without the other person's consent.

STATEMENT OF PROBABLE CAUSE

On or about October 2, 2013 at approximately 11:30 a.m., officers with the Metro Transit Police were sent
to the vicinity of University and Dale in the City of St. Paul, Ramsey County, Minnesota on an alarm on bus
#3240. Upon arrival, police observed the bus driver, identified as James Nomntau Yang, dob 8-6-67, the
Defendant herein, standing on the driver's seat with a hammer in his hand, and a woman, identified as
Adrieanne Simmons, standing in the aisle holding a folding knife and yelling that she wanted to press
charges. The officer requested that both parties put away their weapons and they both complied.
The officer briefly spoke with the Defendant, who stated that Ms. Simmons had taken his photograph with
her cell phone, which he did not like, so he grabbed the phone and threw it to the ground. The Defendant
then said Ms. Simmons punched him in the mouth, cutting his upper lip. The officer observed that Ms.
Simmons was very upset and that she was yelling into her cell phone that she was going to sue everyone.
A video from the bus was retrieved and viewed by an MTC investigator. The video shows Ms. Simmons
and the bus driver exchanging words as Ms. Simmons was exiting the bus at University and Dale. Ms.
Simmons then re-entered the bus, took a photograph of the Defendant with her cell phone and then re-
exited the bus. The Defendant then exited the bus, took Ms. Simmons's cell phone from her and re-entered
the bus. When Ms. Simmons went after the Defendant and struggled to get her cell phone back, the
Defendant threw the cell phone to the ground. They continued to struggle for several seconds, and during
the course of that struggle, the Defendant is seen punching Ms. Simmons twice in the head area.
As a result of the incident, the screen of Ms. Simmons's was broken and she suffered some swelling to her
cheek. The Defendant also received a cut to his upper lip.

FINDING OF PROBABLE CAUSE
From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, , the ssuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant's arrest
or other lawful steps be taken to obtain Defendant's appearance in court, or Defendant's detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
