If the ship is in a dry-dock or at a cargo berth or a repair berth or an anchorage or any other facility within a port, and the sediments need to be discharged, the sediments shall be landed to the concerned facility for further disposal or to a shore reception facility as appropriate, after obtaining an approval from the Ship Superintendent. A receipt/certificate regarding such disposal shall be obtained from the facility and the required entries shall be made in the Ballast Water Record Book, the ships log book and in any other form as required by the Port State. However, if the Master decides that he can store the sediments on the ship without hampering the safety, security, operational capability and maintenance of the ship, her cargo and the safety of persons on board, he may carry the sediments on ship and discharge the same as per Section 7.3 of chapter 7 of this plan. The required entries shall be made in the Ballast Water Record Book, the ships log book and in any other form as required by the Port State. DISCHARGE OF SEDIMENTS IS NOT PERMITTED IN BALLAST WATER REGULATED AREAS. If for any reason, ballast was carried in spaces designated for other purposes (e.g. oil/fuel tank, fresh water tank, etc.), due regard shall be given to the original contents of the tank. The disposal of the sediments shall depend upon the final mixture. In certain cases, such as when carried in bunker oil tanks, this plan does not apply and more stringent requirements shall be applicable. Disposal of sediments from such spaces shall be carried out after consultation with the Ship Superintendent.
