NOTICE OF SUPPLEMENTAL AUTHORITY IN SUPPORT OF PLAINTIFFS MOTION FOR SUMMARY JUDGMENT Plaintiffs respectfully submit the following notice of supplemental authority in support of their Motion for Summary Judgment filed on September 30, 2013 (ECF No. 44). Plaintiffs brief in support of summary judgment was docketed on October 10, 2013 (ECF No. 62: Defendants briefs in opposition were filed on October 24, 2013 (ECF No. 73, 74); and Plaintiffs reply brief was filed on November 7, 2013 (ECF No. 86). Plaintiffs filed previous notices of supplemental authority on November 19, 2013 (ECF No. 89), December 20, 2013 (ECF No. 92), December 23 (ECF No. 93), and January 15, 2014 (ECF No. 100). In Bourke v. Bashear, No. 3:13-CV-750-H (W.D. Ky. Feb. 12, 2013) (attached as Ex. A), the U.S. District Court for the Western District of Kentucky held that Kentuckys denial of recognition for valid same-sex marriages violates the United States Constitutions guarantee of

equal protection under the law, even under the most deferential standard of review. (Ex. A at 2.) In light of the courts ruling that Kentuckys marriage recognition bans violated equal protection, the court noted that it did not need to conclusively resolve Plaintiffs other constitutional claims. (Id.) As the Bourke court noted, with its decision four federal district courts and all federal district courts to consider the issue after United States v. Windsor, 133 S. Ct. 2675 (2013) have now held that state laws excluding same-sex couples from marriage violate the equal protection or due process guarantees of the Fourteenth Amendment. (Ex. A at 18.) For the same reasons, Plaintiffs motion for summary judgment with respect to Virginias marriage bans should be granted as well.
