The respondent, a native ad citizen of El Salvador, has appealed the Immigration Judge's
decision dated May , 2013, which ordered him removed fom the United States. The
Depament of Homeland Security ("DHS") ha argued that the Immigration Judge's decision
should be afred. The record will be remanded to the Imigration Cou fr fher
proceedings.
We review fndings of fct, including the Immigration Judge's determination of credibility,
under a clealy eroneous standad. 8 C.F.R.

1003.l(d)(3)(i). We review all other issues,
including whether the paies have met the relevant buden of proof, and issues of discretion,
under a de novo standard. C.F.R. { 1003.l(d)(3)(ii).
The issue befre us on appea is whether the respondent was accorded his due process nt
to a fll ad tuhearing. 08 0IOhm V. O, 821 F.2d 1547, 1550 (11th Cir. 1987). As best
that ca be sumised fom the respondent's pro se fling, he appeas to ague, inter alia, that he
was not on notice that his frst heaing was also his fnal heaing, that he was not given enough
time to represent himself ad comprehend his circustances, including his ties in te United
We note that the record befre us does not indicate that the respondent waived his rght to
appeal, d suggested by the DHS in its brief (DHS's Br. at 2 D, S00 Tr. at 8).

"questionable infactions."
Upon review of the record, we conclude that fher proceedings in this case are appropriate
in view of the specifc circumstances of this case. During te respondent's one ad only
immigation heang on May 14, 2013, the respondent opted to represent himself, and admited
that he is residing in the United States as an immigrat witout proper documents (Tr. at 2-3).
When the Immigration Judge asked the respondent if there is any reason why he can ot ret to
El Salvador, the respondent indicated that he fared he will be killed by gangs (Tr. at 5-6).
Although the Immigation Judge infrmed the respondent that he can make an application
explaining his fa of retng to El Salvador, this statement was preceded and fllowed by the
Immigration Judge's suggestion to the respondent that the heaing was "not the proper frum" to
address his fa and that his claim was probably not suffcient enough, to which the respondent
responded with, "Well, if not, then just depor me" (Tr. at 6).
The transcript shows tat inquiry into the respondent's expressed fea was cursory and
minimal. Tere is also a concer that the Immigration Judge's comments may have had an
unintended efect of dissuading the respondent fom submiting an application fr relief fom
removal based on his fa of returing to El Salvador, in contravention of the regulations in
8 C.F.R. { 1240.ll(c)(l). Accordingly, to ensure that the respondent has a reasonable
opportity to present evidence on his behalf, we will remand the record to te Immigration
Court fr fher proceedings. The fllowing order shall be entered.
ORER: Te record is remanded to the Immigration Court fr fher proceedings.
