Improving vigilance administration is possible only if system improvements are made to prevent the possibilities of corr#ption and also enco#rage a c#lt#re of honesty. In eFercise of the po4ers conferred on the ! by 8ection 8(1)(h)C the follo4ing instr#ctions are iss#ed for compliance< 7." Creati./ a cu ture !8 '!.e*t9 ;any organisations have a rep#tation for corr#ption. .he &#nior employees and officers 4ho &oin the organisations hopef#lly may not be so corr#ption minded as those 4ho have already been part of the corr#pt system. In order to ens#re that a c#lt#re of honesty is enco#raged and the &#nior officers do not have the eFc#se that beca#se their seniors are corr#ptC that they have to also adopt the corr#pt practicesC it is decided 4ith immediate effect that &#nior employees 4ho initiate any proposal relating to vigilance matters 4hich is li)ely to res#lt in a reference to the ! can send a copy directly to the ! by name. .his copy 4ill be )ept in the office of the ! and data fed into the comp#ter. If 4ithin a reasonable time of say three to siF monthsC the reference does not come to the ! C the ! then can verify 4ith the concerned a#thorities in the department as to 4hat happened to the vigilance case initiated by the &#nior employee. If there is an attempt to protect the corr#pt or dil#te the chargesC this 4ill also become visible. Above all the &#nior officers 4ill not have the eFc#se that they have to fall in line 4ith the corr#pt seniors. IncidentallyC the seniors also cannot treat the references made directly to the ! as an act of indiscipline beca#se the &#nior officers 4ill be complying 4ith the instr#ctions iss#ed #nder 8ection 8(1)(h) of the ! ,rdinance 1998. Ho4everC if a &#nior officer ma)es a false or frivolo#s complaint it 4ill be vie4ed adversely.

7.7 Greater tra.*6are.c9 i. a0+i.i*trati!. 2.2.1 ,ne ma&or so#rce of corr#ption arises beca#se of lac) of transparency. .here is a scope for patronage and corr#ption especially in matters relating to tendersC cases 4here eFercise of discretion relating to o#t of t#rn conferment of facilities/ privileges and so on. 9ach ,rganisation may identify s#ch items 4hich provide scope for corr#ption and 4here greater transparency 4o#ld be #sef#l. .here is a necessity to maintain secrecy even in matters 4here discretion has to be eFercised. (#t once the discretion has been eFercised or as in matters of tendersC once the tender has been finalisedC there is no need for the secrecy. A practiceC thereforeC m#st be adopted 4ith immediate effect by all organisations 4ithin the p#rvie4 of the ! that they 4ill p#blish on the notice board and in the organisationAs reg#lar p#blication the details of all s#ch cases regarding tenders or o#t of t#rn allotments or discretion eFercised in favo#r of an employee/party. .he very process of p#blication of this information 4ill provide an a#tomatic chec) for corr#ption ind#ced decisions or #nd#e favo#rs 4hich go against the principles of healthy vigilance administration. 2.2.2 .he ! 4ill in co#rse of time ta)e #p each organisation and revie4 to see 4hether any additions and alterations have to be made to the list of items 4hich the organisation identified in the first instance for the monthly comm#nications for p#blicity in the interests of greater transparency. .his may be implemented 4ith immediate effect. 7.: S6ee09 0e6art+e.ta i.;uirie* 2.-.1 ,ne ma&or so#rce of corr#ption is that the g#ilty are not p#nished ade?#ately and more important they are not p#nished promptly. .his is beca#se of the prolonged delays in the departmental in?#iry proced#res. ,ne of the reasons for the departmental in?#iry being delayed is that the in?#iry officers have already got their reg#lar b#rden of 4or) and this in?#iry is to be done in addition to their normal 4or). .he same is tr#e for the %resenting ,fficers also. 2.-.2 9ach organisationC thereforeC may immediately revie4 all the pending cases and the 1isciplinary A#thority may appoint In?#iry ,fficers from among retired honest employees for cond#cting the in?#iries. .he names of these officers may be got cleared by the ! . .he ! 4ill also separately iss#e an advertisement and start b#ilding a panel of names all over India 4ho can s#pplement the in?#iry officers 4or) in the department. In factC it 4ill be a healthy practice to have all the in?#iries to be done only thro#gh s#ch retired employees beca#se it can then be ens#red that the departmental in?#iries can be completed in time. If any service/departmental r#les are in conflict 4ith the above instr#ctions they m#st be modified 4ith immediate effect. 2.-.- In order to ens#re that the departmental in?#iries are completed in timeC the follo4ing time limits are prescribed<

(i) In all cases 4hich are presently pending for appointment of In?#iry ,fficer and %resenting ,fficerC s#ch appointment sho#ld be made 4ithin one month. In all other casesC the In?#iry ,fficer and the %resenting ,fficer sho#ld be appointedC 4herever necessaryC immediately after the receipt of the p#blic servantAs 4ritten statement of defence denying the charges. (ii) .he ,ral in?#iryC incl#ding the s#bmission of the In?#iry ,fficerAs reportC sho#ld be completed 4ithin a period of 6 months from the date of appointment of the In?#iry ,fficer. In the preliminary in?#iry in the beginning re?#iring the first appearance of the charged officers and the %resenting ,fficerC the In?#iry ,fficer sho#ld lay do4n a definite time$bo#nd programme for inspection of the listed doc#mentsC s#bmission of the lists of defence doc#ments and defence 4itnesses and inspection of defence doc#ments before the reg#lar hearing is ta)en #p. .he reg#lar hearingC once startedC sho#ld be cond#cted on day$to$day basis #ntil completed and ad&o#rnment sho#ld not be granted on frivolo#s gro#nds. 2.-./ ,ne of the ca#ses for delay is repeated ad&o#rnments. Not more than t4o ad&o#rnments sho#ld be given in any case so that the time limit of siF months for departmental in?#iry can be observed. 2.-.2 .he I,/%,C 1A and the !, 4ill be acco#ntable for the strict compliance of the above instr#ctions in every case. 7.< Te.0er* .enders are generally a ma&or so#rce of corr#ption. In order to avoid corr#ptionC a more transparent and effective system m#st be introd#ced. ====== .he ommission has banned post$ tender negotiations eFcept 4ith >$1 vide its instr#ction No.8(1)(h)/98(1) dated 18/11/98. 8#bse?#entlyC the ommission had also iss#ed a clarification vide No.98/,01/1 dated 12/-/99. Not4ithstanding the clarifications iss#ed by the ommissionC many 1epartments/,rganisations have been approaching the ommission on specific iss#es 4hich 4ere clarified to the individ#al departments/organisations. 2. A clarification so#ght by many 1epartments/,rganisationC 4hich is vital and has relevance to many of the organisations relates to the applicability of the above said instr#ction of ! to 'orld (an) %ro&ects. It has been decided after d#e considerationC that in so far as the 'orld (an) %ro&ects and other international f#nding agencies s#ch as I;:C A1( etc. are concernedC the department/organisations have no other alternative b#t to go by the criteria prescribed by the 'orld (an)/concerned agencies and the ommission"s instr#ction 4o#ld not be applicable specifically to those pro&ects. Ho4everC the instr#ctions of the ! 4ill be binding on p#rchases/sales made by the departments 4ithin the o#ntry. .he ! "s instr#ction of 18/11/98 4ill apply even if they are made 4ith so#rces o#tside the o#ntry and if they are 4ithin the b#dget provisions and normal operations of the 1epartment/,rganisationC -. It is re?#ested that s#ch matters may be dealt 4ith in accordance 4ith the clarifications iss#ed by the ommission vide its letter of even n#mber dated 12.-.99 (copy enclosed). -. 8ome of the organisations have so#ght clarification as to 4hether they can consider the >$2 offer or negotiate 4ith that firm if >$1 4ithdra4s his offer before the 4or) order is

placedC or before the s#pply or eFec#tion of 4or) order ta)es place. In this regardC it is clarified that s#ch a sit#ation may be avoided if a t4o$bid system is follo4ed (technocommercial) so that proper assessment of the offers is made before the a4ard of 4or) order.C .hereforeC if >$1 party bac)s o#tC there sho#ld be retendering in a transparent and fair manner. .he a#thority may in s#ch a sit#ation call for limited or short notice tender if so &#stified in the interest of 4or) and ta)e a decision on the basis of lo4est tender. /. .he ommission has also been getting references for its advice on the proced#res being follo4ed in individ#al cases of tenders. .he ommission 4o#ld not involve itself in the decision ma)ing process of individ#al organisations. (i) In addition to the eFisting r#les and practices regarding giving p#blicity of tenders thro#gh ne4spapersC trade &o#rnals and providing tender doc#ments man#ally and thro#gh post etc. the complete bid doc#ments along4ith application form shall be p#blished on the 4eb site of the organiDation. 8#spension is an effective tool for chec)ing corr#ption. .here have been many instances 4here senior officialsC 4ho had been trapped or 4ere alleged to have disproportionate 4ealth or 4ho 4ere facing charge sheets on other serio#s chargesC had not been s#spended. It has also come to notice that officers charged of corr#ptionC if not s#spendedC manage to get their in?#iries delayed beca#se delay in criminal/departmental proceedings enables them to contin#e in service even tho#gh the charges against them are grave eno#gh to deserve the p#nishment of dismissal from service. 8#ch officials can also #se the opport#nity of contin#ance in service for earning money thro#gh illegal/corr#pt means. .he ommissionC thereforeC is of the vie4 that officers facing criminal/ departmental proceedings on serio#s charges of corr#ption sho#ld be placed #nder s#spension as early as possible and their s#spension sho#ld not be revo)ed in a ro#tine manner. 2.
