Preamble
WETHEPEOPLESOFTHEUNITED
NATIONSDETERMINED
tosavesucceedinggenerationsfromthescourgeofwar,
whichtwiceinourlifetimehasbroughtuntoldsorrowto
mankind,and
toreaffirmfaithinfundamentalhumanrights,inthe
dignityandworthofthehumanperson,intheequalrights
ofmenandwomenandofnationslargeandsmall,and
toestablishconditionsunderwhichjusticeandrespectfor
theobligationsarisingfromtreatiesandothersourcesof
internationallawcanbemaintained,and
topromotesocialprogressandbetterstandardsoflifein
largerfreedom,
ANDFORTHESEENDS
topracticetoleranceandlivetogetherinpeacewithoneanotheras
goodneighbors,and
touniteourstrengthtomaintaininternationalpeaceandsecurity,and
toensurebytheacceptanceofprinciplesandtheinstitutionofmethods,
thatarmedforceshallnotbeused,saveinthecommoninterest,and
toemployinternationalmachineryforthepromotionoftheeconomic
andsocialadvancementofallpeoples,

HAVERESOLVEDTOCOMBINEOUREFFORTSTO
ACCOMPLISHTHESEAIMS
Accordingly,ourrespectiveGovernments,throughrepresentatives
assembledinthecityofSanFrancisco,whohaveexhibitedtheirfull
powersfoundtobeingoodanddueform,haveagreedtothepresent
CharteroftheUnitedNationsanddoherebyestablishaninternational
organizationtobeknownastheUnitedNations.

CHAPTERI
PURPOSESANDPRINCIPLES
Article1
ThePurposesoftheUnitedNationsare:
1.Tomaintaininternationalpeaceandsecurity,andtothatend:totake
effectivecollectivemeasuresforthepreventionandremovalofthreatsto
thepeace,andforthesuppressionofactsofaggressionorother
breachesofthepeace,andtobringaboutbypeacefulmeans,andin
conformitywiththeprinciplesofjusticeandinternationallaw,adjustment
orsettlementofinternationaldisputesorsituationswhichmightleadtoa
breachofthepeace
2.Todevelopfriendlyrelationsamongnationsbasedonrespectforthe
principleofequalrightsandselfdeterminationofpeoples,andtotake
otherappropriatemeasurestostrengthenuniversalpeace
3.Toachieveinternationalcooperationinsolvinginternationalproblems
ofaneconomic,social,cultural,orhumanitariancharacter,andin
promotingandencouragingrespectforhumanrightsandforfundamental
freedomsforallwithoutdistinctionastorace,sex,language,orreligion
and
4.Tobeacenterforharmonizingtheactionsofnationsintheattainment
ofthesecommonends.
Article2
TheOrganizationanditsMembers,inpursuitofthePurposesstatedin
Article1,shallactinaccordancewiththefollowingPrinciples.
1.TheOrganizationisbasedontheprincipleofthesovereignequalityof
allitsMembers.
2.AllMembers,inordertoensuretoallofthemtherightsandbenefits
resultingfrommembership,shallfulfillingoodfaiththeobligations
assumedbytheminaccordancewiththepresentCharter.
3.AllMembersshallsettletheirinternationaldisputesbypeacefulmeans
insuchamannerthatinternationalpeaceandsecurity,andjustice,are
notendangered.

4.AllMembersshallrefrainintheirinternationalrelationsfromthethreat
oruseofforceagainsttheterritorialintegrityorpoliticalindependenceof
anystate,orinanyothermannerinconsistentwiththePurposesofthe
UnitedNations.
5.AllMembersshallgivetheUnitedNationseveryassistanceinany
actionittakesinaccordancewiththepresentCharter,andshallrefrain
fromgivingassistancetoanystateagainstwhichtheUnitedNationsis
takingpreventiveorenforcementaction.
6.TheOrganizationshallensurethatstateswhicharenotMembersof
theUnitedNationsactinaccordancewiththesePrinciplessofarasmay
benecessaryforthemaintenanceofinternationalpeaceandsecurity.
7.NothingcontainedinthepresentChartershallauthorizetheUnited
Nationstointerveneinmatterswhichareessentiallywithinthedomestic
jurisdictionofanystateorshallrequiretheMemberstosubmitsuch
matterstosettlementunderthepresentCharterbutthisprincipleshall
notprejudicetheapplicationofenforcementmeasuresunderChapter
VII.

CHAPTERII
MEMBERSHIP
Article3
TheoriginalMembersoftheUnitedNationsshallbethestateswhich,
havingparticipatedintheUnitedNationsConferenceonInternational
OrganizationatSanFrancisco,orhavingpreviouslysignedthe
DeclarationbyUnitedNationsofJanuary1,1942,signthepresent
CharterandratifyitinaccordancewithArticle110.
Article4
1.MembershipintheUnitedNationsisopentoallotherpeaceloving
stateswhichaccepttheobligationscontainedinthepresentCharterand,
inthejudgmentoftheOrganization,areableandwillingtocarryout
theseobligations.
2.TheadmissionofanysuchstatetomembershipintheUnitedNations
willbeeffectedbyadecisionoftheGeneralAssemblyuponthe
recommendationoftheSecurityCouncil.
Article5
AmemberoftheUnitedNationsagainstwhichpreventiveor
enforcementactionhasbeentakenbytheSecurityCouncilmaybe
suspendedfromtheexerciseoftherightsandprivilegesofmembership
bytheGeneralAssemblyupontherecommendationoftheSecurity
Council.Theexerciseoftheserightsandprivilegesmayberestoredby
theSecurityCouncil.

Article6
AMemberoftheUnitedNationswhichhaspersistentlyviolatedthe
PrinciplescontainedinthepresentChartermaybeexpelledfromthe
OrganizationbytheGeneralAssemblyupontherecommendationofthe
SecurityCouncil.

CHAPTERIII
ORGANS
1.ThereareestablishedastheprincipalorgansoftheUnitedNations:a
GeneralAssembly,aSecurityCouncil,anEconomicandSocialCouncil,
aTrusteeshipCouncil,anInternationalCourtofJustice,anda
Secretariat.
2.Suchsubsidiaryorgansasmaybefoundnecessarymaybe
establishedinaccordancewiththepresentCharter.
Article8
TheUnitedNationsshallplacenorestrictionsontheeligibilityofmen
andwomentoparticipateinanycapacityandunderconditionsof
equalityinitsprincipalandsubsidiaryorgans.

CHAPTERIV
THEGENERALASSEMBLY
Article9
Composition

1.TheGeneralAssemblyshallconsistofalltheMembersoftheUnited
Nations.
2.Eachmembershallhavenotmorethanfiverepresentativesinthe
GeneralAssembly.

FunctionsandPowers
Article10
TheGeneralAssemblymaydiscussanyquestionsoranymatterswithin
thescopeofthepresentCharterorrelatingtothepowersandfunctions
ofanyorgansprovidedforinthepresentCharter,and,exceptas
providedinArticle12,maymakerecommendationstotheMembersof
theUnitedNationsortotheSecurityCouncilortobothonanysuch
questionsormatters.
Article11
1.TheGeneralAssemblymayconsiderthegeneralprinciplesof
cooperationinthemaintenanceofinternationalpeaceandsecurity,
includingtheprinciplesgoverningdisarmamentandtheregulationof

armaments,andmaymakerecommendationswithregardtosuch
principlestotheMembersortotheSecurityCouncilortoboth.
2.TheGeneralAssemblymaydiscussanyquestionsrelatingtothe
maintenanceofinternationalpeaceandsecuritybroughtbeforeitbyany
MemberoftheUnitedNations,orbytheSecurityCouncil,orbyastate
whichisnotaMemberoftheUnitedNationsinaccordancewithArticle
35,paragraph2,and,exceptasprovidedinArticle12,maymake
recommendationswithregardtoanysuchquestionstothestateorstates
concernedortotheSecurityCouncilortoboth.Anysuchquestionon
whichactionisnecessaryshallbereferredtotheSecurityCouncilbythe
GeneralAssemblyeitherbeforeorafterdiscussion.
3.TheGeneralAssemblymaycalltheattentionoftheSecurityCouncil
tosituationswhicharelikelytoendangerinternationalpeaceand
security.
4.ThepowersoftheGeneralAssemblysetforthinthisArticleshallnot
limitthegeneralscopeofArticle10.
Article12
1.WhiletheSecurityCouncilisexercisinginrespectofanydisputeor
situationthefunctionsassignedtoitinthepresentCharter,theGeneral
Assemblyshallnotmakeanyrecommendationwithregardtothat
disputeorsituationunlesstheSecurityCouncilsorequests.
2.TheSecretaryGeneral,withtheconsentoftheSecurityCouncil,shall
notifytheGeneralAssemblyateachsessionofanymattersrelativeto
themaintenanceofinternationalpeaceandsecuritywhicharebeingdealt
withbytheSecurityCouncilandshallsimilarlynotifytheGeneral
Assembly,ortheMembersoftheUnitedNationsiftheGeneral
Assemblyisnotinsession,immediatelytheSecurityCouncilceasesto
dealwithsuchmatters.
Article13
1.TheGeneralAssemblyshallinitiatestudiesandmake
recommendationsforthepurposeof:
a.promotinginternationalcooperationinthepoliticalfieldand
encouragingtheprogressivedevelopmentofinternationallawandits
codification
b.promotinginternationalcooperationintheeconomic,social,cultural,
educational,andhealthfields,andassistingintherealizationofhuman
rightsandfundamentalfreedomsforallwithoutdistinctionastorace,
sex,language,orreligion.
2.Thefurtherresponsibilities,functionsandpowersoftheGeneral
Assemblywithrespecttomattersmentionedinparagraph1(b)above
aresetforthinChaptersIXandX.

Article14
SubjecttotheprovisionsofArticle12,theGeneralAssemblymay
recommendmeasuresforthepeacefuladjustmentofanysituation,
regardlessoforigin,whichitdeemslikelytoimpairthegeneralwelfare
orfriendlyrelationsamongnations,includingsituationsresultingfroma
violationoftheprovisionsofthepresentChartersettingforththe
PurposesandPrinciplesoftheUnitedNations.
Article15
1.TheGeneralAssemblyshallreceiveandconsiderannualandspecial
reportsfromtheSecurityCouncilthesereportsshallincludeanaccount
ofthemeasuresthattheSecurityCouncilhasdecideduponortakento
maintaininternationalpeaceandsecurity.
2.TheGeneralAssemblyshallreceiveandconsiderreportsfromthe
otherorgansoftheUnitedNations.
Article16
TheGeneralAssemblyshallperformsuchfunctionswithrespecttothe
internationaltrusteeshipsystemasareassignedtoitunderChaptersXII
andXIII,includingtheapprovalofthetrusteeshipagreementsforareas
notdesignatedasstrategic.
Article17
1.TheGeneralAssemblyshallconsiderandapprovethebudgetofthe
Organization.
2.TheexpensesoftheOrganizationshallbebornebytheMembersas
apportionedbytheGeneralAssembly.
3.TheGeneralAssemblyshallconsiderandapproveanyfinancialand
budgetaryarrangementswithspecializedagenciesreferredtoinArticle
57andshallexaminetheadministrativebudgetsofsuchspecialized
agencieswithaviewtomakingrecommendationstotheagencies
concerned.

Voting
Article18
1.EachmemberoftheGeneralAssemblyshallhaveonevote.
2.DecisionsoftheGeneralAssemblyonimportantquestionsshallbe
madebyatwothirdsmajorityofthememberspresentandvoting.
Thesequestionsshallinclude:recommendationswithrespecttothe
maintenanceofinternationalpeaceandsecurity,theelectionofthe
nonpermanentmembersoftheSecurityCouncil,theelectionofthe
membersoftheEconomicandSocialCouncil,theelectionofmembers
oftheTrusteeshipCouncilinaccordancewithparagraph1(c)ofArticle
86,theadmissionofnewMemberstotheUnitedNations,the

suspensionoftherightsandprivilegesofmembership,theexpulsionof
Members,questionsrelatingtotheoperationofthetrusteeshipsystem,
andbudgetaryquestions.
3.Decisionsonotherquestions,Compositionincludingthe
determinationofadditionalcategoriesofquestionstobedecidedbya
twothirdsmajority,shallbemadebyamajorityofthememberspresent
andvoting.
Article19
AMemberoftheUnitedNationswhichisinarrearsinthepaymentof
itsfinancialcontributionstotheOrganizationshallhavenovoteinthe
GeneralAssemblyiftheamountofitsarrearsequalsorexceedsthe
amountofthecontributionsduefromitfortheprecedingtwofullyears.
TheGeneralAssemblymay,nevertheless,permitsuchaMemberto
voteifitissatisfiedthatthefailuretopayisduetoconditionsbeyondthe
controloftheMember.

Procedure
Article20
TheGeneralAssemblyshallmeetinregularannualsessionsandinsuch
specialsessionsasoccasionmayrequire.Specialsessionsshallbe
convokedbytheSecretaryGeneralattherequestoftheSecurity
CouncilorofamajorityoftheMembersoftheUnitedNations.
Article21
TheGeneralAssemblyshalladoptitsownrulesofprocedure.Itshall
electitsPresidentforeachsession.
Article22
TheGeneralAssemblymayestablishsuchsubsidiaryorgansasitdeems
necessaryfortheperformanceofitsfunctions.

CHAPTERV
THESECURITYCOUNCIL
Article23
1.TheSecurityCouncilshallconsistoffifteenMembersoftheUnited
Nations.TheRepublicofChina,France,theUnionofSovietSocialist
Republics,theUnitedKingdomofGreatBritainandNorthernIreland,
andtheUnitedStatesofAmericashallbepermanentmembersofthe
SecurityCouncil.TheGeneralAssemblyshallelecttenotherMembers
oftheUnitedNationstobenonpermanentmembersoftheSecurity
Council,dueregardbeingspeciallypaid,inthefirstinstancetothe
contributionofMembersoftheUnitedNationstothemaintenanceof

internationalpeaceandsecurityandtotheotherpurposesofthe
Organization,andalsotoequitablegeographicaldistribution.
ThenonpermanentmembersoftheSecurityCouncilshallbeelectedfor
atermoftwoyears.Inthefirstelectionofthenonpermanentmembers
aftertheincreaseofthemembershipoftheSecurityCouncilfromeleven
tofifteen,twoofthefouradditionalmembersshallbechosenforaterm
ofoneyear.Aretiringmembershallnotbeeligibleforimmediate
reelection.
EachmemberoftheSecurityCouncilshallhaveonerepresentative.

FunctionsandPowers
Article24
1.InordertoensurepromptandeffectiveactionbytheUnitedNations,
itsMembersconferontheSecurityCouncilprimaryresponsibilityfor
themaintenanceofinternationalpeaceandsecurity,andagreethatin
carryingoutitsdutiesunderthisresponsibilitytheSecurityCouncilacts
ontheirbehalf.
2.IndischargingthesedutiestheSecurityCouncilshallactin
accordancewiththePurposesandPrinciplesoftheUnitedNations.The
specificpowersgrantedtotheSecurityCouncilforthedischargeof
thesedutiesarelaiddowninChaptersVI,VII,VIII,andXII.
3.TheSecurityCouncilshallsubmitannualand,whennecessary,special
reportstotheGeneralAssemblyforitsconsideration.
Article25
TheMembersoftheUnitedNationsagreetoacceptandcarryoutthe
decisionsoftheSecurityCouncilinaccordancewiththepresent
Charter.
Article26
Inordertopromotetheestablishmentandmaintenanceofinternational
peaceandsecuritywiththeleastdiversionforarmamentsoftheworld's
humanandeconomicresources,theSecurityCouncilshallbe
responsibleforformulating,withtheassistanceoftheMilitaryStaff
CommitteereferredtoinArticle47,planstobesubmittedtothe
MembersoftheUnitedNationsfortheestablishmentofasystemforthe
regulationofarmaments.

Voting
Article27
1.EachmemberoftheSecurityCouncilshallhaveonevote.
2.DecisionsoftheSecurityCouncilonproceduralmattersshallbe
madebyanaffirmativevoteofninemembers.

3.DecisionsoftheSecurityCouncilonallothermattersshallbemade
byanaffirmativevoteofninemembersincludingtheconcurringvotesof
thepermanentmembersprovidedthat,indecisionsunderChapterVI,
andunderparagraph3ofArticle52,apartytoadisputeshallabstain
fromvoting.

Procedure
Article28
1.TheSecurityCouncilshallbesoorganizedastobeabletofunction
continuously.EachmemberoftheSecurityCouncilshallforthispurpose
berepresentedatalltimesattheseatoftheOrganization.
2.TheSecurityCouncilshallholdperiodicmeetingsatwhicheachofits
membersmay,ifitsodesires,berepresentedbyamemberofthe
governmentorbysomeotherspeciallydesignatedrepresentative.
3.TheSecurityCouncilmayholdmeetingsatsuchplacesotherthanthe
seatoftheOrganizationasinitsjudgmentwillbestfacilitateitswork.
Article29
TheSecurityCouncilmayestablishsuchsubsidiaryorgansasitdeems
necessaryfortheperformanceofitsfunctions.
Article30
TheSecurityCouncilshalladoptitsownrulesofprocedure,including
themethodofselectingitsPresident.
Article31
AnyMemberoftheUnitedNationswhichisnotamemberofthe
SecurityCouncilmayparticipate,withoutvote,inthediscussionofany
questionbroughtbeforetheSecurityCouncilwheneverthelatter
considersthattheinterestsofthatMemberarespeciallyaffected.
Article32
AnyMemberoftheUnitedNationswhichisnotamemberofthe
SecurityCounciloranystatewhichisnotaMemberoftheUnited
Nations,ifitisapartytoadisputeunderconsiderationbytheSecurity
Council,shallbeinvitedtoparticipate,withoutvote,inthediscussion
relatingtothedispute.TheSecurityCouncilshalllaydownsuch
conditionsasitdeemsjustfortheparticipationofastatewhichisnota
MemberoftheUnitedNations.

CHAPTERVI
PACIFICSETTLEMENTOFDISPUTES
Article33
1.Thepartiestoanydispute,thecontinuanceofwhichislikelyto
endangerthemaintenanceofinternationalpeaceandsecurity,shall,first
ofall,seekasolutionbynegotiation,enquiry,mediation,conciliation,
arbitration,judicialsettlement,resorttoregionalagenciesor
arrangements,orotherpeacefulmeansoftheirownchoice.
2.TheSecurityCouncilshall,whenitdeemsnecessary,calluponthe
partiestosettletheirdisputebysuchmeans.
Article34
TheSecurityCouncilmayinvestigateanydispute,oranysituationwhich
mightleadtointernationalfrictionorgiverisetoadispute,inorderto
determinewhetherthecontinuanceofthedisputeorsituationislikelyto
endangerthemaintenanceofinternationalpeaceandsecurity.
Article35
1.AnyMemberoftheUnitedNationsmaybringanydispute,orany
situationofthenaturereferredtoinArticle34,totheattentionofthe
SecurityCounciloroftheGeneralAssembly.
2.AstatewhichisnotaMemberoftheUnitedNationsmaybringtothe
attentionoftheSecurityCounciloroftheGeneralAssemblyanydispute
towhichitisapartyifitacceptsinadvance,forthepurposesofthe
dispute,theobligationsofpacificsettlementprovidedinthepresent
Charter.
3.TheproceedingsoftheGeneralAssemblyinrespectofmatters
broughttoitsattentionunderthisArticlewillbesubjecttotheprovisions
ofArticles11and12.
Article36
1.TheSecurityCouncilmay,atanystageofadisputeofthenature
referredtoinArticle33orofasituationoflikenature,recommend
appropriateproceduresormethodsofadjustment.
2.TheSecurityCouncilshouldtakeintoconsiderationanyprocedures
forthesettlementofthedisputewhichhavealreadybeenadoptedbythe
parties.
3.InmakingrecommendationsunderthisArticletheSecurityCouncil
shouldalsotakeintoconsiderationthatlegaldisputesshouldasageneral
rulebereferredbythepartiestotheInternationalCourtofJusticein
accordancewiththeprovisionsoftheStatuteoftheCourt.

Article37
1.ShouldthepartiestoadisputeofthenaturereferredtoinArticle33
failtosettleitbythemeansindicatedinthatArticle,theyshallreferitto
theSecurityCouncil.
2.IftheSecurityCouncildeemsthatthecontinuanceofthedisputeisin
factlikelytoendangerthemaintenanceofinternationalpeaceand
security,itshalldecidewhethertotakeactionunderArticle36orto
recommendsuchtermsofsettlementasitmayconsiderappropriate.
Article38
WithoutprejudicetotheprovisionsofArticles33to37,theSecurity
Councilmay,ifallthepartiestoanydisputesorequest,make
recommendationstothepartieswithaviewtoapacificsettlementofthe
dispute.

CHAPTERVII
ACTIONWITHRESPECTTOTHREATSTOTHEPEACE,
BREACHESOFTHEPEACE,ANDACTSOF
AGGRESSION
Article39
TheSecurityCouncilshalldeterminetheexistenceofanythreattothe
peace,breachofthepeace,oractofaggressionandshallmake
recommendations,ordecidewhatmeasuresshallbetakenin
accordancewithArticles41and42,tomaintainorrestoreinternational
peaceandsecurity.
Article40
Inordertopreventanaggravationofthesituation,theSecurityCouncil
may,beforemakingtherecommendationsordecidinguponthe
measuresprovidedforinArticle39,calluponthepartiesconcernedto
complywithsuchprovisionalmeasuresasitdeemsnecessaryor
desirable.Suchprovisionalmeasuresshallbewithoutprejudicetothe
rights,claims,orpositionofthepartiesconcerned.TheSecurityCouncil
shalldulytakeaccountoffailuretocomplywithsuchprovisional
measures.
Article41
TheSecurityCouncilmaydecidewhatmeasuresnotinvolvingtheuseof
armedforcearetobeemployedtogiveeffecttoitsdecisions,andit
maycallupontheMembersoftheUnitedNationstoapplysuch
measures.Thesemayincludecompleteorpartialinterruptionof
economicrelationsandofrail,sea,air,postal,telegraphic,radio,and

othermeansofcommunication,andtheseveranceofdiplomatic
relations.
Article42
ShouldtheSecurityCouncilconsiderthatmeasuresprovidedforin
Article41wouldbeinadequateorhaveprovedtobeinadequate,itmay
takesuchactionbyair,sea,orlandforcesasmaybenecessaryto
maintainorrestoreinternationalpeaceandsecurity.Suchactionmay
includedemonstrations,blockade,andotheroperationsbyair,sea,or
landforcesofMembersoftheUnitedNations.
Article43
1.AllMembersoftheUnitedNations,inordertocontributetothe
maintenanceofinternationalpeaceandsecurity,undertaketomake
availabletotheSecurityCouncil,onitscallandinaccordancewitha
specialagreementoragreements,armedforces,assistance,and
facilities,includingrightsofpassage,necessaryforthepurposeof
maintaininginternationalpeaceandsecurity.
2.Suchagreementoragreementsshallgovernthenumbersandtypesof
forces.theirdegreeofreadinessandgenerallocation,andthenatureof
thefacilitiesandassistancetobeprovided.
3.Theagreementoragreementsshallbenegotiatedassoonaspossible
ontheinitiativeoftheSecurityCouncil.Theyshallbeconcluded
betweentheSecurityCouncilandMembersorbetweentheSecurity
CouncilandgroupsofMembersandshallbesubjecttoratificationby
thesignatorystatesinaccordancewiththeirrespectiveconstitutional
processes.
Article44
WhentheSecurityCouncilhasdecidedtouseforceitshall,before
callinguponaMembernotrepresentedonittoprovidearmedforcesin
fulfillmentoftheobligationsassumedunderArticle43,invitethat
Member,iftheMembersodesires,toparticipateinthedecisionsofthe
SecurityCouncilconcerningtheemploymentofcontingentsofthat
Member'sarmedforces.
Article45
InordertoenabletheUnitedNationstotakeurgentmilitarymeasures
Membersshallholdimmediatelyavailablenationalairforcecontingents
forcombinedinternationalenforcementaction.Thestrengthanddegree
ofreadinessofthesecontingentsandplansfortheircombinedaction
shallbedetermined,withinthelimitslaiddowninthespecialagreement
oragreementsreferredtoinArticle43,bytheSecurityCouncilwiththe
assistanceoftheMilitaryStaffCommittee.

Article46
PlansfortheapplicationofarmedforceshallbemadebytheSecurity
CouncilwiththeassistanceoftheMilitaryStaffCommittee.
Article47
1.ThereshallbeestablishedaMilitaryStaffCommitteetoadviseand
assisttheSecurityCouncilonallquestionsrelatingtotheSecurity
Council'smilitaryrequirementsforthemaintenanceofinternational

CommitteeshallbeinvitedbytheCommitteetobeassociatedwithit
whentheefficientdischargeoftheCommittee'sresponsibilitiesrequires
theparticipationofthatMemberinitswork.
3.TheMilitaryStaffCommitteeshallberesponsibleundertheSecurity
Councilforthestrategicdirectionofanyarmedforcesplacedatthe
disposaloftheSecurityCouncil.Questionsrelatingtothecommandof
suchforcesshallbeworkedoutsubsequently.
4.TheMilitaryStaffCommittee,withtheauthorizationoftheSecurity
Councilandafterconsultationwithappropriateregionalagencies,may
establishregionalsubcommittees.
Article48
1.TheactionrequiredtocarryoutthedecisionsoftheSecurityCouncil
forthemaintenanceofinternationalpeaceandsecurityshallbetakenby
alltheMembersoftheUnitedNationsorbysomeofthem,asthe
SecurityCouncilmaydetermine.
2.SuchdecisionsshallbecarriedoutbytheMembersoftheUnited
Nationsdirectlyandthroughtheiractionintheappropriateinternational
agenciesofwhichtheyaremembers.
Article49
TheMembersoftheUnitedNationsshalljoininaffordingmutual
assistanceincarryingoutthemeasuresdecideduponbytheSecurity
Council.
Article50
Ifpreventiveorenforcementmeasuresagainstanystatearetakenbythe
SecurityCouncil,anyotherstate,whetheraMemberoftheUnited
Nationsornot,whichfindsitselfconfrontedwithspecialeconomic
problemsarisingfromthecarryingoutofthosemeasuresshallhavethe

righttoconsulttheSecurityCouncilwithregardtoasolutionofthose
problems.
Article51
NothinginthepresentChartershallimpairtheinherentrightofindividual
orcollectiveselfdefenseifanarmedattackoccursagainstaMemberof
theUnitedNations,untiltheSecurityCouncilhastakenmeasures
necessarytomaintaininternationalpeaceandsecurity.Measurestaken
byMembersintheexerciseofthisrightofselfdefenseshallbe
immediatelyreportedtotheSecurityCouncilandshallnotinanyway
affecttheauthorityandresponsibilityoftheSecurityCouncilunderthe
presentChartertotakeatanytimesuchactionasitdeemsnecessaryin
ordertomaintainorrestoreinternationalpeaceandsecurity.

CHAPTERVIII
REGIONALARRANGEMENTS
Article52
1.NothinginthepresentCharterprecludestheexistenceofregional
arrangementsoragenciesfordealingwithsuchmattersrelatingtothe
maintenanceofinternationalpeaceandsecurityasareappropriatefor
regionalaction,providedthatsucharrangementsoragenciesandtheir
activitiesareconsistentwiththePurposesandPrinciplesoftheUnited
Nations.
2.TheMembersoftheUnitedNationsenteringintosucharrangements
orconstitutingsuchagenciesshallmakeeveryefforttoachievepacific
settlementoflocaldisputesthroughsuchregionalarrangementsorby
suchregionalagenciesbeforereferringthemtotheSecurityCouncil.
3.TheSecurityCouncilshallencouragethedevelopmentofpacific
settlementoflocaldisputesthroughsuchregionalarrangementsorby
suchregionalagencieseitherontheinitiativeofthestatesconcernedor
byreferencefromtheSecurityCouncil.
4.ThisArticleinnowayimpairstheapplicationofArticles34and35.
Article53
1.TheSecurityCouncilshall,whereappropriate,utilizesuchregional
arrangementsoragenciesforenforcementactionunderitsauthority.But
noenforcementactionshallbetakenunderregionalarrangementsorby
regionalagencieswithouttheauthorizationoftheSecurityCouncil,with
theexceptionofmeasuresagainstanyenemystate,asdefinedin
paragraph2ofthisArticle,providedforpursuanttoArticle107orin
regionalarrangementsdirectedagainstrenewalofaggressivepolicyon
thepartofanysuchstate,untilsuchtimeastheOrganizationmay,on

requestoftheGovernmentsconcerned,bechargedwiththe
responsibilityforpreventingfurtheraggressionbysuchastate.
2.Thetermenemystateasusedinparagraph1ofthisArticleappliesto
anystatewhichduringtheSecondWorldWarhasbeenanenemyof
anysignatoryofthepresentCharter.

TheSecurityCouncilshallatalltimesbekeptfullyinformedofactivities
undertakenorincontemplationunderregionalarrangementsorby
regionalagenciesforthemaintenanceofinternationalpeaceandsecurity.

1.TheEconomicandSocialCouncilshallconsistoffiftyfourMembers
oftheUnitedNationselectedbytheGeneralAssembly.
2.Subjecttotheprovisionsofparagraph3,eighteenmembersofthe
EconomicandSocialCouncilshallbeelectedeachyearforatermof
threeyears.Aretiringmembershallbeeligibleforimmediatereelection.
3.Atthefirstelectionaftertheincreaseinthemembershipofthe
EconomicandSocialCouncilfromtwentyseventofiftyfourmembers,
inadditiontothememberselectedinplaceoftheninememberswhose

reportswithrespecttointernationaleconomic,social,cultural,
educational,health,andrelatedmattersandmaymake
recommendationswithrespecttoanysuchmatterstotheGeneral

Assembly,totheMembersoftheUnitedNations,andtothespecialized
agenciesconcerned.
2.Itmaymakerecommendationsforthepurposeofpromotingrespect
for,andobservanceof,humanrightsandfundamentalfreedomsforall.
3.ItmaypreparedraftconventionsforsubmissiontotheGeneral
Assembly,withrespecttomattersfallingwithinitscompetence.
4.Itmaycall,inaccordancewiththerulesprescribedbytheUnited

1.TheEconomicandSocialCouncilmayenterintoagreementswithany

1.TheEconomicandSocialCouncilmaytakeappropriatestepsto
obtainregularreportsfromthespecializedagencies.Itmaymake
arrangementswiththeMembersoftheUnitedNationsandwiththe
specializedagenciestoobtainreportsonthestepstakentogiveeffectto
itsownrecommendationsandtorecommendationsonmattersfalling
withinitscompetencemadebytheGeneralAssembly.
2.ItmaycommunicateitsobservationsonthesereportstotheGeneral
Assembly.

TheEconomicandSocialCouncilmayfurnishinformationtothe
SecurityCouncilandshallassisttheSecurityCounciluponitsrequest.

1.TheEconomicandSocialCouncilshallperformsuchfunctionsasfall
withinitscompetenceinconnectionwiththecarryingoutofthe
recommendationsoftheGeneralAssembly.
2.Itmay,withtheapprovaloftheGeneralAssembly,performservices
attherequestofMembersoftheUnitedNationsandattherequestof
specializedagencies.

3.Itshallperformsuchotherfunctionsasarespecifiedelsewhereinthe

1.EachmemberoftheEconomicandSocialCouncilshallhaveone

TheEconomicandSocialCouncilshallsetupcommissionsineconomic
andsocialfieldsandforthepromotionofhumanrights,andsuchother
commissionsasmayberequiredfortheperformanceofitsfunctions.

TheEconomicandSocialCouncilshallinviteanyMemberoftheUnited
Nationstoparticipate,withoutvote,initsdeliberationsonanymatterof
particularconcerntothatMember.

TheEconomicandSocialCouncilmaymakearrangementsfor
representativesofthespecializedagenciestoparticipate,withoutvote,in
itsdeliberationsandinthoseofthecommissionsestablishedbyit,and
foritsrepresentativestoparticipateinthedeliberationsofthespecialized

TheEconomicandSocialCouncilmaymakesuitablearrangementsfor
consultationwithnongovernmentalorganizationswhichareconcerned

withinternationalorganizationsand,whereappropriate,withnational
organizationsafterconsultationwiththeMemberoftheUnitedNations

1.TheEconomicandSocialCouncilshalladoptitsownrulesof
procedure,includingthemethodofselectingitsPresident.
2.TheEconomicandSocialCouncilshallmeetasrequiredin
accordancewithitsrules,whichshallincludeprovisionfortheconvening
ofmeetingsontherequestofamajorityofitsmembers.

DECLARATIONREGARDINGNONSELFGOVERNING
TERRITORIES

MembersoftheUnitedNationswhichhaveorassumeresponsibilities
fortheadministrationofterritorieswhosepeopleshavenotyetattained
afullmeasureofselfgovernmentrecognizetheprinciplethatthe
interestsoftheinhabitantsoftheseterritoriesareparamount,andaccept
asasacredtrusttheobligationtopromotetotheutmost,withinthe
systemofinternationalpeaceandsecurityestablishedbythepresent
Charter,thewellbeingoftheinhabitantsoftheseterritories,and,tothis
end:
a.toensure,withduerespectforthecultureofthepeoplesconcerned,
theirpolitical,economic,social,andeducationaladvancement,theirjust
treatment,andtheirprotectionagainstabuses
b.todevelopselfgovernment,totakedueaccountofthepolitical
aspirationsofthepeoples,andtoassistthemintheprogressive
developmentoftheirfreepoliticalinstitutions,accordingtotheparticular

MembersoftheUnitedNationsalsoagreethattheirpolicyinrespectof
theterritoriestowhichthisChapterapplies,nolessthaninrespectof
theirmetropolitanareas,mustbebasedonthegeneralprincipleof
goodneighborliness,dueaccountbeingtakenoftheinterestsand
wellbeingoftherestoftheworld,insocial,economic,andcommercial
matters.

CHAPTERXII
INTERNATIONALTRUSTEESHIPSYSTEM
Article75
TheUnitedNationsshallestablishunderitsauthorityaninternational
trusteeshipsystemfortheadministrationandsupervisionofsuch
territoriesasmaybeplacedthereunderbysubsequentindividual
agreements.Theseterritoriesarehereinafterreferredtoastrust
territories.
Article76
Thebasicobjectivesofthetrusteeshipsystem,inaccordancewiththe
PurposesoftheUnitedNationslaiddowninArticle1ofthepresent
Charter,shallbe:
a.tofurtherinternationalpeaceandsecurity
b.topromotethepolitical,economic,social,andeducational
advancementoftheinhabitantsofthetrustterritories,andtheir
progressivedevelopmenttowardsselfgovernmentorindependenceas
maybeappropriatetotheparticularcircumstancesofeachterritoryand
itspeoplesandthefreelyexpressedwishesofthepeoplesconcerned,
andasmaybeprovidedbythetermsofeachtrusteeshipagreement
c.toencouragerespectforhumanrightsandforfundamentalfreedoms
forallwithoutdistinctionastorace,sex,language,orreligion,andto
encouragerecognitionoftheinterdependenceofthepeoplesofthe
worldand
d.toensureequaltreatmentinsocial,economic,andcommercial

1.Thetrusteeshipsystemshallapplytosuchterritoriesinthefollowing
categoriesasmaybeplacedthereunderbymeansoftrusteeship
agreements:
a.territoriesnowheldundermandate
b.territorieswhichmaybedetachedfromenemystatesasaresultofthe
SecondWorldWar,and
c.territoriesvoluntarilyplacedunderthesystembystatesresponsible
fortheiradministration.2.Itwillbeamatterforsubsequentagreement
astowhichterritoriesintheforegoingcategorieswillbebroughtunder
thetrusteeshipsystemanduponwhatterms.

Thetrusteeshipsystemshallnotapplytoterritorieswhichhavebecome
MembersoftheUnitedNations,relationshipamongwhichshallbe
basedonrespectfortheprincipleofsovereignequality.
Article79
Thetermsoftrusteeshipforeachterritorytobeplacedunderthe
trusteeshipsystem,includinganyalterationoramendment,shallbe
agreeduponbythestatesdirectlyconcerned,includingthemandatory
powerinthecaseofterritoriesheldundermandatebyaMemberofthe
UnitedNations,andshallbeapprovedasprovidedforinArticles83
and85.

1.Exceptasmaybeagreeduponinindividualtrusteeshipagreements,
madeunderArticles77,79,and81,placingeachterritoryunderthe
trusteeshipsystem,anduntilsuchagreementshavebeenconcluded,
nothinginthisChaptershallbeconstruedinorofitselftoalterinany
mannertherightswhatsoeverofanystatesoranypeoplesortheterms
ofexistinginternationalinstrumentstowhichMembersoftheUnited

Thetrusteeshipagreementshallineachcaseincludethetermsunder
whichthetrustterritorywillbeadministeredanddesignatetheauthority
whichwillexercisetheadministrationofthetrustterritory.Such
authority,hereinaftercalledtheadministeringauthority,maybeoneor
morestatesortheOrganizationitself.

Theremaybedesignated,inanytrusteeshipagreement,astrategicarea
orareaswhichmayincludepartorallofthetrustterritorytowhichthe
agreementapplies,withoutprejudicetoanyspecialagreementor
agreementsmadeunderArticle43.

1.AllfunctionsoftheUnitedNationsrelatingtostrategicareas,
includingtheapprovalofthetermsofthetrusteeshipagreementsandof
theiralterationoramendment,shallbeexercisedbytheSecurity
Council.

2.ThebasicobjectivessetforthinArticle76shallbeapplicabletothe
peopleofeachstrategicarea.
3.TheSecurityCouncilshall,subjecttotheprovisionsofthetrusteeship
agreementsandwithoutprejudicetosecurityconsiderations,availitself

1.AllMembersoftheUnitedNationsareipsofactopartiestothe

1.IntheperformanceoftheirdutiestheSecretaryGeneralandthestaff
shallnotseekorreceiveinstructionsfromanygovernmentorfromany
otherauthorityexternaltotheOrganization.Theyshallrefrainfromany
actionwhichmightreflectontheirpositionasinternationalofficials
responsibleonlytotheOrganization.
2.EachMemberoftheUnitedNationsundertakestorespectthe
exclusivelyinternationalcharacteroftheresponsibilitiesofthe
SecretaryGeneralandthestaffandnottoseektoinfluencetheminthe
dischargeoftheirresponsibilities.
Article101
1.ThestaffshallbeappointedbytheSecretaryGeneralunder
regulationsestablishedbytheGeneralAssembly.
2.AppropriatestaffsshallbepermanentlyassignedtotheEconomicand
SocialCouncil,theTrusteeshipCouncil,and,asrequired,toother
organsoftheUnitedNations.Thesestaffsshallformapartofthe
Secretariat.
3.Theparamountconsiderationintheemploymentofthestaffandinthe
determinationoftheconditionsofserviceshallbethenecessityof
securingthehigheststandardsofefficiency,competence,andintegrity.

Dueregardshallbepaidtotheimportanceofrecruitingthestaffonas
wideageographicalbasisaspossible.

CHAPTERXVI
MISCELLANEOUSPROVISIONS
Article102
1.Everytreatyandeveryinternationalagreemententeredintobyany
MemberoftheUnitedNationsafterthepresentChartercomesinto
forceshallassoonaspossibleberegisteredwiththeSecretariatand
publishedbyit.
2.Nopartytoanysuchtreatyorinternationalagreementwhichhasnot
beenregisteredinaccordancewiththeprovisionsofparagraphIofthis
Articlemayinvokethattreatyoragreementbeforeanyorganofthe
UnitedNations.
Article103
IntheeventofaconflictbetweentheobligationsoftheMembersofthe
UnitedNationsunderthepresentCharterandtheirobligationsunder
anyotherinternationalagreement,theirobligationsunderthepresent
Chartershallprevail.
Article104
TheOrganizationshallenjoyintheterritoryofeachofitsMemberssuch
legalcapacityasmaybenecessaryfortheexerciseofitsfunctionsand
thefulfillmentofitspurposes.
Article105
1.TheOrganizationshallenjoyintheterritoryofeachofitsMembers
suchprivilegesandimmunitiesasarenecessaryforthefulfillmentofits
purposes.
2.RepresentativesoftheMembersoftheUnitedNationsandofficialsof
theOrganizationshallsimilarlyenjoysuchprivilegesandimmunitiesas
arenecessaryfortheindependentexerciseoftheirfunctionsin
connectionwiththeOrganization.
3.TheGeneralAssemblymaymakerecommendationswithaviewto
determiningthedetailsoftheapplicationofparagraphs1and2ofthis
ArticleormayproposeconventionstotheMembersoftheUnited
Nationsforthispurpose.

CHAPTERXVII
TRANSITIONALSECURITYARRANGEMENTS
Article106
Pendingthecomingintoforceofsuchspecialagreementsreferredtoin
Article43asintheopinionoftheSecurityCouncilenableittobeginthe
exerciseofitsresponsibilitiesunderArticle42,thepartiestothe
FourNationDeclaration,signedatMoscowOctober30,1943,and
France,shall,inaccordancewiththeprovisionsofparagraph5ofthat
Declaration,consultwithoneanotherandasoccasionrequireswith
otherMembersoftheUnitedNationswithaviewtosuchjointactionon
behalfoftheOrganizationasmaybenecessaryforthepurposeof
maintaininginternationalpeaceandsecurity.
Article107
NothinginthepresentChartershallinvalidateorprecludeaction,in
relationtoanystatewhichduringtheSecondWorldWarhasbeenan
enemyofanysignatorytothepresentCharter,takenorauthorizedasa
resultofthatwarbytheGovernmentshavingresponsibilityforsuch
action.

CHAPTERXVIII
AMENDMENTS
Article108
AmendmentstothepresentChartershallcomeintoforceforall
MembersoftheUnitedNationswhentheyhavebeenadoptedbyavote
oftwothirdsofthemembersoftheGeneralAssemblyandratifiedin
accordancewiththeirrespectiveconstitutionalprocessesbytwothirds
oftheMembersoftheUnitedNations,includingallthepermanent
membersoftheSecurityCouncil.
Article109
1.AGeneralConferenceoftheMembersoftheUnitedNationsforthe
purposeofreviewingthepresentChartermaybeheldatadateand
placetobefixedbyatwothirdsvoteofthemembersoftheGeneral
AssemblyandbyavoteofanysevenmembersoftheSecurityCouncil.
EachMemberoftheUnitedNationsshallhaveonevoteinthe
conference.
2.AnyalterationofthepresentCharterrecommendedbyatwothirds
voteoftheconferenceshalltakeeffectwhenratifiedinaccordancewith
theirrespectiveconstitutionalprocessesbytwothirdsoftheMembers
oftheUnitedNationsincludingallthepermanentmembersofthe
SecurityCouncil.

3.Ifsuchaconferencehasnotbeenheldbeforethetenthannualsession
oftheGeneralAssemblyfollowingthecomingintoforceofthepresent
Charter,theproposaltocallsuchaconferenceshallbeplacedonthe
agendaofthatsessionoftheGeneralAssembly,andtheconference
shallbeheldifsodecidedbyamajorityvoteofthemembersofthe
GeneralAssemblyandbyavoteofanysevenmembersoftheSecurity
Council.

CHAPTERXIX
RATIFICATIONANDSIGNATURE
Article110
1.ThepresentChartershallberatifiedbythesignatorystatesin
accordancewiththeirrespectiveconstitutionalprocesses.
2.TheratificationsshallbedepositedwiththeGovernmentoftheUnited
StatesofAmerica,whichshallnotifyallthesignatorystatesofeach
depositaswellastheSecretaryGeneraloftheOrganizationwhenhe
hasbeenappointed.
3.ThepresentChartershallcomeintoforceuponthedepositof
ratificationsbytheRepublicofChina,France,theUnionofSoviet
SocialistRepublics,theUnitedKingdomofGreatBritainandNorthern
Ireland,andtheUnitedStatesofAmerica,andbyamajorityofthe
othersignatorystates.Aprotocoloftheratificationsdepositedshall
thereuponbedrawnupbytheGovernmentoftheUnitedStatesof
Americawhichshallcommunicatecopiesthereoftoallthesignatory
states.
4.ThestatessignatorytothepresentCharterwhichratifyitafterithas
comeintoforcewillbecomeoriginalMembersoftheUnitedNationson
thedateofthedepositoftheirrespectiveratifications.
Article111
ThepresentCharter,ofwhichtheChinese,French,Russian,English,
andSpanishtextsareequallyauthentic,shallremaindepositedinthe
archivesoftheGovernmentoftheUnitedStatesofAmerica.Duly
certifiedcopiesthereofshallbetransmittedbythatGovernmenttothe
Governmentsoftheothersignatorystates.
INFAITHWHEREOFtherepresentativesoftheGovernmentsofthe
UnitedNationshavesignedthepresentCharter.
