1 Introduction
1.1
1.1.1

Background
Childmarriage aconcernfor WestBengal
1.

UndertheProhibitionofChildMarriageAct,2006,thelegalageofbetrothalandmarriageforgirlsis18years, andforboysis21years.InspiteofseveralyearsofthisActbeinginexistence,theearlybetrothalandmarriage ofchildrencontinuestobeanormintheWestBengal.AccordingtotheDistrictLevelHealthSurvey3,2007 08(DLHS3,200708),thestateranksfifthhighestinthecountrywhenitcomestotheprevalenceofchild marriage.Itisvitaltonotethat: a. WhileallIndiatrendsshowthatfamiliesareslowlydelayingthebetrothalandmarriageoftheirgirls, inWestBengal,almosteverysecondgirlisachildbrideover54.7%ofthestatescurrentlymarried womenaged2024weremarriedbeforetheyreachedtheageof18(ascomparedtoallIndiafigures of43%).Someofthestatesthathavemadesignificantprogressinpreventingchildmarriageare Maharashtra(40.4%),Odisha(37.5%),Gujarat(35.4%)andTamilNadu(24.4%).Somestatesthatlag behindareBihar(68.2%)andJharkhand(55.7%). ThedistrictsofMurshidabad,Malda,Birbhum,Purulia,Bankura,DakshinDinajpur,South24Parganas, NadiaandCoochBeharareareaswiththehighestincidenceofchildmarriageinthestate. Whilethefiguresshowthatchildmarriageismoreprevalentinruralareas,statisticsforKolkatareveal thaneveninnonslumareasintheheartofthecity,wherefamiliesarewealthierandgirlsarelikelyto bebettereducated,morethanaquarterofgirlsaremarriedbeforetheyreachadulthood.

Significantly,childbetrothalandmarriageiscompletelygenderedpracticeandanoverwhelminglylarge percentageofgirlsaremarriedatbeforereachingadulthoodandonlyaminisculepercentageofboysare subjectedtothesamefate.

1.1.2

NegativeImpactofchildmarriage
1.

Childmarriageandfemaleschooldropout:Childmarriageleadstogirlsdroppingoutofschool,whichfurther limittheirscopeoffuturedevelopment.InWestBengal,attendanceofgirlsinschooldropsfrom85%inthe agegroup610yearstoamere33%intheagegroup1517years.(NFHSIII,200506)Aftertheimplementation SarvaShikshaAbhiyantowardsuniversalizationofelementaryeducation,significantprogresshasbeennoticed amonggirls,bothintermsofenrolmentandcompletionrateattheelementarylevel.However,thetransition fromelementarytosecondaryschoollevelsremainsaconcern.Whilegirlsareoftentakenoutofschooltoget married,inothercases,whengirlsdonotdowellinstudiesorarenotacademicallyinclined,marriageisseenas theonlyviablealternativeforthem.Infact,manygirlswhodropoutofschoolaresentawaybyparentstoearn theirdowriesbyworkingaschildlabour,leavingthemvulnerabletotraffickers. AccordingtoastudyentitledFinalStudyReportonRestructuringofSchoolEducationSysteminWestBengal byIIMCalcutta,thepercentageofgirlsenrolmentgraduallyfallsatthesecondaryandhighersecondarylevel. Whileattheelementarylevelthegirlsenrolmentismorecomparedtoboysatthesecondarylevelitisalmost thesameasthatoftheboys.ButatthehighersecondaryleveltheGenderParityIndexisonly0.75.Itisatthis juncture,whenchildrenarebetweentheageof17and18thatmostofthegirlsarecompelledtoleaveschool andparentsstartnegotiatingfortheirmarriage.

Childandmaternalillhealthandmortality:Childmarriageisoneofthedeterrentfactorswhichislimitingthe progressofmaternalandchildhealthandimprovementsinthenutritionalstatusofchildreninWestBengal. Childmarriagesresultinearlypregnancies,whichinturnleadtohighmaternalandinfantdeaths,andarealsoa leadingcauseformalnutritionamongchildren.

Childmarriagesresultingirlsbecomingmothersatanagewhentheyarenotoutofchildhoodthemselvesof allteenagegirlsaged1519inWestBengal,onefourthhavealreadybegunchildbearing,apercentagethatis muchhigherthanthenationalaverage(16%)andalsohigherthanallotherIndianstatesexceptJharkhand.

Childmarriageandtrafficking:Childmarriageisoneoftheluresusedbyhumanexploitationracketstoentice poorparentstopartwithyounggirls.Althoughitisnotpossibletodisaggregatedataonchildrenwhohave gonemissingbecauseofchildmarriagesarrangedbyfraudulentmeans,itissignificanttonotethatthedistricts whichrankthehighestamongstalldistrictsforchildmarriages,namely,MurshidabadandMalda,arealso consideredthemostvulnerabletotrafficking.

AboutKanyashreePrakalpa
1.

Inviewoftheabove,theDepartmentofWomenDevelopmentandSocialWelfare,WestBengal(DWSW) formulatedtheKanyashreePrakalpaaconditionalcashtransferschemewiththeaimofimprovingthestatus andwellbeingofthegirlchildinWestBengalbyincentivizingschoolingofallteenagegirlsanddelayingtheir marriagesuntiltheageof18,thelegalageofmarriage.KanyashreePrakalpaisaWestBengalGovernment sponsoredschemewhichwillbeimplementedhenceforthinalldistrictsofthestate.

ExpectedBenefitsoftheScheme
1.

Whileanumberoffactorscontributetowardsgirlsdroppingoutofschool,humanrightsresearchshowsthat thegreatestobstaclestogirlseducationarechildmarriage,pregnancyanddomesticchores,andthatensuring thatgirlsstayinschoolisoneofmosteffectiveprotectivemeasuresagainstchildmarriage.Giventhatchild marriagehasagrosslynegativeimpactonthelivesofchildren,adolescentsandyoungwomen,thisschemeis expectedtobringaboutmeasurableimprovedoutcomesfortheeducation,health(especiallyinfantand maternalmortality)andempowermentofthestatesgirls,theirchildrenandimmeasurablebenefitsforlarger society.

PurposeoftheImplementationGuidelines

ThedocumentlaysdownthekeyprovisionsofKanyashreePrakalpa,andprovidesasetoftoplevelguidelines toensurethattheSchemeisimplementedconsistentlyandefficientlythroughoutthestate.

TheprovisionslaiddownintheseGuidelinesandelsewheremaybesubjecttochangebytheGovernmentof WestBengalatanytime.

AimsandObjectives
1.

Throughconditionalbenefits,KanyashreePrakalpa(hereinafterreferredtoasTheScheme)aimstoreducethe prevalenceofchildmarriageinWestBengalbyincreasingtheenrollmentofgirlsinsecondaryeducationor vocational/sportstraining,andsimultaneouslyencouragingthedelayofmarriagesofgirlsuntiltheyreachthe ageof18.ThespecificobjectivesoftheSchemeareto: a. Incentivizethroughscholarships,thecontinuationofeducationofthegirlchildinSecondaryand HigherSecondaryclasses,vocationaltrainingorsportstraining.Toreducedropouts,especially amongstgirlsfrompoorfamilies,whoarenotcoveredbyanyotherscholarship Disincentivisechildmarriageofgirlstoensurecompliancewiththelegalprovisionspertainingtothe minimumageatmarriage.

ScopeoftheScheme
TheSchemewillbeapplicabletotheStateofWestBengalonly,andwillbeimplementedintheentirestate.

1.

TheScholarshiporOneTimegrantwillbepaidtothebeneficiariesbywayoffundtransferthroughabank accountonly. Havingabankaccountintheapplicantsnameisnotaprerequisiteatthetimeofapplyingforeitherofthe Schemesbenefits.Onceanapplicationisapproved,theapplicantwillbehelpedinopeningandoperatinga bankaccountbythebankingpartner). ItisproposedthatanyScheduledBankaspertheSecondScheduleofReservebankofIndiaActmaybethe bankingpartner(tobedecidedbyDepartmentofFinance).

3 ManagementofScheme
3.1
3.1.1

ManagementStructures
State,District, Blockand KolkataMunicipallevelSteeringandMonitoringCommittees
1.

State,district,KolkatamunicipalityandblocklevelSteeringandMonitoringCommitteesshallbeestablishedto stewardtheSchemeintheirrespectiveareas.FortheDistrictofDarjeeling,therewillbetwoDistrictSteering andMonitoringCommittees,oneforGorkhalandTerritorialAuthorityandtheotherfornonGTAareas.(See Appendix1forcompositionofSteeringandMonitoringCommittees) Thesecommitteesshall,attheirrespectivelevels: a. Review,monitorandadviseonallmattersrelatingtotheimplementationoftheScheme,including reviewingprogress,andstrengtheningcoordinationandconvergencebetweenandwithinconcerned departments. WillconsiderthebottlenecksfacedduringtheimplementationoftheSchemeandsuggest modificationsrequiredforimprovingimplementation. Willmeetperiodically(quarterlyatstatelevelandmonthlyatdistrictandblocklevel)orearlier,if needed,atthediscretionoftheChairpersonoftheCommittee.Ifrequired,technicalexperts,NGOsor civilsocietygroupsmaybeinvitedtoattendtomeetings.

Project ManagementUnits
1.

TheSchemewillbeimplementedbyProjectManagementUnits,withoneunitattheStatelevel,andonein eachdistrictinWestBengal.TheDistrictlevelProjectManagementteamswillfunctionunderthesupervisionof theStateProjectManagementUnit. StateProjectManagementUnit(SPMU) a. TheSPMUwillbeestablishedundertheDepartmentofWomenDevelopmentandSocialWelfare,and beheadedbyaStateProjectManager(Kanyashree)assistedbyaDeputyProjectManager (Kanyashree)andanAccountsofficerrecruitedondeputationorcontractualbasis. Tomanagetheprojectatthestatelevel,aProgrammeManagementConsultant(amanagement agency)wouldbehiredfortheinitialperiodof1year.UndertheguidanceofSecretary,Child DevelopmentandWomenDevelopment&SocialWelfare,theagencywouldberesponsibleforoverall managementoftheITcomponent(maintenanceoftheWebportalandMIS)aswellas implementationofcommunicationandcapacitybuildingstrategyforthescheme.Theagencywould alsosupporttheSPMUinhiringimplementingagencies. b. Theywillbeassistedbytwoaccountantscumdatamanagersemployedonacontractualbasis,and whomustbeproficientincommonofficeapplications,especiallywordprocessing,spreadsheets, presentationandaccountingsoftware. Allnewappointmentswillbemadefor3yearsonprobationbasis. TheSPMUshallberesponsiblefor: i. Coordinationandmanagementoftheschemeatstatelevel ii. OverseeingtheperformanceoftheDPMU iii. Maintainingallrecords,MISandreportingmechanismsatstatelevel iv. PeriodicreportingtotheStateSteeringCommittee

ItisproposedthattheSPMUcanbesubsequentlyregisteredunderWestBengalSocietiesActtoensure resourcemobilizationfromcorporatedonorsunderSocialCorporateResponsibilityandthecontributorswillbe grantedexemptionunderSection80GofI.T.Act.

DistrictProjectManagementUnit(DPMU) a. Inalldistricts,withtheexceptionofKolkata,theDPMUshallbeestablishedundertheofficeofthe DistrictMagistrate.InKolkata,theDPMUwillbeestablishedundertheofficeofCommissioner,Social Welfare.ForthedistrictofDarjeeling,therewillbetwodistrictprojectmanagementunits,onefor GTAandtheotherfornonGTAareas.TheformerwillbeestablishundertheofficeofPrincipal SecretaryGTAandthelatterundertheofficeofDistrictMagistrate,Darjeeling. TherewillbeoneProjectManagerondeputationorcontractualbasisandoneAccountantemployed onacontractualbasisforeachsuchProjectManagementUnit,inadditiontoatleasttwoaccounts cumdatamanagersoncontractualbasis. Allnewappointmentswillbemadefor3yearsonprobationbasis. TheProjectManagementUnitsshall,intheirdistrict,beresponsiblefor: i. Coordinationandmanagementoftheschemeinthedistrict ii. Maintainingallrecords,MISandreportingmechanismsatdistrictlevel iii. PeriodicreportingtotheStateLevelProjectManagementUnitsandtotheDistrictlevel steeringcommittees

PartnerBank
1.

ApartnerbankwillbeselectedtomanagethefundsoftheScheme.ThebankmaybeanyScheduledBankas pertheSecondScheduleofReservebankofIndiaAct,andwillberesponsibleformanagingthefundsofthe scheme,includingdisbursementstobeneficiaries,maintainingthefinancialaccountingsystems,FMISofthe SchemeandregularlysubmitthestatementsandreportingonaregularbasistoDPMUandSPMU. Thebankwillalsoassistbeneficiariesinopening/operatingbankaccountstoreceivetheirentitlements. Theimplementationwillbethroughleadbanksystematstate,districtandblocklevel.

3.2

Fundmanagement
1.

ThefundsfortheSchemewillbemetfromtheBudgetprovisionfortheDepartmentofWomenDevelopment andSocialWelfare. 3%offundbudgetedfortheSchemewillbereservedforProjectManagementandPublicitycosts.Ofthis,one thirdwillbeallocatedattheStateProjectManagementUnitlevel,andthebalancetwothirdswillbeallocated atthedistrictlevel. Thebudgetprovisionforscholarshipswillbemadeonthebasisofexpectednumberofbeneficiariesbetween theagesof13and18andenrolledinInstitutionsofEducationorTrainingasdefinedinChapter2ofthis document Thebudgetprovisionforonetimegrantwillbemadeonthebasisofexpectednumberofbeneficiarieswho haveturned18andareenrolledinInstitutionsofEducationorTraining,InstitutionsofHigherEducationorJ.J. HomesdefinedinChapter2ofthisdocument

4.1 PublicityoftheScheme&IdentificationofBeneficiaries
1.

PublicityoftheSchemewillbearrangedbytheDepartmentofInformation&Culturethroughvariousmass medialikeprintandelectronicmedia,streetplays,folktheatreandothers. Publicitywillalsobedonebyharnessingplatformsofexistingselfhelpgroupsthroughinterpersonal communication.TheAWW,ANM,ASHAworkersandschoolteacherswillalsopublicizetheSchemethrough theirdailywork. Publicityoftheschememayalsobelinkedtoanygovernmentrecognizedchildmarriageprevention interventionsinthestate.Inaddition,localbodies(PanchayatsandMunicipalities)willconducttargeted interventionstoidentifyandenrolleligiblebeneficiariesintheirrespectiveareas.

CapacityBuildingofconcernedofficialsandfunctionaries
1.

TheAdministrativeTrainingInstitutesandStateInstituteofPanchayat&RuralDevelopmentwillincludethe schemeintheirtrainingcurriculum. Inaddition,theinformationregardingtheschemeanditsimplementationwillbemadeapartofregulartraining programmesofASHAsandANMs(underNRHM),AWWs(underICDS)andteachers(underSSA).

Submissionofapplications
1.

AllInstitutionsofEducationandTrainingdefinedunderChapter2ofthisdocumentinanyareawillbedeemed asApplicationOffices. Inaddition:thefollowingofficeswillalsoreceivecompletedapplicationsalongwithdocumentscertifying eligibility: Residentsof: i. ii. iii. Scrutiny andVerificationofapplications
1.

TheschoolsandallotherApplicationOfficesmentionedabovewillforwardallapplicationstoofficesofBDOs (ruralareas),SDOs(urban/municipalareas)andCommissioner,SocialWelfare(KolkataMunicipalCorporation). Eachscrutinyofficeatblockandsubdivisionlevelwillbesupportedbytwodataassistantsrecruitedon contractualbasis.Therecruitmentwillbefor3yearsonprobationbasis. TheofficesofBDOs(ruralareas),SDOs(urban/municipalareas)andDirector,SocialWelfare(Kolkata)willeach appointanofficertoundertakescrutinyoftheapplications.Theofficerswillcarryoutscrutinyofdocuments andwillrecommendforapprovalorrejectapplicationbasedoneligibilitycriteriawithinonemonthofreceiving theapplications. ListofrecommendedandrejectedapplicationswithcommentswillbeforwardedtoSanctioningOfficer RandomphysicalverificationmaybeundertakenbyDistrictProgrammeOfficerICDS,CDPOsoranyother officerappointedbytheDistrictMagistrate,PrincipalSecretaryGTAorDirectorSocialWelfare,Governmentof WestBengal.

Sanctioningofapplications
1.

ThefollowingofficialswillbedesignatedSanctioningOfficers: a. b. c. InalldistrictsbarringKolkata,theDistrictMagistratewillbetheSanctioningOfficer; InKolkata,theCommissioner,SocialWelfareDepartmentshallbetheSanctioningOfficer. ForGTA,thePrincipalSecretary,GTAwillbethesanctioningofficer.

2.

TheabovementionedSanctioningOfficersmayauthorizeanyothercompetentOfficertodischargethefunction ofSanctioningOfficeroftheSchemeintheirrespectivedistricts. Withinonemonthofreceivingthescrutinisedapplications,theSanctioningOfficerissuesanctionsordersthat authorizethepartnerbanktotransferthesanctionedamounttothebankaccountoftheapproved beneficiaries.Thepartnerbankshallperformthenecessaryfundtransferstobeneficiarieswithinaweekof receivingthesanctionorders.

Informingbeneficiaries/rejectedapplicants
1.

AlistofsanctionedandrejectedapplicationswillbedisplayedupatAnganwariCenters,schools,Institutions, Panchayats,OfficesofBDO,SDO,Municipality,BoroughOffices,KMCheadoffice,Commissioner,SocialWelfare andwillalsobeavailableonlineinadownloadableformat.

4.8

ApplicationsforRenewalofScholarships
Theproceduresforapplicationsofrenewalscholarshipswillbethesameasfornewapplications;barringsubmission ofincomecertificate.Allothercertificationsforeligibilitywillhavetobeprovidedbytheapplicantandscrutinized andverifiedasdirectedabove.

5 Recordkeeping,MISandreportingmechanisms
5.1 Overview
1. Allregistersandotherrecordkeepingformatswillbemaintainedelectronically,andbedesignedtoensurethatkey

monitoringindicatorsofschemecoverage,financialdisbursementsandmanagement/implementation performancecanbeeasilyelicitedonaregularbasis.
2. Allprimarydataentry(ofapplicationsreceived,sanctionedandrejected)willbeundertakenatthelevelofBDOs

(RuralAreas),SDOs(UrbanAreas)andDirector,SocialWelfare(Kolkata).Thedatafromruralandurbanareaswill becompiledatdistrictlevelbythedatamanageratDPMU.Subsequently,alldistrictsdatawillbeconsolidatedand compiledatSPMU.


3. AllsanctionedandrejectedapplicationformswillberetainedforsampleverificationsinofficesofBDOs(ruralareas),

SDOs(urbanareas)andDirector,SocialWelfare(Kolkata)foratleastonefinancialyear.

Thepartnerbankwillprovidemonthlystatementsofdisbursementsundertheschemeandconsolidated reportsfromfinancialMIStotheDPMUandSPMU EachDPMUwillprovideamonthlystatementsrelatingtoSchemecoverage,expenditureandother administrativematterstotheDistrictSteeringandMonitoringCommitteesandtotheSPMU. TheDPMUandSPMUswillperiodicallypreparemonitoringreportsonkeyperformanceindicators. TheSPMUwillcollateallmonthlystatementsandreportsfromallsourcesintoacomprehensivestatementfor theStateSteeringandMonitoringCommittees. Continuous Concurrent Evaluation of the scheme is proposed by involvement of external independent agencies toensurethatthedesiredoutcomesarebeingachieved.
