CHAPTER VI. ENVIRONMENTAL TAXES, FEES AND CHARGES Article A.

Tax on Sand, Gravel and Other Quarry Resources

Section 69. Imposition of Tax. There is hereby imposed a tax of not more than ten percent (10%) of the fair market value in this province per cubic meter of ordinary stones, sand, gravel, earth (delete), and other quarry resources, such as but not limited to marl, marble, granite, volcanic cinders, basalt, tuff and rock phosphate, extracted from the public lands or from the beds of seas, lakes, rivers, streams creeks, and other public waters within the territorial jurisdiction of the Province of Surigao del Norte as follows: a) Surigao City and Municipality of San Francisco b) Mainland Municipalities c) Island Municipalities * *Subject to the favorable endorsement of PAMB For Ordinary Earth Soil a) All Areas in Surigao del Norte P 10.00/cu.m. Section 70. Issuance of Permit. Every person who shall extract sand and gravel and other quarry resources shall secure a permit from the Provincial Governor, pursuant to applicable provisions of RA 7942 and the procedural guidelines embodied in the Mines Administrative Order No. 2010-12, series of 2010, the applicable provisions of which are hereby adopted as an integral part of this ordinance and subject to the following conditions. Conditions for Issuance of Permits. Permits under this article shall be subject to the following conditions: a) The permit shall be issued only upon compliance of an Environmental Compliance Certificate (ECC) issued by the DENR-EMB and other basic requirements as provided by RA 7942 or the Philippine Mining Act of 1995, SP Ordinances and PMRB Resolutions. - (new) b) The permit shall be inoperative over seas covered by Mines temporary Permits or Mining Leases; c) The statements made in the application shall be considered as conditions and essential parts of the permit and any misrepresentation contained herein shall be cause for revocation or suspension of the permit; d) Extraction shall not be allowed within the distance of one (1) kilometer from the boundaries of reservoirs established for public water or of any public or private works or structures, unless prior clearance of the agency or owner is obtained; e) The extraction shall be confirmed within the area specified in the permit, the boundaries of which are established on the ground by prominent markers; f) The permittee shall assume full responsibility for damages to public or private property or to any injury to persons or loss of human life, occasioned by his extraction or operation under the permit; g) The permit shall be issued for the exclusive use and benefit of the permittee as stated in his application and shall not be transferable to any person,

partnership or corporation. Any transfer can be made effective if approved by the Provincial Governor; h) The permittee should put up a signboard of reasonable size at the place of extraction which shall legibly and substantially reflect the contents of his permit; i) The permit shall be available at all times for inspection by any representative of the Governor or the Provincial Treasurer; j) The permittee shall keep a book of accounts wherein there shall be entered daily the quantity and kind of materials removed from the area covered by the permit. The tax, if any, paid thereof, the quantity and kind materials disposed of or sold, their selling prices, the names and addresses of persons to whom it was sold, and such other transactions in connection with the permitees business or operation; k) The permittee shall within ten (10) days after the end of each month, submit to the Provincial Treasurer, copy furnished the office of the Governor and the DENR, a report under oath stating the quantity and kind of materials extracted, the amount of tax paid, their selling prices, the delivery receipt number, the names and; addresses of buyers, the quantity and kind of materials left or balance not extracted per permit; l) The permit may be suspended or revoked at anytime by the Governor when in his opinion, public interest so requires or upon failure of the permittee to comply with the terms and conditions stipulated in the permit; and m) For gratuitous permits, the term is coterminous with the term of the project but not to exceed one (1) year. The applicant shall submit a project proposal where the materials to be taken shall be used and estimated volume needed. Whenever practicable, the government office concerned shall use its own vehicles and equipments in extracting, hauling and transporting the materials provided, however, that the permittee may enter into a contract with private persons or entities for the purpose of hauling and transporting such materials. Section 71. Time/Period of Extraction. Extraction should commence only upon approval of the Permit Application, and that extraction or operation should only be done during daytime (8:00 a.m. to 5:00 p.m.). No extraction/operation should be allowed during nighttime (after 5: p.m. until 7:59 a.m.) of the following day. However, extractions to be made beyond 5:00 p.m. and before 8:00 a.m. must arranged with the office of the Provincial Governor. Extraction/operation should automatically stop upon consumption of the volume specified in the permit. Section 72. Periodic Inspection. All operations conducted under a permit issued under this ordinance shall be subject to periodic inspection by the duly authorized representative of the Governor and the Provincial Treasurer or his duly authorized representative for the purpose of ensuring: a) The operation is within the permitted area. b) The materials removed are in accordance with the terms and conditions stipulated in the permit. c) The aesthetic and ecological value of the permitted area is not seriously damaged. d) That the operation does not threaten the ground stability of any public or private structure; and e) That peace and order is maintained in the area.

Section 73. Verification of Areas. The Provincial Engineer or his representative shall conduct field verification of the area applied for and submit their report with their recommendations to the Governor. Section 74. Survey Plan. All applications, except an application for personal use, shall be supported by a survey plan duly prepared, signed and sealed by a licensed Geodetic Engineer. Sketch plan shall contain general information, including technical description reference point, location map, etc. Section 75. Documents Accompanying Quarry Application. The quarry permit application shall be accompanied by: A duly notarized survey contract executed by and between the applicant and the authorized geodetic engineer; Affidavit of the geodetic engineer that he can execute the survey of the claims and submit the returns thereof within the periods prescribed unless prevented by force majeure, and admitting payment by application not less than twenty percent (20%) nor more than fifty percent (50%) of the agreed professional fee paid in advance in consideration of such representation; and A survey bond filed by the geodetic engineer in the amount of fifty pesos (P50.00) per hectare but not less than five hundred pesos per application for survey, which bond shall be subject to forfeiture for failure to execute the survey and/or comply with his obligations under this ordinance. Section 76. Application involving the same area. In cases of application involving the same area, the application first registered, accompanied by standard requirements, shall be entertained and preferred. Section 77. Rehabilitation of Excavated Areas. Holders of permits, other than special permit, shall rehabilitate the excavated areas by planting trees suitable thereon as may be determined, and have it conditioned suitable for agriculture or other economic activities. To guarantee the faithful compliance with this duty, a Surety/Cash Bond in the amount of Twenty Thousand (P20,000.00) per hectare or a fraction thereof shall be posted by the applicant, except applicants for Gratuitous Permit, Exclusive Sand and Gravel, Guano, Gemstone Permits before the grant of a permit with the quarry acceptable to the Governor or the Provincial Treasurer. Section 78. Assignment and Transfer. An application or permit may be assigned or transferred by the applicant or permittee, respectively, to any qualified person by an instrument duly notarized and registered with the office of the Governor, who in turn informs the Provincial Treasurer of the said assignment and transfer.

Section 79. Time of Payment. The extraction fees shall be paid in advance equivalent to the volume per cubic meter applied to the Provincial Treasurer. Provided, that in case of large scale operation, the provincial treasurer may allow, subject to the conditions stated in the instrument signed by the parties concerned staggered payment of the tax of not less than twenty five percent (25%) of the contracted volume per quarter. Section 80. Surcharge for late payment. Failure to pay the tax imposed in this Article on time shall subject the taxpayer to a surcharge of twenty-five percent (25%) of the original amount of tax due, such surcharge to be paid at the same time and in the same manner as the tax due. Section 81. Interest on Unpaid Tax. In addition to the surcharge for the late payment, there shall be imposed upon the unpaid amount an interest of two percent (2%) per month from the date until the tax is fully paid but in no case shall the total interest on the unpaid amount or a portion thereof exceed thirty-six (36) months. Section 82. Penalty for Extraction without Permit. Any person who extracts sand, gravel and other quarry resources, without a permit shall pay a penalty/fine of P200.00 per cubic meter of the total volume of material extracted or of an imprisonment of one (1) year or more or both at the discretion of the court. Section 83. Sharing of Proceeds. The proceeds of the tax on sand, gravel, and other quarry resources shall be distributed as follows: (a) (b) (c) Province Thirty percent (30%) Component City or Municipality where the sand, and other quarry resources are extracted, Thirty percent (30%) Barangay where the sand, gravel, and other quarry resources are extracted Forty percent (40%)

Section 84. Delivery Receipts. The permittee shall at all times issue to truck drivers engaged in hauling from the permitted area as stated in the permit, sand, gravel, and other quarry resources, delivery receipts for the purpose of inspection by any authorized representative of the Governor or the Provincial Treasurer. The original of the delivery receipts shall be issued to and carried by the truck drivers while in transit and shall be shown upon demand by inspectors wherein said inspectors record the delivery receipt numbers and volume of materials carried, the date and plate numbers and also place a tick mark with his initial on the receipts. The duplicate copy shall be attached to the monthly report of the permittee and be made available at all times for inspection by proper authorities. Failure of truck drivers to present delivery receipts upon demand shall subject them to penalty and cause trucks to be impounded and shall only be released upon presentation of such receipts and only upon written order of the Governor, in proper case, the court. Failure of permittee to issue delivery receipts, or issuance of fraudulent ones shall be sufficient ground for the suspension or revocation of the permit.

Section 85. Adverse Claims, Protests and Oppositions. All adverse claims, protest, and oppositions involving permits covered by this article must be verified and filed with the office of the legal officer of the Province of Surigao del Norte accompanied by the receipts of payment of the filing fees and the proof of service of the copies of the claims, protest, and oppositions, upon the respondents. The adverse claims, protests, or opposition shall contain the name and address of the adverse claimant, protestant, or oppositor, and the respondent, a detailed statement of the ground and facts relied upon the exhaustive discussion of issues and arguments raised; and shall also be accompanied by the affidavit of witnesses and other supporting documents. Section 86. Answer. If the adverse claim, protest or opposition is sufficient in form and substance, it shall be given due course; otherwise it shall be dismissed. Should it be given due course, the respondent shall be required to answer within a period of not less than five (5) days nor more than fifteen (15) days from receipt of the order. The order shall also fix the date of summary hearing. The answer shall contain a detailed statement of the facts relied upon by the respondent; and exhaustive discussion refusing the issue and arguments raised in the claim, protest or opposition; and defense availed of by the respondent. It shall be accompanied by the affidavits of witnesses and other supporting documents, if any. Section 87. Decision. The Governor shall decide the case within five (5) days from submission of report. The decision shall become final and executory after ten (10) days from receipts of it, or of the order denying the motion for its reconsideration shall be allowed. Section 88. Existing Permits. Valid and existing permits shall continue as such, by their revocation of modification after the effectivity of this ordinance shall be subject to the provision hereof. Holder of such permits shall register the same with the office of the Governor within thirty (30) days from the effectivity of this ordinance. Section 89. rules, to wit; Unlawful Acts. The following shall constitute unlawful acts under this

Any extraction and removal or sale of sand and gravel; and other loose and unconsolidated materials from its source without a permit duly issued; Any extraction and removal or sale of materials in excess of allowable quantity specified in the permit; and Any extraction and removal or sale of materials outside the permit area. All persons responsible or committing any of the foregoing acts shall be prosecuted for theft and penalized in accordance with the succeeding section. Section 90. Penalty. Conviction of any of the acts referred to in the preceding section shall be subject to the penalty provided for by provision of Presidential Decree No. 463 as amended.

Section 91. Recognition of Existing Mining Rights. All existing and valid mining claims perfected and non perfected, registered under the provision of Commonwealth Act No. 137 as amended, Presidential Degree No. 463 as amended, and other laws relating mining, shall be recognized and the rights acquired there-under respected. Section 92. Preferential Right. Owners/lessees of private lands shall have the preferential right to extract and remove sand and gravel materials that maybe found in their land. Lands with imperfect title shall be recognized if supported by up-to-date payment of realty taxes. Section 93. Abandoned Materials. Any person desiring to dispose of abandoned materials may apply for a special permit subject to the condition that the fees corresponding to the quantity applied for shall have been paid in advance and to such other conditions that may be imposed. Section 94. Failure to Keep Book of accounts and submit Monthly Reports, Etc. Failure of the permittee as required, to keep book of accounts containing the records of transaction related to the materials removed and disposed of, or repeated failure to submit the monthly reports without justifiable reasons shall be sufficient ground for the suspension or revocation of the permit, the confiscation of the bond and forfeiture of all payments made by the permittee. There shall be collected an annual fee at the rates provided hereunder for the issuance of Governors permit and other attendant fees to every person/contractor/permit fee angaged in the extraction, removal, disposal and/or utilization of quarry ssand and gravel, guano and gemstone resources in private and/or public lands.

Section 98. Automatic Adjustment of Fees . Fees herein provided shall be deemed automatically increased at the rate of ten percent (10%) every three (3) years unless otherwise provided by an ordinance enacted within the same span of period by the Sangguniang Panlalawigan of Surigao del Norte. Section 99. Environmental Fund Allocation. For purposes of environmental protection and preservation, there shall be allocated fund to be provided for its projects and activities which shall be Ten per cent (10%) of the actual collection of the previous year. This fund shall be known as Special Environmental Fund. Section 100. Sand and Gravel and other Quarry Resources coming from sources outside Surigao del Norte. NEW The quarry operator/permittee/contractor/truck driver shall carry and produce the following requirements before allowed entry and delivery of sand, gravel, earth and other quarry materials to any destination within the province. 1. Presentation of approved Governors Permit with proof of payment for materials quarried/extracted from other provinces; 2.
