END USER LICENSE AGREEMENT

(a) /rant o# License! &ub8ect to the terms and conditions o# this Agreement, you may access and use the &o#tware in connection with the use o# the Licensed *roduct! (b) 1estrictions on Use! The &o#tware is $rovided to you solely #or use as installed on the Licensed *roduct! Use o# this &o#tware with any other #lash dis9, #lash card, resident #lash array or solid state dis9 o# any 9ind is e6$ressly $rohibited, and constitutes an illegal in#ringement o# $atents, co$yright and other rights o# Kingston and Licensors in and to the &o#tware! :! Limitations on 1everse Engineering, Decom$ilation and Disassembly! ,ou may not reverse engineer, decom$ile, reverse com$ile, ada$t or disassemble any o# the &o#tware or any $art thereo#, e6ce$t and only to the e6tent that such activity is e6$ressly $ermitted by a$$licable law notwithstanding this limitation! ;! .on<-ircumvention! ,ou are not allowed to circumvent, by$ass, modi#y or de#eat any o# the #unctions or $rotections o# the &o#tware or any mechanisms o$eratively lin9ed to the &o#tware. =! (a) De#inition! The &o#tware has a gra$hical user inter#ace that can be remotely u$dated, #rom time to time, to dis$lay various third $arty $roducts and a$$lications ((Third *arty A$$lications))! The $rovider o# each such $roduct or a$$lication is solely res$onsible #or that Third *arty A$$lication, the content therein, any warranties to the e6tent that such warranties have not been disclaimed, and any claims that you or any other $arty may have relating to that Third *arty A$$lication or your use o# that Third *arty A$$lication! -ertain Third *arty A$$lications may dis$lay, include or ma9e available content, data, in#ormation, a$$lications or materials #rom third $arties ((Third *arty 5aterials)) or $rovide lin9s to certain third $arty websites ((Third *arty 2ebsites))! (b) ,our 1es$onsibility! Third *arty A$$lications, Third *arty 5aterials and lin9s to Third *arty 2ebsites are $rovided solely as a convenience to you! # you buy or obtain access to a Third *arty A$$lication, your relationshi$ and recourse is entirely with the third $arty $rovider o# that Third *arty A$$lication and not Kingston! Kingston is merely $roviding the medium #or you to access such Third *arty A$$lications and is not a $arty to the relationshi$ (contractual or otherwise) between you and the $rovider o# the Third *arty A$$lication! Kingston, its o##icers, a##iliates and subsidiaries do not warrant or endorse and do not assume and will not have any res$onsibility or liability, directly or indirectly, #or any damage or loss caused or alleged to be caused by or in connection with your use o# or inability to use Third *arty A$$lications, Third *arty 5aterials or Third *arty 2ebsites or claims that you or any other $arty may have relating to the Third *arty A$$lications, Third *arty 5aterials or Third *arty 2ebsites!
