take donations to get the bench up.

Alderman Lewis moved to adjourn the meeting. Alderman Anderson seconded the motion and it passed
unanimously.
Mayor Watson adjourned the meeting at 8: 10 pm.

Note 1: Minimum fund balance policy for the general fund
Ordinance 438 states that the general fund shall maintain a level of fund balance equal to
20% of budgeted
operating
expenditures.
Currently,
this figure is $ 2, 231, 868
Note 2: Fund balance classifications
Effective with the January 31, 2011 financial statements, there are new fund balance classifications
for the General and Street funds. The new classifications and their definitions are as follows:
Nonspendable- fund balance that can' t be spent, such as inventory and prepaid items
Restricted- use of these funds is restricted by external sources, such as law or grant
requirements
Committed- use of these funds is restricted by formal action of the city council
Assigned- use of these funds is restricted by informal action of the city council

ANORDINANCE TOESTABLISHANDLAYOFF THEMAUMELLE
MUNICIPALPROPERTYOWNERS' MULTIPURPOSEIMPROVEMENT
DISTRICTNO. 16 ANDFOROTHERPURPOSES
WHEREAS, a Petition to form the Maumelle Municipal Property Owners' Multipurpose
Improvement District No. 16 has been filed with the Maumelle City Clerk; and
WHEREAS, the City Clerk has presented the petition to the Mayor; and
WHEREAS, the Mayor has set June 2, 2014 at 6 p. m. as the date and time for a hearing
before the Maumelle City Council for consideration of the petition; and
WHEREAS, the Maumelle City Council has determined from an abstractor' s certificate of
property ownership that those signing the petition constitute all the owners ofthe real property to be
located in said district; and
WHEREAS, the Arkansas Municipal Property Owners' Improvement District Lawprovides
that if the governing body determines that all the owners of the real property to be located in the
district have petitioned for the improvements, it shall then be its duty by ordinance to establish and
lay offthe district as defined in the petition and to appoint the commissioners named in the petition.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
MAUMELLE, ARKANSAS:
Section 1.
That the real property described in Exhibit" A" attached hereto and made a part
hereofis hereby established and laid offas the Maumelle Municipal Property Owners' Multipurpose
Improvement District No. 16 for the purpose ofconstructing and installing facilities for waterworks,
recreation, drainage, gas pipelines, underground trenches and excavations necessary for the
installation ofelectric and telephone distribution systems, sanitary sewers, streets, including curbs
and gutters, sidewalks, together with facilities related to any of the foregoing within said district.
Section 2. The following three individuals are hereby appointed as commissioners of said
improvement district: Wayne Moore,
Mary
Ann Moore and Jett Moore.
Section 3.
The name ofimprovement district shall be the Maumelle Municipal Property
Owners' Multipurpose Improvement District No. 16.
Section 4. The Maumelle City Council hereby determines that there is a need for additional
infrastructure within the City and hereby determines that the passage ofthis ordinance will facilitate
construction ofadditional infrastructure within the City. Therefore, an emergency is hereby declared
to exist, and this ordinance being necessary for the public health, safety and welfare shall be in full
force and effect from and after its passage and approval.

a)( 1)( A) Upon the filing ofthe petition with the clerk, it shall be the duty ofthe clerk to present the petition tothe mayor.
B) The petition shall be accompanied by a certificate from a title insurance company transacting. business in the
municipality:
i) Stating that the signatures on the petition constitute all of the owners ofreal property to be located in the district; and
ii) Identifying any mortgagee holding a first mortgage lien on real property constituting more than ten percent( 10%)
in area ofthe real property to be located in the district.
2)(A) The mayor shall thereupon set a date and time, not later than fifteen( 15) days after the date ofthe presentation ofthe
petition to the mayor, for a hearingbefore the governing body for consideration ofthe petition.
B) Notice of the hearing shall be sent by certified mail to any mortgagee holding a first mortgage lien on real property
constituting
more than ten percent( 10%)
in area ofthe real property to be located in the district.
C) The notice of hearing under subdivision (a)(2)(B) of this section shall state that any existing mortgage shall be
subordinated pursuant to this section and

formation ofthe district.
b)( 1) At the hearing, it shall be the duty ofthe governing body to hear the petition and to ascertain whether those signing the
petition constitute all the owners ofthe real property to be located in the district.
2)(A) Except as provided in subdivision( b)(2)(B) of this section, if the governing body determines that all the owners of
the real property to be located in the district have petitioned for the improvements, it shall then be its duty by ordinance
to establish and lay off the district as defined in the petition and to appoint the commissioners as named in the petition if
commissioners are named in the petition and are property owners in or creditors of the district, or as is otherwise provided
from among such property owners or creditors.

B) If at the hearing on the petition any mortgagee holding a first mortgage lien on real property constituting more than
ten percent( 10%)
in area ofthe real property to be located within the district objects to the formation ofthe district, then
the governing body shall reject the petition for creation ofthe district.
3) The petition shall state the specific purposes for which the district is to be formed, and the ordinance establishing the
district shall give it a name which shall be descriptive of the purpose. It shall also receive a number to prevent its being
confused with other districts for similar purposes.
c) The ordinance establishing the district shall be published within thirty( 30) days after its adoption by one( 1) insertion in
some newspaper ofgeneral circulation in the municipality in which the district lies.
d) The findings ofthe governing body shall be conclusive unless attacked by a suit in the circuit court ofthe county in which
the municipality is located, brought within thirty( 30) days after the publication.

Petitioners are the record title owners to all of the real property described in
Exhibit" A" attached heretoand made a part hereof as reflected bythe deed records in the
Office of the Circuit Clerk and Ex-Officio Clerk of Pulaski
County,
Arkansas. All of said
property is located within the corporate limits of the City of Maumelle.
2.
Petitioners desire that the real property described in Exhibit " A" attached
heretoand made a part hereof be laid off intoa Municipal Property Owners' Improvement
District pursuant to Ark. Code Ann. Sections 14-94-101 et seq. for the purpose of (a)
constructing
waterworks, sewers, recreational facilities and systems of gas pipelines, and

b) grading, draining, paving, curbing, and guttering street and laying sidewalks, together
with facilities related to any of the foregoing within said district.

WHEREAS, the City of Maumelle allows signs identifying properties for sale within the
City under certain circumstances and with particular requirements in place, and
WHEREAS, provisions regulating said signs do not address those corner properties
which may need more than one sign and the City Council desires to add those provisions.
NOW, THEREFORE, BEITORDAINEDBYTHECITYCOUNCILOFTHECITYOF
MAUMELLE, ARKANSAS, THAT:
SECTION1. Chapter 58. Sign Regulations, Article III. Residential and Miscellaneous, Section
58- 163, Real Estate Signs, ofthe Maumelle City Code, is hereby amended as follows:
See. 58- 163. Real estate signs.
On a lot, there may be placed one unanimated real estate sign, but such signs shall be
limited to wall and freestanding signs whose permitted illumination and maximum display
surface area shall be as follows:
1)
Residential. For residential, eight non-illuminated square feet.
2)
Nonresidential. For nonresidential, 32 non-illuminated square feet. No sign shall exceed
eight feet in length or height.
3) Exception. Two (2) signs
may
be allowed on corner lots that front on two streets. Two
2) signs must be separated
by
at least 100 feet. However, no sign shall be allowed in the rear
ofany residential property except when the rear of the property borders a golf course.
3)( 4)
Temporary open house/directional signs. Open house/directional signs, of a size
not greater than six non-illuminated square feet, may be placed at a rate of one per company
per intersection, for a period from 9: 00 a. m. to 8: 00 p. m. on the day of the open house only,
provided, that there shall be only one route designated by signs to a particular open house. No
more than four directional open house signs may be placed within the city limits for any one
open house on any one day. Failure to remove signs within the prescribed time period will
cause a fine to be levied at a rate of$ 50. 00 per sign left on the site. Chronic violation of this
subsection shall result in a suspension of such privileges for a period of up to six months.
Chronic violation shall be defined as four separate violations within a period of six months.
Violation of this suspension shall be a misdemeanor charged upon the principal broker of the

Sold signs/stickers. Sold signs/stickers, of a size not greater than 25 percent of the
sign on which it is placed, may be placed at a rate of one per lot or tract, per company. All real
estate signs and stickers shall be removed from the lot or tract within 30 days of the sale or
within 30 days after the sold sign/sticker has been placed.

Services or offerings directly related to the sale or lease of the property. In
addition to the real estate signage allowed herein, no more than one sign may be placed upon
any property advertised for sale or lease which advertises services directly related to the sale or
lease of said property.

Such services may include, but are not limited to, financing, insurance, or home
improvement services.
b. All restrictions placed upon the size and placement of real estate signs expressed
herein shall likewise apply to signs placed under this provision.

Signs may not be placed without the express permission of the property owner or
his or her agent.
SECTION2. Codification.
It is the intention of the City Council ofthe City of Maumelle that
the provisions of this Ordinance shall become and be made a part ofthe Code of Ordinances of
the City of Maumelle, Arkansas, and that the Sections ofthis ordinance may be renumbered, re-
lettered and the word " Ordinance"
may
be changed to " Section", " Article" or such other word or
phrase in order to accomplish such intention.
SECTION3. Severability. Ifany clause, section or other part ofthis Ordinance shall be held by
any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or
invalid part shall be considered as eliminated and in no way effecting the validity of the other
provisions ofthis Ordinance.
SECTION4. Repealer. All other provisions of Chapter 58 of the Maumelle City Code remain
unamended hereby. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions
in conflict herewith, be and the same are hereby repealed to the extent of such conflict.

WHEREAS, the City Council is committed to the safety and peace ofthe City of
Maumelle; and
WHEREAS, the Maumelle City Code provisions allow for the discharge of
fireworks on certain dates and provide for certain penalties for discharge on other dates;
and
WHEREAS, the City Council wishes to amend the penalty provision to increase
the possible fine for a violation of the ordinance.
NOW, THEREFORE, BEITORDAINEDBYTHECITYCOUNCILOFTHE
CITYOFMAUMELLE, ARKANSAS, THAT:
SECTION1. The Maumelle City Code, Chapter 26 FIREPREVENTIONAND
PROTECTION, Article III. Fireworks, Section 26- 72, Penalty for Violation ofArticle, is
hereby amended to read as follows:
Sec. 26- 72. Penalty for violation of article.
Any violator of this article shall be guilty of a misdemeanor and upon conviction, the
