WHEREAS, Section 11, Article II of the 1987 Philippine Constitution provides that the State values the di nit! of ever! hu"an person and uarantees full respect for hu"an ri hts# WHEREAS, the $ienna %eclaration and Pro ra""e of Action of the World Conference on Hu"an Ri hts &'une 199() and the *ei+in %eclaration and Platfor" for Action of the ,ourth World Conference on Wo"en &Septe"-er 199.) reaffir" the e/ual ri hts and inherent hu"an di nit! of 0o"en and "en, and particularl! the hu"an ri hts of 0o"en as an inaliena-le, inte ral and indivisi-le part of all hu"an ri hts and funda"ental freedo"s# WHEREAS, the Philippines, 0ith other States of the World, has reaffir"ed, throu h the $ienna %eclaration and Pro ra""e of Action and the *ei+in %eclaration and Platfor" for Action, its sole"n co""it"ent to fulfill its o-li ations to pro"ote universal respect for, and o-servance and protection of all hu"an ri hts and funda"ental freedo"s for all in accordance 0ith the Charter of the 1nited 2ations, other instru"ents relatin to hu"an ri hts, and international la03 WHEREAS, the $ienna %eclaration and Pro ra""e of Action stresses that all for"s of se4ual harass"ent are inco"para-le 0ith the di nit! and 0orth of the hu"an person and "ust -e eli"inated -! le al "easures and throu h national action, 0hile the *ei+in Platfor" for

"andates 5overn"ents to 6enact and7or reinforce penal, civil, la-our and ad"inistrative sanctions in do"estic le islation to punish and redress8violence a ainst 0o"en includin se4ual harass"ent and 6develop pro ra""es and procedures to eli"inate se4ual harass"ent and other for"s of violence a ainst 0o"en in all educational institutions, 0or9places and else0here38

WHEREAS, the Philippine Con ress enacted on ,e-ruar! 1:, 199., Repu-lic Act 2o# 7877, other0ise 9no0n as the 6Anti;Se4ual Harass"ent Act of 199.8, 0hich too9 effect on <arch ., 199. and declares unla0ful se4ual harass"ent a ainst 0o"en and "en in the e"plo!"ent, education and trainin environ"ent# WHEREAS, Section : &a) of Repu-lic Act 2o# 7877 "andates ever! e"plo!er or head of a enc! in the pu-lic and private sectors to pro"ul ate rules and re ulations prescri-in the procedure for the investi ation of se4ual harass"ent cases and the ad"inistrative sanctions therefor3 WHEREAS, there is a need to devise unifor" rules and re ulations particularl! in the definition of the ad"inistrative offense of se4ual harass"ent and the sanctions therefor, and the procedures for the ad"inistrative investi ation, prosecution and ad+udication of se4ual harass"ent cases# WHEREAS, Section (, Article I= &*) of the 1987 Constitution, Section 1 and Section 1> &19), Su-title A, ?itle I of *oo9 $ of the Ad"inistrative Code of 1987 &E4ecutive @rder 2o# >9>) and Section : &*), Repu-lic Act 2o# A71(, other0ise 9no0n as the 6Code of Conduct and Ethical Standards for Pu-lic @fficials and E"plo!ees,8 e"po0er the Civil Service Co""ission, as the central personnel a enc! of the 5overn"ent, to adopt positive "easures for the o-servance of su-stantive and procedural ad"inistrative standards, includin standards for the personal conduct of overn"ent officials and e"plo!ees, in order to pro"ote "orale,

efficienc!, inte rit!, responsiveness and pro ressiveness in the entire overn"ent -ureaucrac!3

WHEREAS, Section : of Repu-lic Act 2@# A71( provides nor"s of personal conduct for pu-lic officials and e"plo!ees to o-serve in the perfor"ance of official duties, and specificall! directs that the! shall act 0ithout discri"ination a ainst an!one, and shall at all ti"es respect the ri hts of others and refrain fro" doin acts contrar! to la0, ood "orals, ood custo"s, pu-lic polic!, pu-lic order, pu-lic safet! and pu-lic interest3 WHEREAS, se4ual harass"ent violates the di nit! of 0or9ers and their ri ht to hu"ane, +ust and safe 0or9 environ"ent, defeats and i"pairs "orale and efficienc! in the 0or9place, and violates the "erit and fitness principle in the civil service# 2@W, ?HERE,@RE, this Co""ission here-! pro"ul ates these Rules and Re ulations definin the ad"inistrative offense of se4ual harass"ent and prescri-in the standard procedure for the ad"inistrative investi ation and resolution of se4ual harass"ent cases in the pu-lic sector#
R1BE I# ?I?BE Section I# ?hese Rules shall -e 9no0n as the CAd"inistrative %isciplinar! Rules on Se4ual Harass"ent Cases#C R1BE II# C@$ERA5E Section ># ?hese Rules shall appl! to all officials and e"plo!ees in overn"ent, 0hether in the career or non;career service and holdin an! level of position, includin Presidential appointees and elective officials, re ardless of status, in the national or local overn"ent,

state colle es and universities, includin overn"ent;o0ned or controlled corporations, 0ith ori inal charters# R1BE III# %E,I2I?I@2 Section (# ,or the purpose of these Rules, the ad"inistrative offense of se4ual harass"ent is an act, or a series of acts, involvin an! un0elco"e se4ual advance, re/uest or de"and for a se4ual favor, or other ver-al or ph!sical -ehavior of a se4ual nature, co""itted -! a overn"ent e"plo!ee or official in a 0or9;related, trainin or education related environ"ent of the person co"plained of# &a) Wor9 related se4ual harass"ent is co""itted under the follo0in circu"stancesD &1) su-"ission to or re+ection of the act or series of acts is used as a -asis for an! e"plo!"ent decision &includin , -ut not li"ited to, "atters related to hirin , pro"otion, raise in salar!, +o- securit!, -enefits and an! other personnel action) affectin the applicant7e"plo!ee3 or &>) the act or series of acts have the purpose or effect of interferin 0ith the co"plainantEs 0or9 perfor"ance, or creatin an inti"idatin , hostile or offensive 0or9 environ"ent3 or &() the act or series of acts "i ht reasona-l! -e e4pected to cause discri"ination, insecurit!, disco"fort, offense or hu"iliation to a co"plainant 0ho "a! -e a co;e"plo!ee, applicant, custo"er, or 0ord of the person co"plained of# &-) Education or trainin ;related se4ual harass"ent is co""itted a ainst one 0ho is under the actual or constructive care, custod! or supervision of the offender, or a ainst one 0hose education, trainin , apprenticeship, internship or tutorship is directl! or

Section A# An! overn"ent official or e"plo!ee, re ardless of se4, is lia-le for se4ual harass"ent 0hen he7sheD &a) directl! participates in the e4ecution of an! act of se4ual harass"ent as defined -! these Rules3 &-) induces or directs another or others to co""it se4ual harass"ent as defined -! these Rules3 &c) cooperates in the co""ission of se4ual harass"ent -! another throu h an act 0ithout 0hich the se4ual harass"ent 0ould not have -een acco"plished3 &d) cooperates in the co""ission of se4ual harass"ent -! another throu h previous or si"ultaneous acts# R1BE $I# C@<<I??EE @2 %EC@R1< A2% I2$ES?I5A?I@2 @, SE=1AB HARASS<E2? CASES

Section 7# A Co""ittee on %ecoru" and Investi ation shall -e created in all national or local a encies of the overn"ent, state colle es and universities, includin overn"ent;o0ned or controlled corporations 0ith ori inal charter# ?he Co""ittee shall perfor" the follo0in functionsD &a) Receive co"plaints of se4ual harass"ent3 &-) Investi ate se4ual harass"ent co"plaints in accordance 0ith the prescri-ed procedure3 &c) Su-"it a report of its findin s 0ith the correspondin reco""endation to the disciplinin authorit! for decision3 &d) Bead in the conduct of discussions a-out se4ual harass"ent 0ithin the a enc! or institution to increase understandin and prevent incidents of se4ual harass"ent3 BocaliFed Co""ittees on %ecoru" and Investi ation esta-lished in the re ional or field offices, as the case "a! -e, of the a enc! or institution shall have the sa"e functions as stated a-ove and shall su-"it the report of investi ation 0ith its reco""endation directl! to the disciplinin authorit!# When a "e"-er of the Co""ittee is the co"plainant or the person co"plained of in a se4ual harass"ent case, he7she shall -e dis/ualified fro" -ein a "e"-er of the Co""ittee# Section 8# Co"position# ; In a 0or9;related environ"ent, a Co""ittee on %ecoru" and Investi ation shall -e co"posed of at least one &1) representative each fro" the "ana e"ent, the accredited union, if an!, the second level e"plo!ees, and fro" the first level e"plo!ees, dul! selected -! the unit concerned# In an educational or trainin institution, the Co""ittee shall -e co"posed of at least one &1) representative fro" the ad"inistration, the trainers, teachers, instructors, professors or coaches, and

students or trainees, as the case "a! -e, dul! selected -! the level concerned# Section 9# ?he a enc! "a! for"ulate its o0n rules overnin the ter" of office of its "e"-ers 0hich should -e "ore than t0o !ears, and other "atters pertainin to the functions of the Co""ittee not other0ise provided in these Rules# R1BE $II# PRE;,IBI25 S?A2%AR% @PERA?I25 PR@CE%1RES I2 A??E2%I25 ?@ $IC?I<S @, SE=1AB HARASS<E2? Section 1G# ?he Pre;filin Sta e# H ?he a enc! "a! adopt "echanis"s to provide assistance to an alle ed victi" of se4ual harass"ent 0hich "a! include counselin , referral to an a enc! offerin professional help, and advice on options availa-le -efore the filin of the co"plaint# R1BE $III# S?A2%AR% PR@CE%1RAB REI1IRE<E2?S Section 11# ?he procedural rules provided hereunder are the standard re/uire"ents in handlin a se4ual harass"ent case# Section 1># Co"plaint# &a) ?he co"plaint "a! -e filed at an! ti"e 0ith the disciplinin authorit! of the office or a enc!, or 0ith the Co""ittee on %ecoru" and Investi ation# 1pon receipt of the co"plaint -! the disciplinin authorit! of the office or a enc!, the sa"e shall -e trans"itted to the Co""ittee on %ecoru" and Investi ation, if there is an!# In the a-sence of a Co""ittee on %ecoru" and Investi ation, the head office or a enc! shall i""ediatel! cause the creation of Co""ittee on %ecoru" and Investi ation in

accordance 0ith the la0 and rules, and trans"it the co"plaint to the Co""ittee# &-) ?he co"plaint "ust -e in 0ritin , si ned and s0orn to -! the co"plainant# It shall contain the follo0in D 1# the full na"e and address of the co"plainant3 ># the full na"e, address, and position of the respondent3 (# a -rief state"ent of the relevant facts3 :# evidence, in support of the co"plainant, if an!3 .# a certification of non;foru" shoppin # In the a-sence of an! one of the afore"entioned re/uire"ents, the co"plaint shall -e dis"issed 0ithout pre+udice to its refilin # Where the co"plaint is not under oath, the co"plainant shall -e su""oned -! the Co""ittee to s0ear to the truth of the alle ations in the co"plaint# &c) Co"plaints sent -! tele ra", radio ra", electronic "ail or si"ilar "eans of co""unication shall -e considered non;filed unless the co"plainant shall co"pl! 0ith the re/uire"ents provided in Section 1>&-) 0ithin ten &1G) da!s fro" receipt of the notice for co"pliance# &d) Withdra0al of the co"plaint at an! sta e of the proceedin s shall not preclude the Co""ittee fro" proceedin 0ith the investi ation 0here there is o-vious truth or "erit to the alle ations in the co"plaint or 0here there is docu"entar! or direct evidence that can prove the uilt of the person co"plained of# Section 1(# Action on the Co"plaint# H 1pon receipt of a co"plaint that is sufficient in for" and su-stance, the Co""ittee on %ecoru" and Investi ation shall re/uire the person co"plained of to su-"it a

Counter;Affidavit7Co""ent under oath 0ithin three &() da!s fro" receipt of the notice, furnishin a cop! thereof to the co"plainant, other0ise the Counter;Affidavit7Co""ent shall -e considered as not filed# Section 1:# Preli"inar! Investi ation# H A preli"inar! investi ation shall -e conducted -! the Co""ittee on %ecoru" and Investi ation# ?he investi ation involves the e4 parte e4a"ination of docu"ents su-"itted -! the co"plainant and the person co"plained of, as 0ell as docu"ents readil! availa-le fro" other overn"ent offices# %urin the preli"inar! investi ation, the parties "a! su-"it affidavits and counter;affidavits# 1pon receipt of the counter;affidavit or co""ent under oath, the Co""ittee on %ecoru" and Investi ation "a! no0 reco""end 0hether a pri"a facie case e4ists to 0arrant the issuance of a for"al char e# %urin preli"inar! investi ation, proceedin s -efore the Co""ittee on %ecoru" and Investi ation shall -e held under strict confidentialit!# Section 1.# %uration of the Investi ation# H A preli"inar! investi ation shall co""ence not later than five &.) da!s fro" receipt of the co"plaint -! the Co""ittee on %ecoru" and Investi ation and shall -e ter"inated 0ithin fifteen &1.) 0or9in da!s thereafter# Section 1A# Investi ation Report# H Within five &.) 0or9in da!s fro" the ter"ination of the preli"inar! investi ation, the Co""ittee on %ecoru" and Investi ation shall su-"it the Investi ation Report and the co"plete records of the case to the disciplinin authorit!# Section 17# %ecision or Resolution After Preli"inar! Investi ation# H If a pri"a facie case is esta-lished durin the investi ation, a for"al char e shall -e issued -! the disciplinin authorit! 0ithin three &() 0or9in da!s fro" receipt of the Investi ation Report#

In the a-sence of a pri"a facie case, the co"plaint shall -e dis"issed 0ithin the sa"e period# Section 18# ,or"al Char e# H After findin a pri"a facie case, the disciplinin authorit! shall for"all! char e the person co"plained of# ?he for"al char e shall contain a specification of the char e&s), a -rief state"ent of "aterial or relevant facts, acco"panied -! certified true copies of the docu"entar! evidence, if an!, s0orn state"ents coverin the testi"on! of 0itnesses, a directive to ans0er the char e&s) in 0ritin under oath in not less than sevent!;t0o hours fro" receipt thereof, an advice for the respondent to indicate in his7her ans0er 0hether or not he7she elects a for"al investi ation of the char e&s), and a notice that he7she is entitled to -e assisted -! a counsel of his7her choice# If the respondent has su-"itted his7her co""ent and counter; affidavits durin the preli"inar! investi ation, he7she shall -e iven the opportunit! to su-"it additional evidence# ?he Co""ittee on %ecoru" and Investi ation shall not entertain re/uests for clarification, -ills of particulars or "otions to dis"iss 0hich are o-viousl! desi ned to dela! the ad"inistrative proceedin # If an! of these pleadin s is filed -! the respondent, the sa"e shall -e considered as part of his7her ans0er 0hich he7she "a! file 0ithin the re"ainin period for filin the ans0er# Section 19# Ans0er# H ?he ans0er 0hich "ust -e in 0ritin and under oath, shall -e specific and shall contain "aterial facts and applica-le la0s, if an!, includin docu"entar! evidence, s0orn state"ents coverin testi"onies of 0itnesses, if there -e an!, in support of respondentEs case# If shall also include a state"ent indicatin 0hether he7she elects a for"al investi ation# Section >G# ,ailure to ,ile an Ans0er# H If the respondent fails or refuses to file his7her ans0er to the for"al char e 0ithin sevent!;t0o &7>) hours fro" receipt thereof 0ithout +ustifia-le cause, he7she shall

-e considered to have 0aived his ri ht thereto and for"al investi ation "a! co""ence# Section >1# Preventive Suspension# H 1pon petition of the co"plainant or "otu proprio upon the reco""endation of the Co""ittee on %ecoru" and Investi ation, at an! ti"e after the service of the ,or"al Char e to the respondent, the proper disciplinin authorit! "a! order the preventive suspension of the respondent durin the for"al investi ation, if there are reasons to -elieve that he7she is pro-a-l! uilt! of the char es 0hich 0ould 0arrant his7her re"oval fro" the service# An order of preventive suspension "a! -e issued to te"poraril! re"ove the respondent fro" the scene of his7her "isfeasance or "alfeasance and to preclude the possi-ilit! of his7her e4ertin undue influence or pressure on the 0itnesses a ainst hi"7her or ta"perin of docu"entar! evidence on file 0ith this office# Section >># %uration of Preventive Suspension# ; When the ad"inistrative case a ainst the respondent under preventive suspension is not finall! decided -! the disciplinin authorit! 0ithin the period of ninet! &9G) da!s after the date of his7her preventive suspension, unless other0ise provided -! special la0, he7she shall -e auto"aticall! reinstated into the serviceD Provided, that 0hen the dela! in the disposition of the case is due to the fault, ne li ence or petition of the respondent, the period of dela! should not -e included in the countin of the ninet! &9G) calendar da!s period of preventive suspensionD Provided, further, ?hat should the respondent -e on paternit!7"aternit! leave, said preventive suspension shall -e deferred or interrupted until such ti"e that said leave has -een full! en+o!ed# Section >(# Re"edies fro" the @rder of Prevention Suspension# H ?he respondent "a! file a "otion for reconsideration 0ith the disciplinin authorit! or "a! elevate the sa"e to the Civil Service Co""ission -! 0a! of an appeal 0ithin fifteen &1.) da!s fro" receipt thereof#

Section >:# Conduct of ,or"al Investi ation# H Althou h the respondent does not re/uest a for"al investi ation, one shall nevertheless -e conducted -! the Co""ittee on %ecoru" and Investi ation if it dee"s such investi ation as necessar! to decide the case +udiciousl!# ?he investi ation shall -e held not earlier than five &.) da!s nor later than ten &1G) da!s fro" receipt of the respondentEs ans0er# Said investi ation shall -e finished 0ithin thirt! &(G) da!s fro" the issuance of the for"al char e or the receipt of the ans0er unless the period is e4tended -! the disciplinin authorit! in "eritorious cases# Section >.# Pre;hearin Conference# H At the co""ence"ent of the for"al investi ation, the Co""ittee on %ecoru" and Investi ation "a! conduct a pre;hearin conference for the parties to appear, consider and a ree on an! of the follo0in D a# stipulation of facts3 -# si"plification of issues3 c# identification and "ar9in of evidence of the parties3 d# 0aiver of o-+ections to ad"issi-ilit! of evidence3 e# li"itin the nu"-er of 0itnesses, and their na"es3 f# dates of su-se/uent hearin s3 and # such other "atters as "a! aid in the pro"pt and +ust resolution of the case# ?he parties "a! su-"it position paper7"e"oranda and su-"it the case for resolution -ased on the result of the pre;hearin conference 0ithout an! need for further hearin # Section >A# Continuous Hearin 1ntil ?er"inated3 Postpone"ent# H Hearin s hall -e conducted on the hearin dates set -! the Co""ittee on %ecoru" and investi ation or as a reed upon durin a pre;hearin conference#

Where no pre;hearin conference is conducted, the parties, their counsels and 0itnesses, if an!, shall -e iven a notice of at least five &.) da!s -efore the first scheduled hearin specif!in the ti"e, date and place of the said hearin and su-se/uent hearin s# ?hereafter, the schedule of hearin s previousl! set shall -e strictl! follo0ed 0ithout further notice# A part! shall -e ranted onl! three &() postpone"ents upon oral or 0ritten re/uests# A further postpone"ent "a! -e ranted onl! upon 0ritten re/uest and su-+ect tot the discretion of the Co""ittee on %ecoru" and investi ation# If the respondent fails to appear durin the scheduled hearin s despite due notice, the investi ation shall proceed e4;parte and the respondent is dee"ed to have 0aived his ri ht to -e present and to su-"it evidence in his favor durin those hearin s# Section >7# Preli"inar! <atters# H At the start of the hearin , the Co""ittee on %ecoru" and Investi ation shall note the appearances of the parties and shall proceed 0ith the reception of evidence for the co"plainant# If the respondent appears 0ithout the aid of a counsel, he7she shall -e dee"ed to have 0aived his7her ri ht to counsel# *efore ta9in the testi"on! of a 0itness, the Co""ittee on %ecoru" and Investi ation shall place hi"7her under oath and then ta9e his7her na"e, address, civil status, a e, and place of e"plo!"ent# Section >8# Appearance of Parties# H An! person representin an! of the parties -efore an! hearin or investi ation shall "anifest orall! or in 0ritin his7her appearance for either the respondent or co"plainant, statin his7her full na"e and e4act address 0here he7she can -e served 0ith notices and other docu"ents# An! pleadin or appearance "ade 0ithout co"pl!in 0ith the a-ove stated re/uire"ents shall not -e reco niFed# Section >9# @rder of Hearin # H 1nless the Co""ittee on %ecoru" and Investi ation directs other0ise, the order of hearin shall -e as follo0sD
