856 December 23, 1975 C DE N SANITATI N WHEREAS, the health of the people, being of paramount importance, all efforts of public services should be directed towards the protection and promotion of health; and WHEREAS, with the advance in the field of sanitation in recent years, there arises the need for updating and codifying our scattered sanitary laws to ensure that they are in eeping with modern standards of sanitation and provide a handy reference and guide for their enforcement; !"W, #HERE$"RE, %, $ER&%!A!& E' MAR("S, )resident of the )hilippines, by virtue of the powers vested in me by the (onstitution, do hereby order and decree the following (ode on Sanitation* C DE N SANITATI N ! T"E P"ILIPPINES C"APTER 1 GENERAL PR #ISI NS Sec$%o& 1. #itle #he title of this (ode is +(ode on Sanitation of the )hilippines+' Sec$%o& 2. &efinition of #erms Whenever any of the following words or terms is used herein or in any rule or regulation issued under this (ode, it shall have the meaning given it in this section, as follows* ,a- (ode (ode on Sanitation of the )hilippines' ,b- &epartment #he &epartment of Health' ,c- Secretary #he Secretary of Health' ,d- Regional &irector an official who heads a Regional Health "ffice'

,e- .ocal Health Authority an official or employee responsible for the application of a prescribed health measure in a local political subdivision' ,f- Health "fficer )rovincial, (ity or Municipal Health "fficer' ,g- Engineer A Sanitary Engineer' ,h- Section any section of this code unless the term refers to other statutes which are specifically mentioned' Sec$%o& 3. $unctions of the &epartment of Health #he &epartment shall have the following powers and functions* ,a- /nderta e the promotion and preservation of the health of the people and raise the health standards of individuals and communities throughout the )hilippines; ,b- E0tend ma0imum health services to the people in rural areas and provide medical care to those who cannot afford it by reason of poverty; ,c- &evelop, administer and coordinate various health activities and services which shall include public health, preventive, curative and rehabilitative programs, medical care, health and medical education services; ,d- /pgrade the standards of medical practice, the 1uality of health services and programs to assure the people of better health services; ,e- Assist local health agencies in developing public health programs including medical care, and promote medical and public health research; ,f- %ssue permits to establish and operate government and private hospitals, clinics, dispensaries, schools of nursing, midwifery, and other para2medical course, puericulture centers, clinical laboratories and blood ban s;

,g- )rescribe standard rates of fees for health, medical, laboratory, and other public health services; and ,h- )erforms such other functions as may be provided by law' Sec$%o& '. Authority of the Secretary %n addition to the powers and authority of the Secretary which are provided by law, he is li ewise empowered to promulgate rules and regulations for the proper implementation and enforcement of the provisions of this (ode' Sec$%o& 5. Authority of the 3ureau of &irectors #he 3ureau &irectors shall be responsible for staff activities involving the development of plans, programs, operating standards and management techni1ues in their respective field of assignment' Sec$%o& 6. Authority of the Regional &irectors #he Regional &irectors shall administer health functions in their regions, implement policies, standards and programs involving health services; and enforce the provisions of this (ode and the rules and regulations promulgated by the Secretary under this (ode' Sec$%o& 7. Authority of the Health "fficers #he health officers shall administer health functions in areas under their 4urisdiction and enforce the provisions of this (ode and the rules and regulations promulgated by the Secretary under this (ode' Sec$%o& 8. Miscellaneous )rovisions ,a- %nternational treaties, agreements and conventions #he Republic of the )hilippines recogni5es international treaties, agreements and conventions on public health' #heir provisions may be considered parts of this (ode provided they do not contravene the (onstitution, e0isting laws or any provision of this (ode' ,b- Rights and proceedings Any proceeding which has commenced or any right which has accrued upon the effectivity of this (ode shall not be affected by any of its provisions'

However, matters of procedure and rights arising after the date of effectivity of this (ode shall conform to the provisions hereof' ,c- &elegation of power and assignment of duty Whenever a power is granted or a duty is assigned to any public health officer in this (ode, the power may be e0ercised by a deputy or agent of the official pursuant to law, unless it is e0pressly provided otherwise in this (ode' ,d- .anguage re1uired Any notice, report, statement or record re1uired or authori5ed by this (ode, shall be written in English or )ilipino' ,e- Mailing of notices /nless otherwise e0pressly provided, any notice re1uired to be sent to any person by any provision of this (ode, shall be sent through the postal service' #he affidavit of the official or employee who mailed the notice is prima facie evidence that the notice was sent as prescribed herein' ,f- (ondemnation and sei5ure of property When any property is officially condemned or sei5ed by government authorities in the interest of public health, the owner thereof shall not be entitled to compensation' ,g- (ommand responsibility When a duty is e0pressly vested in a health officer as provided in this (ode, it shall be understood that it shall li ewise be the concern of the superiors of the health office under the principle of command responsibility' C"APTER II (ATER S)PPL* Sec$%o& 9. )rescribed Standards and procedures Standards for drin ing water and their bacteriological and chemical e0aminations, together with the evaluation of results, shall conform to the criteria set by the !ational &rin ing Water Standards' #he treatment of water to render it safe for drin ing, and the disinfection of contaminated water sources together with their distribution

systems shall be in accordance with procedures prescribed by the &epartment' Sec$%o& 1+. 6urisdiction of the &epartment #he approval of the Secretary or that of his duly authori5ed representative is re1uired in the following cases* ,a- Sites of water sources before their construction; ,b- &elivery of water to consumers from new or recently repaired water systems; ,c- "peration of a water system after an order of closure was issued by the &epartment; ,d- )lans and specifications of water systems of subdivisions and pro4ects prior to the construction of housing units thereat; and ,e- (ertification of potability of drin ing water' Sec$%o& 11. #ypes of Water E0aminations Re1uired #he following e0aminations are re1uired for drin ing water* ,a- %nitial e0amination #he physical, chemical and bacteriological e0aminations of water from newly constructed systems or sources are re1uired before they are operated and opened for public use' E0amination of water for possible radio2active contamination should also be done initially' ,b- )eriodic e0amination Water from e0isting sources is sub4ect to bacteriological e0amination as often as possible but the interval shall not be longer than si0 months, while general systematic chemical e0amination shall be conducted every 78 months or oftener' E0amination of water sources shall be conducted yearly for possible radioactive contamination' Sec$%o& 12. E0amining .aboratories and Submission of Water Samples #he e0amination of drin ing water shall be performed only in private or government laboratories duly accredited by the &epartment' %t is

the responsibility of operators of water systems to submit to accredited laboratories water samples for e0amination in a manner and at such intervals prescribed by the &epartment' Sec$%o& 13. "ther )rotective Measures #o protect drin ing water from contamination, the following measures shall be observed* ,a- Washing clothes or bathing within a radius of 89 meters from any well or other source of drin ing water is prohibited' ,b- !o artesians, deep or shallow well shall be constructed within 89 meters from any source of pollution' ,c- !o radioactive sources or materials shall be stored within a radius of 89 meters from any well or source of drin ing water unless the radioactive source is ade1uately and safely enclosed by proper shielding' ,d- !o person charged with the management of a public water supply system shall permit any physical connection between its distribution system and that of any other water supply, unless the latter is regularly e0amined as to its 1uality by those incharge of the public supply to which the connection is made and found to be safe and potable' ,e- #he installation of booster pump to boost water direct from the water distribution line of a water supply system, where low2 water pressure prevails is prohibited' ! C"APTER III D ESTA,LIS"MENT

Sec$%o& 1'. Sanitary )ermit ,a- !o person or entity shall operate a food establishment for public patronage without securing a permit from the local health office' #he term +food establishment+ as used in this chapter means an establishment where food or drin s are manufactured, processed, stored, sold or served'

,b- Every Sanitary )ermit shall be posted in a conspicuous place of the establishment' ,c- $ees #he fees payable on application for permits and upon the issuances, renewal and noting of such certificates shall be in such amounts as the (ity of Municipal Authority may by resolution impose' ,d- !oting of )ermit Within 7: days after any change in the ownership or occupancy of any establishment, the new occupant shall apply to the (ity or Municipal Health "fficer to have such change noted in the records and on the permit certificate which he shall produce for the purpose and shall pay the corresponding fee in respect of such noting' ,e- Record of )ermit (ertificates 7' Every (ity or Municipality shall eep a record of all establishments in respect of which permits have been issued and of all permit certificates and renewals thereof' ,f- #he record shall in every case show the following* i' #he name and address of the holder of the permit who in every case shall be the actual occupier of the establishment; ii' #he location of the establishment; iii' #he purpose or purposes for which the permit has been issued; iv' #he date the first permit was issued and the dates of any renewal thereof; v' Every change of occupation and management of the establishment since the first permit was issued; and vi' (onditions under which the permit was issued or any renewal thereof granted' #he record shall be available at all reasonable times for inspection by any officer of the &epartment of Health'

Sec$%o& 15. Health (ertificates !o person shall be employed in any food establishment without a Health (ertificate issued by the local health authority' #his certificate shall be issued only after the re1uired physical and medical e0aminations are performed and immuni5ations are administered at prescribed intervals' Sec$%o& 16. ;uality and )rotection of $ood All food must be obtained from sources approved by the local health authority' %n this regard, the following re1uirements are applicable* ,a- Meats, meat products and fish shall be procured from sources under sanitary or veterinary supervision' ,b- All meat and fish shall be properly coo ed before serving' ,c- !o meat products, fish, vegetables and other food sources shall be procured from sources or areas nown to have been affected by radioactivity as for e0ample, areas contaminated with a very large amount of radioactive fallout' ,d- Mil and fluid mil products shall be obtained from sources approved by the local health authority' Mil obtained from other sources must be sterili5ed, pasteuri5ed or otherwise heated' ,e- Mil shall be stored in a refrigerator' (anned or pac age mil , other than dry mil powders, shall be refrigerated after the container has been opened' ,f- All perishable and potentially ha5ardous foods shall be stored at :9<$ ,=<(- or below' (oo ed food intended to be served hot shall be ept at a temperature not lower than 7:><$ ,?><(-' Raw fruits and vegetables shall be thoroughly washed before they are used' Sec$%o& 17. Structural Re1uirements $ood establishments shall be constructed in accordance with the following re1uirements*

7' !o person shall use any room or place for or in connection with the preparation, storage, handling or sale of any article of food ,a- Which is at anytime used or in direct communication with a sleeping apartment or toilet; ,b- %n which any animal is ept; or ,c- Which is or has been used for any purpose which would be li ely to contaminate the food or to affect in4uriously its wholesomeness or cleanliness; or ,d- Which is not used e0clusively for the purpose; )rovided, #hat in department stores or multi2purpose business establishments, food may be manufactured, prepared, coo ed, stored, or sold only in the area set aside e0clusively for said purpose and for which a sanitary permit has been issued' 8' !o sanitary permit shall be issued for any premises to be used for the preparation, handling and sale of food unless it is constructed in accordance with the following re1uirements* ,a- $.""RS #he $loors shall be i' (onstructed of concrete or other impervious and easily cleaned material that is resistant to wear and corrosion and shall be ade1uately graded and drained; all angles between the floors and walls shall be rounded off to a height of not less than @ inches ,='?8 cm'- from the floor; or ii' (onstructed of wood with dovetailed or tongue and grooved floor boards laid on a firm foundation and tightly clamped together with all angles between the floor and walls rounded off to a height of @ inches ,='?8 cm'-; or

iii' (onstructed in accordance with the re1uirements of sub2clause ,i- and ,ii- of this clause and covered with linoleum, smooth surfaced rubber or similar material fi0ed to the floor with cement or suitable adhesive* )rovided, #hat with the approval in writing of the local authority, floors may be covered with carpets or other floor covering in those parts of the premises where such carpets or coverings can be satisfactorily cleaned and maintained' ,b- WA..S i' #he internal surface of walls shall have a smooth, even, non2absorbent surface capable of being readily cleaned without damage to the surface and constructed of dust2proof materials; ii' #he walls, where sub4ect to wetting or splashing, shall be constructed of impervious, non2absorbent materials to a height of not less than =A inches ,8 meters- from the floor; iii' #he internal walls shall be painted in light colors or treated with such other wall finish as the health authority may prescribe' ,c- (E%.%!BS i' All ceilings or, if no ceiling is provided, the entire under2surface of the roof shall be dust2proof and washable' ii' #he ceiling or undersurface of the roof of rooms in which food is prepared or pac ed or in which utensils or hands are washed shall be smooth, non2absorbent and light' ,d- .%BH#%!B

i' #he general standards of illumination provided shall permit effective inspection and cleaning and shall be of sufficient intensity appropriate to the purpose for which any room or place is used; ii' %n rooms where food is prepared or pac ed or in which utensils or hands are washed there shall be a minimum illumination intensity of 8> foot2candles; in premises where food is consumed, there shall be a minimum illumination intensity of 9 foot2candles' %ntensities of illumination shall be measured at a point @> inches ,=?'8> cm'- above the floor; iii' All lighting shall be reasonably free from glare and distributed so as to avoid shadows; iv' At other areas or wor ing surfaces, the illumination shall be of such intensity as may be re1uired by the health authority' ,e- CE!#%.A#%"! i' Centilation shall be provided which shall be effective and suitable to maintain comfortable condition; ii' #he ventilation shall be ade1uate to prevent the air from becoming e0cessively heated, prevent condensation and the formation of e0cess moisture on walls, ceilings and for the removal of ob4ectionable odors, fumes and impurities; iii' %n the absence of effective natural ventilation, mechanical ventilation with airflow from a clean area, and discharging in such a manner as not to create a nuisance, shall be provided; iv' (anopies, air ducts, fans or other appliances shall be provided as re1uired by the health authority in particular circumstances;

v' Effective provision shall be made for securing and maintaining a reasonable temperature; ,f- "CER(R"W&%!B #here shall be sufficient floor space to enable every person wor ing thereon to carry out his duties efficiently and to permit easy access for cleaning' Wor ing spaces, aisles or passageways and areas to which customers have access shall be unobstructed and sufficient to permit movement of employees and customers without contamination of food by clothing or personal contact' ,g- (HA!BER""MS 7' #here shall be provided ade1uate and suitable loc ers or other facilities for the orderly storage of clothing and personal belongings of employees or persons engaged or employed in the premises' Such facilities shall be so situated and arranged so that there is no contamination of food by contact with clothing, and where the number of persons engaged or employed is four or more of either se0, there shall be provided separate changing rooms for each se0' ,h- WASH2HA!& 3AS%!S i' Wash2hand basins shall be installed in convenient places and as near as practicable to where the person for whose use they are provided are wor ing while handling food for sale or in such locations as may be otherwise prescribed in any particular case' ii' %f re1uired in writing by the local health authority an additional wash2hand basin shall be installed as near as practicable to the toilet facilities* )rovided, that the wash2hand basins specified in this (ode need not be installed in premises where only food in sealed containers is sold* and, )rovided, further, that wash2hand basins specified in this regulation shall be installed under specifications of the !ational )lumbing (ode of the )hilippines'

,i- WASH2HA!& 3AS%! MA%!#E!A!(E i' An ade1uate supply of soap, clean towels, roller towels presenting a clean surface to each user from a continuous roller towel dispenser or other hand drying services approved by health authorities' ii' #he wash2hand basin and all hand washing facilities shall, at all times, be maintained in good repair and in a clean condition' iii' All wash2hand basins shall, at all times, while the premises are being used, be supplied with hot and cold or tempered running water at a minimum temperature of 7>><$ ,@='D<(-' Sec$%o& 18. /se of $ood2Service Spaces ,a- $ood2service spaces shall not be used as living or sleeping 1uarters' ,b- (lothing or personal effects shall be ept in loc ers or in designated places away from food service spaces' ,c- !o animal or live fowls shall be allowed in such spaces' ,d- )ersons not directly connected with food preparation and serving shall not be allowed to stay in food2serving spaces' ,e-$oods in storage or in preparation must not be handled by anyone other than the preparation and serving staff' Sec$%o& 19. $ood Handlers ,a- !o person shall be employed in any food establishment without a health certificate issued by the local health authority' ,b- $ood handlers shall at all times* i' Wear clean wor ing garments' #he (oo shall wear prescribed caps and female employees caps or hairnets' ii' "bserve good personal hygiene' iii' Wash their hands thoroughly with soap and water and dry them with a clean or disposable towel or a suitable hand2

drying device immediately before wor ing, or after visiting the toilet' Sec$%o& 2+. Cermin (ontrol Cermin A group of insects or small animals such as flies, mos1uitoes, coc roaches, fleas, lice, bedbugs, mice, and rats which are vectors of diseases' ,a- Spaces where food and drin s are stored, prepared and served shall be so constructed and maintained as to e0clude vermin' ,b- All opening which connects spaces to the outer air shall be effectively protected with screen of non2corrosive wire 7?2mesh or finer' &oor screens shall be tight2fitting' ,c- A vermin abatement program shall be maintained in the establishments by their owners, operators, or administrators' %f they fail, neglect or refuse to maintain a vermin abatement programs, the local health agency will underta e the wor at their e0pense' ,d- &uring deratting or disinfecting operations, all foodstuffs, utensils, food preparation and cleaning e1uipment shall be covered to protect them from to0ic chemical substances' ,e- Cermin control in public places shall be the responsibility of the provincial, city or municipal governments which have 4urisdiction over them' ,f- #he procedure and fre1uency of vermin abatement program shall be determined and approved by the local health authority' Sec$%o& 21. #oilet and Washing $acilities ,a- Ade1uate and clean toilet facilities for male and female customers and personnel shall be provided in properly located areas'

,b- #oilet rooms shall not open directly into spaces where food is prepared, stored or served' Where such toilets e0ist, the doors shall be tight fitting and self2closing' ,c- Ade1uate hand2washing facilities shall be provided within or ad4acent to toilet room' ,d- $acilities shall include hot and cold running water, single2 service paper or cloth towel dispenser or drying device and soap or detergent' Sec$%o& 22. &isposal of Refuse ,a- Refuse cans may be used in food2preparation areas for immediate use only' ,b- Storage refuse cans, filled and empty, shall be in a designated space separate from food2handling operations' ,c- #hese cans shall be constructed and maintained as to be vermin2proof and easily cleaned' ,d- (ans containing refuse shall be tightly covered at all times, e0cept during actual use in food2handling areas' ,e- Holding bins may li ewise be used, provided they are constructed of impervious, readily2cleaned materials, and fitted with tight2fitting covers' ,f- Where refuse cans are used, a space separated from the food2 handling spaces and ad4acent to the refuse2can storage space shall be provided for cleaning them' #his space shall be e1uipped with scrubbing2brushes, cleansing agents, steam or hot water under pressure, and a hose fitted with ad4ustable no55le' Sec$%o& 23. E1uipment and /tensils ,a- #hey shall be so designed, fabricated and installed so that cleaning is easy and they do not pose health ha5ards' ,b- .ead2soldered containers and cadium2lined piping and fi0tures shall not be used'

,c- Surfaces that come into contact with food or drin s shall be constructed of materials that are impervious, corrosion2resistant, non2to0ic, easily cleanable, durable and resistant to chipping' ,d- Sliding doors on cabinets shall be easily cleanable and removable' Runners shall be allotted at the ends to permit removal of dust and debris' #he bottom shelves of open2based fi0tures shall be removable to facilitate inspection, cleaning and maintenance' Sec$%o& 2'. Washing of /tensils ,a- #hey shall be scraped and pre2rinsed to remove food articles' ,b- #hey shall be thoroughly cleansed in warm water at 78><$ ,:A<(- with soap or detergent' ,c- %f running water is not used, the wash2water shall be changed fre1uently' Sec$%o& 25. 3actericidal #reatment Eating and drin ing utensils and e1uipment, after thoroughly cleaned, shall be sub4ected to one of the following bactericidal treatments* ,a- %mmersion for at least half a minute in clean hot water at a temperature of at least 7=><$ ,==<(-; ,b- %mmersion for at least one minute in a lu ewarm chlorine solution 9> ppm; ,c- E0posure in a steam cabinet at a temperature of at least 7=><$ ,==<(- for at least 79 minutes at a temperature of 8>><$ ,A><(- for at least 9 minutes; ,d- E0posure in an oven or hot2air cabinet at a temperature of at least 7D><$ ,D8<(- for at least 8> minutes; or ,e- Any other method approved by the local health authority' Sec$%o& 26. Handling of Washed /tensils

,a- Washed utensils shall be allowed to drain dry in wire rac s without use of drying cloths, or shall be stored in a self2draining position to permit ready air2drying' ,b- #he drying cloth on which to store dishes and utensils temporarily after bactericidal treatment should be clean and changed fre1uently' Sec$%o& 27. Storage of Washed /tensils ,a- #hey shall be stored in a clean and dry place ade1uately protected against vermin and other sources of contamination' ,b- (ups, bowls, and glasses, shall be inverted for storage' ,c- When not stored in closed cupboards or loc ers, utensils and containers shall be covered or inverted whenever practicable' /tensils shall not be stored on the bottom shelves of open cabinets below the wor ing top level' ,d- Rac s, trays and shelves shall be made of materials that are impervious, corrosion2resistant, non2to0ic, smooth, durable and resistant to chipping' ,e- &rawers shall be made of the same materials and ept clean' $elt2line drawers are not acceptable, but the use of clean and removable towels for lining drawers is acceptable' Sec$%o& 28. &ry Storage of !on2)erishable $oods !on2perishable foods shall be stored in the following manner* ,a- &esignated spaces, loc ers, cupboards, rac s, shelves and containers shall be used for storage' ,b- All spaces, loc ers and cupboard shall be constructed of materials of the same 1uality as used for food2preparation and food2serving operations' (ontainers shall be made of metal fitted with tight covers'

,c- #he recommended temperature range for dry stores is 9>2 ?><( ,7>279<(- e0cept where dry foods for immediate use are stored in the preparation and servicing spaces' Sec$%o& 29. Refrigerated Storage of )erishable $oods )erishable foods shall be stored in the following manner* ,a- #hey shall be ept at or below :9<$ ,=<(- e0cept during preparation or when held for immediate serving after preparation' ,b- When such foods are to be stored for e0tended periods, a temperature of :><$ ,:><(- is recommended' ,c- $ruits and vegetables shall be stored in cool rooms' ,d- Recommended temperatures for perishable food storage are* 7' $ro5en foods; not more than 7><$ ,8<(8' Meat and fish* @82@D<$ ,>2@<(@' Mil and mil products* :>2:9<$ ,92=<(:' $ruits and vegetables* ::29><$ ,=27><(,e- All refrigerating compartments and refrigerators must be ept clean, in good repair and free from odours' #hey shall be provided with thermometers with scale divisions not larger than 8<$ ,7<(-' Sufficient shelving shall be provided to prevent stoc ing and to permit ade1uate ventilation and cleaning' Sec$%o& 3+. $ood Servicing "perations #hese operations should be in accordance with the following re1uirements* ,a- Hand contacts with food or drin shall be avoided; fingers shall not be used to serve butter, ice, or similar items of food' Sugar shall be served in covered dispensers or containers, or in pac ages wrapped for single service'

,b- #he surfaces of containers and utensils, including glasses and tablewares, which come in contact with food and drin shall not be handled' ,c- &isposable cups, plates, spoons and other single2service containers and utensils shall be purchased in sanitary cartons and stored in a clean, dry place until used' #hese articles shall be so handled on removal from the carton that the hand does not touch the surface which will be in contact with food or drin ' ,d- (lean cloths, nap ins, spoons, towels, and other cloth e1uipment shall be stored in clean places designated specifically for them' Soiled linens, including towels, aprons, and coats, shall be stored in a closed bin or loc er, suitably mar ed' ,e- Spoons, spatulas, dippers and scopps used intermittently for dispensing fro5en desserts shall be ept in running water or in water maintained at 7=><$ ,==<(- and fre1uently changed, or they may be washed and stored in a dry place after each use' (onstant2temperature bottles and other containers used for potable water and other beverages shall be ept clean and given effective bactericidal treatment before and after subse1uent use' Sec$%o& 31. Evaluation of $ood Establishment %t shall be the duty of the )rovincial, Municipal or (ity Health "fficer to cause an inspection and evaluation of every food establishment re1uiring a permit for its operations, at least every si0 months and shall cause as many additional inspections and re2inspections and evaluation to be made as are necessary for the enforcement of the provision of this (hapter' &uring the inspection or evaluation carried out at least every si0 months, the inspector shall record his findings on an inspection form provided for the purpose and shall furnish the original of such report to the holder of sanitary permit, the manager or occupier of the premises' &emerits entered in the appropriate column inspection forms shall indicate that the item does not, in the opinion of the inspector, comply with the re1uirements of this regulation' Within :D

hours of the inspection or evaluation, the original of the inspection report shall be furnished the holder of the permit certificate, the manager or occupier of the food establishment' Whenever an inspection form issued indicates non2compliance items relating to any particular type of premises, the inspector shall notify the holder of the sanitary permit, the manager or occupier of the correction to be made and indicate a reasonable period for its compliance' %f upon re2 inspection after the deadline the inspector finds the correction has not been effected he shall forthwith report to the Health "fficer and the Health "fficer shall revo e the sanitary permit' A copy of the inspection form and any notices served shall, in all cases, be filed and ept by the local health authority and be available at all reasonable time for inspection by an officer of the &epartment of Health' ,a- SERC%(E "$ !"#%(E Whenever an inspection or evaluation report form indicates non2complying items, the Health "fficer of the )rovince, Municipality or (ity may cause to be served on the holder of the permit, the manager or occupier a notice re1uiring him, within the time stated in the notice, to ta e such remedial action as may be specified therein' %n the event within the time stated in the notice, hereinafter called the first notice, the terms of the first notice are not complied with, the Health "fficer may cause to be served on the holder of the permit, the manager or occupier a second notice calling on him to show cause, at a time and place stated in the notice, why the permit issued in respect of the food establishment should not be revo ed' ,b- REC"(A#%"! "$ )ERM%#S After prior notice and hearing as provided above, the Health "fficer, if satisfied that the terms of the two notices have not been complied with or that the failure to comply therewith is not e0cusable, shall revo e the said permit' ,c- S/MMARE S/S)E!S%"! "$ )ERM%#S Whenever the )rovincial, Municipal or (ity Health "fficer finds unsanitary or unhealthy conditions in the operation of a food establishment which in his 4udgment constitute a substantial ha5ard to the

public health, the Health "fficer may order the immediate suspension of the permit' Any person to whom such an order is issued written petition shall be afforded a hearing as soon as possible' ,d- A))EA.S #he person or panel conducting the hearing may confirm, modify or reverse the decision appealed from, which decision shall be final' ,e- )R"#E(#%"! "$ $""& !otwithstanding the other provisions of this regulation relating to the issuance of permits, every person who is engaged in the sale of food or in the manufacture, preparation, storage, pac ing or delivery of food for sale protect such food from contamination' ,f- )"WER "$ E!#RE Any Sanitary %nspector or duly authori5ed officer of the &epartment of Health or of the )rovincial, Municipal or (ity Health "fficer, upon presentation of proper credentials may at all reasonable times enter any premises engaged in the manufacture, preparation or pac ing of any article of food for sale or any premises used for any of the purposes referred to in this (ode for the purpose of inspection or any other action necessary for administration of this (ode' Sec$%o& 32. Special )rovisions ,a- Broceries or +Sari2Sari+ Stores 7' !o grocery or sari2sari store shall be established within a distance of 89 meters from any source of contamination' 8' All foods which re1uire no further coo ing before they are eaten shall be protected from contamination while in countries or showcases' ,b- 3a eries' 7' &elivery truc s and carts of ba ery products shall always be ept clean and sanitary' ,c- &airies

7' !o dairy shall eep unhealthy or infected cows, carabaos or goats for the production of mil , or feed them unwholesome food which produces impure or unwholesome mil ' 8' !o animals used for the production of mil shall be allowed to gra5e on land which has been contaminated by radioactivity' @' !o dairy shall sell unwholesome mil that has not been previously pasteuri5ed or otherwise sterili5ed' ,d- %ce )lants 7' "nly potable water shall be used in the manufacture of ice' 8' %n storing and transporting ice intended for public consumption, precautionary measures shall be ta en to protect the ice from sources of contamination' ,e- Ambulant $ood Cendors 7' #hese vendors shall sell only bottled food drin s, biscuits and confectionaries' 8' %t is prohibited for food vendors to sell food that re1uires the use of utensils' ,f- "yster 3eds 7' "ysters shall be planted and grown only in areas approved by the Secretary or his duly authori5ed representatives and in places duly licensed by the 3ureau of $isheries and A1uatic Resources' 8' "ysters offered for sale, if not originating from approved areas, shall be confiscated and destroyed by the local health authority' ,g- $ish Mar eting Areas 7' "nly fresh and wholesome fish products shall be sold'

8' $ish caught in radioactive 5ones as well as in areas contaminated by to0ic substances or high in mercury count as determined by the health authorities shall be condemned and not be allowed for public consumption' @' #he selling, distribution and buying of fish caught through the use of e0plosives and chemicals are prohibited' Sec$%o& 33. Responsibility of the .ocal Health Authority #he local health authority shall* ,a- Ma e periodic inspections to enforce the maintenance of ade1uate sanitation in food establishments and their premises; ,b- #a e samples of food and drin from any establishments or vendor as often as necessary to determine if there are unwholesome, adulterated, or contaminated by radioactivity; ,c- )revent the sale or condemn and destroy food and drin s if these are found unfit for human consumption; ,d- Seal and prohibit the use of devices, utensils, containers, vehicles, machines, piping and appurtenances if in his opinion they are unsanitary; and ,e- Enforce the provisions of this (hapter and the rules and regulations promulgated by the Secretary' C"APTER I# MAR-ETS AND A,ATT IRS Sec$%o& 3'. )rescribed Standards of (onstruction #he construction of mar ets and abattoirs shall conform to standards prescribed by the &epartment' #hese standards shall be set along the following guidelines* 7' Suitability of site insofar as elimination of nuisance condition and prevention of contamination are concerned; 8' Availability of ample water supply for cleaning; @' Accessibility of ade1uate drainage facilities;

:' &urability of construction to protect vendors and customers from any ha5ard and e0posure to the elements; and 9' $acilities for sanitation maintenance, such as cleaning and elimination of harborages of vermin' Sec$%o& 35. Responsibility of the .ocal Health Authority ,a- "n Mar ets 7' Ma e periodic inspections to ascertain the maintenance of ade1uate sanitary conditions of mar ets and their premises; 8' Supervise and control the proper care and use of mar et stalls; @' )rohibit the construction of living 1uarters within any mar et and its premises; :' Enforce the ban on construction of partitions, sheds or booths within the mar et area' ,b- "n Abattoirs 7' Supervise the maintenance of ade1uate sanitation in abattoirs and their premises; 8' Enforce the re1uirements on the e0amination of meat as provided in e0isting laws; @' )ermit the slaughter of animals for public consumption in other designated areas in certain e0igencies, provided public health is ade1uately protected; :' Supervise the sanitary disposal of all abattoir wastes; and 9' Ensure that only healthy animals shall be slaughtered, and that the method of slaughtering, the techni1ues of dressing and the storing, handling and transporting procedures are in accordance with prescribed standards' Sec$%o& 36. Responsibility of .ocal Bovernments and )rivate "perators .ocal governments and private operators in charge of public or private mar ets and abattoirs shall employ an ade1uate

number of personnel to ensure their efficient operation and hygienic maintenance' #hese employees shall be under the direct supervision of the local health authority' C"APTER # P),LIC LA)NDR* Sec$%o& 37. Sanitary )ermit !o public laundry shall operate without a sanitary permit from the Secretary or his duly authori5ed representative' As used in this (hapter, a public laundry is a laundry established and operated for commercial purposes, open to the public, and not to an e0clusive clientele' Sec$%o& 38. Beneral Re1uirements #he construction and operation of a public laundry shall be governed by the following re1uirements* ,a- Structural Re1uirements 7' #he site should be distant from sources of nuisance' 8' "nly durable construction materials shall be used' @' Smooth and water2tight materials shall be used for flooring' :' All wor rooms shall be properly ventilated and provided with 7> foot2candles of lighting' 9' Ade1uate drying facilities shall be provided and articles for drying protected from sources of contamination' ,b- Sanitary Re1uirements 7' .aundry supplies in both li1uid and solid state shall be properly stored, prepared and handled' (ontainers of chemical shall be properly labeled' 8' Employees shall be provided with potable drin ing water, toilets, bathing and washing facilities' @' Employees shall be provided with loc ers for their wor ing garments and street cloths'

:' #he plant and its premises and e1uipment shall be maintained clean and sanitary at all times' Sec$%o& 39. Special Re1uirements #he following re1uirements shall be enforced* ,a- All articles to be laundered coming from hospitals and infected sources shall be treated by e0posure to a sufficient 1uantity of hot water detergents or by other effective means of disinfection' ,b- All linen, bed clothes, pa4amas, towels, bedsheets, pillow cases, etc' that have come in contact with any form of radioactivity should be isolated in a certain area and monitored by Radiation Safety personnel before sending these articles for laundry' %f any amount of radioactive contamination is found, the affected article should be set aside and the radioactivity allowed to completely decay before said article is sent for laundry' ,c- All articles for delivery to the laundry shall be ept in containers which shall be ept closed until the articles are removed at the laundry' ,d- .aundry vehicles shall be ept clean and sanitary at all times' ,e- A separate room shall be used solely for receiving, sorting, mar ing or handling unwashed articles' ,f- &iapers must be protected from pathogenic organisms and from chemical substances which are irritating to the s in of the infant' .aundered diapers for delivery shall be pac ed in sealed sanitary containers' SC" C"APTER #I L SANITATI N AND "EALT" SER#ICES

Sec$%o& '+. &efinition of #erms As used in this (hapter, the following terms shall mean* ,a- School An institution of learning which may be public, private or parochial'

,b- Special School A school which utili5es cadavers, plants, animals, bacterial and viral cultures for studies and research' ,c- )hysical Environments #he school plant, grounds and facilities' ,d- Emotional Environment $actors which affect the emotional health of students and members of the faculty' Sec$%o& '1. #he )hysical Environment %n the design and construction of the school plant, the following factors shall be considered* ,a- Site #raffic ha5ards are to be avoided but not to the point of sacrificing accessibility to public transportation' %t shall be distant from sources of nuisances' ,b- Brounds #he acreage shall be large enough to permit playgrounds, athletic fields and school gardens' ,c- 3uilding )referably it shall be constructed of strong and durable materials and designed along functional lines' $or the prevention of fire ha5ards, the re1uirements of the local fire department shall be observed' Sufficient ventilation shall be provided' Wall and ceiling finishes should be chosen so as to give optimum lighting with minimum glare' Artificial lighting with louvered flourescent or incandescent fi0ture shall be used to supply a minimum lighting of 89 foot2candles in the dar est corner' $or flooring, suitable materials shall be used which will give ma0imum durability without creating a slippery surface' ,d- Sanitary $acilities #he school population shall be provided with potable water, sewage and waste disposal systems shall li ewise conform to the re1uirements prescribed in this (ode' Sec$%o& '2. #he Emotional Environment $or the promotion of emotional health of the school population the following re1uirements shall be observed* ,a- Suitable .ocation #he school site shall be located away from disturbances and places which give undesirable influence'

,b- Recreational $acilities #he school must have safe and attractive playgrounds and ade1uate facilities for suitable sports and games' ,c- Rest Rooms $acilities shall be provided where faculty members can rest and get short respite from teaching chores' Sec$%o& '3. Health Services #rained personnel and ade1uate facilities should be available so that students may be afforded the following health services* ,a- )eriodic physical and medical e0amination; ,b- )eriodic immuni5ation; ,c- Medical and dental treatment; ,d- #reatment for common emergencies; and ,e- (ounselling and guidance' Sec$%o& ''. Re1uirements for Special Schools ,a- (adavers shall be stored in morgues and dissected in dissecting rooms, all of which shall be constructed and maintained in accordance with standards prescribed by the &epartment' ,b- )oisonous or harmful plants and animals shall be ade1uate and a secured areas' ept in

,c- Ciral and bacterial cultures shall be ept in laboratories under standard security laboratory measures' ,d- Schools utili5ing radioactive materials or sources for study or research should closely conform to the re1uirements and guidelines given by the Radiation Health "ffice and the )hilippine Atomic Energy (ommission concerning radiation protection' C"APTER #II IND)STRIAL "*GIENE

Sec$%o& '5. Sanitary Re1uirements for "perating an %ndustrial Establishment #he following sanitary re1uirements shall be applicable to industrial establishments* ,a- !o person, firm, corporation, or entity shall operate any industrial establishment without first obtaining a sanitary permit from the Secretary or his duly authori5ed representatives' ,b- %ndustrial establishments shall be allowed to operate only in places or 5ones assigned for the ind of industry by e0isting 5oning laws, ordinances, or policies' #he local health authority shall determine the suitability of location where no 5oning law, ordinance or policy e0ists' ,c- Ade1uate potable water supply shall be provided to employees' ,d- Sewage disposal shall be by means of a municipal or city sewerage system whenever possible' %f no municipal or city sewerage system e0ists it shall be done in accordance with the provisions of this (ode' Ade1uate and conveniently located toilet and bath facilities shall be provided for each se0' ,e- All wastes incident to the operation of the industrial plant shall be collected, stored, or disposed of in a manner to prevent health ha5ards, nuisances, and pollution' Where a city or municipal collection and disposal system e0ists, it should be utili5ed' ,f- An abatement program for the control of vermin shall be maintained' ,g- Ade1uate restrooms and mass halls shall be provided for employees' ,h- All places of employment and all wor rooms, including machinery and e1uipment, shall be ept clean and sanitary' Sec$%o& '6. Responsibility of the Secretary #he Secretary shall*

,a- %ssue a list of ma0imum concentration of atmospheric contaminants as a guide in appraising health ha5ards and in evaluating control measures' #he term ma0imum concentration as used in this (hapter means the amount of atmospheric contaminant which can be tolerated by man for continuous daily e0posure with no impairment of health or well2being either immediate or after a long period of e0posure' ,b- Review the concentration values at regular intervals to amend or alter the list where indicated' ,c- Specify other concentrations of short intermittent duration capable of causing acute impairment of health' ,d- Re1uire control of other contaminants nown or believed to be capable of causing impairment of health but not included in the list already issued by the &epartment' ,e- )rescribe control measures to eliminate transmission of infection disease through processing or handling of industrial products or wastes' ,f- )rescribe illumination standard values and order their review at regular intervals to alter or amend values when indicated' ,g- )romulgate measures to effectively and ade1uately control any possible radioactivity to which wor ers may be e0posed while on their 4ob' ,h- )romulgate control measures to reduce noise and pollution' Sec$%o& '7. Responsibilities of the Employer and Employees #he following are the responsibilities of the employer and employees in industrial establishments* ,a- Employer responsibility 7' )rovide, install and maintain in good repair all control measures and protective e1uipment;

8' %nform affected employees regarding the nature of the ha5ards and the reasons for, and methods of control measures and protective e1uipment; @' Ma e periodical testing of the hearing of all employees in noisy areas of operation; :' Adopt measures so that the noise produced is within allowable limits so as not to affect neighboring offices, buildings or establishments; 9' Re1uest the &epartment a permit for variation from the re1uirements when other means of e1uivalent protection are provided; and ?' )rovide personal protective e1uipment andFor protective barriers when they are necessary' ,b- Employee responsibility 7' "bserve strictly protective control measures which are prescribed; and 8' /se e1uipment provided them properly' Sec$%o& '8. Environmental )rovisions #he environmental provisions enumerated hereunder for the protection of the health of wor ers are applicable to all industrial establishments* ,a- (ontrol of atmospheric contaminants 7' Wor ers shall not be e0posed contaminants ha5ardous to health' to atmospheric

8' (ontrol of atmospheric contaminants shall be accomplished by methods approved by the Secretary or his duly authori5ed representatives or other government authority' ,b- (ontrol of infectious agents

7' (ontrol measures shall be provided to eliminate or control the transmission of infectious diseases through processing or handling of industrial products or wastes' ,c- (ontrol of possible sources of radiation ha5ards should be carried out under the supervision of the Radiation Health "fficer or his authori5ed representative' ,d- !oise (ontrol measures shall be provided to reduce intensity of noise sufficiently to render it harmless to wor ers and to eliminate it at its source as a nuisance by following the recommendations of the local health or other government authority' ,e- %llumination 7' Ade1uate lighting shall be provided and distributed in all wor areas in amount re1uired for the type of wor or seeing tas s measured by a light2meter with a minimum of glare and contrasting intensities between wor and wor room' 8' Where the specific tas re1uires more light than provided by general illumination, supplementary lighting shall be supplied' ,f- Centilation 7' !atural or artificial ventilation shall be provided in all wor areas at a rate to insure a safe and healthful wor ing atmosphere, free from in4urious amounts of to0ic materials and reasonably free from offensive odours and dust throughout the establishment' 8' )roper control measures shall be used to reduce concentration of to0ic contaminants to allowable limits' @' Air inlets shall be arranged, located and e1uipped to insure sufficient air velocity and an e0haust system which shall be located so that discharged materials shall not re2

enter places of employment or habitations nor create any ha5ard of nuisance' Sec$%o& '9. )ersonal )rotective E1uipment #he following re1uirements shall be applicable for personal protective e1uipment' ,a- )ersonal protective e1uipment andFor protective barriers shall be provided whenever substances, radiations or mechanical irritants are encountered in a manner capable of causing any pathological change or in4ury or impairment in functions of any part of the body through s in andFor mucous membrane absorption' ,b- )ersonal protection e1uipment which shall include respiratory protectors and other accessories shall be fitted to each e0posed wor er when necessary' ,c- G2ray film badges or poc et desimeters should be worn by wor ers who, during their course of wor are unavoidably e0posed to even a small amount of radiation' ,d- Supervisors and employees shall familiari5e themselves with the use, proper sanitary care and storage of this e1uipment' Sec$%o& 5+. Health Services Medical services shall be provided to all employees in accordance with e0isting laws and the rules and regulations prescribed by the &epartment' C"APTER #III P),LIC S(IMMING R ,AT"ING PLACES Sec$%o& 51. Sanitary )ermit !o public swimming and bathing places shall be operated for public use without a sanitary permit issued by the Secretary or his duly authori5ed representative' Sec$%o& 52. )rotection of (ustomers #o protect the health and safety of persons who use them, the &epartment shall promulgate* ,a- Rules and regulations concerning*

7' (orrect sanitary practices for persons swimming or bathing to prevent the transmission of communicable diseases; 8' (orrect sanitary procedures for personnel wor ing in those places to maintain their ade1uate sanitation and cleanliness of accessories used by customers; @' Ade1uate number of trained personnel and necessary e1uipment needed for life2saving and rescue wor ; :' )ost conspicuous signs to warn the public of the presence of artificial or natural ha5ards; and ,b- Standards and criteria concerning* 7' Sanitary structural re1uisites for swimming pools and bath houses to prevent pollution of their waters and to facilitate sanitation maintenance; 8' Sanitary structural standards for appurtenances, such as toilets, shower baths and dressing rooms to eliminate the ris of infection; @' Methods of determining the sanitary 1uality of water, particularly that which is used in swimming pools; and :' (riteria to be used in the limitation of swimming or bathing loads of swimming pools in accordance with the type of water treatment applied' Sec$%o& 53. Responsibility of the .ocal Health Authority #he local health authority concerned shall* 7' %nspect the state of sanitation of public swimming or bathing places; 8' Ascertain if their personnel are e0amined regularly for the presence of any infections or contagious disease; @' Enforce rules and regulations of the &epartment under this (hapter; and

:' Recommend to the &epartment the revocation of their permits when it is deemed necessary for the protection of public health' C"APTER I. REST AREAS, ,)S TERMINALS, ,)S ST PS, AND SER#ICE STATI NS Sec$%o& 5'. Rest areas, bus terminals, bus stops and service station areas with one or more permanent sheds, buildings and service facilities for motor vehicles shall be provided with sanitary facilities for the convenience and personal necessities of the travelling public' ,a- Rest areas, bus terminals, bus stops and service stations shall be established with ample area to prevent overcrowding of motor vehicles and travellers' ,b- #hey shall be provided with ade1uate ventilation and lighting and away from sources of nuisance' ,c- Safe and ade1uate water supply shall be provided in accordance with the provisions of (hapter %% of this (ode' ,d- E0creta and sewage collection and disposal shall be provided in accordance with the provisions of (hapter GC%% of this (ode' ,e- Refuse collection and disposal shall be in accordance with the provisions of (hapter GC%%% of this (ode' ,f- (omfort rooms Ade1uate number of comfort rooms shall be provided as well as au0iliary facilities therein in accordance with the provisions on (hapter GC%% of this (ode' ,g- Waiting sheds for commuters shall be of ade1uate si5e to comfortably accommodate a minimum of thirty ,@>- persons' $loors shall be of smooth concrete finish and ade1uate sitting facilities provided for' ,h- Sale of foodstuffs in those establishments shall be done in conformity with the provisions of (hapter %%% of this (ode'

C"APTER . CAMPS AND PICNIC GR )NDS Sec$%o& 55. !o camps and picnic grounds shall be open for public patronage without a sanitary permit issued by Secretary or his duly authori5ed representative' ,a- (amps and picnic ground sites shall not be sub4ect to flooding, must be well drained, distant from any source of nuisance and will not endanger sources of any public water supply' ,b- (amp and picnic houses shall be provided with ade1uate lighting and ventilation' Where tents are used flooring shall be at least : inches above the ground' ,c- Ade1uate and safe drin ing water shall be available at all times in accordance with the provisions of (hapter %% of this (ode' ,d- Ade1uate number of sanitary facilities shall be provided' ,e- Sewage disposal shall be in accordance with the provisions on (hapter GC%% of this (ode' ,f- #he storage, preparation and serving of food shall be in accordance with (hapter %%% of this (ode' ,g- Refuse cans shall be provided at strategic points in the ground area provided with tight fitting cover' A regular collection service shall be maintained' Refuse disposal shall be in accordance with the provisions of (hapter GC%%% of this (ode' ,h- (amps and picnic grounds shall at all times be maintained clean, free from litter and accumulated rubbish' ,i- A program on Cermin (ontrol shall be made in accordance with (hapter GC% of this (ode' DANCING SC" C"APTER .I LS, DANCE "ALLS AND NIG"T CL),S

Sec$%o& 56. Beneral )rovisions #he following provisions applicable to dancing schools, dance halls and night clubs*

Special )rovisions #he following provisions are applicable in cases herein specified* ,a- $or dancing schools !o person shall be employed as a dancing instructor or instructress without first securing a health certificate from the local authority' ,b- $or dance halls and night clubs 7' !o person shall employed as hostess or coo or bartender or waiter without first securing a health certificate from the local health authority' 8' #he storage, preparation and serving of food and drin s shall be in accordance with the provisions prescribed in (hapter %%% of this (ode' C"APTER .II T NS RIAL AND ,EA)T* ESTA,LIS"MENTS Sec$%o& 58. &efinition of #erms As used in this (hapter, the term +#onsorial and 3eauty Establishments+ include barber shops, beauty

parlors, hairdressing and manicuring establishments and figure slendering salons' ,a- Re1uirements' #hese establishments are sub4ect to the following re1uirements* 7' A sanitary permit shall be procured from the local health authority before their operation' 8' #hey shall be maintained clean and sanitary at all times' @' !o person shall be employed to service customers without a health certificate issued by the local health authority' ,b- (orrect Sanitary )ractices' #he following sanitary practices shall be observed' 7' Wor ing personnel shall wash their hands with soap and water before servicing customers' 8' #hey shall wear clean wor ing garments' @' #hey shall not smo e nor eat while wor ing' :' %mplements of their trade shall be cleaned and disinfected before and after their use' 9' (ustomers shall be supplied with clean and fresh towels, drapes and other linen necessary' ?' )recautionary measures to prevent disease transmission shall be observed when serving customers showing any form of dermatoses' C"APTER .III MASSAGE CLINICS AND SA)NA ,AT" ESTA,LIS"MENTS Sec$%o& 59. &efinition of #erms As used in this (hapter the following shall mean* ,a- Massage' A method wherein the superficial soft parts of the body are rubbed or stro ed or neaded for remedial or aesthetic or hygienic purposes'

,b- Massage (linic' An establishment where massage is administered to customers' ,c- Masseur' A trained person duly licensed by the Secretary or his authori5ed representative to perform massage and to supervise massage clinic attendants' ,d- Massage (linic Attendant' A trained person duly permitted by the Secretary or his authori5ed representative to massage customers under the guidance and supervision of a masseur' ,e- Sauna 3ath Establishment' An establishment where customers are e0posed to steam which is generated by sprin ling water on hot stones or by some other means' ,f- Sauna 3ath Attendant' A person who applies the proper techni1ue of giving steam bath to customers' Sec$%o& 6+. 9' Masseur and masseur attendant shall wash their hands with soap and water before and after massaging a customer' ?' #he establishment and its premises shall be maintained clean and sanitary at all times' ,b- Sauna 3ath Establishment 7' #he reception and office rooms shall be properly lighted and ade1uately ventilated' 8' #he sauna bath room shall be properly lighted, provided with thermometers, and maintained clean and sanitary at all times' @' Sanitary and ade1uate handwashing, bath and toilet facilities shall be available' :' (ustomers shall be provided with soap, clean towels and saniti5ed rubber or plastic slippers' Sec$%o& 62. )ersonnel #he following re1uirements shall be enforced* ,a- Masseur 7' #he person must have a certificate as a registered masseur, issued by the (ommittee on E0aminers for Masseur of the &epartment' 8' He must possess an up2to2date health certificate issued by the local health authority' @' #he person shall wear a clean wor ing garment when attending to customers or when supervising massage clinic attendants' ,b- Massage (linic Attendant 7' #he person shall be properly registered and authori5ed by the local health authority to wor as massage clinic attendant after compliance with the following re1uirements* a- #he Satisfactory completion of a training course or study given by a government office, school or hospital,

which is duly authori5ed and recogni5ed by the &epartment; and b- /p2to2date health certificate issued by the local health authority to include C& clearance secured from any government clinic or hospital' 8' person must clean wor ing garments when attending to customers' ,c- Sauna 3ath Attendant 7' Attendant must possess an up2to2date health certificate issued by the local health authority' 8' #he person must wear clean wor ing garments when attending to customers' C"APTER .I# " TELS, M TELS AND APARTMENTS, L DGING, , ARDING, R TENEMENT " )SES, AND C ND MINI)MS Sec$%o& 63. &efinition of #erms As used in this (hapter, the following terms shall mean* ,a- Hotel' A building where transient guests are received and are supplied with and charged for meals, lodging and other services' ,b- Motel' A roadside hotel for motorists, usually consisting of private cabins' ,c- 3oarding House' A building where selected persons for fi0ed periods of time are supplied with, and charged for sleeping accommodations and meals' ,d- .odging House' A building where persons are supplied with and charged for sleeping accommodations only' ,e- #enement House' A building or portion thereof which is leased or sold to an occupied as residence by four or more families doing their coo ing within the premises but living independently

of one another although having a common right in the use of halls, stairways, terraces, verandas, toilets, and baths' ,f- Apartment House' A building containing a number of separate residential suites' ,g- (ondominium' A building with one or more storeys composed of multi2unit residential suites under 4oint ownership of occupants, each unit provided with complete sanitary facilities, utilities and other amenities' ,h- Establishments' A collective term construed to include items ,a- to ,g-' Sec$%o& 6'. Beneral )rovisions #he following are re1uired for the establishments defined in the preceding Section* ,a- !o establishment shall be operated and opened for public patronage without a sanitary permit issued by the Secretary or his duly authori5ed representative' ,b- Any e0tension or additional construction in an establishment shall re1uire a sanitary permit before it could be operated' ,c- All establishments shall provide their patrons with ade1uate water supply, toilet and bath facilities in accordance with standards prescribed in this (ode' ,d- Establishments and their premises shall be sanitary at all times' ept clean and

,e- )eriodic insect and vermin control measures shall be underta en to eradicate vectors of diseases' ,f- Animals, fowls and pets shall be housed in appropriate ennels or cages separate from living 1uarters' ,g- !o person shall be employed in establishments without first procuring a health certificate from the local health authority' Sec$%o& 65. Special applicable' )rovisions #he following provisions are

,a- Hotels and Motels 7' #he storage, preparation and serving of food to customers shall be in accordance with the standards prescribed in (hapter %%% of this (ode' 8' (ustomers shall be provided with clean linen such as bedsheets, pillow cases, towels and nap ins' @'When rooms or cabins are vacated, their toilets or baths shall be saniti5ed and clean and fresh linen shall be provided before the room or cabin is rented for occupancy' ,b- (ondominium #he following conditions are applicable* 7' #he choice for sites should consider availability of bus and ta0i transportation services' 8' !earness to place of wor , schools, police stations and clinics' @' Availability of low2cost goods' :' )ar ing facilities and playgrounds for children' 9' $acilities for refuse disposal and cleanliness of buildings, and ?' Efficiency of lifts' C"APTER .# P RT, AIRP RT, #ESSEL AND AIRCRA!T SANITATI N Sec$%o& 66. )ort and Airport Sanitation %n ports and airports, the following sanitary re1uirements shall be applied* ,a- Every port and airport shall be provided with potable drin ing water and wholesome food supplied from sources approved by the Secretary or his duly authori5ed representative' ,b- #he drin ing water and food shall be stored and handled in a manner to ensure their protection against contamination' #he local health authority shall conduct periodic inspections of e1uipment, installations and premises, and collect regularly

samples of water and food for laboratory e0amination to determine if they are fit for human consumption' ,c- #here shall be available to as many ports and airports as practicable organi5ed medical and health services with ade1uate staff, e1uipment and facilities for the prompt isolation and care of infected persons, disinfection, disinsecting, deratting, laboratory e0amination, collection and e0amination of rodents for plague infection, collection of water and food samples for e0amination' ,d- #he local health authority for each port and airport shall ta e all practicable measures to eep port and airport installation free of rodents' ,e- %n ports and airports of entry, facilities shall be provided for immuni5ations re1uired in international travel' ,f- Every port of entry and the area within the perimeter of an airport of entry shall be ept free from mos1uito vectors of yellow fever, malaria and other diseases of epidemiological significance' Sec$%o& 67. Cessel Sanitation $or the purpose of this Section, the provisions of Art' %% of the ;uarantine Regulations promulgated under Section 9 of Republic Act !o' 78@ shall be applied and enforced' Sec$%o& 68. Aircraft Sanitation $or the purpose of this Section, the re1uirements in the Buide to Hygiene and Sanitation in Aviation of the World Health "rgani5ation are adopted as part of this (ode' C"APTER .#I #ERMIN C NTR L Sec$%o& 69. &efinition of #erms As used in this (hapter, the following terms shall mean* ,a- )lace .and, building, residence, pier, watercraft, aircraft or any means of conveyance' ,b- Cermin A group of insects or small animals such as flies, mos1uitoes, coc roaches, fleas, lice, budbugs, mice and rats which are vectors of diseases'

Sec$%o& 7+. Beneral Re1uirements ,a- A vermin abatement program shall be maintained in places by their owners, operators or administrators' %f they fail, neglect or refuse to maintain a vermin abatement program, the local health agency will underta e the wor at their e0pense' ,b- Cermin control in public places shall be the responsibility of the provincial, city or municipal governments which have 4urisdiction over them' ,c- #he procedure and fre1uency of vermin abatement program shall be determined and approved by the local health authority' C"APTER .#II SE(AGE C LLECTI N AND DISP SAL, E.CRETA DISP SAL AND DRAINAGE Sec$%o& 71. &efinition of #erms As used in this (hapter, the following terms shall mean* ,a- )ublic sewerage system A system serving twenty2five persons or more' ,b- Septic tan A water tight receptacle which receives the discharge of a plumbing system or part thereof, and is designed to accomplish the partial removal and digestion of the suspended solid matter in the sewage through a period of detention' %ts construction shall be in accordance with specifications prescribed in this (hapter' ,c- House sewer #he pipe line conveying sewage from the house or building to the septic tan or to any point of discharge' ,d- Septic tan absorption bed or drain field An underground system of pipes leading from the outlet of the septic tan , consisting of open24ointed or perforated pipes so distributed that the effluent from a septic tan is o0idi5ed and absorbed by the soil'

,e- Effective capacity of a septic tan #he actual li1uid capacity of a septic tan as contained below the li1uid level line of the tan ' ,f- Effective depth of a septic tan #he actual li1uid depth of a septic tan as measured from the inside bottom of the septic tan to the li1uid level line' ,g- $reeboard or air space of a septic tan #he distance as measured from the li1uid level line to the inside top of the septic tan ' ,h- &istribution bo0 A small concrete receptacle between the septic tan and the drain field from which lines of drain tile e0tends and which acts as surge tan to distribute the flow of sewage e1ually to each line of drain tile' ,i- Approved e0creta disposal facilities shall mean any of the following* 7' $lush toilets properly connected to a community sewer; 8' $lush toilets connected to a septic tan accordance with this (hapter; constructed in

,m- (oncrete vault privy A pity privy with the pit line with concrete in such manner as to ma e it water tight' ,n- (hemical privy A privy where fecal matter is deposited into a tan containing a caustic chemical solution to prevent septic action while the organic matter is decomposed' Sec$%o& 72. Scope of Supervision of the &epartment #he approval of the Secretary or his duly authori5ed representative is re1uired in the following matters* ,a- (onstruction of any approved type of toilet for every house including community toilet which may be allowed for a group of small houses of light materials or temporary in nature; ,b- )lans of individual sewage disposal system and the sub2 surface absorption system, or other treatment device; ,c- .ocation of any toilet or sewage disposal system in relation to a source of water supply; ,d- )lans, design data and specifications of a new or e0isting sewerage system or sewage treatment plant; ,e- #he discharge of untreated effluent of septic tan s andFor sewage treatment plants to bodies of water; ,f- Manufacture of septic tan s; and ,g- Method of disposal of sludge from septic tan s or other treatment plants' Sec$%o& 73. "peration of Sewage #reatment Wor s )rivate or public sewerage systems shall* ,a- )rovide laboratory facilities for control testsH and other e0aminations needed; ,b- $orward to the local health authority operating data, control tests and such other records and information as may be re1uired; ,c- %nform the local health authority in case of brea 2down or improper functioning of the sewage treatment wor s; and

,d- )rovide for the treatment of all sewage entering the treatment plant' Sec$%o& 7'. Re1uirements in the "peration of Sewerage Wor s and Sewage #reatment )lants #he following are re1uired for sewerage wor s and sewage treatment plants' ,a- All houses covered by the system shall be connected to the sewer in areas where a sewerage system is available' ,b- "utfalls discharging effluent from a treatment plant shall be carried to the channel of the stream or to deep water where the outlet is discharged' ,c- Storm water shall be discharged to a storm sewer, sanitary sewage shall be discharged to a sewerage system carrying sanitary sewage only; but this should not prevent the installation of a combined system' ,d- )roperly designed grease traps shall be provided for sewers from restaurants or other establishments where the sewage carries a large amount of grease' Sec$%o& 75. Septic tan s Where a public sewerage system is not available, sewer outfalls from residences, schools, and other buildings shall be discharged into a septic tan to be constructed in accordance with the following minimum re1uirements* ,a- %t shall be generally rectangular in shape' When a number of compartments are used, the first compartment shall have the capacity from one2half to two2thirds of the total volume of the tan ' ,b- %t shall be built of concrete, whether pre2cast or poured in place' 3ric , concrete bloc s or adobe may be used' ,c- %t shall not be constructed under any building and within 89 meters from any source of water supply' Sec$%o& 76. &isposal of Septic #an Effluent #he effluent from septic tan s shall be discharged into a sub2surface soil, absorption field

where applicable or shall be treated with some type of a purification device' #he treated effluent may be discharged into a stream or body of water if it conforms to the 1uality standards prescribe by the !ational Water and Air )ollution (ontrol (ommission' Sec$%o& 77. &etermination of Septic #an (apacity #he septic tan capacity may be determined from the estimated unit flow contained in #able % +;uantities of Sewage $low,+ based on ade1uate detention time interval resulting in efficient sedimentation' &aily flow from mattered results, may be used as estimated flow when available' $or edifices with occupants, the number of persons to be served shall be computed on the number of rooms with each room considered as occupied by two persons or on the basis of the actual number of persons served by the tan , whichever is greater' Sec$%o& 78. Sanitary )rivies #he privy recommended for use is the sanitary privy' %t shall conform with the following minimum re1uirements* ,a- %t shall consist of an earthen pit, a floor covering the pit, and a water2sealed bowl' %t shall be so constructed in order that fecal matter and urine will be deposited into the earthen pit which shall be completely fly2proof' ,b- #he pit shall be at least one meter s1uare' ,c- #he floor should cover the pit tightly to prevent the entrance of flies' %t shall be constructed of concrete or other impervious material' ,d- #he water2sealed bowl shall be 4oined to the floor so as to form a water2tight and insect proof 4oint' ,e- A suitable building, shall be constructed to provide comfort and privacy for the users of the privy' ,f- Wooden floors and seat risers shall not be used' Sec$%o& 79. &rainage

,a- Responsibility of cities and municipalities %t shall be the responsibility of all cities and municipalities to provide and maintain in a sanitary state and in good repair a satisfactory system of drainage in all inhabited areas where waste water from buildings and premises could empty without causing nuisance to the community and danger to public health' ,b- (onnection to the municipal drainage system 3uildings or premises producing waste water shall be connected to the municipal drainage system in all areas where it e0ists' Sec$%o& 8+. Special )recaution for Radioactive E0creta and /rine of Hospitali5ed )atient' ,a- )atients given high doses of radioactive isotope for therapy should be given toilet facilities separate from those used by +non2 radioactive+ patients' ,b- Radioactive patients should be instructed to use the same toilet bowl at all times and to flush it at least @ times after its use' C"APTER .#III RE!)SE DISP SAL Sec$%o& 81. &efinition of #erms As used in this (hapter, refuse is an inclusive term for all solid waste products consisting of garbage, rabbish, ashes, night soil, manure, dead animals, street sweepings and industrial wastes' Sec$%o& 82. Responsibility of (ities and Municipalities (ities and municipalities shall provide an ade1uate and efficient system of collecting, transporting and disposing refuse in their areas of 4urisdiction in a manner approved by the local health authority' Sec$%o& 83. Additional Re1uirements ,a- "ccupants of buildings and residences shall; provide a sufficient number of receptacles for refuse' Refuse in receptacles shall be protected against vermin and other animals'

,b- Refuse shall be disposed through a municipal collection service' %f this service is not available, disposal shall be by incineration, burying, sanitary landfill or any method approved by the local health authority' ,c- Refuse shall not be thrown in any street, sidewal , yard, par or any body of water' %t shall be stored in a suitable container while awaiting its final disposal' ,d- Streets shall be ept clean by occupants or owners of properties lining the street from the line of the property to the middle of the street and from one property to the other' ,e- )ar s, pla5as and streets ad4acent to public buildings shall be ept clean by the local government concerned' N)ISANCES AND C"APTER .I. !!ENSI#E TRADES AND CC)PATI NS

A' .ye ma ing; and 7>' Any manufacturing process in which lead, arsenic, mercury, phosphorous, or other poisonous substance is used' Sec$%o& 85. #ypes of !uisances $or the purpose of this (hapter, the following shall be considered nuisances* ,a- )ublic or private premises maintained and used in a manner in4urious to health; ,b- 3reeding places and harborages of vermin; ,c- Animals and their carcasses which are in4urious to health; ,d- Accumulation of refuse; ,e- !o0ious matter or waste water discharged improperly in streets; ,f- Animals stoc age maintained in a manner in4urious to health; ,g- E0cessive noise; and ,h- %llegal shanties in public or private properties' Sec$%o& 86. Responsibilities of "wners, Managers or "perators #he "wners, managers or operators of establishments shall* ,a- Secure a sanitary permit from the local health authority before establishing and operating their business or trade; ,b- Remove daily all in4urious by2products and wastes; ,c- )revent the escape of industrial impurities and adopt methods to render them innocuous; ,d- Maintain wor ing establishments and their premises clean and sanitary at all times; ,e- Store all materials properly to prevent emission of no0ious or in4urious effluvia' C"APTER .. P LL)TI N ! T"E EN#IR NMENT

Sec$%o& 87. Beneral )rovisions $or the purpose of this (hapter, the provisions of Republic Act !o' @A@7, the rules and regulations of the !ational Water and Air )ollution (ontrol (ommission promulgated in accordance with the provisions of Section ?,a- 8 of the said Act, the provisions of )residential &ecree !o' :D>, and the rules and regulations of the Radiation Health "ffice of the &epartment of Health shall be applied and enforced' Sec$%o& 88. Authority of the Secretary #he Secretary is authori5ed to promulgate rules and regulations for the control and prevention of the following types of pollution* ,a- )ollution of pesticides and heavy metals; ,b- )ollution of food caused by chemicals, biological agents, radioactive materials, and e0cessive or improper use of food additives; ,c- !on2ioni5ing radiation caused by electronic products such as laser beams or microwaves; ,d- !oise pollution caused by industry, land and air transport and building construction; ,e- 3iological pollutants including the causative agents of intestinal infections; ,f- )ollution of agricultural products through the use of chemical fertili5ers and plant pesticides containing to0ic chemical substances and unsanitary agricultural practices; and ,g- Any other type of pollution which is not covered by the provisions of Republic Act @A@7, the Rules and Regulations of the !ational Water and Air )ollution (ontrol (ommission, the provisions of )residential &ecree !o' :D> and the rules and regulations of the Radiation Health "ffice of the &epartment of Health which is li ely to affect community Health adversely' C"APTER ..I DISP SAL ! DEAD PERS NS

Sec$%o& 89. &efinition As used in this (hapter, the following terms shall mean* ,a- 3urial grounds cemetery, memorial par of any place duly authori5ed by law for permanent disposal of the dead' ,b- Embalming preparing, disinfecting and preserving a dead body for its final disposal' ,c- Embalmer a person who practices embalming' ,d- /nderta ing the care, transport and disposal of the body of a deceased person by any means other than embalming' ,e- /nderta er person who practices underta ing' ,f- $uneral establishment any place used in the preparation and care of the body of a deceased person for burial' ,g- Remains the body of a dead person' ,h- 3urial %nterment of remains in a grave, tomb or the sea' ,i- &isinterment the removal or e0humation of remains from places of interment' Sec$%o& 9+. 3urial Brounds Re1uirements the following re1uirements shall be applied and enforced* ,a- %t shall be unlawful for any person to bury remains in places other than those legally authori5ed in conformity with the provisions of this (hapter' ,b- A burial ground shall at least be 89 meters distant from any dwelling house and no house shall be constructed within the same distance from any burial ground' ,c- !o burial ground shall be located within 9> meters from either side of a river or within 9> meters from any source of water supply' Sec$%o& 91. 3urial Re1uirements #he burial remains is sub4ect to the following re1uirements*

,a- !o remains shall be buried without a dead certificate' #his certificate shall be issued by the attending physician' %f there has been no physician in attendance, it shall be issued by the mayor, the secretary of the municipal board, or a councilor of the municipality where the death occurred' #he death certificate shall be forwarded to the local civil register within :D hours after death' ,b- Shipment of remains abroad shall be governed by the rules and regulations of the 3ureau of ;uarantine' ,c- Braves where remains are buried shall be at least one and one2half meters deep and filled well and firmly' ,d- #he cost of burial of a dead person shall be borne by the nearest in' %f the in is not financially capable of defraying the e0penses or if the deceased had no in, the cost shall be borne by the city or municipal government' ,e- #he burial of remains in city or municipal burial grounds shall not be prohibited on account of race, nationality, religion or political persuasion' ,f- %f the person who issues a death certificate has reasons to believe or suspect that the cause of death was due to violence or crime, he shall notify immediately the local authorities concerned' %n this case the deceased shall not be buried until a permission is obtained from the provincial or city fiscal' %f these officials are not available the permission shall be obtained from any government official authori5ed by law' ,g- E0cept when re1uired by legal investigation or when permitted by the local health authority, no unembalmed remains shall remain unburied longer than :D hours after death' ,h- When the cause of death is a dangerous communicable disease, the remains shall be buried within 78 hours after death' #hey shall not be ta en to any place of public assembly' "nly the

adult members of the family of the deceased may be permitted to attend the funeral' Sec$%o& 92. &isinterment Re1uirements &isinterment of remains is sub4ect to the following re1uirements* ,a- )ermission to disinter remains of persons who died of non2 dangerous communicable diseases may be granted after a burial period of three years' ,b- )ermission to disinter remains of person who died of dangerous communicable diseases may be granted after a burial period of five years' ,c- &isinterment of remains covered in paragraphs +a+ and +b+ of this Section may be permitted within a shorter time than that prescribed in special cases, sub4ect to the approval of the Regional &irector concerned or his duly authori5ed representative' ,d- %n all cases of disinterment, the remains shall be disinfected and places in a durable and sealed container prior to their final disposal' Sec$%o& 93. $uneral and Embalming Establishments establishments are sub4ect to the following re1uirements* #hese

,a- Scope of inclusion for the purposes of this Section, re1uirements prescribed herein shall be applied and enforced to funeral chapels, embalming establishments and morgues' ,b- Sanitary permit !o establishment mentioned in the preceding paragraph shall be operated without a sanitary permit issued by the Secretary or his duly authori5ed representative' #his permit shall be revo ed in case of any violation of the provisions of this (hapter and the rules and regulations promulgated by the Secretary' ,c- (lassification $uneral establishment shall be classified in three ,@- categories which are described as follows*

7' (ategory % Establishments with chapels, and embalming facilities and offering funeral services' 8' (ategory %% Establishments with chapels and offering funeral services but without embalming facilities' @' (ategory %%% Establishments offering only funeral services from the house of the deceased to the burial ground' ,d- Sanitary re1uirements $or funeral chapels #he re1uirements prescribed for places of public assembly in this (ode shall be applied' $or embalming and dressing rooms 7' #hey should be constructed of concrete or semi2concrete materials with sufficient space to accommodate five bodies at one time' 8' #he floors and walls shall be made of concrete or other durable impervious materials' @' Centilation and lighting should be ade1uately provided' :' Embalming shall be performed on a table made of a single marble slab or other e1ually impervious materials' %t shall be so constructed that all washings and body fluids shall flow to a drain connected to the waste piping system of the building' 9' Embalming and assistants shall use rubber gloves when wor ing' ?' Washing facilities with soaps, detergents and germicidal solutions shall be provided for use of the following personnel' Sec$%o& 9'. .icensing and Registration )rocedures #he licensing and registration of underta ers and embalmers are sub4ect to the following re1uirements* ,a- %ssuance of license to practice

7' Any person who desires to practice underta ing or embalming shall be licensed to practice only after passing an e0amination conducted by the &epartment' 8' .icensed underta ers or embalmers shall practice underta ing or embalming in accordance with re1uirements prescribed by the &epartment' @' .icensed underta ers or embalmers shall display their licenses conspicuously in the establishments where they wor ' ,b- %ssuance of certificates of registration 7' An underta er or embalmer shall apply annually for a registration certificates and pay an annual registration fee of twenty2five pesos to the Regional Health "ffice concerned' 8' #he first registration certificate issued shall cover the period from the date of issuance to the last day of the current year' Subse1uent certificates shall bear the date of 6anuary 7 of the year of issue and shall e0pire &ecember @7 of the same year' @' (ertificates of registration shall be posed conspicuously in establishments concerned' ,c- E0emption Bovernment and private physicians may perform embalming without license and registration certificates as e0igencies re1uire' Sec$%o& 95. Autopsy and &issection of Remains #he autopsy and dissection of remains are sub4ect to the following re1uirements* ,a- )erson authori5ed to perform these are* 7' Health officers; 8' Medical officers of law enforcement agencies; and @' Members of the medical staff of accredited hospitals' ,b- Autopsies shall be performed in the following cases*

7' Whenever re1uired by special laws; 8' /pon orders of a competent court, a mayor and a provincial or city fiscal; @' /pon written re1uest of police authorities; :' Whenever the Solicitor Beneral, provincial or city fiscal as authori5ed by e0isting laws, shall deem it necessary to disinter and ta e possession of remains for e0amination to determine the cause of death; and 9' Whenever the nearest in shall re1uest in writing the authorities concerned to ascertain the cause of death' ,c- Autopsies may be performed on patients who die in accredited hospitals sub4ect to the following re1uirements* 7' #he &irector of the hospital shall notify the ne0t of in of the death of the deceased and re1uest permission to perform an autopsy' 8' Autopsy can be performed when the permission is granted or no ob4ection is raised to such autopsy within :D hours after death' @' %n cases where the deceased has no ne0t of in, the permission shall be secured from the local health authority' :' 3urial of remains after autopsy After an autopsy, the remains shall be interred in accordance with the provisions in this (hapter' Sec$%o& 96. &onation of Human "rgans for Medical, Surgical and Scientific purposes Any person may donate an organ or any part of his body to a person, a physician, a scientist, a hospital or a scientific institution upon his death for transplant, medical, or research purposes sub4ect to the following re1uirements*

,a- #he donation shall be authori5ed in writing by the donor specifying the recipient, the organ or part of his body to be donated and the specific purpose for which it will be utili5ed' ,b- A married person may ma e such donation without the consent of his spouse' ,c- After the death of a person the ne0t of in may authori5e the donation of an organ or any part of the body of the deceased for similar purposes in accordance with the prescribed procedure' ,d- %f the deceased has no ne0t of in and his remains are in the custody of an accredited hospital, the &irector of the hospital may donate an organ or any part of the body of the deceased in accordance with the re1uirement prescribed in this Section' ,e- A simple written authori5ation signed by the donor in the presence of two witnesses shall be deemed sufficient for the donation of organs or parts of the human body re1uired in this Section, notwithstanding the provisions of the (ivil (ode of the )hilippines on matters of donation' A copy of the written authori5ation shall be forwarded to the Secretary' ,f- Any authori5ation granted in accordance with the re1uirements of this Section is binding to the e0ecutors, administrators, and members of the family of the deceased' Sec$%o& 97. /se of Remains for Medical Studies and Scientific Research /nclaimed remains may be used by medical schools and scientific institutions for studies and research sub4ect to the rules and regulations prescribed by the &epartment' Sec$%o& 98. Special )recautions for Safe Handling of (adavers (ontaining Radioactive %sotopes ,a- (adavers containing only traces ,very small dose- of radioactive isotope do not re1uire any special handling precautions'

,b- (adavers containing large amounts of radioactive isotopes should be labelled properly identifying the type and amount or radioactive isotopes present and the date of its administration' ,c- 3efore autopsy is performed, the Radiation Health "fficer or his duly authori5ed representative should be notified for proper advice' #he pathologist andFor embalmer should be warned accordingly of the radioactivity of the cadaver so that radiation precautions can be properly enforced' ,d- !ormal burial procedures, rules and regulations may be carried out on the above mentioned cadavers provided that their amount of radioactivity has decayed to a safe level which will be determined by the Radiation Health "fficer or his authori5ed representative' ,e- (remation %f cremation is performed without autopsy, there is no handling problem; otherwise, autopsy precautions should be strictly enforced' )recautions should be ta en to prevent any possible concentration of radioactivity at the base of the stac of the crematorium' Sec$%o& 99. Responsibility of the Regional &irector #he Regional &irector shall* ,a- Act on applications for the establishment of burial grounds; and ,b- (lose any burial ground which is a menance to public health' Sec$%o& 1++. Responsibility of the .ocal Health Authority #he local health authority shall* ,a- Administer city or municipal cemeteries; ,b- %ssue permits to inter, disinter or transfer remains; ,d- Apply prescribed measures when cause of death is due to a dangerous communicable disease;

,e- Ieep records of death occurring within his area of 4urisdiction; and ,f- Authori5e the deliver of unclaimed remains to medical schools and scientific institutions for purposes specified in this (hapter and in accordance with the rules and regulations of the &epartment' Sec$%o& 1+1. Responsibility of .ocal Bovernment .ocal governments shall* ,a- Reserve appropriate tracts of land under their 4urisdiction, for cemeteries sub4ect to approval of Regional &irectors concerned; ,b- /tili5e 4udiciously grants, gifts, be1uests of property or financial donations for the establishment or improvement of cemeteries; and ,c- (lose cemeteries under their 4urisdiction sub4ect to approval of the Regional &irector' Sec$%o& 1+2. )enal )rovisions ,a- #he Secretary or his duly authori5ed representative may revo e or suspend the license of an underta ers or embalmer who violates any provisions of this (hapter or the rules and regulations promulgated by the Secretary under this (hapter' ,b- Any person who shall engage in the business of underta ing or embalming in violation of any provision of this (hapter shall be liable to a penalty of not more than one thousand pesos for each violation' ,c- Each day or any part thereof during which any prohibited business or practice is continued shall be deemed a separate violation and sub4ect to the same penalty prescribed in the preceding paragraph' C"APTER ..II !INAL PR #ISI NS

Sec$%o& 1+3. )enal )rovision ,a- /nless otherwise provided in any (hapter or section in this (ode, any person who shall violate, disobey, refuse, omit or neglect to comply with any of the rules and regulations promulgated under this (ode shall be guilty of misdemeanor and upon conviction shall be punished by imprisonment for a period not e0ceeding si0 months or by a fine of not e0ceeding one thousand pesos or both depending upon the discretion of the court' ,b- Any person who shall interfere with or hinder, or oppose any officer, agent or member of the &epartment or of the bureaus and offices under it, in the performance of his duty as such under this (ode, or shall tear down, mutilate, deface or alter any placard, or notice, affi0ed to the premises in the enforcement of the (ode, shall be guilty of a misdemeanor and punishable upon conviction by imprisonment for a period not e0ceeding si0 months or by a fine of not e0ceeding one thousand pesos or both depending upon the discretion of the (ourt' Sec$%o& 1+'. Separability (lause %n the event that any section, paragraph, sentence, clause, or word of this (ode is declared invalid for any reason, other provisions thereof shall not be affected thereby' Sec$%o& 1+5. Repealing (lause All laws, as well as pertinent rules and regulations thereof which are inconsistent with the provisions of this (ode are hereby repealed or amended accordingly' Sec$%o& 1+6. Effectivity #his (ode is hereby made part of the law of the land and shall ta e effect immediately' &one in the (ity of Manila, this 8@rd day of &ecember, in the year of "ur .ord, nineteen hundred and seventy2five'
