This matter arises under the Job Training Partnership Act


(JTPA), 29 U.S.C. § 1579(a), and the applicable regulations set
forth at 20 C.F.R. Part 629.
On September 23, 1994, the U.S. Department of Labor (DOL)
issued a final determination notifying the State of California
Health and Welfare Agency of a disallowance as a result of DOL's
audit of Complainant's programs under JTPA. By letter dated
October 18, 1994, Complainant requested a hearing. On November
16, 1994 this Office issued a Notification of Receipt of Request
for Hearing and Prehearing Order, which required both parties to
file certain information relating to this matter. On December 6,
1994 a Motion to stay proceedings until March 23, 1995 was filed
and granted by my Order issued January 5, 1995. To date, neither
Complainant nor DOL have responded to the Prehearing Order.
Accordingly, Complainant and DOL are hereby ORDERED to
either respond to the Prehearing Order or explain why such a
response should not be submitted within thirty (30) days of the
date of this Order. A response shall be deemed adequate if it
complies with the previously issued Notification of Receipt of
Request for Hearing and Prehearing Order. Failure to respond to
this Order could result in a default judgment against the non- -
complying party. See 29 C.F.R. §18.6(d) (2) (v).
