Nuclear Regulatory Commission Division of Contracts Justification for Other than Full and Open Competition

1. The U.S. Nuclear Regulatory Commission (NRC) proposes to enter into a sole source purchase order with Operation Technology, Inc., to purchase an additional user license for the existing Electrical Transient Analysis Program (ETAP) network WAN and to purchase maintenance and support services to cover the existing ETAP network WAN and the additional user. The period of performance of this effort is July 1, 2009 through June 30, 2010. 2. The statutory authority permitting Other Than Full and Open Competition is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1 (b)(1), which provides for limiting competition in those situations where the services are available from only one responsible source. 3. In accordance with NRC regulations, 10 CFR 50, Appendix B, nuclear utilities are required to perform analyses of the electrical distribution systems installed in nuclear power plants in order to revise their license design basis. Performance of this analysis requires the use of computer simulation models. Approximately 88% of the U.S. nuclear power plants use the ETAP software for the analyses of their electrical distribution systems. In order for the NRC to make independent in-house assessments of the accuracy of the applicants analysis, the NRC staff must use identical software to the nuclear power plant (i.e. ETAP). Therefore, the NRC must use ETAP to perform confirmatory analysis of electrical distribution systems at nuclear power plants. Operation Technology, Inc. is the only organization that distributes and provides maintenance services for the ETAP software. 4. ETAP offers a suite of fully integrated software solutions including arc flash, load flow, short circuit, relay coordination, cable ampacity, transient stability, and optimal power flow. ETAP is capable of performing (1) transient stability calculations; (2) harmonic analysis; (3) DC load flow analysis; (4) battery sizing calculations; and (5) DC fault analysis. 5. Market research was conducted to ensure that the price to the Government for this service will be fair and reasonable. The vendor is offering the list price to all government and commercial customers. 6. In accordance with FAR Subpart 5.101(a)(1), this acquisition is required to be synopsized in the Government Wide Point of Entry (GPE), as the proposed contract action is for an amount expected to exceed the specified $25,000.00 threshold. This acquisition will be publicized for 10 business days.
