ECTION +' Authority. This Ordinance is enacted to pro3ide for *uidelines in the issuance of a Baran*ay resolution certifyin* the social acceptability of business establish&ents 4ho are applyin* for -epart&ent of Touris& ;-OT< Accreditation' ECTION ,- Purposes. This Ordinance is enacted for the follo4in* purposes8 a< To *uide and re*ulate business establish&ents 4ho are applyin* for -epart&ent of Touris& ;-OT< Accreditation' b< To enhance the total social en3iron&ent of the locality throu*h the necessary control and re*ulation of sub!standard facilities of businesses 4hich are pre=udicial) not =ust for the co&&unity) but for 3isitin* tourists' c< To pro&ote and protect the health) safety) peace and con3enience of the *eneral 4elfare of the inhabitants of the Baran*ay: ARTICLE IV Definition of Ter.) ECTION /- Terms. The &ore technical>rele3ant ter&s used in this Ordinance shall be defined as follo4s8 a'< +ocially Acceptable ? as that 4hich is 4ithin the bounds of social appro3al and accordin* to its accepted standards' b'< Applicant ? pertains to the person) 4hether the o4ner) the &ana*er) or the representati3e) 4ho is see9in* for the appro3al of its application for -OT accreditation' c'< ,stablish&ents ? refers to the businesses co3ered by Resolution No' @"!"//A 4hich are applyin* for -OT accreditation' ARTICLE V Endor)e.ent G&ideline) ECTION 0- Guidelines. The follo4in* are the *uidelines 4hich should be obser3ed prior to the issuance of a resolution certifyin* that such business establish&ent is Bsocially acceptableC: a' Restaurants and bars that operate 4ith sin*!alon* syste& or unit) or li3e band &usic &ust be adeDuately sound!proofed so that disturbance to residential nei*hbors 4ill be &iti*ated' b' Restaurants) bars) inns) and hotels &ust be eDuipped 4ith security personnel>s' c' +uch restaurants) bars) inns) and hotels are NOT cradles for ille*al acti3ities 4hich include any for&s of *a&blin*) prostitution) child!eEploitation and the li9e' d' Business establish&ents shall ha3e a clean or sanitary 9itchen and co&fort roo&s 4hich shall be inspected by the Baran*ay Co&&erce and Touris& Tea&' e' Business establish&ents shall ha3e a&ple par9in* space for custo&ers' ARTICLE V Baran*ay Co&&erce and Touris& Tea&'

ECTION 1' Composition. There shall be a Baran*ay Co&&erce and Touris& Tea& 4ho shall be co&posed of a Chair&an and at least three ;0< &e&bers fro& the Baran*ay Council representin* the areas of 2ealth) ,n3iron&ent) Infrastructure and>or Touris&' ECTION 2- Roles and Responsibilities. The tea& shall ha3e the follo4in* roles and responsibilities8 a' They shall conduct ocular inspection of the actual establish&ent applyin* for such accreditation' b' They shall obser3e and collect co&&unity concerns re*ardin* the business establish&ent and e3aluate the& accordin* to the pro3ided *uidelines' c' They shall inter3ie4 the o4ner>&ana*er of such establish&ent re*ardin* its security syste&) and obser3ance of la4 and ordinance' d' .pon e3aluation and inspection) and after sufficient co&pliance of the *i3en *uidelines) they shall 3ote and reco&&end for the certification of such business establish&ent endorsin* the sa&e for -OT Accreditation' e' The 4ritten reco&&endation by the Baran*ay Co&&erce and Touris& Tea&) representin* the &a=ority of the tea&) shall be the basis of the Baran*ay Council to issue or not to issue certifications connected to such -OT Application' f' The tea& is also &andated to report ille*al acti3ities eEistin* in such business establish&ents) and conseDuently not to reco&&end such business 4hich pro&otes) practices) or tolerates the sa&e' ARTICLE I3 Mi)cellaneo&) Pro$i)ion) ECTION 4- Citizen Protest' 7or purposes of enforcin* the pro3isions of this Ordinance) any citi5en &ay file an appropriate protest in the baran*ay a*ainst any business establish&ent 4ho 3iolates or fails to co&ply 4ith the pro3isions of this Ordinance' The Baran*ay concerned shall eEe&pt such action fro& pay&ent of filin* fees' ECTION 5- Separability Clause. If any pro3ision of this Ordinance or the application of such pro3ision to any person or circu&stances is declared unconstitutional) the re&ainder of this Ordinance or the application of such pro3ision to other persons or circu&stances shall not be affected by such declaration' ECTION 6- Repealing Clause. All eEistin* ordinances and resolutions of this baran*ay found to be inconsistent here4ith are hereby repealed or &odified accordin*ly' ECTION +7- Effecti ity. This Ordinance shall ta9e effect in accordance 4ith the pro3isions of the Local Go3ern&ent Code of #AA#'
