I, Christopher-Earl :Strunk in esse, declare under penalty of perjury with 28 USC 1746 as

follows:

1. I am the Plaintiff, in the above-captioned action, am filly aware of the facts stated herein,

'and make this declaration in support of the Plaintiffs application for entry of a default by the

Clerk of the Court against Defendants the State of Maryland by its Governor Martin

O'Malley and the State of Hawaii by its Governor Linda Lingle.

2. The Complaint in this action was filed on July 13,2009. and a summons was issued to each

on the same date.

3. A copy of the Summons and Complaint was served on Defendant Defendants the State of

Maryland by its Governor Martin O'Malley on July 27,2009, by service of a copy of the

Summons and Complaint on the Governor Martin O'Malley at Room 3 11 450 Capitol

Avenue North Washington District of Columbia, a copy of the service filed see Exhibit A.

4. A copy of the Summons and Complaint was served on Defendant the State of Hawaii by its

Governor Linda Lingle on July 27,2009, by alternate service of a copy of the Summons and

Honolulu Hawaii 968 13 (see Exhibit B) whose agent on July 30,2009 there accepted service

proven by the signature of the Governor's agent on the return receipt, a copy see Exhibit C.

5. A copy of the Proof of Service was filed on July 27,2009, showing that all answer or motion

was due on August 17,2009 as to Defendant State of Maryland and by August 30,2009 as to

service by certified mail, and that either of the defendants made no answer or motion at any

time fiom service of process upon them to the present.

6. Accordingly, the Plaintiff requests that the Clerk of the Court enter a default as to each of

Defendants the State of ~ a r ~ l a by
