Condominium residents who have not been provided with the deeds as the property

developers failed to obtain Certificate of Conformity (COC) approval for the buildings
will soon be granted a relief, senior Condominium Management Authority (CMA)
officical said.
Chairman of the CMA Kapila amage told the !unday "imes an amendment
will be introduced so that building developers can get #special approval$ for their
pro%ects.
"he move by the Ministry of Construction, &ngineering !ervices, 'ousing and Common
Amenities follows after a series of cases where building developers could not obtain COC
for the construction.
#(hen we get a compalint from residents, we call both parties and try to settle the issues.
)f they are pressuring us, then we have to call for a special in*uiry. (e have panel of
in*uiry officers, this can be regarded as a %udicial process.$ he said.
'e said some of the developers have not constructed the building according to the
original approved building plan and therefore not been able to obtain the COC.
#As a result deeds cannot be provided. +nder the proposed amendment the developer
should apply for the registration of the property within two years from the date of the
coming in to the operation. "his will be valid for constructions made prior to ,ecember
-., /001.$ he added.
'e e2plained that the owner should inform the general manager of the CMA in writing
about any other unauthorised constructions or modifications made to the property which
did not e2ist in the approved building plan. "he eneral manager will ta3e apprpriate
actions in respect of the unauthorised building with CMA law.
"he general manager will issue a certificate specified mentioning that having been
satisfied of the availability of the building plan as it certified by a surveyor. "here after
the M will issue a #special condominium certificate$certifying that this is the according
to the condominium laws and there after they can prepared the declartion deeds, he
e2plained.
#(e don4t have any responsibility of mainteneance, we functions as a regulating
authority$ he said regarding the internal problems evolving in the apartments.
Commenting on what 3ind of complaints the CMA has been receiving, he said they
accept all complaints which are releavant to common condominium facilities.
Meanwhile 5esidents of !eagulls residencies which is located in !t Anthony4s Mawatha,
Colombo - have complained to the CMA and +,A that they have paid for the
apartments with the assurance that the deeds would follow within a period of si2 months.
"hey claimed the developer has not received the COC as he had submitted plan to the
Municipalty which vastly different from the construction itself. As a result they have not
received the deeds still now.
)n this letter !eagull 5esidencies management committee claims since the building has
not been handed over to the apartment dwellers the developer has to maintain the
building and he refused todo so. 6ow the apartment is in a poor maintenance state.
"hey pointed out even after many complaints made to the CMA and +,A officials there
was no action ta3en place to solve their problems.
Kirubananthan, the lowner of the seagulls developers responding to allegations said since
some of the residents of the condominium have not paid the maintenanace fee to the
company, they cannot ta3ecare of the maintenance.
5egarding the deeds issue he said that it will be possible to solve the issue within ne2t
couple of months with the support of CMA.
