The &anel noted that the 1resent 2atter 4as s-02itted to FAM and later to S6L'M on 6th ,an-ary# *0+.# th-s a3ter the ex1iry o3 ti2e li2it 3or s-02ission o3 A11eal. The &anel# there3ore# concl-ded that the t4o cl-0s did not a11eal 4ithin the ti2e li2it and the 2atter co-ld 0e dis2issed on gro-nds o3 ex1iry o3 1eriod o3 a11eal o3 .9 ho-rs. :o4e$er# the &anel considered the 0asic 1rinci1les o3 d-e 1rocess and noted that there 4as a 4ai$er o3 ti2e li2it 0y the S6L'M "xec-ti$e Co22ittee.
